They also extend to filing forms and documents needed by a probate (surrogate) court, assessing any tax dues on the estate, and settling them.

Mr. Portnoy said an attorney could also be tasked with collecting funds from checking, savings and investment accounts and in addition obtaining value appraisals for any real estate or business ownership interests left by the decedent.

He advised that a probate attorney handles the probate process after a person dies, while an estate planning attorney works with clients to draft their wills, and trusts, and overall provide planning for their estates. A probate attorney can also provide services as an estate planning attorney.

When there is a challenge to a will from a beneficiary, a probate lawyer can offer representation to a party in probate litigation.

Mr. Portnoy said that while probate lawyers are either paid by a flat rate, by the hour, or as a percentage of the estate’s value, the exact arrangement will depend on an attorney’s experience and the legalities needed to be addressed.
