E-Cig Explosion Lawsuit Filed After Severe Injuries Sustained, As Other Potential E-Cigarette Lawsuit Cases Arise

July 18, 2016 – – LipsigLawyers.com reports on an e-cigarette explosion that occurred in Albany, NY on May 19th. A WTVR.com news story stated that the victim suffered severe burns, lost several of his teeth, and sustained a punctured hole in his tongue when his e-cig allegedly exploded. WTVR.com also reported that the victim muffled speech and could not speak well as a result of the incident. A subsequent report by the local NBC affiliate station, WNYT.com, stated that the victim filed a lawsuit on June 22nd. The victim’s legal representation is surmising that the lithium-ion battery was to blame for the explosion.

In addition to this particular case, the sixth e-cig-related explosion since 2009, there have been other lawsuits filed in New York State recently. The first e-cigarette case was filed not long after a young man from Brooklyn sustained severe burns and lost eyesight in his left eye as a result of an explosion on April 5th. The 14-year-old boy was holding an e-cig at the Kings Plaza Mall at a kiosk which an employee plugged in when the device allegedly exploded in his hand. The Federal Emergency Management Agency (FEMA) has stated that the most likely culprit in the explosions is the faulty lithium-ion batteries. FEMA maintains this position due to the unstable lithium-ion battery core, which is subject to a very strong overload of energy. When such an overload occurs, because of the instability of the battery, this can cause an explosion along with a possibility of flames which have occurred in many instances.

Recent Risperdal Lawsuit Or Settlement Case: $70M Awarded

July 18, 2016 – – A recent lawsuit has ended with a $70 million loss for Janssen Pharmaceuticals. The pharmaceutical company is the producer of Risperdal, a drug that has been approved since 1993 to treat schizophrenia in adults.

It was reported that the said amount “has been awarded against Janssen Pharmaceuticals ending a Risperdal lawsuit brought by plaintiff Andrew Yount.” The plaintiff alleged that he experienced excessive breast growth while he was taking the antipsychotic drug. Yount, who was born in 1998, began taking the drug in 2003 to treat a severe psychiatric issue, and states that one year later in 2004, he began experiencing growth in his breast area.

“It’s not an uncommon complaint,” says a spokesperson for the organization with website at www.risperdal-settlement.com, which focuses on this drug and its complications and lawsuits.

This particular trial focused on the pharmaceutical company, which is a subsidiary of Johnson & Johnson, and stated that the company withheld vital information that shows a substantial link between Risperdal and excessive breast growth. Attorneys used as evidence labels from the drug as well as internal documents from the pharmaceutical company and argued that purposeful steps were taken to shield the community from this information. They pointed out that Janssen failed to acknowledge and reveal all of the risks associated with the drug.

As a result, the jury found that the pharmaceutical company intentionally falsified or destroyed records that would alert the community of this risk and awarded $70 million in compensatory damages to the plaintiff. This is the fifth case against Janssen to go to trial, and the largest award amount to date.

Risperdal is an atypical antipsychotic drug that changes how certain natural substances in the brain react. The FDA initially approved the drug in the 1990’s for use in adults, and as of September 2012, there have been more than 400 lawsuits against the drug for various side effects. Side effects include male breast growth as well as high blood sugar, stroke, heart attack, tardive dyskinesia, and in some cases, death.

30-Foot Fall Kills Florida Construction Worker, Prompting Comment From Personal Injury Lawyer

ABC7 reported the news early last month stating that the man had been working at Beach Walk condominium complex when fire departments received the call. The man fell from scaffolding onto the concrete pavement and suffered severe head trauma. He was in critical condition at a nearby hospital and had to undergo emergency surgery. He died on July 7.

The Occupational Safety and Health Administration has set forth criteria for scaffolding with which companies are expected to comply. The standards address various aspects of the scaffolding including strength criteria, the width of walkways, guardrails and spacing between platform units.

Scaffolding accidents are among the top most common accidents on construction sites.The Bureau of Labor Statistics reported that in 72 percent of workers that were injured in scaffolding accidents, the accident was caused either by the planking or support giving way, the employee slipping, or being struck by a falling object. These instances can result in multiple injuries including broken bones, impalement, amputations, spinal cord injuries and brain injuries but have also resulted in death.

IVC Filter Lawsuit Filings Increase, As Researchers Investigate Potentially Life-Threatening Side Effects

Deep vein thrombosis (DVT) is a condition that occurs when a blood clot forms within a deep vein, leading to an increased risk of pulmonary embolism, and post- thrombotic syndrome. Some of the most common symptoms of DVT are increased swelling, tenderness, discoloration of the skin, along with pain and fatigue.

IVC filters are meant to prevent inferior vena cava thrombosis, which is the formation of a clot in the IVC, the largest vein in the body, that in turn limits deoxygenated blood from reaching vital organs such as the heart and lungs. In recent years hundreds of patients have filed lawsuits against IVC filter manufacturers, in most cases naming C.R. Bard and Cook Medical as defendants. Plaintiffs generally claim that the two companies were negligent in releasing the devices which they claim were aware of the defective design of the devices yet marketed them anyway. Additionally, plaintiffs allege that the manufacturers failed to warn users of the potential risks associated with the devices and marketed them as safe to future potential users.

Moreover, 2 Multidistrict Litigations (MDL) have been consolidated against device manufacturers Cook Medical and C.R. Bard, one in the Southern District of Indiana (No. 2570), and another at the U.S. District Court of Arizona (No. 2641). Both MDLs are in the process of developing bellwether cases, in an attempt to expedite the process of justice.

New Treatment Can Alleviate Pediatric Cervicogenic Headaches

July 18, 2016 – – A new study to alleviate cervicogenic headaches has shown that there are alternative methods to medication. Cervicogenic headaches in children have been historically treated with botox and other medication. This study, however, shows that a new treatment method has potential to be safer and more effective.
