Xarelto Lawsuit Cases Granted MDL Status By JPML

June 28, 2016 – – TheProductLawyers.com offers insight on the latest developments in the more than 2,800 cases against Xarelto and its manufacturers, Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson.) In October of 2015, plaintiffs collectively approached the U.S. Judicial Panel on Multidistrict litigation (JPML) with a request for consolidation of cases with similar allegations. They further requested that the trials be held in the Southern District of Illinois. The defendants protested this, citing New Jersey as a more logical venue since many of their corporate offices are based in that state.

Following many weeks of formal hearings and deliberation, the JPML issued their statement on December 4th, 2015. Given the body of evidence evaluated, they stated, “In our judgment, the considerable growth in the litigation over the past few months demonstrates that informal coordination is not practical.” They then agreed to create a multidistrict litigation for the plaintiffs, citing conservation of public and private resources as the foundation for the motion. Additionally, they dictated that the proceedings would be held in the neutral location of the Eastern District of Louisiana to forestall further contention.

The consolidation, which became official on December 12th, also serves the interests of all parties by precluding the potentially variable verdicts of multiple judges. To this end, they made their choice of judge clear, observing that, “Judge Eldon E. Fallon, who presides over three potential tag-along actions, is an experienced transferee judge with the willingness and ability to manage this litigation efficiently.”

They are confident in his prudent sense of the law and his competent management of cases. Plaintiffs are confident that additional cases will continue to swell their numbers as the cases proceed to court. In Pennsylvania, a mass tort program comprising 550 individual cases is was consolidated by the Philadelphia Court of Common Pleas. McCain shared photos on Facebook of their adventures that day, photos that have been shared and viewed hundreds of thousands of times since they first hit the internet.

The father stated that he felt it would be best to have fun with the task, and then reposted the same pictures on his company’s Facebook page. “We love that he’s so in tune with his daughter, and that he’s helping to build a future doll collector,” says the spokesperson for the Doll Collectors of North Park.

In the shared images, viewers will see Abbie the doll standing on a truck filled with wheat and waiting to get into the truck while it’s being loaded. McCain even shared pictures of the doll “eating” a Slim Jim stick and enjoying a can of soda. He says that his daughter did not approve of the “meal” but he assured the child that the doll did not complain about her “food”.

The story has gone viral, with many praising the dad for his enthusiasm with his daughter.

Doll Collecting Club In San Diego Announces First Event

June 28, 2016 – – Doll Collectors of North Park has announced their first ever event. The meet up, which will be a regular event, is set for the Lafayette Hotel in North Park in San Diego, California, on June 25, 2016. This is a group of like minded collectors of dolls of all types. They meet once per month, and have programs and doll sharing at each meeting.

Two Workers Hurt In Arizona Accident Prompts Comment From Construction Accident Lawyer

These injuries are far from an isolated incident. According to the Occupational Safety and Health Administration (OSHA), 4,821 workers were killed on the job in 2014. One in five of those deaths were in the construction industry. The Bureau of Labor Statistics (BLS) reports that the leading causes of worker deaths on construction sites were falls, followed by electrocution, being struck by an object, and caught-in/between machinery. These incidents, called the “Fatal Four,” were responsible for more than half (57.6%) the construction worker deaths in 2014, BLS reports.

Xarelto Lawsuit Plaintiffs Prepare As JPML Consolidates Cases

Third, it will function as a collection for all subsequently filed federal court cases against Xarelto.

The JPML approved a neutral court location for the hearings, which will take place in the Eastern District of Louisiana. In addition to the benefits of combination for all concerned, they felt a single presiding judge would streamline verdicts, preventing the wildly varying interpretations of the law that can result from informally organized lawsuits of this magnitude.
