June 13, 2016 – – TheProductLawyers.com reports on the U.S. Food and Drug Administration (FDA) approval of Xarelto in 2011, which at the time was launched as a new-generation blood thinner drug. Xarelto was unlike its predecessor anticoagulant drugs because patients did not require constant monitoring and special diets. These benefits that were not available to patients before could have contributed to the public’s lack of focus on the risks associated with the drug, which today, are becoming well known because of the thousands of lawsuits filed against the makers of the drug, Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer Healthcare.

Xarelto is now the focus of concern in an excess of 2,800 federally-filed lawsuits from across the United States along with 550 or more additional cases in a mass tort program created by an action of the Court of Common Pleas in Philadelphia, Pennsylvania.

One lawsuit in particular filed by a Florida resident on behalf of her deceased husband alleges the manufacturers of the drug failed to sufficiently warn consumers of the serious bleeding risks associated with Xarelto. The plaintiff is claiming that her husband’s use of Xarelto to lessen the threat of having a stroke due to his atrial fibrillation caused his untimely death. He suffered an instance of uncontrollable internal bleeding that doctors could not stop since Xarelto was still in his system. This case was eventually transferred to the Eastern District of Louisiana with the U.S. Judicial Panel’s consolidation order which is now being overseen by the Honorable Judge Eldon Fallon.

An action by the U.S. Food and Drug Administration (FDA) has given plaintiffs even more ammunition in their legal battle against the manufacturers of Xarelto. The agency has issued two black box warnings which are the harshest possible issuance prior to a product being fully removed from the market.

Users often choose them as a way to cut down on tobacco smoking, yet now they are discovering that they face other risks when using these electronic cigarettes. A JDNews.com report notes the case of a man who lives in North Carolina, and at age 54 decided he wanted to cut down on his smoking habit. He purchased an e-cigarette to aid him in quitting traditional cigarettes but the device exploded while he was using it, and sprayed what felt like hot oil on his face. The explosion resulted in significant burns and temporary blindness. He wound up spending a night in the hospital for treatment and expressed concern that what warning there was on the device was in small print, difficult to read and understand. He did not know that the device had the potential to “pack a punch,” as he said. It turns out that his chosen brand uses both alcohol and propylene glycol in the consumable “juice,” both combustible liquids.

The U.S. Food and Drug Administration encourages those who experience adverse events from e-cigarettes to visit their MedWatch program page and file a report, but they have not yet begun keeping official statistics for electronic cigarette devices. Increasing reports of events resulting in personal harm and property damage have been in the news, and most alarming are the reports of children and teens being injured during these explosions. For example, at a mall kiosk, a 14-year-old Brooklyn boy suffered burns, permanent blindness in one eye, and a ripped cornea after an e-cigarette battery exploded as he was holding it. This particular event has spurred much controversy due to the fact that state laws prohibit the sale of these devices to minors.
