Xarelto Lawsuit Filed After Man Died From Uncontrollable Internal Bleed

May 24, 2016 – – TheProductLawyers.com reports on a South Florida resident whose husband died from internal bleeding while taking Xarelto, a new-generation blood thinner released on the market in 2011 after its approval by the U.S. Food and Drug Administration (FDA). The deceased’s wife filed a lawsuit on his behalf against the manufacturers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer Healthcare, stating they did not adequately warn consumers about the dangerous risks related to taking Xarelto, specifically the potential for significant and uncontrollable bleeding.

The plaintiff, in this case, alleges that Janssen and Bayer are responsible for her husband’s death because of bleeding that doctors were unable to stop. He subsequently died from a subdural hemorrhage. The deceased was taking Xarelto to decrease his risk of having a stroke that he was susceptible to because of his heart condition, atrial fibrillation.

When Xarelto was released it was touted as being much better than the traditional blood thinners that came before it because patients taking it did not have to be constantly monitored nor did they require special diets. Yet, today there are lawsuits filed from across the country which allege that the anticoagulant can cause dangerous and fatal bleeds and the filings are still increasing in number.

Xarelto now is the focus of 2,800 lawsuits filed in federal courts all across the United States. It is also the subject of 550 more in a mass tort program in Philadelphia, PA.

Recent actions taken by the FDA also seem to verify the alleged risks associated with taking Xarelto with its issuance of two black box warnings for the drug. A black box warning is considered to be the harshest that can be given to a product before being ordered to remove it from the consumer market.

The attorneys of Banville Law, the firm behind TheProductLawyers.com, are offering complimentary consultations to anyone who suffered injury or hospitalization after a bleed while on Xarelto. For more information about this release or the Xarelto litigation call 888-997-3792.

FDA Releases New E-Cigarette Regulations Following Exploding E-Cig Lawsuit Filings

May 24, 2016 – – LipsigLawyers.com reports on a recent article from Teen Vogue discussing important new rules released by the U.S. Food and Drug Administration regarding e-cigarette use. Minors under the age of 18 have been ordered unable to purchase e-cigarettes or hookah tobacco since May 5 of 2016.

These new rules were reported to be in effect 90 days after this ruling. Prior to this, those under 18 were able to purchase e-cigarettes, hookah tobacco, or cigars. Now, purchasers will be required to show ID proving that they are over 18. Under these rules, free samples and tobacco sale from vending machines will be outlawed (unless the machines are located in an adults-only venue).

In a statement from the FDA, it was indicated that these rules were implemented to, “prevent misleading claims by tobacco product manufacturers, elevate the ingredients of tobacco products and how they are made, as well as communicate their potential risks.”

Under the new provisions, e-cigarette manufacturers will be required to report the ingredients of their products, (even those which are potentially harmful,) and will undergo premarket reviews and have to become authorized by the FDA, which will provide health warnings on the product packaging.

The Teen Vogue article reports that “e-cigarette use has skyrocketed among teens over the last five years; a recent survey showed use increased among high-schoolers from 1.5% to 16% between 2011 and 2015, with about 3 million middle and high schoolers reporting e-cigarette use in 2015.

Recent reports of exploding e-cigarettes have caused increased controversy surrounding an already controversial product. The article discusses a 17-year-old from Ogden, New York who required hospitalization after suffering injuries to his soft palate, lip, and hand following an alleged e-cigarette explosion. As e-cigarette use has increased, so have reports much like this one.

Attorney Marc Freund of Lipsig, Shapey, Manus & Moverman is currently helping several clients pursue legal action following reported e-cigarette explosion injuries. He encourages anyone who has also suffered from e-cigarette damage to investigate their legal rights, and notes that these individuals may be entitled to significant compensation. To assist these individuals, Attorney Freund is now offering free legal consultations.

Xarelto Lawsuit Plaintiff Claims Drug Manufacturers Responsible For Husband’s Death

May 24, 2016 – – TheProductLawyers.com reports the U.S. Food and Drug Administration (FDA) approval of Xarelto in 2011, which at the time was launched as a new-generation blood thinner drug. Xarelto is unlike its predecessor blood thinners because patients do not require constant monitoring or special diets when using it. These benefits that were not available to patients before and may have contributed to the initial dismissal of the risks associated with the drug. Today, however, these risks are becoming well known because of the thousands of lawsuits filed against the makers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer Healthcare. Plaintiffs in these many lawsuits are claiming that Xarelto is one of the most dangerous blood-thinning drugs on the market due to the risk of uncontrollable bleeding it presents to its users.

Xarelto is now the focus of concern in an excess of 2,800 federally-filed lawsuits from across the United States along with 550 or more additional cases in a mass tort program created by an action of the Court of Common Pleas in Philadelphia, Pennsylvania.

One lawsuit in particular filed by a south Florida resident on behalf of her deceased husband, alleges the manufacturers of the drug failed to sufficiently warn consumers of the serious bleeding risks associated with Xarelto. The plaintiff is claiming that her husband’s use of Xarelto to lessen the threat of having a stroke due to his atrial fibrillation caused his untimely death. He suffered an instance of uncontrollable internal bleeding that doctors could not stop while he was using the drug. This case was eventually transferred to the Eastern District of Louisiana with the U.S. Judicial Panel’s consolidation order which is now being overseen by the Honorable Judge Eldon Fallon.

An action by the U.S. Food and Drug Administration (FDA) has given plaintiffs even more ammunition in their legal battle against the manufacturers of Xarelto. The agency has issued two black box warnings which are the harshest warnings possible prior to a product being fully removed from the market.

The attorneys of Banville Law, the firm behind TheProductLawyers.com, are offering complimentary consultations to anyone who suffered injury or hospitalization after a bleed while on Xarelto. For more information about this release or the Xarelto litigation call 888-997-3792.

Xarelto Lawsuit Plaintiffs Note Celebrity Endorsement Of Drug

May 24, 2016 – – TheProductLawyers.com reports on the public relations and advertising campaign undertaken by Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, in regard to the blood-thinning drug Xarelto. The makers of Xarelto have retained celebrities and famous athletes to endorse the benefits of Xarelto but failed to sufficiently state the potentially dangerous risks involved with taking the drug according to several plaintiffs who have filed suit against the drug manufacturers.

The commercial in question features Saturday Night Live star Kevin Nealon, golf legend Arnold Palmer, NBA star Chris Bosh, and NASCAR driver Brian Vickers. Each of these celebrities endorses the virtues of Xarelto and provide information about the drug but fail to mention risks such as excessive bleeding which could cause death.

There have been thousands of lawsuits filed against Janssen and Bayer since the drug was released on the market with over 2,800 being consolidated into a multidistrict litigation (MDL) in Louisiana under the oversight of the Honorable Judge Eldon Fallon. Another 550 cases have been consolidated in a mass tort program in Philadelphia, PA. The plaintiffs in these cases have a much different view of the drug than that expressed by the celebrity spokespersons in the Xarelto commercial. Many plaintiffs are questioning the tactics of the manufacturers and feel the ad is very misleading as they allege it puts users at risk of severe uncontrollable bleeding.

It should also be noted that the U.S. Food and Drug Administration (FDA) has questioned the safety of the drug as well in its issuance of two black box warnings for the drug since the agency approved it for release on the market. Black box warnings are ominous and do not portend well for a product since these warnings come at a point when it is potentially about to be pulled from the market.

The attorneys of Banville Law, the firm behind TheProductLawyers.com, are offering complimentary consultations to anyone who suffered injury or hospitalization after a bleed while on Xarelto. For more information about this release or the Xarelto litigation call 888-997-3792.

New E-Mini Futures Retirement Portfolio Hedge Course Launched On Udemy

May 24, 2016 – – Through the University of Puerto Rico, people can now learn how to use stock index futures in order to help protect their retirement portfolio. They have launched a new course through the Udemy network that focuses on futures trading, designed to ensure people can protect their indexed retirement portfolios. The course is available at https://www.udemy.com/trading-controlled-leverage-financial-and-commodity-futures/.

Dr. Scott Brown from the University of Puerto Rico says: “Index futures hedging is absolutely vital to investors with retirement accounts. By properly investing at 12%, it is possible for people to have a million by the time they reach 65, and we want to help them achieve this. The new course, which is available through Udemy, teaches people how to achieve this in a very easy way.”

The industry apparently agrees with Dr. Scott’s views on the importance of index futures hedging. As can be seen at http://www.schwab.com/public/schwab/nn/articles/Using-Futures-to-Help-Protect-Your-Portfolio-2, industry experts such as David Schwab feel that this type of investment is vital in building a diverse portfolio. Through index futures hedging, it is possible to protect the value of stock investments. Furthermore, Schwab has provided information to help people calculate the appropriate number of futures contracts for hedging, which the new Udemy course also offers in a more in-depth manner.

The new course offers evidence of investors in the Ed Seykota commodity fund who grew $15 million with an investment of just $5,000. The course will show people how to easily estimate the profits on their futures position. Additionally, it provides them with a toolkit on the best futures marketing hedging strategies. It also offers the Gyroscopic method, which helps investors to diversify their portfolio by trading accross seven factor markets that are completely unrelated.

“Believing that $5,000 can be turned into $15 million may seem incredible, but it is possible,” adds Dr. Brown. “There are vasts bodies of evidence out there on how to achieve this, and what this shows in particular is that people need to start with this as early as possible.” The evidence Dr. Scott refers to can be accessed at http://worryfreewealth.com/how-a-million-dollar-retirement-can-get-you-your-hearts-desire/, which provides invaluable information on making good investments.

Construction Accident Lawyer Comments On Need For Reevaluation Of Construction Site Protocol

May 24, 2016 – – LipsigLawyers.com’s Thomas Moverman recently commented on the need for reevaluation of construction safety measures, indicating that the rise in New York City construction deaths should be prompting officials to take a harder look at construction site protocol.

According to Construction Dive, New York City Mayor Bill de Blasio has started introducing safety procedures and penalties for the city’s construction sites. They include enforcement sweeps at thousands of construction sites, new supervision requirements, the addition of 100 building inspectors, and quadrupling penalties for safety lapses. These new procedures follow the investigation into a crane collapse that occurred last year in New York City, which injured three people and killed a pedestrian when the huge machine tipped over succumbing to high winds.

New York City has seen a significant rise in construction-related injuries in the past year. According to the Bureau of Labor Statistics, New York saw 86 fatal injuries in 2014 related to construction and maintenance occupations. Twenty-four of those incidents involved contact with objects and equipment and 28 were because of falls, slips, and trips. Common injuries associated with construction accidents include lacerations, broken or fractured bones, spinal injuries and brain injuries.

Mr. Moverman has represented hundreds of victims affected by construction accidents and, in some cases, has helped those individuals receive the compensation they deserve. In one case, lawyers from the firm represented a man who was eventually awarded $1.75 million after he fractured his pelvis in a scaffolding fall. Lawyers at Lipsig, Shapey, Manus & Moverman are currently looking to assist individuals who have been injured in a construction accident. The firm is currently offering free consultations to those individuals injured in a construction accident.

Senator Schumer Requests Federal Government Investigation Of E-Cig Explosion Reports Following New York Lawsuit Filings

May 24, 2016 – – LipsigLawyers.com reports on recent information published by Daily News surrounding the controversies of e-cigarette explosion allegations. Senator Chuck Schumer has requested that the federal government begin an investigation of reports of exploding e-cigarettes. He noted that at this time, at least 4 New York residents have come forward reporting painful injuries over the last few weeks, and have each attributed those injuries to electronic cigarette explosions and the fires that they say have followed.

The article notes that Schumer indicated new federal regulations will provide the U.S. Food and Drug Administration with the power to begin investigations upon these reported incidents and to require warning labels or, if necessary, recalls of the products. Also last week, the federal government noted that it will now require e-cigarettes to be further regulated by requiring that manufacturers submit their products for reviews.

In a recent e-cigarette explosion report in New York City, a woman stated that she was parking her car in Queens when her e-cigarette device suddenly exploded, ripping apart her jeans and burning her leg. She says that the device exploded with such force that it became embedded in her dashboard. The woman has pursued legal action following her injuries and is working with Attorney Marc Freund of Lipsig, Shapey, Manus & Moverman.

Attorney Freund is working to help several clients who have decided to pursue lawsuits after allegedly suffering from similar e-cigarette explosion injuries. He is also working to investigate these occurrences as he assists his clients, and he strongly encourages anyone who believes they have been injured by one of these devices to investigate their legal options fully. He notes that affected individuals may be entitled to significant compensation gained through legal action. To better assist those who wish to explore their opportunities moving forward, Freund is now offering free legal consultations for involved parties.

Built To Sell Podcast Interview With Dennis Hart – Selling His Business Shows How EBITDA Equals Your Value

May 24, 2016 – – Carrie Hartunian Smith of Smart Marketing Consulting, a business in CaveCreek, AZ, is proud to announce that they have arranged a podcast interview with entrepreneur, direct response and ministry media expert, Dennis Hart on Built to Sell Radio program hosted by John Warrillow.

John Warrillow is the host of this successful podcast, author and creator of a tool to help business owners assess the “sellability” of their company.

Dennis Hart was the founder of a successful media company, Apex Media Sales, Inc., which generated over ¾ of a billion dollars in revenue from the time the business opened in 1993 through sale of company in 2007.

Apex Media was a unique hybrid media company within the Direct Response market. Having success working with broadcast television stations, local, regional and national cable networks, increasing their quarterly budgets, Apex’s explosive growth had much to do with creating an Ad Agency division, for many top direct response and ministry brands.

Carrie Hartunian Smith explains: “Dennis speaks about some of the core values that made Apex so successful, but focuses on how although he was able to sell Apex for an impressive 7 times EBITDA (approx) – the realization that the company did not sell for a higher multiple was a struggle during the negotiation process. So much so, that Dennis walked away from the complex negotiations multiple times. A powerful take away from this interview was – despite how successful the company was for 14+ years, it does not mean you’ll get the payout you are expecting.

The interview demonstrates the importance of clearly understanding how EBITDA impacts one’s business before beginning the process of selling one’s company. To listen to the complete interview, people are encouraged to visit the Build to Sell website, where the podcast has been posted.

Built To Sell Radio

During the interview, John Warrillow asks Hart to share his thoughts on how he knew it was time to sell the company.

Hart explains: “I’ve gotten to appreciate timing over the years, specifically when playing in the world of stocks. You want to get in on the low and sell on the high. When I set out, I said to myself I was going to grow this company and I wasn’t going to dwell on an exit strategy. I was going to make myself ready when the timing was right. I don’t think I fully understood at the time, but the timing on this acquisition was perfect!”

Dennis Hart hopes that, through his interview, he can inform entrepreneurs and business owners about the importance of EBITDA months or even years prior to thinking through a successful exit strategy. Entrepreneurs living off their business will have a harder time receiving a higher multiple if they have not taken this into consideration.

Part of the acquisition negotiations were centered around Hart’s future role within the company. The acquiring company asked Hart to stay on as Vice Chairman.

Recently the parent company closed the infomercial division of what once was a thriving media organization. Hart continues to enjoy semi-retirement, as he leads the media initiative for one of the largest, most prestigious ministries on television today.

Episode #44 Multiple of What? On Built to Sell Radio podcast continues to be ranked the most popular on iTunes.
