It has been revealed that the parties involved in the multi-district litigation have now agreed on a Protective Order, which has has been submitted to the court and entered on March 1, 2017. Additionally, the plaintiffs and their legal representations have held regular conferences, which are ongoing, about alternative options to the Plaintiff Fact Sheet, Preservation Order, and ESI protocol.

A representative from talcum powder cancer lawsuits website TalcumPowder.org has stated: “Many women now believe that the feminine hygiene products, based on talcum powder, that they used for many years have contributed to the development of ovarian cancer. We are very happy to be able to tell them, or their surviving families, that we are making great strides in the litigation. We will stay on top of any future developments as well, so that we can continue to best help the people.”

In a recent filing, J&J reported to the U.S. Securities & Exchange Commission (SEC) to indicate that it is facing at least 3,100 product liability suits, each of which are based on the alleged link between talc powder and ovarian cancer. These run in various multi-district cases, and 134 of them are in the District of New Jersey.

The claim of the plaintiffs against J&J state was that they regularly applied the talc based powders to their genital area and this resulted in their having ovarian cancer. They also claim that J&J was aware of research findings in the 1970s that demonstrated this link, and that the pharmaceutical company ignored this and did not warn customers because they wanted to protect their sales revenues.

The 22nd Circuit Court in Missouri’s St. Louis is seeing one of the largest cases of all. They have currently trialed in four different cases, where one jury decided in favor of J&J. However, in three other cases, plaintiffs were awarded $72 million, $70 million, and $55 million. J&J is trying to have the various cases spread out across the country.
