Lawsuit Involving Invokana Side Effects Filed by Diabetes Patient Who Developed Life-Threatening Diabetic Ketoacidosis

April 28, 2016 – – TheProductLawyers.com comments on an Invokana lawsuit filed in the Southern District Of Alabama against Janssen Pharmaceuticals (a subsidiary of Johnson & Johnson corporation), related specifically to diabetic ketoacidosis. It is a life-threatening condition that can develop very quickly and is when the body’s bloodstream contains a high level of ketones which can result in the patient suffering a diabetic coma or even death in the extreme case. The plaintiff in this case claims she began taking Invokana in December 2014 and developed ketoacidosis shortly thereafter.

Upon further review of the court papers it showed that the plaintiff also believed that the drug was not sufficiently studied over an adequate period of time and that it was marketed “off-label” to patients like her suffering from type 1 diabetes. She alleges that the manufacturer, despite the drug not being approved by the FDA for the treatment of type 1 diabetes, marketed the drug as a type 1 treatment anyway. She also claims that Janssen Pharmaceuticals did not clearly enunciate the potential adverse side effects of the drug to the public and were willfully negligent in its failure to do so.

The US Food and Drug Adminisration (FDA) issued a public safety warning about the drug and in it encouraged diabetes patients who are using Invokana or any other similar SGLT2 inhibitor drugs to be watchful of any potential symptoms that might emerge denoting the onset of ketoacidosis. The American Diabetes Association has reported on symptoms to be aware of such as excessive thirst or dry mouth, frequent urination, high blood sugar levels, high levels of ketones in the urine, difficulty breathing, pain in the abdomen, confusion fatigue, and nausea or vomiting.

The FDA, in its public safety report, also directed Janssen Pharmaceuticals to revise its warning label for Invokana to better address the potentially lethal side effect of the onset of diabetic ketoacidosis.

IVC Filter Lawsuit Claims Draw Attention To Adverse Event Reports Noting Dangerous Filter Migration Side Effects

April 28, 2016 – – TheProductLawyers.com comments on reports of alarming allegations concerning IVC filter devices and the potential that they are dangerous and have been designed defectively. In 2012, it was estimated that 259,000 patients had been implanted with IVC filters. The devices were first approved by the FDA in 1979, but at that time were much less used, having been implanted in an estimated 2,000 patients that year.

The filters are used by patients who are deemed at increased risk for the development of blood clots but who are unable to take blood-thinning drugs. They are cage-like devices which are surgically implanted into patients’ inferior vena cava veins, where they are expected to capture and hold any blood clots moving from the lower legs toward the heart and lungs where they could cause pulmonary embolism. They are supposed to hold these blood clots until they dissipate. The devices are intended to be used temporarily, and to be removed when the patient is no longer at risk for blood clots.

IVC filters have recently been the subject of an increasing number of lawsuits. Plaintiffs commonly claim that the filters have been defectively designed by various manufacturers. They also claim that the filters are able to break into pieces and migrate within the body away from their initial insertion points, perforating veins and organs, and becoming embedded in high risk areas where they could be unable to be surgically removed. During this time, the filters can cause substantial health risks for patients.

The U.S. Food and Drug Administration discussed this issue when they released a product safety communication referencing the devices after receiving an alarming number of adverse event reports from patients. Through this announcement, the FDA targeted medical professionals and patients and reminded them of potential dangers of the devices. They additionally asked that IVC filters be removed from patients as soon as blood clot risks subside. It has been noted that between the years of 2005 and 2010, the FDA received 921 adverse event reports concerning the filters. Adverse events reported side effects including: filter migration and breakage, embolization of fractured device or device components, and inferior vena cava perforation. Patients currently implanted with IVC filter devices are asked to be on the lookout for filter migration symptoms, which can include: chest pain and heart palpitations, light-headedness, dizziness, fainting, and unusual heart rhythms. Those who have migrated filters within their body are considered at increased risk for serious health complications including: cardiac tamponade or pulmonary embolism.

Risperdal Lawsuit Trial Draws Attention To Controversial Testimony And Potentially Hidden Study Results

Risperdal is a powerful antipsychotic drug which gained approval from the FDA not long ago to treat autism, bipolar disorder, and schizophrenia in adolescents and adults. Janssen Pharmaceuticals manufactures Risperdal and is a division of parent company Johnson & Johnson. It has been reported that the company funded a 2003 study which indicated that no connection between long-term risperidone (generic Risperdal) treatment among patients and the development of elevated prolactin levels existed. It was also indicated that three of this study’s authors were employed by Janssen and two of the study’s independent authors have now requested a reanalysis of the indicated findings.

During the February Risperdal trial, evidence was presented that included a written manuscript of the study now being questioned which included two tables linking use of the drug to elevated prolactin levels. These elevated prolactin levels can cause the development of gynecomastia, which is a condition that several plaintiffs now attribute to their use of the drug. Gynecomastia refers to significant breast development in males, causing their breasts to resemble that of females. The tables shown during the trial, as well as the critical information they presented, were reportedly never given to the FDA or to medical journals for publication.

“We have an adjuster coming out Thursday so we are just now starting really,” said Shupbach. “We have over 20 holes in our roof and we’ve had them covered. But that’s basically it.”

Shupbach is not sure what repairs will cost but expects it’s going to take at least $50-70 thousand. And the Shupbach family is just one of many families facing major repairs. “Everything facing north in Wylie has just been trashed,” said Joel Beckman with BCC Roofing & Storm Repair. “These things actually got damage to the brick.” The Insurance Council of Texas toured the damage on Friday. It estimates the price tag of Monday’s storm, the third major hail event to hit North Texas since March 17, is around $300 million.

“Of the three storms, this probably was the largest hail,” said Mark Hanna. “And probably did the most damage but to a smaller footprint.”

That’s on top of an estimated $700 million in damages on March 23 when large hail battered Plano. Six days before that, Tarrant County was hit hard to the tune of $600 million. The latest storm puts the overall total in North Texas at around $1.6 billion, and it’s still early in the spring storm season. “It’s a pretty bad omen, you know,” said Hanna. “You just don’t know what to expect.”

As detailed in the complaint, on June 30, 2015, the defendants increased Teekay’s quarterly dividend by 75% to $0.55 per share, and assured investors that the Company would maintain its high dividend. Thereafter, Teekay and certain of its executive officers issued a series of false and misleading statements which continued to represent that the Company remained on track to continue to pay out high dividends, and that Teekay would increase its dividend by 15-20% in the near future.

On December 16, 2015, Teekay shocked investors when it announced that it was slashing its dividend by 90% – from $0.55 per share to just $0.055 per share. On this news, the price of Teekay’s common stock declined $10.22 per share, or over 58 percent, to close on December 17, 2015 at $7.27 per share, on heavy trading volume.

The complaint alleges that Teekay and certain of its executive officers made materially false and misleading statements to investors during the Class Period which misrepresented and/or omitted to disclose, among other things, that: (1) the Company’s repeated assurances that it would maintain a quarterly dividend of at least $0.55 per share were baseless; (2) the Company knew, based on then-present facts, that it could not support future dividend payments in excess of $0.55 per share; and (3) the cash flows from the Company’s master MLPs could not possibly sustain such high dividends. As a result of the foregoing, Teekay misled the market about the strength of its business and financial condition.
