In a recent interview, the Co-Founder of Legacy Law Firm, P.C. in Sioux Falls, SD, explained: “Probate is required to authenticate a last Will and Testament after someone has passed away.”

If you’re nominated, and once a court has appointed you as an executor of a Will, there are several steps you need to take to complete the process.”

The first is to file a petition to open probate of the estate in question. “In most states, you’ll need to file the Will with the probate court and file the petition as soon as you can after that person has died,” said Voss. “Courts in several states will have a form for doing this, meaning it doesn’t have to be an overly complicated process.”

A probate judge will hold a court hearing to confirm the Will’s validity, which allows all relevant parties to object to the Will going to probate. Early in the process, an executor must locate and take possession of the deceased’s assets so they can be protected throughout probate. 

Voss said: “It might be that the deceased did not disclose certain assets or make them known in their Will. It’s up to the executor to find these hidden assets by combing through tax forms, insurance policies, and bank statements.” 

In the case of outstanding debt, an executor will have to identify and contact the deceased’s creditors. “You must notify creditors of the person’s death. Additionally, in most states, the executor is required to publish notice in a local newspaper as a way to notify creditors that are not known,” Voss added. 

Following this, an executor then uses estate funds to pay for the deceased’s bills and debts and prepare and file tax returns for the year the decedent passed away. Voss said: “After these steps, the executor will need to petition the court to legally distribute what is left from the assets to any beneficiaries specified in the Will.”

Voss advised named executors to seek further guidance from an experienced probate attorney for a comprehensive list of what needs to be done to complete the process successfully.

Minimum wage and the deciding framework.

Minimum wage is reviewed annually and looks at a number of important social aspects. They look into the demographics that primarily receive minimum wage. How an increase will affect small businesses. What the cost of living is like compared with previous years. How many people will be impacted positively by a minimum wage increase and how many people’s jobs may be reduced or lost due to increased minimum wage. Because there is such a large scope of things to consider and it has to be approved in parliament, the living wage and minimum wage are often different amounts. In the process of deciding on minimum wage, governmental benefits are also factored in as often there are certain thresholds of earning for members on a benefit. Or a massive increase in minimum wage may restrict eligibility for some members of society vulnerable to poverty.

Minimum wage is governmentally considered a manageable amount for both businesses and individuals. Living wage is a wage decided by a number that would generally keep individuals out of poverty. However both numbers do not fully take into account people’s circumstances and organisations still trying to save money.

Individuals have a number of different circumstances that may impact their ability to afford to live. Minimum wage increases such as this year’s increase come to try to accommodate for inflation, or if there has been a long period without an increase. However as the living wage is set to estimate more of a comfortable living, it can better accommodate for exceptional circumstances of in-affordability. 

The Rise in both Living Wage and Minimum wage

There are always impacts when it comes to increasing minimum wage that does not solely impact low income workers. Living Wage is an ideal preposition when considering workers rights and valuing employers. However both wage options have pro’s and con’s for different groups of employers and employees.

Employers can be impacted by a rise in minimum wage through the need to raise prices due to increased cost of staffing. The nuclear option is to cut children out of the inheritance altogether. Mr Price added: “Disinheriting a child means you are not leaving them anything in your will. Clarify the child’s name you don’t want to leave inheritance to and that it’s intentional. In other words, you’re not required to state your reasoning.”

In an interview, the partner of Casey & Lundregan, P.C., in Salem, MA, said that when someone dies, usually a process called probate takes place, concluding with any assets and belongings being distributed to their chosen beneficiaries.

If someone leaves a will, they name a personal representative tasked to manage the probate process. This includes settling outstanding debts, filing tax returns and distributing assets. A personal representative may seek an estate planning or probate administration attorney to aid them through the legal journey.

However, if someone dies intestate – without leaving a will – then a probate court will settle how the assets are distributed and appoint a personal representative to manage probate. 

Casey said fees for probate attorneys and personal representatives vary depending on the level of complication associated with an estate. “However, these fees may increase substantially if a family member contests the will and how these assets should be distributed.

“For instance, if your entire estate is worth over $600,000, your family could be looking at about $30,000 in probate fees, including court filing fees, before the estate is settled. That’s why estate planning is advisable, as the costs involved will be much less than a family fighting it out in court. 

“It has been estimated that probate can cost as much as 20 times more than having a well-thought-out estate plan with a will.”

He advised: “A will directs and gives the family a clear idea of how the estate should be distributed. Otherwise, probate costs can spiral and heighten stress and discord among family members who may well be more focused on fighting over the assets than grieving for your loss. Better yet, clients should discuss strategies with us that will help them avoid probate court altogether.”
