Xarelto Lawsuit Of Ohio Couple To Join MDL

Recently, the U.S. Judicial Panel on Multidistrict Litigation ordered the agglomeration of all federally-filed suits against Xarelto and its manufacturers under the heading of a multidistrict litigation (MDL 2592). It is slated to be tried in the Eastern District of Louisiana under Judge Eldon Fallon, and the suit filed by the Ohio couple will be included.

Many of the claimants have similar allegations and claim they were placed in unwarranted danger of catastrophic bleeding episodes as a result of using Xarelto. As the litigation moves towards trial, plaintiffs are optimistic that additional suits will join the effort.

IVC Filter Lawsuit Plaintiffs Await September 2016 Trials, As Discussions Continue Regarding Rescheduled Settlement Conference Date

June 28, 2016 – – TheProductLawyers.com reports on a settlement conference that plaintiffs hope is rescheduled to prevent the need to go to trial for the many lawsuits filed against Cook Medical in regards to the IVC filter devices the company manufacturers. Plaintiffs are anxiously awaiting word of a new settlement conference that will allow them, their attorneys and the defendant to possibly negotiate a settlement to bring resolution to the approximately 250 lawsuits that are pending in a multidistrict litigation (MDL) being overseen by a court in the Southern District of Indiana. The settlement conference would be before a U.S. Magistrate Judge.

The settlement conference was to have taken place in March 2016. However, the defendant’s attorneys had asked for a postponement to allow for more time to review findings and prepare their client. No word has been given about when a settlement conference will occur. If one is not rescheduled, then trials will proceed sometime in early September 2016.

At the center of the lawsuits are allegations that the IVC filters have been defectively designed and manufactured and once surgically placed in the patient’s inferior vena cava vein, they can fracture thus sending the pieces to other parts of the body with some becoming lodged in veins and organs. In some instances, the pieces cannot be surgically removed as they have embedded in areas of the body considered to be “high risk.” The pieces then are left in the body and can potentially cause more damage.

The IVC filter is a small cage-like medical device usually used in patients who cannot take traditional blood thinning medications. It captures errant blood clots originating in the legs that travel through the inferior vena cava to the heart and lungs. If the clot reaches the heart and lungs it can cause a pulmonary embolism. The filter catches the clot allowing it to dissipate on its own. The IVC filter is a temporary solution, according to the FDA, and should be removed when the risk of blood clot formation has passed.

An update on the case by WNYT.com, a local NBC affiliate, stated that the victim filed a lawsuit on June 22nd, following the alleged device malfunction that occurred on May 19th. The victim’s lawyer claims that they suspect the alleged explosion was a result of the user’s defunct lithium-ion battery.

FEMA has previous clarified their belief that the lithium-ion batteries are the likely cause of most e-cigarette explosions. Their belief stems from the instability of the lithium-ion core, and the strong potential for an energy overload, which victim’s see as an explosion often times accompanied by a resulting fire.

This is the among several e-cigarette explosion lawsuit cases that have been filed in New York within the last month and is the sixth e-cigarette explosion in New York since 2009. The first New York e-cigarette explosion lawsuit case filed in June came shortly after a teenage boy from Brooklyn sustained severe burns, and lost sight in his left eye on April 5th. The alleged explosion occurred while the 14-year-old boy was sampling an e-cig at a mall kiosk at Kings Plaza Mall. Ohio Husband And Wife File Xarelto Lawsuit

However, the approved uses soon expanded to include it as a preventative measure in the treatment of atrial fibrillation.

While it was initially heralded as a wonder drug, Xarelto has since accumulated more than 3,000 lawsuits against it, many with similar claims.
