A real estate attorney is threatening to launch a civil action against Lynn City officials over issuing daily $300 fines against rental condo owners to prove their occupancy.

Allison Burns, a partner from Casey Lundregan Burns, P.C law firm based in Boston and Salem, said she might resort to issuing suit after some elderly owners began receiving fines in the mail from the city’s Inspectional Services Department.

Rental property owners in Lynn who have not registered their properties with the city’s online database were issued a warning on August 22. A letter sent to Lynn landlords, citing a 2020 city ordinance, warned if they failed to register their properties within seven days, they would be fined $300 a day.

The letter states: “By Ordinance dated 9/29/20, the City of Lynn requires that all owners of private residential rental housing units, including condominium units, to register these rental units no later than July 1 of each year with the Inspectional Services Department. All rental registration units are recorded in an electronic database of all owners.”

The letter states owner-occupied properties are exempt from registration, but homeowners must instead file a Homeowner’s Affidavit with the City of Lynn.

Burns’ client, Cyndy Anselmo, owner of East Coast Properties, a property management company, believes the notice places an unfair burden on elderly live-in property owners who are forced to prove their own occupancy with the affidavit.

Anselmo says the City of Lynn keeps referencing the ordinance requiring landlords to register their rental units. 

“No one seems to understand that these elderly people living in the units that they owned shouldn’t have to register their units because they’ve never rented them,” Burns said. 

“The affidavit requires them to pull a copy of their own deed, which is difficult for elderly people to do and readily accessible to the City of Lynn itself.”

“And then they also needed to pull a bill that wasn’t a real estate tax bill or a water and sewer bill that showed their ownership and occupancy of the property, which is, I think, a huge burden on people who are not renting their units and should not be subject to this ordinance at all.”

Burns plans on teaming up with other attorneys representing condominiums to file suit against the City of Lynn if officials fail to act on the fines and address “this unfair action.”

She explained that many are afraid they won’t qualify for Medicaid, but several factors are considered, such as age, income bracket, assets, and the level of care required. 

One misconception is that individuals don’t have to be concerned with Medicaid planning. “Many clients don’t realize how costly long-term nursing care can be, so it’s important to prepare early for potential Medicaid assistance. The earlier you begin, the more money you’ll be able to protect,” she added.

“Another misstep is that once individuals have moved to a nursing residence, it’s too late to begin Medicaid planning. Even if you or your loved one has already used funds to pay for care at a nursing facility, there could still be time for Medicaid planning, especially for anyone married.”

One of their priorities should be to secure all assets as soon as possible. These can range from tracking down financial assets to physically locking up or maintaining a decedent’s property.

However, their failure to handle assets correctly is a common area for potential complaints. “One pitfall for an executor is failing to properly categorize a decedent’s assets. Non-probate examples include trust assets, life insurance policies, and retirement account funds that pass by way of beneficiary designation.”

Another matter easily overlooked is obtaining a Date of Death value for all of the decedent’s assets. This should be done as close after death as possible, so this value is easier to calculate. If a property is involved, a qualified real estate appraiser will be required.

An executor’s inability to communicate with beneficiaries and creditors on developments was another common failing, and contributes to unnecessary litigation. Creditors must receive notice of a pending estate administration, and the estate must remain open for a statutory period to enable creditors to file a claim. 

Douglas stated: “In both cases, executors should seek professional advice and retain the services of a probate attorney who can act as a guiding hand. If they don’t, the probate process may take longer than necessary, and an executor may make costly errors during that period.”

He said that the failure to handle creditors’ claims, distributing assets too quickly, miscalculating estate taxes, and neglecting to issue an inventory and accounting in an estate are additional errors executors are guilty of.

“Executors may also fail to look at alternatives to the formal probate administration. In some states, a small estate affidavit or filing the will for probate may be options instead of formal probate with full administration. This could save considerable cost and time.”

Douglas concluded: “Being an executor is no easy task, so working with an experienced probate attorney can save them from committing unintentional mistakes, reducing the estate’s value, and adding more grief to an already emotional time.”

The TV series is an action packed, accurate story of Richard the Lionheart – the greatest adventure in Christian history.

Salt Lake City, UT – September 20, 2022 —

Being 100% Christian crowdfunded, the Knights of the Cross TV series is based on the third crusade for both Muslim and Christians where the story portrays the details of courage, heroism, betrayal, and brutality on both sides. 

The show aims to be character driven, where the production crew wishes to bring justice to incredible figures such as Saladin, Al-Adil, Philip II of France, and Richard the Lionheart. 

A 20 minutes of Episode 1 will be released for free on Youtube on the 11th of November 2022, where viewers will get a taste of the incredible crusader TV show. “We need your support to expand this into a full Season 1 Three Episode trilogy. And if we exceed our crowdfunding goal, we want to expand the historic battle scenes and storyline of King Richard the Lionheart.” said Stephen Roberts, the writer of the Knights of the Cross. 

Knights of the Cross is being independently crowdfunded on www.KnightsoftheCross.com Studio and creating the series is the https://www.christianchannel.com/.  

The production crew hopes to elevate Christian Entertainment with high quality acting and special effects that can only be achieved with more funding. Episode 1 will be released for free on the Real Crusades History YouTube channel which has 230K Subscribers. As of now there are 27 backers who have pledged $12,397 to help bring this project to life. The project will need to reach $300,000.00 Crowdfund Goal to complete the 3 Episode TV Series and are accepting crowdfunding support until the TV Show is released.

The production is scheduled to finish filming next summer and it is predicted to push back the final due date if there is another COVID-19 outbreak.

Florida Real Estate Developer Richard Zahn Launches Scholarship Fund for Entrepreneurs Available Now

The Richard Zahn Scholarship for Student Entrepreneurs is a scholarship program that was recently opened up for students who are wishing to be entrepreneurs in the future.
