The woman notes that having the filter within her body places her at elevated risk for serious health complications that could possibly be life-threatening. Each day, she states that she lives with fear, and is well aware that there is a possibility for a sudden catastrophic event to occur inside of her body because of the filter.

At this time, Xarelto has become the topic of over 3,400 lawsuits which have been formed into two major groupings. Lawsuits filed in federal court, which now number over 2,800 have been consolidated and transferred to a single court in the Eastern District of Louisiana, forming MDL number 2592. These cases are being overseen by Judge Eldon Fallon, and continue to rise in number. They are also joined by over 620 other Xarelto lawsuits which have been consolidated by the Court of Common Pleas in Philadelphia, Pennsylvania, forming a mass tort program.

The European investigation into Xarelto clinical trials was additionally discussed by AllGov.org, which reported, “The clinical trial relied on blood testing devices that were the subject of two FDA warning letters before the trial began and an FDA recall notice after the trial ended, according to the Project on Government Oversight (POGO). Certain devices in the INRatio product line, the warning notice read, could deliver false test results and that use of those devices may “cause severe or life-threatening injuries, including death.”

Recent information concerning the investigation shows only that the European Medicines Agency, “is currently investigating whether the data generated from the INRatio device could have had any impact on the trial results and the extent of this impact, if applicable.” POGO also noted that an FDA staff review of the trial showed that results seemed to be biased in favor of Xarelto. As the investigations continue and those involved await new information, plaintiffs anxiously await their trial dates.

Traditional blood thinners did not present patients with the same problem, as they have an available antidote through vitamin K. Patients using traditional blood thinners, therefore, who become injured and bleed, are able to be treated with vitamin K which will reverse the blood thinner’s effects and allow their blood to clot much quicker.

Reports surrounding Xarelto bleeding events show that as of last February, Health Canada (the Canadian equivalent of the U.S. Food and Drug Administration) had received nearly 1,100 reports of adverse health events among patients taking the blood thinner. The Xarelto class action lawsuit from Calgary refers to these reports by stating, “A dozen of those adverse events registered with Health Canada indicated that death had resulted from Xarelto.”

Plaintiffs from both Canada and the United States seem to share striking allegations against the drug and drug manufacturers, and unanimously note that if they had been made aware of the potential dangers that they now associate with the blood thinner, they would have been sure to use an alternative drug.

On August 9, 2010, the FDA released an safety communication entitled “Removing Retrievable Inferior Vena Cava Filters.” Their public statement was reportedly directed specifically at surgeons who implant and remove IVC filters in patients. It indicated that when patients’ risks of pulmonary embolism have gone away, the filters should be removed as quickly as possible to avoid further complications. During the statement, they also indicated that in many cases, this was not occurring.

The agency also reported that between 2005 and August of 2010, they had received 921 adverse event reports concerning IVC filters and medical complications suffered by patients implanted with the devices. Additional information detailing the FDA’s adverse event reports shows that 328 of the reports discussed “device migration,” which happens when an IVC filter somehow detaches itself from its original implantation location and begins to move within the body. 146 of the reports involved “embolizations” which happen when IVC filter or filter pieces migrate to vessels which provide blood to the heart and lungs. 70 of the reports noted “perforation,” which happens when filter pieces perforate the inferior vena cava wall or when a piece of the device perforates a blood vessel or organ. Finally, 56 of the reports mentioned “filter fracture” which happens when IVC filters break within patient’s bodies.

IVC filters are used among patients who are at high risk of the formation of blood clots but who cannot use traditional blood thinners. The cage-like devices are surgically implanted into the inferior vena cava vein, where they work to trap and hold blood clots traveling from the lower body toward the heart and lungs, which can cause pulmonary embolism. They are supposed to hold these clots until they dissipate, keeping the patient safe from dangerous health complications caused by blood clots. The filters are intended to be used temporarily, and then removed from patients as quickly as possible after blood clot risks have gone away.
