June 02, 2016 – – Tom Moverman of LipsigLawyers.com commented recently on the charges brought against two supervisors after a 22-year-old man was killed in a construction accident on their job site.

The two men are supervisors for Sky Materials Corp and Harco Construction. On the day of the accident, an OSHA inspector visited their work site. Upon inspection, he found that a nearly 7-foot-deep trench was not reinforced. At 9:45 a.m., the inspector informed both supervisors of the dangerous issue and also told them that until the problem was corrected, no worker should be allowed into the trench. He waited to see if they would comply.

An hour later he noted that multiple employees were still in the trench. In the time that had passed the trench had now become 13-feet-deep. He told the workers about the issue and told them that for their safety they should get out of the trench. The workers ignored him. Another hour passed before one of the supervisors told the workers that they should stop and get out, however, he told them in English and most of the men spoke only Spanish.

It wasn’t until 11:50 a.m. that the second supervisor told the workers to get out of the trench in Spanish, however, his warning came too late. As he was speaking the trench collapsed on the men, instantly killing one of them.

The two supervisors have been formally charged with manslaughter, criminally negligent homicide, and reckless endangerment. The New York City Department of Investigation Commissioner commented on the charges, saying, “These defendants ignored repeated warnings that they were not following safe practices, conduct that led to a tragic outcome.”

Mr. Moverman also commented on the charges, saying that “Until construction company owners and supervisors understand that there are serious consequences for putting their workers in danger, accidents due to poor safety will continue to happen.” He hopes that the combination of criminal charges and possible lawsuits will help inspire others to take their employees safety seriously.

Pix11.com reports that the 14-year-old victim is now blind in his left eye due to a scratch through his cornea and may also have permanent damage to his hands from the explosion.

The victim stated “The guy was showing me different products of the vaporizers, and while he was showing me, he connected one of the vaporizers to the battery of the store. He gave it to me to hold and when I was holding it, it exploded in my hands and my face.” Not only is this incident significant because of the explosion, additionally both state and local laws prohibit the sale of tobacco products to minors.

FEMA concludes that since 2009, there have been at least 25 reported e-cig explosions. Additionally, the actual number of explosions is probably far greater than 25 due to underreporting. Another e-cig explosion occurred in Arizona, a few months prior to the incident in Brooklyn, where a local resident stated that while he was driving, 2 extra e-cigarette batteries that were in his pocket engulfed his lower body with flames. The Arizona native sustained extensive burns to his legs, his hands, and is fortunate to have walked away from the incident.

Shortly after the Brooklyn teen sustained the significant injuries from the e-cig explosion, his father hired attorney Marc Freund to represent his son. June 2, 2016 – Hundreds of talcum powder lawsuits (http://www.rxinjuryhelp.com/talcum-powder/lawsuit/) that accuse Johnson & Johnson of failing to warn women about the alleged association between its talc-based powders and ovarian cancer continue to move forward in courts around the U.S. According to a Motion filed in the California Superior Court for Los Angeles County on May 25th, the Company is seeking the dismissal of an ovarian cancer case recently filed by the husband of a woman who died from the disease in 2012. Johnson & Johnson asserts that the claim lacks personal jurisdiction, and that the plaintiff has failed to establish that the decedent was a resident of California, ever purchased or used Johnson & Johnson’s talc-based powders in the state, or developed or was diagnosed with ovarian cancer in California. (Case No. BC617311)

According to court documents filed on May 20th in the U.S. District Court, Eastern District of Missouri, Johnson & Johnson has removed a multi-party talcum powder lawsuit involving 80 individual plaintiffs to federal court. The Removal Notice also disclosed that a motion has been filed in state court that seeks to dismiss the 77 non-Missouri plaintiffs named in the complaint for lack of personal jurisdiction. In February, another St. Louis jury awarded $72 million in compensatory and punitive damages to the family of a woman who died from ovarian cancer.
