When asked to comment, Elliott wanted listeners to know that because probate can be quite lengthy and costly, failing to go through the motions efficiently will result in delays and more expenses. However, there are actionable steps to take to help make probate a much more painless process.

“The first thing you can do is hire the right lawyer. Hiring the right attorney comes down to someone who is experienced. A delay in court, which could be caused by an inexperienced attorney, can lead to 3 to 6 months added onto the length of your probate. In our area, probates right now are running between 20 and 24 months anyway with no delays.”

According to Elliott, the problem comes when the family needs to continue making that payment on the house while that money is tied up in probate, an extra three-to-six-month delay will cause undue hardship on a family.

She further added that when it comes to selecting the right attorney, it’s important to ensure that they are focusing only on one area of law and not spreading themselves out too thin. If an attorney is practicing in too many areas of law, Elliott pointed out, they are likely not knowledgeable about the process and getting through it as quickly as possible.

Good communication is also essential when it comes to retaining the right legal counsel to set expectations about the probate process and avoid unnecessary costs.

When asked for an example, she said, “If you don’t have an attorney who’s a good communicator, then you could end up paying the debts of the deceased family member, such as their credit card bill. This is a mistake as you’re not supposed to pay the debts unless you have court approval. Paying that debt can actually come out of your pocket as an individual. So listening to your attorney is paramount, as is knowing which bills to pay and what not to pay.”

Elliott was quick to point out that the probate process can be avoided entirely – if the right plan is put into place.

“The most important thing I do is keep families out of court. I do that in the estate planning process. When I work with a family to put a plan in place, that is going to eliminate the need for the probate court to step in and get involved.”

When asked to comment, she said, “Being named as a successor trustee for a trust is a responsibility that should not be taken lightly. That said, the tasks that need to be completed – which might be overwhelming to some – are not impossible to tackle. Here are some important things to keep in mind for trust administration.”

One of the first duties that a successor trustee should do before anything else is looking over trust documents.

“You’ll need to find and then take a look at all the estate planning documents left behind by the decedent. The estate plan should contain the trust document, which will list the successor trustee, the beneficiaries, as well as how the deceased wanted to distribute the estate,” she said.

Ungvarsky further added that successor trustees should get as much contact information of the beneficiaries as possible from these documents. Successor trustees must notify beneficiaries and provide them with a copy of the trust.

“After reviewing all the trust documents, it’s vital that successor trustees make the required filings, which may include submitting the original Will clerk of court, as well as filing the decedent’s death certificate in the county in which they owned property,” she said.

What many people might not realize, according to Ungvarsky, is that they need to provide evidence to banks, brokerage firms, and any other third-party to prove that they are, in fact, named as the successor trustee.

When asked to elaborate, she said, “This step is vital for successor trustees to be able to access information or do business related to the trust. What this means is that you’ll need to have the original signed trustee agreement, death certificate, and the acceptance of trustee form on hand.”

In administering an estate trust, Ungvarsky pointed out that it’s also essential that the successor trustee meet all notice requirements.

“Successor trustees not only need to notify the beneficiaries of a trust – but they also must notify the post office for a change of address for forwarding mail, the Social Security Administration, utility companies, banks and financial advisors, creditors, and insurance companies,” she added.

According to Ungvarsky, this is far from a comprehensive list of things that need to be completed by a successor trustee. However, it is a good starting point.

“Because administering a trust involves so many moving parts, it’s important to be in constant contact with a competent lawyer to ensure you are correctly administering a trust.”

Africa’s prospects have improved sharply since 2018 with the agreement to establish the African Continental Free Trade Area (AfCFTA). The pact, whose implementation began on January 1, 2021, has created the world’s largest free trade area in terms of participant countries and is expected to galvanize the region’s economy through promoting tariff-free intra-continental commerce. However, its success will depend heavily on adequate investment in infrastructure, Jackson Ukuevo notes. According to the OECD/ACET report, “In particular, transport infrastructure that facilitates local, national, and regional linkages will be crucial for fostering trade across the continent. It is also critical for enhancing the connectivity of the many landlocked African countries to the sea. As such, transport infrastructure can increase productivity, reducing Africa’s prohibitively high transport, logistics, and materials costs, and can thereby improve the competitiveness of African firms.
