The Atlanta-Journal Constitution states that a Fulton male’s e-cig exploded in his pocket without warning, generating severe burns, and leading to him being masked in black soot.

E-cig explosions may be familiar to some, but certainly not all. The lithium-ion batteries that are utilized to charge and power the devices may explode abruptly which can cause harm to the user and others. An earlier incident occurred when a Pismo man allegedly sustained serious injuries to his hands and face after his e-cig exploded in his hand. Several individuals have expressed concern stating that because e-cigs are unregulated they possess significant design flaws, which can leave victims, such as the Pismo man, with the sole responsibility of dealing with the ramifications.

FEMA states that e-cigs ablaze and explode as a result of defective lithium-ion batteries. The batteries explode due to an overload of internal pressure, which creates a fracture at the seal end of the battery. This leads to the pressure being instantaneously released, causing an explosion. FEMA emphasizes that there is a difference between the lithium-ion batteries used by e-cigs and those utilized by computers. The cylindrical shape of the e-cigarette batteries increases the risk of an explosion and potential harm to the user unlike that of a computer battery.

FEMA estimates that at least 25 explosions have been reported, however, the true number of explosions is likely higher due to insufficient reporting. Some alleged victims have taken legal action, hoping to confront the harsh consequences due to a lack of regulation.

The man was seriously injured when he fell down a shaft. His fall was a full five stories and when he landed he was impaled on a steel rebar below. The steel rebar went through his abdomen, back, thigh, and groin. Coworkers reported that despite his injuries, he was still conscious and moaning when they rushed to his side. He was taken to Bellevue Hospital where doctors declared that he was in critical condition.

An investigation into the accident by the Department of Buildings found that the man was not wearing safety equipment when he fell. It was also determined that the steel rebar did not have caps which would have prevented the impalement. At this time, the contractor has been fined $1,000 for having unsafe hoisting equipment and another $1,500 for not fixing the issue.

This isn’t the first time that Mr. Moverman has heard about the horrific suffering a construction worker has experienced after an accident on the job. The lawsuits have been filed against Bayer AG and the subsidiary company of corporate giant Johnson & Johnson, Janssen Pharmaceuticals. Additionally, due to the cases being filed, numbering in excess of 2,800, and all against the same defendants with very similar allegations, a group of Xarelto patients petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) to have the cases consolidated and centralized. The consolidation hearing was heard on December 4, 2015.

The panel rendered a decision on December 12, 2015, and concurred with the petitioners that it was a prudent course of action to have the cases transferred and be litigated together. The panel stated that due to the immense growth of the number of cases being litigated, it demonstrated the impracticality of having them all considered individually given that they were all against the same defendants and were similar in scope in terms of the allegations being made about the drug. The panel felt that the decision to consolidate was an easy one in that it would facilitate a more streamlined process, prevent lengthy and duplicative discovery searches, and avoid the potential for many conflicting decisions by numerous judges in other jurisdictions. The legal expenses and time spent by all of the parties involved in each individual case would be greatly minimized as well.

The panel further stated that it was assigning the multidistrict litigation to U.S. District Judge Eldon E. Fallon who was well versed in, willing and able to preside over this particular multidistrict litigation (MDL 2592) in a very prudent and effective fashion.

The defendants in the case had argued that the cases should be transferred to New Jersey since that was where they were located. Instead, the panel opted to assign the case to the Southern District of Illinois.
