Prepare Now Before a Storm Strikes: Hurricane Preparedness Tips from Florida Peninsula Insurance Company

BOCA RATON, FL / ACCESSWIRE / May 30, 2018 / While hurricane season is still approaching, now is the time to prepare for what could be another difficult storm season. Follow these tips by Clint B. Strauch, President of Florida Peninsula Insurance Company, and you’ll be less worried when high winds and rain start to whip up outside your doors:

Make sure you have flood insurance through either an endorsement from your insurance company or the National Flood Insurance Program (NFIP). Many insurance companies now offer flood endorsements making it easier and, in many cases, less expensive to add this much-needed coverage.
Review your insurance policy with your agent to ensure it is up to date. Make sure coverage amounts are adequate and that all structures are insured.
Invest in hurricane shutters or hurricane impact glass. During a hurricane, winds can reach 111-156 mph. Debris in the road and yard can go flying through windows and into your home if they aren’t protected.
If you get accordion hurricane shutters, make sure you put the key to unlock them somewhere safe and, if possible, keep a copy somewhere accessible.
If your budget or home design doesn’t allow for major improvements, purchase plywood in advance, before other homeowners make a pre-hurricane run on the local home improvement store. It can be used to cover your windows and add protection to your home.
Buying a dual fuel generator gives you the ability to have power when gasoline may become scarce. In addition, propane tanks can be stored for longer periods of time than gasoline. It’s a great way to ensure you have some form of electricity during and after the storm.
Determine your electrical necessities prior to a storm and get the size generator that meets those needs. Bigger generators power more items but use more fuel that may be scarce. Before the storm arrives, you must have enough fresh fuel to run the generator. Check the machine by running it monthly to make sure it’s operating properly.
Make an emergency kit for your family and keep it in a place where it’s easily accessible. Include a first aid kit, battery-powered radio, flashlight and batteries, whistle, local maps, water, and cash. Include a copy of your homeowner’s insurance policy and laminate it to avoid water damage. You can also include extra items to keep your families comfortable such as your favorite snacks, or a battery-powered TV.
Keep a supply of food that does not need to be refrigerated. Canned goods – Don’t forget the can opener! – are good provided the expiration date is in the future.
Consider purchasing large tarps in advance that can cover roof leaks and store them in your garage for after the storm, as an extra precaution.
If your policy does not already include ordinance and law coverage, discuss adding this important coverage with your agent. This coverage ensures you have additional repair coverage if your local building permit officials require the undamaged property to be updated along with your storm damages to bring that part of the building up to current building codes.
Take steps to learn your community’s hurricane evacuation routes and how to find higher ground. Determine where you would go if you needed to evacuate and how you would get there. Note: Before you leave your home, make sure you have all your important papers and your home is secure.
Review details on how to file a claim so that, when the storm clears, you know what to do and what’s likely to happen if you experience damage.
In the event you have a claim, contact your insurance agent and the claims department of your insurance company as soon as possible. Most insurance companies provide a list of preferred contractors, especially remediation and restoration companies that specialize in flood and fire cleanup. You will want to begin the process early, so you can document the damage for your insurance company and be prepared for its adjuster to assess the damage.
Make sure you have a fully charged smartphone, disposable camera or a camera with fresh batteries so you can document the damage. Hint: Take pictures now to show the home’s condition before the storm arrives. Once a hurricane does hit and there is damage, you can better document the damage by sending before-and-after photos to your agent and the insurance company.

American Resources Corporation Begins Production at Razorblade Surface Mine

Quest Energy is initially extracting coal from the Hazard 4 and Hazard 4 Rider coal seams, with additional future plans for mining the Amburgy, Whitesburg, Hazard 5, Taylor, and the Hamlin 5, 6, and 7 seams utilizing a contour, auger, and highwall mining plan. Quest Energy anticipates several years’ worth of coal production from the Razorblade Surface mine.

Once fully ramped, American Resources expects Razorblade to contribute as much as 26,000 clean tons of high-grade PCI and thermal coal per month and enable them to expand coal sales to meet customers’ demands since restarting their Access Energy mine at Deane Mining this past September. Razorblade is the first in a series of surface mines to be put into production organically, along with its recent acquisitions of the Wayland Surface mine and PointRock mine, throughout American Resources’ footprint within Floyd, Knott, Letcher, and Pike counties in Kentucky.

Rhode Island Judge Allows Mesothelioma Lawsuit to Proceed Against Crane Co.

A Rhode Island Superior Court Judge rejected an asbestos manufacturer’s attempt to dismiss a lawsuit brought by the family of a mesothelioma victim who was exposed to asbestos by contact.

59-Year-Old Woman Died Following Secondary Exposure to Asbestos 28 Years Earlier

Since 1972, the United States Government has warned manufacturers about their duty to minimize secondary exposure to asbestos-containing materials. Such exposure often occurs when asbestos fibers are transmitted via an exposed employee’s clothing to other members of their household. For this reason, Occupational Safety and Health Administration (“OSHA”) regulations require employers to take appropriate precautions — including, but not limited to, providing exposed employees with special clothing — to minimize the potential for secondary exposure.

Companies who refused to take such precautions may be legally liable for third parties who later develop mesothelioma, a deadly cancer that develops in the lungs and chest following to the inhalation of asbestos fibers. Because mesothelioma has an especially long latency period – more than 40 years in some cases — victims may be entitled to seek relief even decades after the initial exposure.

For example, on April 16, 2018, a Rhode Island Superior Court judge denied a motion to dismiss a mesothelioma-related lawsuit arising from alleged secondary exposure to asbestos that occurred in 1979 and 1980. The plaintiffs are family members of Iva Pearl Jones, a 59-year-old woman who died from mesothelioma in 2007, two years after she was first diagnosed. Back in 1979, Ms. Jones lived with her brother-in-law, Stanley Nichols, who worked for Crane Co., a well-known manufacturer of asbestos-containing products.

According to the lawsuit, Nichols v. Allis Chambers Product Liability Trust, Ms. Jones regularly laundered Mr. Nichols’ work clothing. At the time, Crane did not issue uniforms to employees who worked with asbestos, despite the fact OSHA regulations had placed employers on notice of the risk of secondary asbestos exposure as far back as 1972, seven years before Mr. Nichols began working for the company.

In denying Crane’s motion for summary judgment, Rhode Island Superior Court Associate Justice Sarah Taft-Carter noted that the state’s courts had not previously “addressed the question of [a manufacturer’s] duty in a secondary exposure case.” Without reaching the merits of the lawsuit, Judge Taft-Carter said the evidence presented by the plaintiffs was sufficient for a jury to conclude that Crane “knew or should have known that asbestos could be transmitted on an employee’s clothing and that asbestos fibers and dust presented a health hazard, yet operated its facility in a way that did not prevent foreseeable harm.” Given this, a jury could also find that Crane owed a duty to third parties like Ms. Jones and was therefore responsible for her death.

Boston mesothelioma and toxic torts attorney Andrew Wainwright congratulates the Rhode Island plaintiff’s firm who argued the case. According to Wainwright, the judge’s ruling was a victory for common sense and welcome news for other victims of secondary asbestos exposure. “The relationship between asbestos exposure and the development of mesothelioma is long settled. As the judge in this case explained, in the early 1970s OSHA told employers who handle asbestos they had a responsibility to protect the public from secondary exposure. Because injuries to family members was foreseeable to these employers, they can be held liable for the harm they caused many years later.”
