Deerfield Ranch Winery hosts Checkerbloom Gala & Masquerade Ball on July 18th

Deerfield Ranch Winery is proud to be hosting the 10th Annual Checkerbloom Gala on Saturday, July 18th at 6:30pm. This annual event benefits the restoration and maintenance of the Kenwood Marsh, home of the Kenwood Marsh Checkerbloom. In 2000, Robert and PJ Rex, founders of Deerfield Ranch Winery, purchased 47 acres along Highway 12 in Kenwood to expand their winery and vineyards. Included in 14 of those acres was the Kenwood Marsh, the last remains of a wetlands ecosystem that once covered much of the small village of Kenwood in Sonoma Valley.

The Kenwood Marsh is one of only two places on earth where the endangered Checkerbloom plant exists [1]. “We’ve spent nearly ten years restoring the wetlands. When we purchased the property there were only a handful of Checkerblooms left,” states PJ Rex. In order to permanently protect Kenwood Marsh, Deerfield granted a conservation easement to Sonoma County and established the Kenwood Marsh Checkerbloom Society to assist with the fundraising for restoration and maintenance of the marsh.

So far, Deerfield Ranch Winery and the Checkerbloom Society have removed the Himalayan blackberries and other non-indigenous plant life that is dangerous to the Checkerbloom. They’ve also bridged the pond, and established three more Checkerbloom habitats with the help of US Fish and Wildlife Service. Yet there is still work to be done. The upcoming Checkerbloom Gala will help provide the necessary funds to further restoration efforts and ensure that this endangered plant survives.

The Gala will consist of a welcome reception on the winery’s crushpad showcasing the silent auction items, followed by dinner and dancing in the Grand Room in the wine cave and a live auction featuring rare and spectacular items. Gala-goers are encouraged to don a mask and come incognito in the Masquerade Ball theme for the evening.

Tickets are $125 per person, $100 for wine club members. Seats are also available at the winemaker’s table for $250 per person (winemaker’s table ticket also includes a signed bottle of DRX). Libyan dialogue participants signed the Libyan Political Agreement which aims to put an end to the Libyan crisis following a ceremony attended by Arab and Western diplomats held this Saturday, 11 July 2015, at Skhirat, Morocco.

“The Skhirat Agreement was made possible thanks to the contribution of many Libyans who worked within the working groups and other groups, but also thanks to the host country, Morocco, which has played a very important role, which is not only a host role, but also a role of political support”, said U.N. Special Envoy Bernardino Leon in a statement to the press after the initialing ceremony of the agreement.

”Morocco has played a very important role in the political support to the talks between the Libyan parties, crowned by the initialing Saturday night of the Skhirat Agreement aimed at ending the political and military crisis,” added the UN official.

“This is a very important partnership between Morocco and the UN mission”, Leon said, especially that “during the next step, the parties will work on complex aspects, namely the formation of a national unity government, the negotiation of annexes (of the Agreement) and especially the involvement of armed groups, the Libyan army and the militias”.

The European Union also hailed Morocco’s support to the UN-led political dialogue.

“I would like to thank the UNSG Special Representative Bernardino Léon for his tireless efforts to bring parties towards a deal, and the Government of Morocco for supporting the UN led dialogue”, High Representative of the Union for Foreign Affairs and Security Policy / Vice-President of the Commission, Federica Mogherini, said in a statement.

She also underlined that this agreement is an “important step” towards restoring peace and stability in Libya, adding that with the initialing of the political agreement, the House of Representatives, the independents and representatives of Misrata proved their determination to find a peaceful solution to the crisis that, for almost one year, has divided, impoverished, and inflicted suffering on the Libyan people.

Twitter Delivers Holiday Shoppers to Retailers’ Doorsteps

Imagine you sell mobile phones. One day a crowd of nearly 2,500 customers crowds your front stoop pleading for a phone. Instead of opening the door and yelling, “Come on in, we have what you need!” you lock the door and pull down the shade, cowering behind your register.

Ridiculous, right? Not really – it happens all the time. On a single summer day, customers took to Twitter looking for things like cell phones, purses, TVs and more. As a sample:

And believe it or not, shop owners – both brick and mortar, and those exclusively online – ignore these Tweets from motivated shoppers because 1) they don’t know how to use Twitter, or 2) they haven’t found the right tool to help find and engage these customers.

Proposed FLSA Rules: More Overtime Pay by Dallas employment attorney

The United States Department of Labor recently announced that it proposes to update the regulations governing which executive, administrative, and professional employees are entitled to the Fair Labor Standards Act’s minimum wage and overtime pay protections.

Under the FLSA and corresponding rules, three tests must be met for an exemption to apply: (1) the employee must be paid a predetermined and fixed salary that is not reduced due to the quality or quantity of the employee’s work; (2) the salary paid must meet a minimum specified amount; and (3) the employee’s job duties must primarily involve executive, administrative, or professional duties. In addition, a highly compensated employee is exempt from the overtime pay requirement if the employee is paid total annual compensation of at least $100,000 and if the employee customarily and regularly performs at least one of the duties or responsibilities of an executive, administrative, or professional employee.

Under the proposed rule:

  • the standard salary level would be set at the 40th percentile of weekly earnings for full-time salaried workers ($921 per week; $47,892 annually);
  • the total annual compensation requirement needed to exempt highly compensated employees would increase to the annualized value of the 90th percentile of weekly earnings of full-time salaried workers ($122,148 annually); and
  • the salary and compensation levels would rise automatically in accordance with a set plan.

Medicare and Medicaid Fraud for Payment of Services Not Rendered

Medicare and Medicaid are supposed to only pay for procedures, devices and tests that were actually performed or used. Dishonest healthcare providers and organized crime have learned that with the right falsified paperwork, Medicare and Medicaid can be tricked into paying for nonexistent care and devices for fictional patients or real patients not actually cared for. To receive payment a healthcare provider must certify the services were actually rendered and the goods were actually needed and provided. The submission of a claim for payment for health care services never provided would be a false claim and may be a violation of the False Claims Act (FCA).

The goal of the FCA is to discourage any government contractor, including a health care provider, from overcharging and falsely charging the federal government for goods or services. The law provides for civil liability of up to three times the amount of damages suffered by the government for any person who knowingly submits, or causes to be submitted, a false or fraudulent claim for payment to the Federal government. For the submission to be “knowing” the person must have actual knowledge or act in deliberate ignorance or reckless disregard of the truth or falsity of the information.

The FCA also provides for civil penalties of $5,500–$11,000 per false claim. In healthcare fraud cases involving treatments to hundreds, and sometimes thousands, of patients these penalties can be significant.

The law’s unique “Qui Tam” provision allows individuals to stand in place of the government and file a lawsuit against a person or entity submitting a false claim to the government. The term “Qui Tam” goes back to medieval England and became part of United States law during the Civil War as part of an effort to reduce the rampant fraud on the Union army which was routinely sold defective military supplies.

In 1986 the FCA was amended to strengthen the law and its qui tam provisions in response to massive fraud – again by defense contractors. Since that time, the FCA has become an effective tool to fight healthcare fraud, one of the government’s largest expenditures each year.

The federal government, like all organizations, businesses and individuals, only wants to pay for services and products that were actually provided. Getting paid for actions not taken and products not supplied is fraud. Thanks to the FCA and its provision for qui tam actions, individuals can take action to stop Medicare and Medicaid fraud when dishonest individuals or organizations are paid for nothing more than fraudulent paperwork.

Dallas Bridges and Serious Truck Accidents by 1800TruckWreck

Truck wrecks are typically very serious in nature. In fact, the rate of massive property damage, serious injury and fatalities in accidents involving large trucks is higher than that involving passenger vehicles only. Statistics show that over an estimated 100,000 people are injured in commercial truck crashes annually. Furthermore, data from the Federal Motor Carrier Safety Commission (FMCSA) shows that 78 percent of injuries in big rig accidents are sustained by individuals who are in passenger vehicles, pedestrians, or others not driving or riding in a commercial truck. The same estimates are shown for people who are killed in commercial truck crashes.

There have been several 18-wheeler crashes in Dallas and surrounding areas that have made headlines in recent years because of the shocking nature of what occurs with them. Many have occurred on major overpasses and bridges in DFW. For example following one recent accident involving a semi in Irving, significant damage was done to an overpass that led to the closures of two major highways. The semi wreck, which occurred during early day rush hour left an immense traffic pileup, and loose concrete hazards that Texas Department of Transportation crews were forced to scramble to cleanup.

Stories like this have been reported on over time for practically every major bridge in Dallas’ intricate roadway transportation system. Dallas is known for its many freeways, particularly the award winning High Five Interchange, a $261 million projected that was completed in 2005. The construction is the first five-level stack interchange to have ever been built in Dallas, and is located at the I-635 (Lyndon B. Johnson Freeway) and US Highway 75 (Central Expressway) junction. A number of accidents have occurred on overpasses like these due to issues such as bad weather, driver inattention, ongoing construction, and other causes.

Whether linked to bad weather conditions or driver negligence, 18 wheeler accidents lead to many lives lost and hundreds of injuries each year throughout the DFW Metroplex. These accidents warrant increased risks of injury or death for those involved due to the travelers being at higher altitudes and at risk of falling, and having limited access to a safe place to move out of the way if something occurs. Whistleblower Protection Laws: A Primer and a Path Ahead

When whistleblowers speak out about fraud, they do so to identify and help stop improper behavior. As many frauds have far-ranging impact — whether to taxpayers, a company’s shareholders, or society at large — the good that whistleblowers do can be immeasurable. But those committing the wrong – frequently the whistleblower’s employer – may be tempted to retaliate by firing, demoting, or transferring those who unveil it.

One of the most important things whistleblower statutes do, then, is to provide protections for insiders who speak out about improper behaviors. The idea is to encourage whistleblowers to come forward by assuring them that there are remedies for any retaliation they might experience.

Many of these protections are quite powerful. But navigating the process can be more complicated than one might expect. This makes it important for whistleblowers to understand what the laws provide, when those provisions apply, and any limitations that can impact them. “Whistleblowers have been an extremely effective weapon in the war on fraud so it’s not surprising that there is a wide variety of whistleblower laws and programs,” says Jeffrey F. For many whistleblowers, and potential whistleblowers, that might appear to confuse matters. But it doesn’t have to.”

For one thing, Keller says, many of the elements of a retaliation claim are similar no matter what law or rules apply. For instance, an employee who thinks he or she has been terminated, demoted, transferred, or otherwise punished for whistleblower activity can typically point to the timing of the action, previous performance reviews, the treatment of other employees in similar situations, and any threats or comments the defendant made as evidence of motive – that the action was taken in retaliation for speaking out.

Another basic element of a whistleblower retaliation claim is showing that the employer knew, or had knowledge, that the employee engaged in whistleblower activity. But here the laws can differ. What qualifies as protected whistleblower activity will vary from one statute to another. So, too, can statutes of limitation — the amount of time a whistleblower has — for filing a claim of retaliation.

“Generally the clock starts ticking when an employee learns that he or she will be retaliated against, which can come far sooner than the actual termination, demotion, or transfer,” says Keller, whose firm has offices in Los Angeles and the San Francisco Bay Area. “But here, too, the details will vary depending on which whistleblower law applies.”

Indeed, whistleblower statutes exist on both the federal and state levels. While many of them are based on the gold standard of whistleblower laws – the federal False Claims Act – the actual provisions and procedures can vary, sometimes greatly. Then there are programs on the agency level, such as the whistleblower initiatives created by the Internal Revenue Service and the Securities and Exchange Commission. For whistleblowers, it is paramount to understand which laws or programs apply to them, and what the relevant provisions, and requirements, are.
