Xarelto Lawsuit MDL Judge Eldon Fallon Chooses Spring 2017 For Bellwether Trials

June 08, 2016 – – TheProductLawyers.com reports on the fast approaching Xarelto bellwether trials that were selected from a larger pool of 40 cases as directed by the Honorable Judge Eldon Fallon of the Eastern District of Louisiana who is overseeing the multidistrict litigation (MDL) logged as number 2592. Judge Fallon set a date of January 11, 2016, for the pool of 40 cases to be selected from which the bellwether trials would be chosen to go to court in spring of 2017.

Xarelto has been the focus of over 2,800 lawsuits that all have similar allegations being filed against the drug’s manufacturers, Bayer Healthcare AG, and Janssen Pharmaceuticals, the latter of which is a subsidiary of the Johnson and Johnson Corporation. Plaintiffs have stated in their court documents that their use of Xarelto precipitated dangerous and uncontrollable bleeding, especially gastrointestinal bleeding, as well as strokes and brain hemorrhages. Another commonality among the many lawsuits filed is the allegation that the makers of Xarelto did not adequately notify the public about the serious risks that could result from taking the drug.

As per information released from the court, Judge Eldon Fallon has scheduled the first two of four bellwether trials to be heard on February 6th and March 13th of 2017. The two subsequent trial dates have been set for April 24th and May 30th of 2017.

The purpose and intent of the bellwether trials is to gauge the reaction of the juries and how they may rule on the cases based on the evidentiary arguments presented by the plaintiffs and their attorneys. The next step will be to plan a strategy as future trials are scheduled and they progress forward in the court system.

The court has released information regarding the first 4 cases that will be heard in early spring of 2017. The dates of the first two trials will be February 6th and March 13th of 2017. The second set of case dates released subsequent to these are April 24th and May 30th of 2017. These 4 cases were selected from an initial pool of 40 lawsuits that Judge Fallon directed to be compiled by January 11, 2016.

Scaffolding Fatality In Kansas City Prompts Criticism From Construction Accident Lawyer

Moverman sends his condolences to the family of the 58-year-old construction worker who fell to his death when he was climbing up scaffolding to begin work. Attorney Moverman indicates that with the implementation of additional safety precautions OSHA could help limit the frequency of construction worker fatalities.

As reported by Fox 4 Kansas City, a Kansas City man fell three to four stories while working on a Leawood apartment complex. A local police chief stated that several workers had already made their way up the scaffolding safely when the incident happened, and two other workers were still waiting to go climb the scaffolding when the victim fell. Police claim that no one actually saw the man fall and that the death is being investigated as a construction accident.

The victim was pronounced dead at the scene of the accident by local paramedics. The Federal Occupational Safety & Health Administration (OSHA) has been notified of the incident and are in the process of conducting an investigation to assess whether the death could’ve been prevented. 2,200 OSHA inspectors are responsible for enforcing safety regulations for over 130 million workers.

According to the Bureau of Labor Statistics, there were 4,821 fatal work injuries in 2014, which signified a 5 percent increase in fatalities from 2013. More specifically, the report indicates that there were 94 more fatalities as a result of falls, slips, and trips from 2013 to 2014. The report also details that construction accounted for 899 out of the 4,821 fatalities, which is nearly 19 % of the total from 2014.
