According to King, determining who will be a child’s primary residential parent, and how much parenting time each parent will have, requires a consideration of many factors. These include, among other things, the compartife roles each parent has previously played in caring for the child, each parent’s potential for performing parenting duties in the future, each parent’s home environment and work schedules, etc.

 A custody arrangement must also include provisions governing how decisions affecting the child will be made. Subjects of such decision-making include medical care, education, religious upbringing and extracurricular activities. King says that, depending on the circumstances, some or all of these decisions may be made by both parents, jointly, or one parent may have unilateral decision-making.

King explained the necessity of having a carefully structured custody arrangement for a child whose parents are divorced, separated, no longer cohabiting or who never lived together. 

King said that an equal parenting time arrangement can often work well, but cautioned, “Such an arrangement works well if parents live close to each other and can communicate relatively well. They allow all to maintain the most stable routine possible for the child – but cooperation and good co-parenting is essential for equal time to be successful.”

King elaborated: “Parents that are required to agree on major decisions with the other parent but then refuse to communicate with them and take all decision-making, will inevitably end up back in court for enforcement of the custodial agreement.”

“Like it or not, the child has two parents, and both are entitled to participate in raising their child, in at least some capacity. Parents should always be working in the best interests of the child and not look to cause further stress to their child’s already-altered domestic arrangements.”

A child’s schedule with each parent should include consideration for their schooling, the distance from each parent’s home to their school, the child’s age, and their extracurricular activities. Courts will step in if an agreement cannot be worked out.

King added that a shared parenting schedule could also include alternative months with parents, alternating weekends and holidays with each parent, and even allowing the child to remain within the family home while the parents take turns to move in and out over an agreed period.

According to King, shared parenting that considers these circumstances offers the best advantage of ensuring children will retain contact and involvement with both parents. Of course, there can be problems: children being moved around, non-cooperation of parents, and the cost of maintaining two homes. In such cases, the custody arrangement may need to be modified.

Parents are advised to keep detailed financial records concerning spending on their child to ensure there is never any conflict or claims that one parent is spending more than the other.

A judge could give sole custody to one parent if they deem the other parent unfit or a danger to the child due to alcohol or drug dependency, charges of child abuse or neglect. However, King said that, in Tennessee, by statute, courts must allow each parent as much involvement in the child’s life as is feasible and in his or her best interests.

King stressed that any parent confronted with these issues should seek advice from an experienced family law attorney. “Coming up with the right parenting plan for your child is one of the most important things you will ever do,” he says. “You owe it to your child and to yourself to get competent, professional guidance.’

He emphasized that the consequences of not leaving a will may only add to the confusion and frustration of a person’s grieving loved ones, as they would be left to pick up the pieces without any clear instructions from their deceased loved one.

“Assets and property that are not protected in an estate plan after someone passes away are sent to probate,” he explained. “This means it’s up to a court using state law, instead of your wishes, that decides what happens to those possessions.”

A study from Rocket Lawyer, cited by Huguelet, found that more than half of Americans aged 55-64 don’t have a will. Of those questioned, 57% had intentions to make a will but hadn’t gotten around to it; 22% thought setting one up wasn’t urgent, and 17% didn’t feel they needed one.

“Most people tend to avoid it because it involves them thinking about their own death,” he commented. “However, having their affairs in order greatly helps their loved ones once they’ve passed away.”

This also applies when a person becomes incapacitated, either by illness or serious injury, and can no longer make decisions independently. An estate plan should include life documents like a health care directive and a durable power of attorney. 

“These documents help guide a guardian or an executor to make financial and healthcare decisions in your best interests,” said Huguelet. “Not having your wishes in writing can often lead to further confusion and wrong decisions being made.”

Huguelet addressed the misconception that people don’t need a will if they don’t have an estate. “If you have a house and children, no matter your marital status, you need a will. Every family is different and has its own set of particular circumstances that should be addressed in an estate plan,” he concluded.

In other words, you may have to file a Chapter 13 repayment plan. Generally, the payment shall be determined by what you have the ability to repay. This does not mean that you are required to pay all of your debt. Your individual circumstances will determine the payment amount. 

Mr Keenan said a debtor would be able to file for Chapter 13 if their debts are less than $419,275 in unsecured debts and less than $1,257,850 in secured debt.

“To qualify for a Chapter 13 you are required to have filed your income tax returns for the last four years and provide a trustee with a copy of the most recent federal tax return,” he added.

Under Chapter 13, a debtor must also demonstrate they have enough income to fund their repayment plan.

In recent news, there are some regulations under bill AB 832 COVID-19 Relief: Tenancy: Federal rental assistance that expired on March 31, 2022. One of the terminated statutes included actions you could take to avoid an eviction and highlighted that money had been set aside to help renters who have fallen behind on rent or utility payments. Under this statute, tenants had the option to complete a rental assistance application. 

Although some statutes are expiring, it is important to note that some notice requirements, rent relief, and collection of rent through small claims courts are valid until 2025. According to AB 832, Chapter 27, section 5, “Existing law, until July 1, 2025, provides that a small claims court has jurisdiction in any action for recovery of COVID-19 rental debt, as defined, regardless of the amount demanded.” Furthermore, each individual sovereign (County or City) is able to enact its own laws and regulations for tenant protection caused by COVID hardships. Provisions recently enacted by AB 2179 furthered California’s statewide emergency eviction protections, which will now be limited to only protect tenants where an application for rent relief was submitted on or before March 31, 2022. These protections are set to expire on June 30, 2022.

Both Los Angeles and San Diego currently have suspensions in place concerning evictions.
