Xarelto Lawsuit Update: Internal Bleeding Lawsuit Filed in New York

September 16, 2015 – – BloodThinnerHelp.com reports today on one of the latest Xarelto lawsuit filings. Recently, a Texas woman filed a lawsuit against the manufacturers of Xarelto, Bayer AG and Janssen Pharmaceuticals, the pharmaceutical division of Johnson&Johnson, in the Eastern District of New York. She is alleging that the manufacturer’s failure to adequately warn doctors and patients about the real risks of Xarelto and their failure to perform sufficient safety tests on the drug led to her serious internal bleeding injuries. The full complaint can be found here and is filed under the federal court docket number 1:14-CV-04524.

In this case, the plaintiff was prescribed Xarelto by her doctor and began taking it to prevent blood clots that may be caused by atrial fibrillation, a heart condition. She was using Xarelto for five months when she experienced a severe internal bleeding event that left her seriously injured. The complaint does not specify the injuries sustained but it does note that the injuries she suffered are permanent and will require long term future care.

Xarelto was approved by the Food and Drug Administration, FDA, for released onto the United States market in 2011. Xarelto’s manufacturers pushed the drug as a convenient alternative to the traditional blood thinner Warfarin because of Xarelto’s ‘one size fits all’ dosage and lack of required blood monitoring. Advertisements for the drug were heavily published in medical journals and television commercials for the drug featured well known athletes and public figures. Xarelto was initially approved for usage in patients who suffered from atrial fibrillation, deep vein thrombosis, or who have recently undergone knee or hip replacement surgeries.

The problem with Xarelto is that there is no antidote to the anticoagulant effects of the drug which makes it especially dangerous. If a patient is taking Warfarin and experiences an internal bleeding emergency, a doctor can administer vitamin K to reverse the effects of the Warfarin and the blood will clot. If a patient is taking Xarelto and experiences an internal bleeding emergency, there is no way to stop the bleeding. Xarelto currently has two ‘black box’ warnings attached to it by the FDA. The black box warning is the most strict warning the FDA can assign to a drug short of recalling it.

Four Plaintiffs Have Filed A Zofran Lawsuit In Massachusetts

September 16, 2015 – – Recently, ZofranLegal.com announced that the fourth Massachusetts Zofran lawsuit had been filed. Three of the four lawsuits allege that the drug Zofran caused a cardiac defect in an unborn child, and the fourth alleges that the unborn child died in utero due to birth defects caused by exposure to Zofran.

Zofran is an anti-emetic drug that is manufactured by GlaxoSmithKline. Prior to receiving approval from the U.S. Food and Drug Administration in 1991, GSK conducted multiple studies to determine the level of safety associated with using the drug. However, none of these studies were performed on pregnant women. As a result, the FDA only approved the drug for use in patients experiencing nausea and vomiting after chemotherapy and radiation treatments, or who were ill after being under anesthesia. Zofran was not awarded approval for the treatment of morning sickness.

Regardless of the absence of approval, GSK moved forward with a marketing campaign that promoted the use of Zofran “off-label” to treat morning sickness. Countless expectant mothers were prescribed the drug throughout their pregnancy. Since they first marketed the drug in this manner, GSK has allegedly received over 200 reports of children being born with birth defects after the mothers took Zofran.

The first Zofran lawsuit was filed in the U.S. District Court for the District of Massachusetts on February 16th, 2015 under case number 1:15-cv-10429. The lawsuit alleges that a girl born in 2000 was born with numerous congenital defects after her mother began taking Zofran during her 1st trimester. The worst of these defects is an atrial septal defect of the heart. The lawsuit states that “In twelve years, the child has had to undergo ten surgeries to try and correct her numerous congenital abnormalities. These birth defects impair her development and enjoyment of a normal life at home and at school due to substantial developmental delays.”

The second Massachusetts complaint was filed in April 2105, under case number 1:15-11627. It alleges that because the plaintiff took Zofran, her unborn child was diagnosed with severe physical malformations which were life-threatening. These malformations resulted in the death of her child in utero. The complaint further alleges that “Had the plaintiff and/or her healthcare providers known of the increased risk of birth defects associated with Zofran, she would not have taken Zofran during pregnancy, and her pregnancy would have progressed to term with a healthy child.”

A few months later, on July 22nd, 2015, the third lawsuit was filed under case number 1:15-cv-13002-FDS. Like the first two complaints, the mother claims that she was not warned of the risks associated with the use of Zofran during her pregnancy and that “GSK’s conduct has caused devastating, irreversible, and life-long consequences and suffering to innocent newborns and their families.” Her daughter was born with a cardiac defect known as the Transposition of the Greater Vessels (TGV) and she required life-saving surgery just days after she was delivered.

The latest Zofran lawsuit in Massachusetts was filed on July 17th, 2015 under case number 1:15-cv-12973. The child, in this case, was born in 2007. Shortly after his birth he was found to have a congenital heart defect called a ventricular septal defect and a systolic ejection heart murmur.

These lawsuits are following a complaint that was filed by the U.S. Justice Department against GSK. That complaint alleged that GSK had unlawfully marketed several drugs, including Zofran, “off-label”. In a settlement agreed upon in 2012, GSK paid fines of three billion dollars.

Power Morcellator Lawsuit Update: GAO To Investigate Morcellation Risks

September 16, 2015 – – Tracey & Fox have commented on the U.S. Government Accountability Office’s decision to move forward with an investigation into the controversy stemming from the use of power morcellators during hysterectomies and myomectomies. Mr. Tracey has stated, “I welcome this investigation by the U.S. Government Accountability Office. It is tragic that so many women have lost their lives as a result of the use of this device. If the U.S. Food and Drug Administration’s approval process is improved because of continued scrutiny, only good things will come as a result.”

Mr. Gene Dodaro, the Comptroller General and the head of the GAO, received a letter on August 7th, 2015 from the United States Congress. The letter was a request for the GAO to begin an investigation into the manner through which the U.S. Food and Drug Administration granted approval for the medical device known as a power morcellator. It was signed by twelve members of Congress.

The letter stated that “hundreds, if not thousands, of women in America are dead” because of the use of power morcellators during gynecological surgeries.

The morcellator has been used by surgeons for decades in a wide variety of laparoscopic surgeries. It was first approved by the FDA under a 501(k), which allows the approval of a surgical device without safety testing, if the device can be shown to be “substantially equivalent” to a previously approved device. But on April 17th, 2014, the FDA released a safety communication which warned that “When used for hysterectomy or myomectomy in women with uterine fibroids, laparoscopic power morcellation poses a risk of spreading unsuspected cancerous tissue, notably uterine sarcomas, beyond the uterus.”

In an updated safety communication issued on November 24th, 2014, the FDA required all power morcellators to have a “black box” label, warning of the risks associated with its use.

On September 1st, 2015, the GAO responded to the lead member of the Congressional group, U.S. Rep. Mike Fitzpatrick, agreeing to accept the request. Katherine Siggerud, the managing director for congressional relations at the GAO, has indicated the investigation will begin in several months after the necessary staff are made available.

This announcement comes after speculation that the Federal Bureau of Investigations had begun their own investigation into the risks of the power morcellator, and numerous lawsuits have been filed by women and the families of women who all allege that undiagnosed uterine cancer was spread by a morcellator resulting in metastasis to other areas of the body.

Heroes for Children to Honor Children Fighting Cancer at Annual 5K

Heroes for Children (HFC) – a unique Dallas-based nonprofit that provides social and financial assistance to families whose children are battling cancer – is hosting the 11th Annual Heart of Gold 5K & Fun Run on Sept. 26, 2015. This special event is held in honor of National Childhood Cancer Awareness Month and helps raise money and create awareness for childhood cancer. HFC is pleased to honor three local children currently battling cancer as the Grand Marshals for this event.

The three Grand Marshals are young fighters representing each of the hospitals in Dallas that HFC serves. Micah Ahern (6½) represents Cook Children’s, Bella Robinson (5) represents Medical City Children’s, and Ashley Jackson (17) represents Children’s Medical Center. HFC partners with social workers in these hospitals to find families who could benefit from financial and social help from HFC. As Grand Marshals, they will be honored at the event for their courageous fight against cancer.

Micah, Bella and Ashley all have personal stories about their fight with cancer and have all received help from HFC over the past few years.

Micah was diagnosed with Neuroblastoma when he was only 15 months old and has been fighting ever since. Micah and his family were blessed by the Holiday Heroes program one Christmas after Micah relapsed a few years ago.

“Heroes for Children helped us when there were no other resources. HFC threw a huge party at TCU and bought gifts specific for each of our kids, not just Micah. It was the most special Christmas we’ve ever had. We felt so loved and cared for,” says Micah’s mom, Linda Ahern. “And now here we are two and a half years after his relapse, and Heroes for Children is still helping out our family through financial support.

Only 12 days after her fifth birthday, Bella Robinson was diagnosed with Acute Lymphoblastic Leukemia (ALL). Even though she was suffering, Bella kept her head held high with a positive attitude about her treatments and remained happy and outgoing. She spent a lot of time in the hospital but loved meeting the other kids on the Pediatric Oncology floor at Medical City Children’s.

“We have so many new friendships,” says Bella’s mom, Brittney Robinson. “We’re all battling together.”

HFC has lifted a huge burden off of the Robinsons by financially providing assistance to help pay for treatment. This way, the family can focus on being there for Bella as she battles cancer.

Ashley Jackson and her mom receive financial and emotional support through HFC. Ashley was diagnosed with Ewing’s Sarcoma when she was 16. She spent a lot of her time in the hospital where she grew close with nurses who would dance for her when she was in severe pain. She also started her own organization called Ashley’s Hearts of Hope where she gives gifts to children. HFC has been a large financial help to Ashley and her single mom, Debra, as expenses like travel and medication add up. HFC also cared for Ashley and her mom emotionally.

“Heroes for Children made a huge difference. Ashley was greatly inspired by how Larissa and Jenny (co-founders) turned their tragedies into helping others,” Debra says. “Ashley blossomed during her diagnosis and found her path in life, and through the inspiration of Jenny and Larissa, she has decided to use her experience to help others by becoming a child life specialist.”

HFC understands how isolating a cancer diagnosis can feel. Part of the organization’s mission is to make sure children battling cancer and their families never fight alone.

“There were points in the journey when we weren’t sure what her survival rate was going to be, and there were many months of chemo, but during this time there was still hope,” Debra adds. “It’s okay no matter how bad things get, you have a community that is there for you. We made a lot of connections, and we never felt alone.”

The Heart of Gold 5K & Fun Run will be held on Saturday, Sept. 26, at The Plaza at Galatyn Park in Richardson, Texas. The event begins with the annual commemorative balloon release led by co-founders Jenny and Larissa, followed by the Family Fun Run and 5K.
