Attorney Toni Jaramilla Discusses 2020 Legislation Improving Workplace Protections

LOS ANGELES, CA / ACCESSWIRE / February 17, 2020 / California civil and workers' rights attorney Toni Jaramilla, of A Professional Law Corporation, recently published an article about #MeToo-inspired legislation for the Los Angeles Daily Journal, published on October 17, 2019. They were signed into law in 2018 by then California Governor Jerry Brown. Governor Gavin Newsom signed additional laws in 2019, effective 2020.

In her Daily Journal article, Jaramilla writes that the legislation has significantly improved workplace protections for California workers. "In particular, the #MeToo Movement has inspired legislation that seeks to remedy the societal culture of silencing and punishing targets of sexual harassment and assualt who have the temerity to seek justice for the harms caused to them," said Jaramilla, who was also featured in the December, 2019, issue of Angeleno magazine.

It was a blockbuster year, but just some of the legislation that came into effect in 2019 and 2020 are:

AB 9 which extends the deadline to file a complaint of discrimination and harassment from 1 year to 3 years with the Department of Fair Employment and Housing. This bill was vetoed by Brown but signed into law by Newsom in 2019, giving targets of sexual harassment and discrimination more time to take legal action.

Under SB 188, the CROWN Act, California is the first state to ban discrimination based on natural hairstyles. "Race" under the Fair Employment and Housing Act now includes traits historically associated with race, including hair texture and protective hairstyles such as locks, braids, and twists.

Senate Bill 820, which created Code of Civil Procedure §1001, bans Non-Disclosure Agreements (NDA's) or "gag" provisions in settlement agreements entered into after January 1, 2019, involving claims of sexual harassment, gender discrimination, or retaliation. Assembly Bill 749 bans "No Rehire" clauses in settlement agreements that restrict employment opportunities for women and workers who bring claims of discrimination, harassment, or other employment disputes. Stated Governor Newsom, "Work is about more than earning an income. For many, a job can provide a sense of purpose and belonging – the satisfaction of knowing your labor provides value to the world. Everyone should have the ability to feel that pride in what they do, but for too many workers, they aren't provided the dignity, respect or safety they deserve. These laws will help change that."

Dr. Wu Xiaoyan was originally on a trip back to her hometown for the Spring Festival. But, hearing about the outbreak, she got off midway to return to Wuhan. "I am unmarried and under no burden of looking after a child. Everyone is now fighting. I can celebrate the festival feeling at ease only on the battlefield," she said. These young medical staff always stand at the forefront. In the workgroup of the People's Hospital of Wuhan University, a young doctor sent a message to her superior: "Give me a call if any need arises. I can work overtime. But don't tell my Mom about it to avoid making her worried."

Caring for female medical staff: Feminists making heart-warming remarks

This time, females account for 50% of the doctors and 90% of the nurses resisting the epidemic at the forefront. Every day, they provide the patients with injection, infusion, sputum aspiration, airway care and life care. These highly dangerous operations increased their risks of infection. While their bravery and dedication are encouraging Chinese females in social media, their physical health has received more attention. Twitter blogger Liang Yu teamed up with Wuxi Lingshan Charity Foundation in launching the campaign of "Sisters in worriless fight against the outbreak", in which they donated 183040 comfort pants, 7800 pads, 3156 pairs of disposable knickers for females and 700 hand creams to 26 hospitals in Hubei.

The campaign attracted the attention and response of many females. "This is not a special need. Instead, it is the normal basic need of 50% of the population, " someone commented.

The voices demanding care for the physiological needs of females are also valued by the Chinese government. As a national-level public welfare organization that focuses on serving females, the China Women's Development Foundation also collected 2.25 million yuan worth of funds and goods urgently in a short period of time for targeted assistance to the female medical staff at the forefront, including 200,000 yuan earmarked for purchasing comfort pants, 1 million yuan worth of pads in 2020 cases, 20,000 comfort pants and 1 million yuan worth of long underwear.

This epidemic has quietly changed the ideas of the Chinese people for the medical workers. Before the reform of the medical system, the trust was not high between Chinese patients and medical workers. Furthermore, the absence of death education caused people to always hold excessive expectations for modern treatment and have difficulty in calmly accepting the results of hospital diagnosis and treatment, even leading to conflict with doctors.

These days, however, common Chinese people are praising the medical staff on the Internet.

On January 28, Guo Wei, a member of the medical team from the Military Medical University of Air Force took off the protective suit that she had worn for a day to reveal her swollen face and the deep traces left by the goggles, which was really heartbreaking. In an interview after he became an online celebrity, he said: "I will accept no more interview in future and need no donations from net friends. I didn't think of these questions when making the donation. The government offered to pay for the masks, but I refused. Hope I won't be disturbed."

On Twitter, netizens started the topic of "Backing for medical workers". On the romantic day of Valentine's Day that falls on February 14, many net friends wrote love letters to medical workers. "Thank you for jacking up life with your own life. Thank you for the protection you provide against the wind. Flowers will bloom more brilliantly thanks to you."

GUILDFORD, ENGLAND / ACCESSWIRE / February 17, 2020 / ANGLE plc (AIM:AGL) (OTCQX:ANPCY), a world-leading liquid biopsy company, is pleased to announce that University Medical Centre Hamburg-Eppendorf has published results of work undertaken to assess the analytical and clinical performance of Parsortix in multiple metastatic cancer types with the main emphasis on metastatic breast cancer.

The work was completed as part of the pan-European CANCER-ID consortium funded by the European Innovative Medicine Initiative (IMI), which aims to standardise protocols and validate innovative circulating tumour cell (CTC) detection approaches for future clinical trials.

The results demonstrated the capability of the Parsortix system to work with multiple different cancer types, using multiple blood preservative tube types, and importantly capturing the full range of CTCs, not just epithelial CTCs.

The researchers demonstrated that the CTCs harvested by the Parsortix system were suitable for "robust amplification of single cell DNA at excellent quality for subsequent molecular analysis". Even in metastatic NSCLC (non small cell lung cancer) and gastrointestinal cancer, which are known to be problematic for CTC enrichment, the Parsortix workflow harvested CTCs in 46% of patients notwithstanding treatment and disease condition. The researchers stated in the publication that they had established optimised enrichment protocols, utilising Parsortix, which ensured robust performance.

The Economic Cost of Quarantine

As efforts to contain the COVID-19 epidemic continue, it is important to give consideration to the implications of the response for the economy and life expectancy.

Countries with higher per capita incomes have longer life expectancies, due to their ability and willingness to invest in healthcare, infrastructure, and environmental governance. A 100% increase in per capita income equates to an increase in life expectancy of 1-3 years. A 50% decrease in GDP would therefore see a 1.5 year decrease in life expectancy, meaning for each 1% reduction in in GDP, life expectancy will decrease by approximately 10 days.
In economics, “value of life” refers to the amount that a society is willing to spend in order to increase average life expectancy. Whether in terms of work, business, or social management, a balance must be struck between reducing the risk of fatality and the cost of doing so.
Some jobs inherently entail higher than others, such as mining and construction. Instead of eliminating these jobs and letting society bear the cost of underdevelopment, a more rational approach would see the introduction of stronger labor protections for dangerous jobs, rewarded with higher salaries.
In designing a new road, governments can reduce the number of fatalities through the implementation of safety provisions, but if the cost is excessive, it is likely that the road will not be built, resulting in a lack of transportation infrastructure. Thus, a balance must be found between risk and cost.
Generally speaking, the value of life in developed nations is between 10-100 times the GDP per capita. Assuming that the value of life is calculated at 30 times the GDP per capita, the average life expectancy would be around 80 years, or approximately 30,000 days.
In the absence of large-scale compulsory quarantine measures, the infection rate for previous outbreaks of influenza does not exceed 10% of the population, and the fatality rate will be around 0.2%. Thus, the total number of fatalities relative to the entire population will be 2 in 10,000 (0.02%). Assuming that the life expectancy of those who die of influenza is around 60 years, and the average life expectancy is 80 years, each person who has died of influenza will have died prematurely by 20 years. On the basis of the fatality rate of 0.02%, the per capita reduction in life expectancy will be 20 multiplied by 0.02, or about 1.5 days.
If every person infected with influenza (10% of the population) and family members who have been in close contact with them (assuming 20% of the population) are quarantined for 14 days, the loss to GDP will be 30% * 14/365 = 1% of GDP. As mentioned above, a 1% GDP regression will cause a retrogression across society in medical care, infrastructure and environmental governance, amounting to a reduction in the average life expectancy of about 10 days.
A less optimistic estimation of the losses incurred could be 10% of GDP, leading to a reduction of the average life expectancy by 100 days, possibly amounting to a loss of life hundreds of times the impact of influenza itself.
As society strives to beat this epidemic “at all costs”, the above analysis can help society to keep various “costs” to a minimum. In responding to diseases that threaten lives, we must also give consideration to social and medical resources, and strike a balance that is conducive to protecting lives. Regularity and security in everyday life and work is an important and fundamental part of life for every person, and we should strive to minimize the impact to this.
