When asked to comment, Elliott made the point that workers are often hesitant to file workers’ comp claims when injured because they are afraid they might lose their job.

When asked about this, he responded, “There’s protection for injured workers in Colorado that says you can’t be retaliated against by your employer for having sought benefits or workers comp or having been injured on the job.”

However, Elliott alluded to the fact that it doesn’t mean that there aren’t problems while filing for compensation after being injured on the job.

“Sometimes insurance companies contest claims to determine whether or not the injury that happened was caused by work or was a preexisting condition. This is why a lot of times, there will be contested claims early on to seek all the medical records of the person in question in the last five or ten years,” he said.

Elliott also mentioned that insurance companies have a first-party obligation to be reasonable in workers’ comp cases.

“It’s not a situation where they are inherently adverse in a third-party situation. If we find in the employment file or the claims note no basis for denial, we use that first-party obligation to remind them to be reasonable and to do the right thing,” he said.

Toward the end of the podcast, when asked what advice he would give if someone is facing a workers comp situation, Elliott gave the following pointers:

“If you haven’t filled out a form in writing notifying your employer of the injury, under Colorado law, you need to fill something out within four days of the injury happening. There might be penalties against you if you don’t.”

The other thing that Elliott touched on was that once someone has given notice to the employer that they were hurt at work and need some medical treatment – the employer needs to supply them with a list of doctors they can go and see. The challenge with this list is that the doctors are appointed by the insurance company.

But Elliott was keen to point out that If the employer doesn’t provide those options within a week of being notified of the injury, “then the employee can select their own doctor, which could help you in getting the proper care and also improve your claim by highlighting injuries that may not have been documented by other doctors.”
