Dallas Construction Worker Killed In Lift Accident, Cues Comment From Construction Accident Lawyer

As reported by NBCDFW.com, on May 11th of 2016, a local Dallas construction worker was on site near a forklift in Rowlett at about 8:15 AM. Xarelto Lawsuit Plaintiff Claims Man Died Of Uncontrollable Bleeding Caused By Drug

June 06, 2016 – – TheProductLawyers.com reports on a lawsuit filed in the state of Vermont by the daughter of a deceased Xarelto user, her father. She claims he died from an uncontrollable brain bleed which was caused by his use of the drug when he sustained an injury.

In her lawsuit paperwork, the plaintiff claims her father was prescribed Xarelto to treat his atrial fibrillation, a heart condition that can sometimes put patients at risk for blood clots or stroke. Blood thinners, such as Xarelto, are used as a preventative option to prevent clotting or stroke. Her lawsuit has been filed against the makers of the drug, Bayer AG and Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation.

She further states in her court filing, that her father had only been using Xarelto for a brief period. After his fall and the brain bleeding occurred, he was diagnosed with an intracerebral hemorrhage. He eventually died from the bleeding.

Many blood thinners, such as warfarin, are accompanied with an antidote via the use of Vitamin K, which acts as to counter the effects of the blood thinner and allows blood to form clots. At the time of the plaintiff’s father’s death, there was no antidote released with Xarelto, leaving doctors with no option other than blood transfusions or surgery.

The plaintiff is claiming that the drug’s manufacturers were negligent in releasing a drug on the market with no known antidote, which can create potentially lethal bleeding dangers, as was the case with her father.

In addition to the plaintiff’s lawsuit, many others have been filed claiming the drug caused uncontrollable bleeding. 550 lawsuits have been consolidated into a mass tort program in Philadelphia, PA, along with 2,800 others that have been grouped together in a Multidistrict Litigation (MDL 2592).

June 6, 2016 – A new study suggests that proton pump inhibitors may accelerate aging of the cells that line the blood vessels, an occurrence which could explain findings linking drugs like Nexium to kidney failure, heart attack, and other dangerous complications. According to a report published last month in Circulation Research, the authors of the study cultured endothelial cells, which line the walls of the blood vessels and produce a substance that prevents plaques or blood clots from adhering. The cultured cells were then exposed to typical doses of Nexium for an extended period of time.

The experiment indicated that long-term exposure to proton pump inhibitors impaired the ability of lysosomes to produce the acid which would normally clear waste products from the cells. The resulting build-up of waste caused the endothelial cells to age rapidly, which could interfere with their ability to protect blood vessels. The study authors did not observe a similar phenomenon in cultured cells that were exposed to another class of heart burn drugs called H2 blockers, which includes medications like Zantac and Pepcid.

“This study is just the most recent to suggest that long-term use of Nexium and other proton pump inhibitors could be associated with serious health consequences.     Xarelto Lawsuit Cases Consolidated By JPML

    June 06, 2016 – – TheProductLawyers.com reports on the immense number of cases being filed against Bayer AG and Johnson and Johnson Corporation subsidiary Janssen Pharmaceuticals related to Xarelto. The anticoagulant has been alleged to have caused instances of uncontrolled and very dangerous bleeding in patients using it. Resulting from the large number of cases, a group of plaintiffs that had filed individual lawsuits petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) in October 2015 to consider consolidating the cases since all of the 2,800 or more of the suits filed involved the same defendants and very similar allegations about the drug.

    The petitioners asked that all the cases involved be under the jurisdiction of a court in the Southern District of Illinois. However, the defendants in the case argued against this move since they were located in New Jersey and felt it would be more prudent to have them assigned to a New Jersey court.

    In a decision handed down on December 12, 2015, the judicial panel agreed with the petitioners and opted to consolidate and centralize all the bleeding cases involving Xarelto to the Honorable U.S. District Court Judge Eldon E. Fallon in the Eastern District of Louisiana. The panel expressed its confidence in Judge Fallon to prudently and effectively oversee the consolidation of MDL 2592.

    The JPML felt that having each case heard individually would only serve to increase the amount of time spent by those parties involved in the cases as well as the legal expenses that would be incurred. The panel also felt such a consolidation would reduce the lengthy and sometimes very expensive discovery processes.
