Talc Cancer Lawsuits Continue To Pile Up Against Pharmaceutical Company

March 15, 2017 – – Numerous people from more than 10 states in the nation have recently filed lawsuits against pharmaceutical giant Johnson & Johnson. The lawsuits stem from damages allegedly incurred after using the talcum powder manufactured by the company.

The lawsuits allege that baby powder, as well as the popular Shower To Shower, manufactured by Johnson & Johnson for decades and marketed toward women as safe and hygienic, have actually caused cancer in numerous women.

A spokesperson for a consumer website, www.talcumpowder.org, says, “The lawsuits allege that Johnson & Johnson knew that their products were harmful and they manufactured, marketed, and sold them anyway.”

The number one ingredient in both products is talcum powder, which is known as a human carcinogen when it is ingested. The American Cancer Society has stated that it is not yet sure whether asbestos free talcum powder will cause cancer, but the International Agency for Research on Cancer states that any talc based powders are possibly carcinogenic.

Johnson & Johnson was sued in 2016, receiving jury verdicts for millions of dollars for just three such cases that began in St. Louis, Missouri. Since then, numerous additional lawsuits have been filed. Plaintiffs in the lawsuits state that the pharmaceutical company promoted these products as symbols of freshness and marketed them to women despite knowing that they were harmful.

“The lawsuits are alleging that Johnson & Johnson knew that there was an increased risk of ovarian cancer for women who used these products but they never took them off the shelves,” states the spokesperson for www.talcumpowder.org.

The lawsuits state that the pharmaceutical company knew the risks due to more than 50 years of studies on the association between talc and cancer. Reports show that the Cancer Prevention Coalition informed Johnson & Johnson as early as 1994 that studies dated back to the early 1960s showed a serious health risk when using those products.

NYC Aviation Accident Lawyer Asks: Does LaGuardia Have An Ugly History?

Since 1939, LaGuardia Airport—which was known as the New York Municipal Airport when it first opened—has served as one of the busiest airports in the world. Along with JFK International and Newark Liberty International, it is part of the biggest airport system in the U.S. and the second-largest in the world with respect to passenger traffic.

However, LaGuardia has seen its fair share of accidents and near-misses. Most recently, a plane skidded off the runway in late October 2016. The incident perhaps drew more attention than it might have ordinarily, as the flight happened to include Vice President-elect Mike Pence. Shortly after the incident, several news outlets referenced LaGuardia’s unfortunate history of “ugly” accidents.

LaGuardia’s History of Crashes and Near-Misses

Fortunately, no one was hurt in the October incident, however, the plane tore up the concrete runway as it skidded into a patch of grass. The Federal Aviation Administration (FAA) credited an “Engineered Material Arresting System” as helping the plane to stop, preventing serious injuries. The system in question allows the concrete to deliberately crush apart when a plane begins skidding.

A similar skidding accident occurred just last year, when a Delta flight slid off the runway on an icy day in March. In that case, about two dozen passengers were hurt.

In 2013, a plane’s landing gear collapsed during landing, causing the plane to veer onto the grass, injuring 16 people on board.

Perhaps most notably, the “Miracle on the Hudson” landing in 2009 occurred after the U.S. Airways flight took off from LaGuardia, striking geese that disabled both engines just minutes after lift-off.

Tragically, LaGuardia has also seen several fatal aviation accidents. In 1992, problems with de-icing caused a plane to crash into Flushing Bay just after take-off. The crash resulted in 27 fatalities.

In 1989, another accident during lift-off killed two passengers and caused 15 injuries after the plane ran off the end of the runway and crashed into Bowery Bay.

Short Runways at LaGuardia

Live in New York City long enough—or fly in and out of the city a few times—and you are likely to hear about LaGuardia’s infamously “short runways.” At 7,001 feet and 7,003 feet, LaGuardia’s runways are shorter than most runways at other major U.S. airports. According to a Wall Street Journal report, many aviation experts recommend runways be at least 6,000 feet long for “small commercial aircraft” and 10,000 feet for “nearly any commercial aircraft.”

Although LaGuardia’s runways are well within the suggested length for “small commercial aircraft,” they fall far short of the runways at JFK and Newark, which are 14,000 feet and 11,000 feet, respectively.

Why Are Teen Drivers So Dangerous?

Driver error continues to be one of the largest contributing factors in car accidents, and no group of motorists is more prone to exhibit this type of behavior than teen drivers.

“Unfortunately, teen drivers continue to be one of the biggest risk factors for car wrecks in the U.S.,” stated Dallas personal injury attorney Amy Witherite of Eberstein Witherite. “There are multiple reasons for this, but the biggest in my opinion is the lack of experience in different driving situations. Driving for many years gives you the opportunity to understand how other drivers will react in different circumstances, which helps you take preventative measures to avoid collisions. Young drivers lack that experience, so they tend to make the wrong choices when they are in an extreme situation. And they are also far more prone to exhibit characteristics of driver inattention such as texting while driving, which greatly increases the chances of a wreck.”

The Facts On Teen Drivers

According to the most recent statistics provided by the Centers for Disease Control and Prevention (CDC) website, more than 2,000 teen drivers ages 16 to 20 were involved in fatal collisions in 2014, and more than 200,000 teens suffered injuries in a car wreck.

To put it into perspective, teens between the ages of 15 to 19 are only seven percent of the total U.S. population, but in 2013, they were responsible for 11 percent ($10 billion) of the total costs of all car wrecks.

And even within this demographic, male teen drivers are far more likely to be involved in fatal car wrecks than female drivers.

More troubling, teen drivers who have at least one other passenger in their vehicle are more likely to have a car accident than teens who are driving alone, and the risk increases with each additional teen in the vehicle.

As Witherite mentioned, one of the biggest reasons for these statistics is that teen drivers are often newly licensed, and they lack the built-in reaction time to respond to incidences on the road that an experienced driver would possess.

The Distraction Dilemma

Driver distraction is one of the leading causes of car accidents, and it plays a huge role in the rate of teen driver accidents in the U.S.

To be clear, teenagers are not the only group of drivers who exhibit this behavior, but they are more likely to engage in the behavior, and when that is coupled with their lack of experience on the road, it can become a fatal combination.

That’s the lesson that David Teater learned 10 years ago, when his 12-year-old son was killed in a car wreck caused by a 20-year-old woman who was distracted by a cell phone conversation, and ran a red light.

Teater, who is Senior Director of the National Safety Council said in an interview for a CNN.com article on distracted driving that teens find it very difficult not to engage in activities such as texting while they are driving.

“Even a well-meaning teen is going to have trouble saying no when they get that buzz,” Teater said, referring to an incoming text or social media update. “It’s almost a Pavlovian response.”

Some studies have found that using a mobile phone while driving can slow reaction time more than having a .08 blood alcohol level.

The reason is that while most people believe that the brain can “multitask,” the truth is, the brain shuffles between two tasks, which means that it splits focus and concentration. Even a split-second loss in reaction time on the road can mean the difference between life and death.

What Parents Can Do

While parents often feel overwhelmed by the problems posed by their teens driving, there are some steps parents can take to help lower the chances of an accident.

Per a New York Times article on teenage drivers, Jennifer Ryan, Director of State Relations at the American Automobile Association (AAA), suggests that parents not allow their teens to drive from 9 p.m. to 5 a.m., during the first six months of obtaining their license.

In addition, Nichole Morris of the HumanFIRST Laboratory at the University of Minnesota – which is dedicated to lowering the rate of car crashes – said:

“Our studies show that the more the parent is involved when a teen is learning, the lower their chances are for a crash,” Morris said.

Parents can also purchase apps that disable the texting function on their teenagers’ mobile phones, and closely monitor their children’s driving behavior, especially during the first two years of them obtaining a license.

At 7:00 A.M. on March 4th Jeffrey R. Davis joined Alexandria’s Angels in the Bike MS: Breakaway to Key Largo ride for Multiple Sclerosis. This MS Ride, which begins at the FIU Campus in Miami, follows a route that takes approximately 1,500 cyclists through the Redlands and Homestead, culminating at Key Largo resorts. Team Captain Alexandria Mastriana-Solal and her team raised over $200,000 for the National Multiple Sclerosis Society. The event was incredible!

Three distinct routes were carefully prearranged with police officers halting traffic at every major intersection and crossing. Thousands and thousands of people not only participated in the ride but lined the streets to cheer on the riders. The logistical support, organization and volunteer efforts were phenomenal. Alexandria’s Angels were given the first pull position after a series of inspirational speakers with MS, an appearance by the FIU ROTC and a rousing singing of the National Anthem.

Eventually, after peddling more than 50 miles against 20 MPH headwinds, Alexandria’s Angels assembled for a celebratory lunch at the world-famous Alabama Jack’s on Card Sound Road and a good time for a great cause was had by all.

Reliable water sources are essential for all types of agricultural activities. While commercial farmers typically use large irrigation systems to water their crops, home gardeners or those who cultivate small surfaces have to rely on alternative systems.

Productive Gardens launched an automatic irrigation system based on interconnected ollas. An olla is a porous clay pot that is inserted into the ground, providing water directly to the root area of the plant.

Ollas have long been used to water different crops. However, like most traditional irrigation systems, the water supply was provided manually, which gave them a relatively limited autonomy. The new automatic water supply system developed by Productive Gardens extends the autonomy of an olla system.

The new system, called EasiOyYa, is based on a system of porous clay pots connected by tubing to a central tank or water barrel. The size of the tank can be chosen by each garden owner depending on how much autonomy they want.

The EasiOyYa system works by allowing the plants themselves to control how much water they need. The porous clay capsules will release water as the surrounding garden bed loses moisture. Through capillary suction, the plants alter the moisture level, thus helping to regulate the water flow from the clay pots.

Each EasiOyYa kit comes with eight clay pots and the necessary tubing and fitting system required to connect the pots to the desired water source. An EasiOyYa kit provides sufficient irrigation for over one square meter of garden bed, making it ideal for balcony gardens, pot plants, raised vegetable gardens, patio gardens and many others.
