Woman Files IVC Filter Lawsuit Against Boston Scientific Following Health Issues

June 29, 2016 – – TheProductLawyers.com reports on a lawsuit filed by a woman who claims that the filter caused serious adverse side effects. The plaintiff’s case (Case no. 5:16-cv-00065) states that the woman was implanted with the Boston Scientific Greenfield Vena Cava Filter in May 2005 after being diagnosed with DVT in her right leg. She claims that she then experienced thigh and lower abdomen pain after she received a filter. She also claims that the device has caused serious clotting. After being admitted to the hospital again, the plaintiff’s CAT scan showed the filter had become occluded. She now has to remain on blood thinners for the rest of her life, according to the lawsuit.

Hers is not the first lawsuit to come about from these filters. Hundreds of cases have already accumulated against manufacturers including C.R. Bard and Cook Medical and have been combined in MDLs in Indiana and Arizona. The suits claim that these companies knowingly marketed a defective product that has allegedly caused serious health problems for patients who used the filters. Adverse events noted by the FDA have included filter fracture, device migration, perforation, and embolization.

The devices were made in order to catch blood clots and prevent them from spreading to other parts of the body. They are usually inserted through the neck or groin and can be used as either a permanent or temporary solution for patients at risk of blood clots. They are typically inserted in patients who are at serious risk for pulmonary embolism but who are unable to take anticoagulant drugs.

As Xarelto Lawsuit Plaintiffs Prepare, Bellwether Trials Draw Nearer

June 29, 2016 – – TheProductLawyers.com reports on the progress of the multidistrict litigation (MDL) 2592 against Xarelto and its manufacturers, Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson Corporation.) Late in 2015, the U.S. Judicial Panel on Multidistrict Litigation responded to the petition to combine nearly 3,000 individual suits with similar claims.

In the interest of conserving resources, both public and private, the JPML agreed to proceed. As an additional measure to expedite the trial, they appointed Judge Eldon Fallon to preside over the mass litigation in the Eastern District of Louisiana. Any additional lawsuits with similar claims brought before federal courts are designated to be included in the existing MDL.

There are several allegations leveled at the massive drug manufacturers, many of which are held in common by the plaintiffs. Perhaps the most common is a claim that taking the anticoagulant placed individuals at a substantially increased risk of a catastrophic bleeding event. This is the occurrence of bleeding that cannot be stopped, except in some cases, with immediate and drastic medical intervention.

On December 17th, shortly after the JPML issued its decision, Judge Fallon instructed both parties to select ten cases from the lawsuits of the MDL. These cases must be among the readiest to proceed to trial, and drawn from the states with the most claims. The court then merged the cases with another twenty court-selected lawsuits drawn from Louisiana, Mississippi, and eight other states.

These, Judge Fallon explained, would form a trial pool from which four cases would then be drawn for bellwether proceedings. Commonly used as a measure to further expedite lengthy and complex court cases, bellwether trials allow both the plaintiffs and the defendants to present evidence before a jury panel. They can then observe the reactions, draw conclusions, and tailor their approach in subsequent case hearings.

As plaintiffs await the coming trials of MDL 2592, they are confident that subsequent lawsuits will continue to be joined into the MDL .

IVC Filter Lawsuit Plaintiffs Claim Devices Are “Ticking Time Bombs” As They Await September 2016 Trials

June 29, 2016 – – TheProductLawyers.com reports on the claims made by plaintiffs that surgeons are unable to remove fractured pieces of IVC filters that have migrated to other more “high risk” areas of patients’ bodies after the initial surgical implantation into the inferior vena cava vein. Because the pieces are then able to remove the errant pieces, it creates future uncertainty for some patients who consider themselves “ticking time bombs” since the embedded pieces could potentially move again causing life-threatening damage and consequences.

Due to the fracturing of the devices and the inability to remove the pieces in some patients, many have filed federal lawsuits against Cook Medical with over 250 being filed so far with more expected in the coming months. Due to the number of cases and the similar allegations, the U.S. Panel on Multidistrict Litigation (JPML) has consolidated the cases into a multidistrict litigation (MDL) to expedite the litigation process. The MDL is being administered by a single court in the Southern District of Indiana. Plaintiffs and their attorneys, as well as attorneys for Cook, have been preparing for the start of the trials since the MDL was created. The first trials are scheduled to begin in September 2016.

Many plaintiffs are hoping for a settlement which would negate the need to go to trial. A settlement conference was scheduled before a U.S. Magistrate Judge where all the parties involved would convene and attempt to negotiate a settlement agreement. The initial March 2016 session was postponed and attorneys for Cook have asked for a subsequent postponement to allow for more preparation time and review of all the documents and research associated with the cases. Plaintiffs and their attorneys are anxiously awaiting word on a date for the rescheduled hearing.
