California Teen Suffers Severe Injuries In E-Cigarette Explosion, While E-Cig Explosion Lawsuit Filings Increase

July 20, 2016 – – LipsigLawyers.com reports on a detailed timeline of e-cigarette explosions compiled by TheProductLawyers.com that depicts the increasing prevalence of such occurrences over the last 2.5 years. It also identifies an increasing rate of occurrence of the explosions and an especially dramatic increase in 2016. California leads the nation in the number of explosions since 2009 with 19 such incidences, which equates to 15 percent of the total number of reported explosions to date. It also should be noted that since 2014, there have been 162 verified e-cigarette explosions. Of this amount, 85 occurred in 2014 and 2015, with 77 of them having already occurred in 2016 alone.

One such incident happened in California. As per a news report made by PasoRoblesDailyNews.com, a local teen enjoying the company of his friends in his car sustained physical damage to both himself and his car when the e-cig he was using exploded in his face. The explosion cracked a window in his car, punctured a hole in his tongue and knocked out some of his teeth. Shortly after the incident occurred on the 1900 block of Cottonwood Road, emergency medical personnel arrived and transported the youth to Twin Cities Community Hospital. After the victim arrived at the hospital, he was then airlifted to Fresno Regional Medical Center to receive proper treatment for his burns in the facility’s burn unit.

LipsigLawyers.com’s Marc Freund referenced the late April episode involving the 17-year old teenager. He stated he is always disheartened to hear of such incidences involving underage smokers since they should not be able to purchase and use e-cigarette devices in the first place. He also extended his best wishes to the boy and hopes he makes a full and speedy recovery from his injuries.

Personal Injury Lawyer Demands Revisions To Construction Safety Rules Following Tragic Crane Accident

July 20, 2016 – – LipsigLawyers.com reports on a fatal crane accident at a construction site on a Highway 269 bridge. A local report from ABC3340.com stated that the incident happened during the early morning of June 13th. One construction worker died as a result of the accident.

The Walker County Sheriff’s Department was called to the location and upon arrival, they found that a crane had overturned on top of the operator of the machine. News organizations are still gathering information but a local coroner told ABC3340.com that when the crane started shifting, the operator jumped from it and then it landed on top of him.

LipsigLawyers.com’s Thomas Moverman sent his condolences to the family. He also expressed his hopes that this accident will help to increase awareness of the need to revise construction safety rules and regulations.

The Occupational Safety & Health Administration (OSHA) that the 3rd and 4th most common causes of deaths of construction workers in 2014 were being hit by or caught between an object or construction equipment. These causes are included in the “fatal four” top causes of death of construction workers which also includes slips, trips, and falls, as well as electrocution deaths.

Additionally, the Bureau of Labor Statistics (BLS) has released information stating that the total number of injuries at work that proved fatal were 5 percent higher in 2014 than in the previous year, 2013. The BLS also said that 15 percent of all fatal injuries in 2014 were from contact with objects and equipment.

Lipsig, Shapey, Manus & Moverman have long been representing victims of construction accidents. The firm is currently looking to assist those individuals who have been injured in a construction accident and qualifying individuals may be entitled to financial compensation. They have successfully obtained millions in settlements for victims and strongly believe in fighting for the compensation victims need and deserve. In one case, Attorney Thomas Moverman won a victim $2.6 million for a worker who injured his knee and back in a fall from defective scaffolding.

Personal Injury Lawyer Expresses Relief When Construction Worker Escapes Uninjured

July 20, 2016 – – LipsigLawyers.com’s Thomas Moverman recently expressed relief after news was released that a Concord construction worker escaped an accident uninjured. Moverman said that many workers are not so fortunate and that it is important to keep in mind the dangers that these workers face every day.

Wicked Local Concord reported on the incident in early July stating that a tire from the lift the man operated drove into a high-voltage, underground electricity vault. The man was able to jump to safety from a platform on the lift that was suspended 10 feet off the ground.

Though the most common forms of injury in the construction business include slips, trips and falls, accidents including electrocution and being stuck between objects or struck by them, accounted for over half of construction worker deaths in 2014, according to the Bureau of Labor Statistics. The OSHA reported that more than 20 percent of all work-related fatalities in 2013 were employed in the construction industry and that one in five of the 4,821 reported fatalities in 2014 were in the construction industry.

“My clients’ lives and families are the most important aspect of what I do. I hope the lawsuits that I bring and the results I obtain will allow them to try to restore themselves both physically and personally,” said Moverman of the firm’s efforts.

New Car Insurance Services Very Well Received

July 20, 2016 – – In January of this year, an insurance agency with offices in West Palm Beach and Lake Worth, FL, launched a new car insurance service to qualifying customers. Six months later, they are happy to announce that these services have been very well received, with many customers signing up. Most importantly, it means more people are now fully compliant with Florida car insurance regulations.

Pete Steiner from AC Insurance Services says: “The regulations for car insurance in Florida are very strict, requiring at least $10,000 in personal injury protection and property damage liability. In January, we launched a new service offering qualifying customers new rates, which are lower than those offered anywhere else in the state, all of which are fully compliant with the regulations.”

As part of car insurance, Florida policy holders have to have property damage liability to ensure that if the driver is at fault, he or she will have proper coverage for damages. Additionally, those who currently have financing for their vehicles need to have full coverage, including comprehensive insurance and collision coverage. This ensures that if the vehicle sustains damage in an accident, it is fully covered.

New Car Insurance Services

Since launching their new insurance rates, AC Insurance Services has received numerous requests for free quotations. In these, they provide prospective clients with the best rates possible, based on their specific situation and needs. Their goal is to ensure people receive the level of coverage that they want and need to have according to regulations, while also making sure that the rate is as low as possible.

“We work with both commercial and personal vehicle owners,” adds Steiner. “Insurance is something you cannot do without, and we are there to make sure that it is offered in an affordable way, so that it does not become a burden. We recommend anyone to contact us to review our policy types and options, so we can help them find the best policy for their needs.”

One of the things that the insurance agency has noticed is that, possibly due to their lower rates, people also take out additional coverage that is not required by law, but does provide additional protection, such as bodily injury liability.

Zofran Lawsuit News: Status of Federal Birth Defects Cases to Be Discussed During July Status Conference, Bernstein Liebhard LLP Reports

July 20, 2016 – The federal court overseeing hundreds of Zofran birth defects lawsuits (http://www.rxinjuryhelp.com/zofran/birth-defects/) is scheduled to convene its July Status Conference today at 1:30 p.m., at which time the progress of the litigation will be discussed. According to a Joint Agenda submitted to the U.S. District Court, District of Massachusetts, on June 18th, the Court will also hear arguments on GlaxoSmithKline’s motions for sequenced discovery and a protective order concerning certain plaintiffs’ deposition notices. (In Re Zofran Products Liability Litigation – MDL 2657)

“Our Firm is representing clients who have alleged that the use of Zofran during pregnancy caused their child to develop serious heart defects and other congenital abnormalities. We are looking forward to today’s conference, as the matters addressed during the proceeding may prove relevant to our clients’ claims,” says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to offer free Zofran lawsuit reviews to families whose children may have been harmed by this medication.

Zofran and Birth Defects
Court documents indicate that at least 270 Zofran lawsuits have been filed in the District of Massachusetts. Plaintiffs allege that GlaxoSmithKline concealed evidence linking Zofran to birth defects, and failed to provide doctors and patients with adequate warnings about this risk. They further claim that the company aggressively promoted the use of Zofran as a treatment for pregnancy-related nausea and vomiting, even though the medication has never been approved by the U.S. Food & Drug Administration (FDA) for this purpose.

The FDA has categorized Zofran as a Pregnancy Category C medication, which indicates that its effects on a developing pregnancy have not been well studied. The medication is currently only approved to treat nausea and vomiting experienced by post-op surgery patients or those undergoing certain cancer therapies. In spite of this, a recent analysis published in the American Journal of Obstetrics and Gynecology reported that around 1 million expectant mothers annually are prescribed Zofran or a generic equivalent to treat pregnancy-related nausea and vomiting.

Among other things, Zofran lawsuits claim that GlaxoSmithKline was aware of animal studies conducted as early as the 1980s that suggested the drug’s active ingredient could cross the placental barrier in pregnant mammals. In 2006, a study involving 41 pregnancies confirmed the placental transfer of Zofran in humans. The complaints also point out that in 2012, Glaxo entered into a $3 billion drug marketing settlement with the U.S. Department of Justice that, among other things, resolved claims that the company had illegally promoted Zofran for the off-label treatment of morning sickness.

Children who allegedly suffered serious birth defects due to their mothers’ use of Zofran during the first trimester of pregnancy may be entitled to compensation from GlaxoSmithKline. To discuss filing a Zofran lawsuit with a member of our legal team, please visit Bernstein Liebhard LLP’s website, or call the Firm directly at 800-511-5092.
