He elaborated that estate planning should be an essential tool for any couple, especially if one partner has been diagnosed or suspected of having dementia or Alzheimer’s.

“In my experience, the couple should have a well-thought-out and professionally drafted estate plan built around a living trust,” said Mr. Clark. “A healthy spouse will have powers of attorney to ensure correct financial and healthcare decisions for their loved one.”

While the ideal time to plan is before any illness is diagnosed, a living trust can still be prepared if a spouse has dementia.

“Many assets can be placed in this trust, allowing the healthy spouse to take control of them and keep everything functioning normally,” said the Founder of The Legacy Elder Law Center. “This means that as the spouse with dementia declines, they will not be taken advantage of or misappropriate assets.”

As dementia sufferers become unable to understand financial documents and their assets or even recognize family members, a living trust is an excellent tool to help their spouse manage their existing environment.

Mr. Clark said living trusts allow room for further planning, adding: “If the healthy spouse falls ill or passes away, with a trust in place, a successor trustee can take over its management.”

While a living trust is highly recommended, he said that if one has yet to be put in place, an update of a will, powers of attorney and healthcare directives is essential. He said: “A will that reflects recent wishes ensures assets land in the right hands. If they don’t have a will, the state will decide what happens to their assets after death.”

“A financial power of attorney and advanced healthcare directives allow them to choose a person to make financial and medical decisions when they can no longer do so independently.”

Mr. Clark concluded: “If there is a spouse with dementia who could fall prey to predatory behavior, this can be avoided with a living trust. This protects the spouse with dementia, and ensures assets are passed on to the correct beneficiaries when the couple passes on.”

The founder of The Elderlaw Firm in Greensboro, NC, zeroed in on four myths. The first involves what happens to a person’s assets when admitted to a nursing home.

“There is a lot of misinformation around this topic and can often result in hard-earned assets being poorly protected or unprotected altogether,” he said. One misconception is that a person in nursing home care can give away $16,000 per person a year without penalties.

He said: “The $16,000 limit applies to federal gift tax and has nothing to do with applying to and eligibility for Medicaid. Medicaid gifting rules differ: you will be penalized and not qualify for Medicaid benefits for a period of time if any gifts you make are considered divestments.”

The second myth centered on acquiring a Medicaid-friendly annuity. He said: “Many older adults wrongly assume buying an annuity will act as an asset protection plan. But changes in Medicaid laws at both federal and state level mean annuities may not be as helpful in planning and qualifying for Medicaid.”

Mr Toman reflected: “The downside to many supposed Medicaid-friendly annuities is that they are deferred annuities, many of which have limited options when qualifying for Medicaid, and can narrow the scope of protected assets if you are in a nursing home.”

Another misconception is that the state will seize assets when someone enters a nursing home. He said: “You don’t have to hand anything to the state. If you’re not married, the amount to spend is $2,000 or less in cash and other countable assets.” Meaning Medicaid won’t dispense any money until you ‘spend down’ your countable or available assets.

Lastly, Mr Toman said it’s never too late to develop an asset protection plan even after a loved one is in nursing care. “It’s never too late to protect your assets. You can still qualify for Medicaid benefits even if you’ve used private funds to pay for nursing home expenses for years.”

He concluded that the best advice was to seek the guidance of an experienced attorney in this field so that they can address any questions, worries or misconceptions you may have.

In an interview, the founder of the Law Office of Michael T. Huguelet, P.C., said that when someone dies, a process called a probate administration usually takes place, concluding with any assets and belongings being distributed to their chosen beneficiaries.

If someone leaves a Will, they name a personal representative tasked to manage the probate process. This includes settling outstanding debts, filing tax returns and distributing assets. A personal representative may seek an estate planning or probate administration attorney to aid them through the legal journey.

However, if someone dies intestate – without leaving a Will – then the rules of intestate succession will determine how the assets are to be distributed, rather than the decedent determining how their assets are to be distributed.  In addition, the Court will determine who will manage the probate administration.  The Court’s decision may or may not be consistent with the decedent’s wishes as to who should manage the probate process.  

Mr. Huguelet said fees for probate attorneys and personal representatives vary depending on the level of complication associated with an estate. “However, these fees may increase substantially if a family member contests the Will and challenges how the assets are to be distributed.’’ 

“For instance, if your entire estate is worth over $600,000, your family could be looking at about $30,000 in probate fees, including attorney fees, court filing fees and surety bond premiums before the Estate is settled. That’s why estate planning is advisable, as the costs involved will be much less than a family fighting it out in court for control of the estate assets,’’ Michael Huguelet advised.

“It has been estimated that probate can cost as much as 10 times more than having a well-thought-out estate plan with a Will.”

He concluded: “A Will directs and gives the family a clear idea of how the Estate should be distributed. Otherwise, probate costs can spiral and heighten stress and discord among family members who may well be more focused on fighting over the assets than grieving their loss. Better yet, clients should discuss alternative strategies that may help them avoid probate court altogether with a qualified Estate Planning attorney.”

When asked to comment, La Rue said, “Drug paraphernalia charges are classified as misdemeanors and are a matter of public record, which could negatively affect any employment opportunities. When asked for an example, La Rue said, “It’s possible that a drug paraphernalia charge could be brought against you without enough evidence if the police were not able to produce the drugs in court.”

Another way to resolve drug paraphernalia charges in your favor may be to seek a diversion program for first offenders, or one tied to those seeking to get help with an addiction problem.  Usually, the criminal justice system, particularly where the individual charged is new to being in trouble, or is motivated to get clean and stay sober, will work with the accused and their attorney to resolve the charged in such a way as to give the person a chance at a record that is clean upon completion of the program.  While such programs vary, an attorney that knows the ins and outs of this application and assessment process can be invaluable.

“Having a defense attorney who is well acquainted with the criminal system could help bring these issues to light and break down the other side’s case or find an alternative way to resolve the case, thereby giving you a better chance of avoiding a drug paraphernalia charge on your record,” he said.
