This process helped to limit customer and staff interaction, which is an important factor in reducing potential coronavirus spread.

The sight of bare, empty rooms is enough to make any consumer want new furniture. Fantini, of Rosen Injury Lawyers, is the founder of the Zantac Cancer Compensation Program (“ZCCP”), who are presently reaching out to thousands of people to assess their eligibility for compensation. The program evolved out of the April 2020 recalling of ranitidine, the generic version of Zantac by the Food and Drug Administration (FDA).

The recall was based on part of an ongoing investigation into concerns at the potentially high dosage content of N-Nitrosodimethylamine (NDMA), a known carcinogen, within the drug.
Ongoing tests have revealed Zantac could have 3,000 times more NDMA content than the FDA’s recommended daily dose.

NDMA, which was initially used to manufacture rocket fuel, can cause several types of cancer; the lawsuit focuses on cases of prostate, rectal, colon, breast, kidney, bladder, stomach, liver, pancreatic and esophageal cancers.

Fantini said: “Zantac has been on the market for 30 years, and people would have taken it not only for heartburn but to treat stomach ulcers. It’s fair to say tens of millions of people have used the brand and generic Zantac versions during this period.”

“We are aware of studies, just as the manufacturers, that there were concerns about Zantac for many years. As manufacturers, they were held to be experts in the field, and they have a duty to go above and beyond to make the product safe. But they did not do that.”

“Yet everybody was taking this medication for years, if not decades, in the belief they were safe. In reality, they are very dangerous medications.”

ZCCP had been developed in partnership with leading science and legal experts to enable people to have their cases evaluated at no cost and under no obligation.

“We are working with thousands of people impacted by this medication. But we believe it will run into tens of thousands, and even exceed 100,000 people filing claims related to this,” he added.

As part of the mass tort lawsuit, if someone has one of the cancers listed in the lawsuit and took Zantac for one year or more, they could become a claimant in the case, he explained.

He acknowledged: “We are working with experts who are investigating at least ten cancers linked to this medication. We have proof that we are confident those cancers are linked to that medication, but studies are still ongoing.

“ZCCP aims to go beyond just a person’s lawsuit,” Fantini explained. “We want to lift the weight and stress of this lawsuit off their shoulders and allow them to focus on their treatment and recovery.

“People have been diagnosed with terminal cancer; it is a life-impacting diagnosis that they need to focus on. We work with them and the experts to handle and prove their lawsuit in an efficient manner.

“ZCCP is there to help the ordinary person in the street that doesn’t have the resources to fight these big corporations. These corporations have profited by billions of dollars off the back of these medications and so have a war chest to fight lawsuits.

“But ZCCP has the resources and will do everything to get as much compensation for as many people affected by Zantac as possible. We know how to handle these type of cases.”

The route from potential crime to charge generally runs from a police inquiry, followed by an officer writing up a report and submitting it to a prosecutor to weigh up evidence and the likelihood of success in court before the charges are even officially brought against a person.

“Firstly, someone who is under investigation and charged should certainly consult an experienced defense lawyer as soon as possible,” advised La Rue.

He based this assertion upon knowing that an experienced attorney can work to cement a defendant’s rights, and thus his best avenue to prove his innocence through a number of legal routes before a case gets to court, and certainly before it proceeds to trial.

However, this is often not the right path, as most defense lawyers will tend to opt to wait until charges are filed, he added. “Then a lawyer can meet their client and get a complete grounding of the relevant facts and weigh up their options.”

A lawyer may well feel it is better to investigate the incident and gather evidence to present them to a prosecutor to prove that what has been accused didn’t happen, or wasn’t the proper party to accuse. Nevertheless, most lawyers will probably “keep their powder dry” until the charges are tried in court.

He asserted: “Doing nothing may well be the safest, best and patient option for the defense. In some cases, however, it can take months for a prosecutor to learn there’s insufficient evidence to convict a defendant based on various grounds, including that a witness isn’t credible.”

Alternatively, charges may not survive if a defense lawyer wins a pretrial suppression motion, gets the case dismissed at a preliminary hearing, and the prosecution opts against presenting the case to the Grand Jury, or re-filing the case.

Short of a not guilty verdict at trial, the defense team’s hopes will ultimately stand or fall on the facts and the circumstances. Yet what happens at the start of an investigation or prosecution can make all the difference. “There are over 25,000 lawsuits pending which are being dealt with in part by the Hernia Mesh Compensation Program, and we expect that number to grow in the next few years,” revealed Program founder, Joseph Fantini, during the podcast, hosted by Grant Eagle.

Most lawsuit clients have typically had a second surgery because of complications with the hernia mesh, he explained.

According to Fantini, most hernia repair operations involve mesh, which could be problematic as materials used in recent years lead to increased failure rates. “As many as one-third of hernia mesh surgeries could result in complications. Some people might not be aware of the complications associated with a failed mesh,” he said.

Two common symptoms of hernia mesh failure are extreme pain and recurring infections, while other telltale symptoms are hernia recurrence, which could be caused by the migration, adhesion, fistula, and perforation of the mesh.

Due to a relatively high risk of complications following a hernia mesh implant, the US Food and Drug Administration recalled specific mesh devices. Fantini said: “Hernia mesh litigation has been going on for 25 years, and meshes have been around for more than 70 years. Over the years, there have been tens of millions of dollars paid out for hernia mesh cases.

“Each case is different, and this is why having a mass tort means your case still depends on the facts of your specific case. The damages you get relate to your specific problems caused by the hernia mesh failure.”

One of the most critical elements of the Program is that they retain trial lawyers prepared to take the case to trial compared to attorneys who are ready to settle before they go to trial.
