Bellwether Trial Selection Continues As Xarelto Lawsuit Filings Increase

June 29, 2016 – – TheProductLawyers.com announces progress in the more than 3,000 cases against the new-generation anticoagulant Xarelto. Late in 2015, the U.S. Judicial Panel on Multidistrict Litigation issued their response to a petition for agglomeration. They created a multidistrict litigation (MDL) 2592 in order to expedite the trial process and conserve resources both public and private. They also stated that any subsequent cases with similar allegations brought before federal courts would be joined with the MDL. The mass litigation will ultimately be tried in the Eastern District of Louisiana.

Plaintiffs represented in MDL 2592 allege that taking Xarelto as prescribed substantially increased their risk of suffering a catastrophic bleeding event. This is an event in which bleeding cannot be stopped except through extreme measures. Allegations are made against the defendants,the manufacturers of the anticoagulant, Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson Corporation.)

On December 17th, Judge Eldon Fallon, who was appointed by the JPML, issued a court order. From those represented in the MDL, lawyers for both the plaintiffs and the defendants must each select ten court cases that were most trial-ready from the states of Mississippi, Louisiana, and eight others with the most concentrated claims. These would be merged with twenty lawsuits meeting the same criteria selected by the court.

Judge Fallon explained that this created a trial pool of forty cases, from which only four would then be selected for bellwether trials. Bellwether proceedings will allow lawyers for both the plaintiffs and the defendants to present evidence before a jury panel, observe their reactions, and tailor future proceedings based on gathered data. This is yet another measure to ensure that resources are wisely spent for both parties in the lawsuit.

The original selections for the pool were completed no later than January 11th of this year, which means that the plaintiffs in the MDL are one step nearer to the scheduled bellwether trial court dates. While the bellwether trials will take time, plaintiffs are confident that additional lawsuits will continue to be added to the MDL.

Attorneys Representing Cook Medical Seek Additional Preparation Time, As IVC Filter Lawsuit Plaintiffs Await Conference Date

June 29, 2016 – – TheProductLawyers.com reports on the status of the settlement conference related to the pending lawsuits against the Cook IVC filter. Initially, the conference was set for March 2016. The conference would have provided an opportunity for all parties involved in the litigation process to discuss and try to formulate a settlement proposal among each other before a U.S. Magistrate Judge. The March conference was pushed back once and Cook has allegedly asked for an additional postponement to allow its attorneys to undertake additional study and research. Plaintiffs that have filed lawsuits are anxiously awaiting word on when the settlement conference will take place and are hopeful that it will produce an agreement to prevent the cases from going to trial.

A common allegation made by plaintiffs is that the IVC filter is defectively designed and manufactured. The plaintiffs have made similar claims that the small, cage-like filters move from their initial surgical implantation sites in their inferior vena cava vein and have broken apart with the pieces migrating to other parts of the body that, in some cases, doctors consider “high risk,” thus not allowing for the removal of the pieces. Since the pieces cannot be removed, many patients consider themselves to be live time bombs, as the pieces could potentially move again causing life-threatening consequences.

At the present time, there have been over 250 cases filed that have been consolidated into a multidistrict litigation (MDL) by a decree of the U.S. Judicial Panel on Multidistrict Litigation (JPML). The MDL has been assigned to a sole court in the Southern District of Indiana. Due to similar allegations, the cases were grouped together to expedite their review in the legal system. Since the MDL was created, all parties involved have been preparing for the first trials expected to start in the early part of September 2016.

This is the seventh reported e-cigarette explosion in Colorado, which is among the highest totals of reported e-cig explosions for all U.S. states. Only 3 states have had more reported e-cigarette explosions, which are California (19), Arizona (11), and Oklahoma (8).
