When asked to elaborate on how couples should approach some of the trickier aspects of a divorce, she advised that they adopt an honest and balanced approach to dividing money, personal property, stocks and shares, and accumulated debts.

One of the most significant issues to handle is dividing the family home. If one owns it outright before embarking on a relationship, marriage and eventual cohabitation with a person, they may have a right to ask the spouse to move out.

However, when it comes to holding joint property titles, the partner that provides primary care for the couple’s children usually stays in the family home. This is to provide stability for the children during the separation. However, it does not mean that same spouse will end up with the property at the time of final divorce.

If both are childless and hold joint titles, then a mutual decision can come into play as to the one who retains the property. “It is always advisable to come to an agreement that is acceptable to both parties, but if there is any dispute, they can turn to a local divorce court to rule for them,” advised Weinman.

When it comes to dividing financial assets, she advises couples to draw up an agreed checklist of value items, come to a mutual, sensible decision on the value of each item, and then decide which of them should have an item.

“Couples should try to establish a balanced and fair approach, and avoid one having more than the other,” she advised, noting that couples could utilize professional mediators to minimize further tension and argument.

A balanced approach will ultimately have to be approved by a judge to be legally enforced. “Spouses will likely be retaining a lawyer for representation in court, and a judge is more likely to be inclined to approve an agreement without further investigation.”

When matters are contested, a judge will utilize a state’s property division rule to split the marital assets. Usually, property division is either based on equitable distribution or community property.

Weinman said equitable distribution is marital property equitably distributed, while community property is where the marriage assets belong 50/50 to each spouse. The former is used in many states, especially in the northeast and midwest, and entails a judge splitting all the assets between the spouses equitably in the judge’s eyes.

In some states, including Texas, they follow the community property system. In this approach, everything owned prior to marriage, everything inherited, and all gifts are separate property and cannot be divided by a court. Only community property will be divided.

Everything that is classified as community property is divided equitably (but not necessarily equally) between the spouses. In order to equitably divide the estate, a court will consider such factors as fault in the breakup of the marriage, ability of each of the spouses to earn income going forward, expected inheritance, contributions to the creation of community property, wasting of assets, etc.

When it comes to valuing and dividing community property, it is advised to engage a lawyer on such complexities, especially with more complicated assets such as a family business or unusual employment benefits, concluded Weinman.

He elaborated: “This allows the person making the document to assign a trusted individual, or agent, to make medical decisions on their behalf after they are deemed unable to do so. This encompasses all healthcare-related decisions, so it’s vital the person entrusted to this role is comfortable carrying out medical wishes.”

The agent, acting under a Medical (or Health Care) Power of Attorney, has the authority to execute specified health care wishes in Court, decide on the hiring and firing of doctors and other medical professional workers dealing with treatments, and receive access to medical records if the document is properly drafted with the appropriate HIPAA language.

“To be able to carry out your wishes if you become disabled, you’ll need to have a durable power of attorney already in place. Without a power of attorney, what happens to your assets could be left up to the mercy of a court.”

Shovelin added that “a power of attorney will allow someone to engage in real estate and financial transactions, as well as other legal decisions, on your behalf .”

“In addition to this, make sure to appoint an individual you trust to follow your instructions as a healthcare power of attorney. This should be a trusted person who can make vital healthcare decisions that align with your views if you are not able to make them yourself,” she said.

Brumfield added that living trusts allow room for further planning.

When asked to elaborate, he said, “Let’s say that the healthy spouse falls ill or passes away. With a trust, a successor trustee can be appointed to take over the management of the trust.”

While having a living trust is highly recommended, Brumfield says that if one has not been put in place, then an updated will, power of attorney and healthcare proxy is essential.

He added, “A will that reflects your most recent wishes will ensure that your assets land in the right hands. If you don’t have a will, then the state will decide what happens to your assets after death. A power of attorney and health care proxy allow you to choose a person to make financial and medical decisions for you when you are no longer able to do so safely for yourself.”

“If a spouse with dementia is not in the right mindset to make sound financial decisions, then they could be vulnerable to predatory behavior. But this can easily be avoided by setting up an irrevocable trust,” he said.

Furthermore, Brumfield added, “This trust will continue protecting your spouse and their assets in numerous circumstances after you have passed on.”

Successor trustees are advised to assess potential claims carefully before agreeing to stand any debts against the estate.

“If anyone is unsure of their role as a successor trustee, or the responsibilities they have to take on, it is advisable for them to approach an experienced estate planning attorney for advice and guidance. That extra helping hand can play a significant part towards a stress-free approach to the administration of an estate,” Mr Price concluded.

With a range of business signs, signboards, plaques, lettering, and other types of signage available, Ward Signs has been helping businesses and organizations establish their identity and signpost their location since the era of post-war austerity and, as of London’s Festival of Britain in 1951, began to offer more modern alternatives to the old wooden sign. As such, Ward & Company, as they were known then, became one of the first manufacturers to offer 3D signs.

Originally working with sheet metal and paints to colour in the lettering, Ward & Company soon switched to plastic and extruded aluminium, allowing them to expand their offerings and, as a result, their client base. As a result, Ward Signs has worked with partners from a wide range of industries, including local authorities, building contractors, education, government, health care, leisure, and retail businesses and organizations. Some of the most prestigious clients that Ward Signs has worked with over the seventy years include brands like the BBC, the NHS, the Victoria & Albert Museum, Skanska, and more.

As well as manufacturing the best in contemporary signage, like using fibreglass, snap-fix fastenings and more, Ward Signs still maintains many of the traditional techniques that are otherwise disappearing from the market. These include heraldry, sand-cast, and aluminium and bronze plaques and letters, and corporate logos.

To this day, Ward Signs carries on its legacy and dedication to high-quality signage, weathering storms such as recessions, the 3 day week and now Covid-19. During these troubled times, the team is still dedicated to providing a first-class service. From concept through design, manufacture and installation, they offer a complete sign service and manufacture all types of signage from print to cast solid bronze.
