A San Antonio man survived a serious accident that resulted in a semi-truck rolling over onto his vehicle. The impact of the collision caused the truck trailer to land on top of the man’s truck, and push it backwards into others cars. He was able to pull himself out of the vehicle.

The Deadly Reality of Rollover Accidents

Although the man in the aforementioned truck rollover crash was able to walk away unscathed, this is not the case for many victims of these types of crashes. Texas based truck accident attorney Amy Witherite says that a number of personal injury cases involving rollover accidents she has tried involve fatalities. According to Witherite “statistics show that rollovers claim thousands of lives each year nationwide.”

Data from the National Highway Traffic Safety Administration shows that over 280,000 rollover accidents are reported annually. The NHTSA stated in a report on the “Characteristics of Fatal Rollover Crashes” published by the National Center for Statistics and Analysis Research and Development that “The changing composition in the fleet of vehicles on the nation’s highways has resulted in a growing number of SUVs and other light trucks relative to passenger cars. Findings show that light trucks in general, and Sport Utility Vehicles (SUV) in particular, are a rapidly increasing component of the total number of fatal rollover crashes. Most of the characteristics of vehicle and drivers involved have remained fairly constant over time both for passenger cars and light trucks. While occupant fatalities due to passenger car rollovers have been declining, the greater propensity toward rollovers in some classes of light trucks has maintained the aggregate level of passenger vehicle occupant fatalities in crashes about 32,000 annually.”

Among the most common causes of rollover crashes are:

• Drivers over correcting their vehicles

• Drivers operating vehicles that are top heavy

• Drivers hitting medians, guardrails, uneven ground and other factors that may cause their vehicle to suddenly go out of control and flip over

• Vehicles being too top heavy (whether by design or added weight)

• Driving aggressively (speeding, recklessly changing lanes, or driving erratically in any form)

Witherite says that in truck accident cases involving rollovers one of the most important things injured victims, or families of deceased victims in the event of wrongful death, can do is get an assessment of their legal options for financial recovery. The attorney says that in many cases of rollover accidents in Texas, those most seriously injured or left with significant property damage are individuals not at fault for the crash. Texas truck accident lawyer weighs in on the apparent increase in truck accidents across the U.S. and related factors.

Much has been written about issues impacting the trucking industry lately including the unwarranted effects of a rise in the number of registered big trucks that has been accompanied by an increase in truck accidents. A recent report from The Associated Press stated that although the number of commercial trucks on the road has increased, there has not been the needed growth in the number of rest stops for truck drivers, which some suggest is a major safety hazard. Truck drivers are not supposed to work more than 14 hours total without having had 10 hours of mandatory downtime according to federal regulations. However, the report notes that some drivers allege that an insufficient number of parking spaces prevents them from adhering to the rules.

Jet Express President Kevin Burch is quoted in the report as stating of the issue “These truckers have to have rest, so where do they go?…The truck stops are full. The rest stops are full. The shopping centers have no parking. It is a big problem that no one seems to care about.”

Could this be one issue contributing to more truck accidents across the US? You may not pay much attention to your auto insurance coverage and just focus on the price when you buy or renew your policy, but what coverage you buy could make a big difference if you get into an accident. Philadelphia’s accident attorney, Rand Spear, warns motorists that selecting less expensive coverage can limit your legal rights to recovery if you sue after being injured in an accident.

In Pennsylvania auto policy holders have the option of selecting full or limited tort coverage. Limited tort coverage is normally less expensive, but the dollars saved on the premium could result in far less recovery if you need to go to court.

“Full tort coverage means that you can bring a lawsuit regardless of the extent of your injury, you don’t have to prove an injury is permanent. Limited tort is a less expensive policy but you have to prove a serious impairment of a bodily function in order to recover damages for your injuries,” Spear says.

He explains that back in 1990 the Pennsylvania legislature wanted to limit the number of lawsuits so they created a two-tier system where policy holders paying more money have more legal rights if they’re involved in an accident. “I think it’s unfair because it impacts mostly people who don’t have a lot of money, can’t or don’t want to pay for the most expensive coverage,” Spear says.

Most accident victims Spear has spoken to tell him their agents never fully explained the difference in the coverage and what benefit they would receive if they decide to pay more for the better coverage. “Most consumers tell me they would’ve opted for the full tort coverage had it been explained exactly what was involved.”

“Always try to get the best coverage,” Spear advises, “It’s protecting you if you’re injured and need help. Not only does it protect you, it protects members of your family and it protects people in the car with you. Accidents happen when you least expect them. They hurt you financially, they hurt you physically and the more you can protect yourself, the better off you’ll be.”

Those who opt for limited tort coverage still have legal rights and Spear says he can help many of them with their legal claims. He says when a cases starts, it may be unknown the true extent of a person’s injuries.

“Someone would typically go to a doctor for medical attention and often get an MRI done. We look to see if there’s a herniated disc, a protrusion, something that we can argue constitutes a serious impairment of a bodily function,” Spear says, “In many cases even when they have limited tort coverage we take their case, we do represent them and we do collect damages on their behalf.”
