What You Need To Know About Mental Health And Drug Addiction Programs In New Jersey

Multiple studies have shown that one of the most effective ways to help addicts regain control of their lives is through mental health and drug addiction programs. But according to the CBS affiliate in Philadelphia, a recent proposal by Governor Chris Christie will change the way these programs are run in New Jersey.

Christie’s proposal would shift mental health and drug addiction programs from the purview of the Department of Human Services to the Department of Health. And while this may not sound like a major shift, the change signals the way lawmakers now view these treatment programs. Here are some of the reasons that the proposal would make these programs more effective. (1)

Changes How Treatment Programs Are Perceived

Division of Aging Services

Division of the Deaf and Hard of Hearing

Division of Developmental Disabilities

Division of Disability Services

Division of Family Development

Division of Mental Health and Addiction Services

With the exception of the Division of Mental Health and Addiction Services, most of the other divisions are not dealing with crisis health issues that could determine whether a person lives or dies.

That doesn’t mean that these other divisions aren’t providing invaluable resources, it simply means that from a perception standpoint, mental health and addiction services do not have the proper health care urgency that is required to successfully treat addicts.

By shifting the Division of Mental Health and Addiction Services to the Department of Health, mental health and drug addiction programs in New Jersey will be perceived as crisis management facilities within the healthcare system.

Burlington County Assemblyman Herb Conaway proposal echoed that sentiment when he commented on the governor’s proposal:

“There has been this division between what is regarded as a mental health and physical health, when in fact what we ought to be talking about is health for an individual and a population in a holistic way,” Conaway stated.

Eliminates Red Tape and Delays In Obtaining Treatment

People who need mental health and drug addiction treatment often have to wade through reams of red tape and paperwork in order to find a facility for urgent detox and long-term care.

This is due in part to the fact that the Department of Human Services does not treat those in need of addiction treatment with the urgency reserved for people in the Department of Health.

As a result, delays in patients getting addiction treatment are not viewed as detrimental as they would be if the mental health and drug addiction treatment were under the Department of Health umbrella.

The governor’s office believes there will be less bureaucracy and red tape after mental health and drug services shift to the Department of Health, providing a greater level of care to those most in need.

“We’re bringing overall the program staff, the senior management team, the subject matter experts,” stated New Jersey Health Commissioner Cathleen Bennett. “And because they’re all moving over, it will feel seamless to the outside world.”

Treats Mental Health and Drug Addiction As a Health Issue Instead of a Legal Issue

One of the problems with providing effective drug and mental health treatment services is that there is still a prevailing sentiment that these are legal or moral problems, instead of health problems that can be effectively treated.

This was the impetus for a recent proposal by the United Nations Office on Drugs and Crime (UNODC), which recommended that substance abuse disorders be treated as a medical, not a legal issue. (3)

In fact, the UNODC found that substance use disorders are a disease, caused by developmental, biological, neuropsychological, and psychosocial factors, and thus should be addressed within a public health framework.

Furthermore, the UNODC recommended that healthcare systems take the lead in addressing drug abuse and addiction through the creation of evidence-based programs.

The link between these proposals and what is happening in New Jersey is clear. By shifting mental health and drug treatment services into the sphere of the Department of Health, the state is declaring that the health care system is the most appropriate place for addicts to recover in an environment where their addiction is treated medically as well as through proven psychological treatment.

Deep Dive Into Air Purifiers Such As The CamCleaner

Ozone Purifier – they produce ozone that reacts with airborne chemicals. These are controversial devices because exposure to ozone can worsen asthma symptoms and cause lung problems. Also, ozone purifiers don’t eliminate dust or pollen.

Some Of The Worst Drivers In Philadelphia Says Car Accident Lawyer Rand Spear

Anyone who’s been the victim of a car accident in Philadelphia won’t be surprised by Allstate’s America’s Best Drivers Report, at least if you start at the bottom. Out of 200 metropolitan areas in the country Philadelphia is nine slots away from the bottom, a position held by Boston. Philadelphia car accident lawyer Rand Spear says the city’s good drivers suffer at the hands of the bad ones.

The insurance company compiles this annual list and considers a number of insurance claim related factors, including:

Average years between insurance claims

The likelihood of a claim compared to the national average

Average number of hard braking events for every thousand miles driven

Rankings after considering population density, and rankings after considering average annual precipitation.

The top ranked area is Kansas City, MO. Once population density is considered the number one title goes to New York City which overall is listed at 116. When population density is in the equation Philadelphia moves up to 179.

On average Kansas City vehicle owners go 14.9 years between insurance claims, are about a third less likely to file a claim compared to the national average and have about 9.9 hard braking incidents for every thousand miles driven. Philadelphians on the other hand make an insurance claim on average every 6.1 years, are nearly 63% more likely to file a claim than the nationwide average and have about four times more hard braking incidents than Kansas City residents.

The bottom tier includes much older, East Coast cities, including New Haven, CT (192), Providence, RI (194), Washington, DC (197), Baltimore, MD (199) and finally Boston, MA (200). Of the bottom ten cities for drivers only one, Glenside, CA, is not located between Alexandria, VA, and Boston. There’s only one East Coast area in the top twenty, Cary, NC, at number 14.

The only other Pennsylvania city to make the list is in the bottom quarter, Pittsburgh, at 175. All the New Jersey areas on the list are in the bottom half: Jersey City (114), Paterson (160) and Newark (165).

“Worst drivers” are in the eye of the beholder and the statistician. Financial website Nerdwallet last year ranked the top and bottom urban areas for relative safety and danger and Philadelphia made neither top twenty list. Their criteria were similar to Allstate’s but also added auto theft and larceny rates. Cary, NC, was listed as the safest area while Detroit, MI, was listed as the most dangerous. In Cary the number of fatal vehicle accidents per 100,000 residents is listed at 1.3 while in Detroit it’s 16.2.

Nerdwallet’s main “take aways” for its survey include:

Larger cities are generally considered more dangerous. The average population for the twenty safest cities is less than half of the average population of the twenty most dangerous cities. But big need not mean bad as New York City is their 34th safest city.

There are higher risks for drivers in the South and East Coast where 13 of the twenty most dangerous cities are located. Twelve of the twenty safest places are in the Midwest and West.

Whatever the statistics, Philadelphia drivers may get the luck of the draw and be surrounded by good drivers one day, surrounded by bad ones the next. Drivers need to be on the defensive and not be too trusting of others but there’s a limit on what you can do. The Opioid Epidemic From Its Epicenter

The opioid epidemic in America has taken hold and is not on its way out anytime soon. Perhaps the hardest hit is Montgomery County, Ohio where law enforcement and local government are doing their best to wage war on the epidemic. Known as the “overdose capital of America,” the county sees more drug deaths than any other county in the country. In fact, the opioid problem has gotten so extreme that Ohio State Attorney General, Mike DeWine, is suing five prescription opioid drug manufacturers for the role they have played in the staggering number of opioid-related deaths.

While the current opioid street drugs that are plaguing Montgomery County are believed to be trafficked in from China (the world’s largest illegal exporter of the opioid Fentanyl) via Mexico, the opioid problem began two decades ago with prescription painkillers.

How the Opioid Epidemic Became So Extreme

The opioid epidemic that the country is currently experiencing cannot be blamed solely on illegal drugs like heroin. The problem began back in the 1990s with a perfectly legal one.

At that time, pain management was beginning to be treated by doctors as a serious medical condition. It is reported that about a third of adult Americans suffer from chronic pain, so it is easy to understand why this concern took hold in the medical community.

Unfortunately, several pharmaceutical companies used this concern to their advantage. They began to market – extensively and ubiquitously – pain medication like OxyContin, Percocet, and other opioids to doctors as a solution to chronic pain. This was done even though there was very little evidence to support using these opioids for long-term pain, despite the effectiveness of their use for short-term, acute pain.

Use of the opioid painkillers flourished, with prescriptions for those with chronic pain multiplying year over year. Sadly, the drugs were not only in the hands of the patients for whom they were prescribed – they were available to any teen that had access to their parents’ medicine cabinet, friends and family with whom the drugs were shared, and illegally on the streets.

Finally, officials began to take note of the rise in opioid abuse, addiction, and overdoses, and they started to crack down on painkiller prescriptions. Doctors were threatened with losing their medical licenses and even incarceration if they failed to prescribe opioids responsibly. This new scrutiny forced many doctors to stop prescribing opioids so freely and to review patients’ medical records for indications of past drug abuse before prescribing.

Unfortunately, many patients were already addicted. When they could no longer refill prescriptions for their painkillers, they turned to cheaper, stronger opioids like heroin and fentanyl.

Though this scenario is not consistent among all opioid users, it was the case for many. In a study reported on by the Journal of the American Medical Association, it was found that many prescription painkiller patients were moving on to heroin. Additionally, an analysis by the Centers for Disease Control and Prevention in 2015 found that people who become addicted to painkillers are 40 times more likely to become addicted to heroin.

Those statistics shouldn’t lead us to believe that regulating the prescription of opioid painkillers was a mistake. It has had some beneficial results – while opioid deaths as a whole have increased, the rise in the number of deaths due to prescription opioids has slowed. It may also have prevented a whole new generation of pain sufferers from becoming addicted.

Are There Any Solutions?

Clearly, the best solution for current opioid addicts is to get them into treatment and hope for successful recovery. However, in a 2014 report, it was determined that 89 percent of individuals who meet the criteria for a drug abuse disorder diagnosis did not receive treatment. There are many factors that contribute to that statistic, including denial on the part of the drug abuse, financial issues, and concern about the stigma associated with drug addiction. Many people with drug abuse disorders also complained about the accessibility to treatment and long waiting periods for care.

Other solutions, or at least improvements, include:

Improving opioid painkiller prescribing to reduce the overall exposure to opioids, prevent potential abuse, and decrease addiction.

Expand access to treatment for those suffering from substance abuse disorders.

Increase the access and use of naloxone, an antidote that can reverse opioid overdose.

Work with state and local public health agencies, medical examiners, and law enforcement to improve the detection of trends regarding illegal opioid use.

Work to reduce the stigma of addiction with education, communication, and awareness.

Finding the Right Treatment

While we wait to see what the outcome of the lawsuits in Ohio is, the focus needs to be on treatment and recovery for opioid addicts. The relapse rates for heroin and other opioids is very high, making long-term, the intensive treatment necessary in most cases. Air Filtration, Energy Savings And Good Health

And the EPA has found that a growing body of scientific evidence has indicated that the air within homes and other buildings can be more seriously polluted than the outdoor air in even the largest and most industrialized cities.”

Why is that something you should worry about? Because most of us spend 90 percent of our time inside an office, home or other types of workplace, and that means we are continuously exposed to pollutants than can affect our long-term health.

That’s why air filtration is such a vital part of protecting your health, especially at commercial facilities where workers toil eight hours or more per day. This article provides some important takeaways from Camfil’s recent presentation at the 2017 Premier Breakthrough Conference in June, that can help you understand some of the challenges and solutions in improving air quality throughout the world.

Camfil’s 50-Year Commitment to Commercial Air Filtration

One of the key takeaways from the Premier Breakthrough Conference was the years of commitment that Camfil has made to the commercial air filtration industry.

Camfil is one of the leading commercial air filter companies in the world. It was established in 1963 and has been manufacturing high-efficiency air filters and air purifying products that are designed to provide improved indoor air quality, save energy costs and provide years of service.

Camfil is a global, privately held company that is 100 percent dedicated to the air filtration market. In 2017, the company anticipates $750 million in sales and is well positioned throughout the world with 26 manufacturing plants, six research and development centers, and more than 4,000 employees.

Camfil operates under the principle that ‘Clean Air Is a Human Right,’ which refers to the fact that the World Health Organization (WHO) recently reported that, 98% of cities in low-and-middle income countries with more than 100,000 inhabitants do not meet WHO air quality guidelines. However, in high-income countries, that percentage decreases to 56%”, (2) still a significant if not surprising number.

Clearly, developing countries are not playing on a level field, and in fact, some of these larger nations such as India and China are only now beginning to develop clean air solutions such as a shift to clean energy to reduce their level of toxic emissions.

Given these challenges, Camfil has a three-fold mission:

Comfort Air – the goal with ‘Comfort Air’ is to protect people by improving IAQ within the indoor facilities they most frequent, such as malls, shopping centers, retail shops, restaurants, and hospitals.

Clean Process – the goal with ‘Clean Process’ is to improve industrial and medical processes where airborne contaminants can jeopardize the desired output, either a quality product or a healthy individual.

Safety & Protection – the goal with ‘Safety & Protection’ is to protect the environment by eliminating harmful airborne pollutants and gases that may cause serious immediate damage to the environment or people.

Reducing the Total Cost of Air Filtration

Another takeaway from the conference was Camfil’s goal of reducing the total cost of air filtration for commercial facilities.

One of the main ways to lower the costs of air filters is to build filters that do not require frequent replacement. The average commercial air filter is made to last only several months before it has to be replaced.

In the commercial air filtration industry, these are known as ‘sacrificial’ air filters, because their purpose is to provide short-term use at low-cost prices.

The problem with sacrificial air filters, however, is that you will need to replace them three or four times a year, and in a commercial facility, the cost of multiple installations can start to add up.

Camfil’s solution is to make filters with a lifespan of as many as two years, which drastically lowers costs by limiting installation expenses and lowering energy costs by providing filters that remain efficient for a far longer period of time.

In fact, Camfil offers Life Cycle Cost (LCC) software that analyzes future costs of owning its air filters compared to owning standard air filters.

The latest version is known as LLC Green, which allows you to compare air filters based on filter efficiency, filter life, filter change labor, filter cost, and disposal costs. Once all these factors are input, the software produces a life cycle cost for the selected filter, which gives you real-world expenses based on the type of filter you select.

Air Filters and Energy Savings

Camfil’s presentation also pointed out the direct correlation between air filters and energy savings at a commercial facility.

As previously discussed, using standard air filters typically results in multiple changes, which increase the cost of filter ownership. But there is another aspect of cost savings related to the heating, ventilation and air conditioning (HVAC) system at a commercial facility.

The typical breakdown of energy costs at a commercial facility is:

25.9% of costs are due to fans

24.2% of costs are due to steam for heating

18% of costs are due to miscellaneous equipment

15.6% of costs are due to lighting

11.5% of costs are due to cooling

2.6% of costs are due to HVAC pumps

The fans, cooling, pumps, and steam for heating are all part of HVAC system, which means 65% of energy costs at the average commercial facility are directly related to HVAC.

Camfil filters are able to maintain proper airflow and are made so that the HVAC system doesn’t have to work as hard to draw air through the ducts and vents. This means less energy is expended, resulting in monthly savings.

Mobile Air Quality Testing

Another important highlight of the presentation was Camfil’s ongoing commitment to using mobile laboratories to test the efficiency of theirs and even competitors’ air filters, and to test the ambient air quality specific to that location.

How A High-Efficiency Air Filter Could Save Your Life

When you hear the term ‘high-efficiency air filter’ what do you think? Like most people, you probably think of hard-working filters that can improve the air you breathe, and that’s true. But do you understand how a filter achieves high-efficiency? Or what that phrase even means?

This is important because without understanding the basic standards of air filter efficiency, you won’t understand how to shop for the best filters, or what the terminology companies often use really means. With that in mind, let’s look at how high-efficiency filters are measured, and why they are so important in the fight to improve indoor air quality.

Explaining the MERV Standard

Explaining the Minimum Efficiency Reporting Value (MERV) standard is a good place to start because this is the standard established by the American Society of Heating Refrigeration and Air Conditioning Engineers (ASHRAE), which oversees the air filtration industry.

According to the National Air Filtration Association (NAFA), MERV is based on a scale from 1 to 16 and measures an air filter’s capacity to trap particles from the air based on three different size ranges.

Within each of these three size ranges, there are four sub-ranges, so air filters are really measured against a total of 12 different size ranges. The 16-point scale works in ascending order, so the higher the MERV rating, and the greater the efficiency of the air filter. (1)

The problem with the MERV standard is that the measurements don’t follow strict logic. For example, you would assume that an air filter rated a MERV 8 would capture 50 percent of all airborne particles, but a MERV-8 filter is only rated to trap about five percent of harmful particles.

That’s because the 16-point scale doesn’t work in exact accordance with logical percentages, so it’s difficult for consumers to know just how efficient their air filters are based on the MERV point system.

The New ISO 16890 Standard Changes the Game

This confusion regarding MERV is not the only reason air filter efficiency ratings are difficult to understand. Another reason is that the U.S. is on a different standard than countries in Europe, which means consumers cannot make valid comparisons about air filter efficiency.

That’s why the new ISO 16890 Standard changes the game for consumers and manufacturers of air filters.

It levels the playing field so that consumers can now judge every air filter manufacturer based on the same set of standards throughout the world.

According to the International Organization for Standardization (ISO), ISO 16890 is the first high-efficiency air filter standard based on a filter’s ability to trap particulate matter (PM) consistent with values published by air quality authorities, pollutants identified as the most harmful to human health. (2)

According to the Centers for Disease Control (CDC), PM is created from a variety of sources such as vehicle exhaust emissions, power plant emissions, coal-burning and wood stoves. (3) Long-term exposure to PM has been linked to eye irritation, difficulty breathing, lung cancer, and heart disease.

The new standard measures how well air filters trap PM10, PM2.5 and PM1 levels, so unlike previous standards, there are only three size ranges and three pollutants being measured.

The 10, 2.5 and 1 designations refer to the diameter of particulate matter in micrometers, and these three sizes are the most harmful because their microscopic size makes them easy to swallow or inhale.

“The new ISO 16890 standard is a game-changer for the air filtration industry,” stated Kevin Wood, Camfil USA Vice President Sales & Marketing. “Until this point, there had never been a global standard for high-efficiency air filters. Therefore, air filter consumers could not decide which filter was superior, because different countries were operating under different standards. With ISO 16890, consumers can make valid comparisons between air filters, especially since PM remains the biggest health threat to indoor air quality.”

Particulate Matter Prevention Methods

The fact that high-efficiency air filters are now being measured based on PM is important because these pollutants pose the biggest risk to human health.

Some of the PM prevention methods you can take include:

Checking the U.S. Environmental Protection Agency (EPA) Air Quality Index – this is a daily listing that tells you the air quality in your area, and how harmful it could be, especially to people with respiratory problems such as asthma.

Limit outdoor activities on days when PM levels are elevated.

Limit the time you spend on busy streets to lower your exposure to vehicle emissions

Invest in high-efficiency air filters using the ISO Standard to ensure you are removing the most harmful particles of concern.

According to Ohio State Fair organizers, the fair brings in massive crowds. Each year, the event attracts about 920,000 people. Organizers also claim that the rides are inspected prior to the fair opening to the public. The chief inspector told CNN, “It was inspected at a couple of different stages and it was signed off today.”

CNN reported that a similar ride in California was shut down when local authorities inspected it a second time.

How Often Do Amusement Park Accidents Happen?

Amusement parks are big business, especially in the United States. You need look no further than Disney World to see how the U.S. has become the go-to destination for big thrills and themed fun. Drug Use In America: The Shocking Truth

The 2015 National Survey on Drug Use and Health is the most recent big-picture study about drug use in America and provides a revealing look at popular drugs of choice and demographics related to drug users. It also analyzes alcohol use in the U.S. Here are some of the key takeaways from this comprehensive report.

Illicit Drug Use Is Rampant Across All Major Age Groups

More than 27 million people age 12 or older in the U.S. are users of illicit drugs. But what’s even more staggering is that 10 percent of the U.S. population that is 12 years or older admitted to using illicit drugs in the month prior to the survey. (1)

Worse yet, more than two million adolescents age 12 to 17 use illicit drugs in the U.S., and nearly 23 percent of young adults in the 18 to 25 age group were drug users. An additional 17 million adults 26 or older used illicit drugs within the past year.

What this tells us is that illegal drug use is growing in all segments of the U.S. population, a terrifying prospect if even a quarter of these people turn out to be addicts who require a comprehensive drug treatment program in the future.

Marijuana Remains a Preferred Drug of Choice

Not surprisingly, marijuana remains a popular drug of choice, with an estimated 22 million people in the country using the drug on a regular basis. In fact, marijuana use has trended upward from 2002 to 2013, with a brief downturn in 2014 that was followed by another spike in 2015.

Undoubtedly, part of the reason marijuana use is steadily increasing is that many states have decriminalized or legalized marijuana use for recreational purposes or for medicinal reasons.

The negative perception of marijuana as an illicit drug has markedly decreased over the past decade.

Many people who smoke marijuana don’t even refer to it as a drug because marijuana is not considered to be a narcotic that is as dangerous or addictive as cocaine, heroin or prescription painkillers such as opioids.

As a result, marijuana use has become much more socially acceptable among most age groups, an activity that is considered as normal as smoking a cigarette.

Prescription Pain Reliever Misuse Is On the Rise

The existing opioid crises in states such as Ohio have publicized the abuse of prescription pain relievers. And the 2015 survey confirmed this trend, with nearly four million people 12 or older abusing prescription pain pills.

Part of what is driving opioid abuse in many states is the fact that pharmaceutical companies have downplayed or mislead users about the highly-addictive nature of these drugs. In some instances, drug companies have incentivized their representatives to wine and dine physicians in an effort to persuade them to prescribe painkillers to their patients to drive up profits. (2)

But as millions of people have become addicted to these pain killers, drug companies have continued to insist that the drugs are safe if used in moderation.

Binge-Drinking Is a Huge Problem

The survey also found that binge-drinking has become a huge problem for a large segment of the population.

For example, nearly 67 million people age 12 or older in the U.S. admitted to binge-drinking (5 or more drinks at one time for males, 4 or more drinks at one time for females) in the previous month, and 17 million admitted to heavy alcohol use during that same time period.

Binge-drinking often occurs at house parties, raves, and clubs in which drinking heavily is part of the social contract participants make when they agree to attend. In addition, a party-all-the-time culture has taken over many college campuses in the U.S., leading to incidents of high alcohol use, violence, and sexual assaults.

But of even greater concern is that a staggering 138 million people in the U.S. age 12 or older admitted to current alcohol use in the month prior to the survey.

Underage alcohol use is a persistent problem despite the fact that every state restricts alcohol consumption to people who are 21 or older.

The Need For Long-Term Solutions

Drug use in America is trending upward, and illicit use is starting at a much younger age than in the past.

Some of the respondents in the 2015 survey may never turn into addicts, but many will, and they will need access to drug detox facilities that can also provide in-house and outpatient counseling to ensure long-term recovery.

14 Yr Old Killed By Distracted Sister Says Boca Car Accident Lawyer Joe Osborne

Her eighteen-year-old sister was behind the wheel, videoing her driving when the accident occurred in July. Obdulia Sanchez was driving a car in Merced, California, and live streaming on Instagram when she veered onto the shoulder and over corrected. Another fourteen year old was in the back seat of the car. He survived the crash with a leg injury. The driver was using a seat belt but not the passengers in the car.

The day after the accident Sanchez was arraigned on six felony charges, including gross vehicular manslaughter and drunken driving resulting in injuries. Police report that Sanchez called first responders who came to the scene racial slurs and spit on them. She is accused of kicking a paramedic in the face and she was later strapped to a gurney. Sanchez also refused an alcohol screening test at the scene. Officers state she smelled strongly of liquor and hospital records show she was legally drunk.

The video shows what happened before the accident, including Sanchez removing her hands from the steering wheel and singing, as well as the aftermath. After a gap in the video, she is visible over her sister’s body, shaking her and telling her she was sorry. “Wake up baby, I’m [expletive] sorry, baby, I did not mean to kill you, sweetie,” Sanchez said.

Drivers like Obdulia Sanchez are not only found in California.

The National Highway Traffic Safety Administration (NHTSA) estimates that 3,477 people were killed in accidents involving distracted drivers in 2015.

EverQuote Inc., an online insurance firm, released a study in April showing Florida ranks second only to Louisiana for distracted drivers, reports the Sun Sentinel. Drivers were given scores based on a motion sensing smartphone app. The state’s drivers got the second worst score for driving while distracted. The EverDrive app logged 2.7 million vehicle trips and 230 million miles.

An estimated ten percent of high school students drink and drive, according to the federal Centers for Disease Control and Prevention. They report drivers aged sixteen to twenty are 17 times more likely to be killed in an accident if they have a blood alcohol concentration of 0.08% compared to if they have not been drinking. Though the percentage of high school teens who drink and drive has decreased by more than half since 1991, it’s estimated that nearly a million teens got behind the wheel after drinking alcohol in 2011.

Lawyer Discusses Supreme Court Rejecting Electronic Logging Devices Challenge

The issue of electronic logging devices (ELDs) has been a hot button topic in the trucking industry for the past few years.

Safety advocates say that switching to computer-based logs will reduce semi-truck wrecks by making sure drivers are obeying driving laws and getting enough sleep before hitting the road. But, leaders of the trucking industry claim that ELDs won’t do anything to keep drivers safer.

The federal government is requiring all semis to have an ELD by December 18, 2017, but that hasn’t stopped the trucking industry from pushing back against the new regulation.

Recently, the U.S. Supreme Court declined to hear a challenge to the ELD mandate, which was upheld in a lower federal court. According to media report, the decision to decline to hear the case is the end of the road for the Owner-Operator Independent Drivers Association (OOIDA), which brought the challenge.

Truckers’ Group Says It Will Pressure Congress to Change the ELD Rule

The media also reports that the OOIDA will go to Congress in hopes of persuading federal lawmakers to roll back the ELD mandate. Although the group hasn’t released any specifics for how it plans to push lawmakers for change, some have speculated that it might lobby for new legislation that amends the mandate.

The OOIDA’s position is that the ELDs pose an unconstitutional intrusion of truck drivers’ Fourth Amendment protection against unreasonable searches and seizures. The federal courts have overwhelmingly rejected this argument.

The Seventh Circuit Court of Appeals declined to review the challenge, and the U.S. Supreme Court failed to grant certiorari, which means it will not review the lower court’s decision to uphold the ELD mandate.

Safety Groups (and Even Some Truckers) Believe ELDs Will Save Lives

Those who advocate for ELDs say they offer a number of benefits, including cutting down on costly truck idling, reducing accidents, and making logs more accurate.

The Federal Motor Carrier Safety Administration (FMCSA) has released data that says trucks with ELDs installed have a crash rate that is 11.7 percent lower than trucks without the devices.

Trucks with ELDs also have 53 percent fewer violations. All in all, the FMCSA estimates that ELDs will save approximately 26 lives and prevent 562 injures every year.
