When asked for a comment, she said, “What everyone wants to know is how they can pay their medical bills, because treatment gets very expensive very quickly. Even if you have good health insurance, you still pay the copay and out-of-pocket expenses, so you’re still spending thousands and thousands of dollars before you see any money.”

In personal injury cases, even though the at-fault person is liable for the injured’s medical bills, they do not have to pay them as they come in, according to Long.

“They don’t pay until your case is wrapped up and ready to go, but that doesn’t happen until treatment is finished and you’re better – until you’re 100% back to how you were, or you’ve reached the maximum medical improvement,” she said.

One way to get medical bills paid while a case is progressing is through personal health insurance.

When asked to elaborate, she said, “If you have health insurance, they will pay for your accident related medical treatment subject to your copay and out-of-pocket costs like deductibles, as well as any policy limitations or exclusions. So, for example, if they say that you can only have 12 chiropractic visits in a year, that’s all they’ll pay for – even if you need more. So you’re limited to whatever your policy allows.”

Long recommends knowing the ins-and-outs of a policy to avoid paying high copays for out-of-network specialists, which can be significantly more expensive.

The second way to promptly pay for medical expenses during a personal injury case is through personal injury protection, or PIP.

“If your personal injury case is due to an auto, pedestrian, or cycling accident, you may have purchased what’s called personal injury protection, which is an additional layer of coverage on your own auto insurance. If you have this policy, your auto insurance company would be required to pay your bills without any copays or out-of-pocket expenses up until your covered policy amount. In Washington state, I typically see $10,000 policies and $35,000 policies,” she explained.

Long further pointed out that PIP pays for more than just medical bills.

“They will pay for what’s known as essential services. So if you’re injured and your doctor says that you shouldn’t be lifting over 10 pounds, you may need to hire someone to help take care of your children. So it would pay for that cost or it would pay for someone to come in and do that yard work for you if you’re not able to do that.”

She was quick to add that it’s important to note that using the PIP policy does not result in an increase in premiums.

When asked what advice she would give someone in a personal injury case facing costly medical bills, she said, “Be reassured in the fact that the person will ultimately be responsible for the reasonable and necessary bills that you’re incurring, but also be mindful as you’re going through treatment about who is going to be paying for what and when.
