Minor Falls Can Cause Major Problems Says Philadelphia Slip And Fall Lawyer

It started simply enough. Guy Leach was leaving his apartment, walking down a flight of stairs when one of them collapsed causing him to tumble down the remaining steps. Leach, a member of the Air Force, thought he sprained his ankle. Instead his injuries resulted in permanently disabling him and ending his military career, reports The Oklahoman. Leach achieved a life-long dream after high school when he became an aircraft mechanic for the Air Force. That career lasted 18 years and was ended by the effects of an injury he suffered on the stairs of his Oklahoma apartment building in 2012. A step of the concrete stairs collapsed, causing him to fall down a few steps.

He thought he just sprained an ankle but the injury ended up causing complex regional pain syndrome (CRPS) which affects the nervous system following an injury. Symptoms can include constant and severe pain, joint stiffness, swelling, discoloration, changes in skin temperature, muscle weakness and spasms. Leach has had various treatments, including physical therapy and more than a hundred nerve injections to block his pain. He told the newspaper the treatments are a temporary help because there is no cure for CRPS. The focus of his treatments is to manage pain that will never go away.

Leach continued to be a part of the Air Force until 2015 when he was medically retired and honorably discharged. Leach has military health insurance and collects disability pay but can’t collect retirement benefits because he wasn’t in the Air Force for 20 years. Due to his condition and medications he’s not allowed to work on civilian aircraft.

A year after his fall Leach sued the owner and manager of his apartment complex. In April after a jury trial in Oklahoma City Leach was awarded $12 million in damages ($6 million in actual damages and $6 million in punitive damages). The defendants are appealing the decision. Defendants offered $1.25 million to settle, Leach was willing to take $4 million. No settlement was reached and the case went to trial.

The jury found the defendants acted in reckless disregard of the rights of others. Leach claimed the defendants were negligent by failing to maintain the exterior stairs Leach used, which resulted in the stair’s collapse and caused his injury. The judge in the case found defendants failed to preserve evidence concerning the inspection and repair of the property.

Leach uses a custom made brace to help him get around. He said the condition has spread to both knees. While before the injury he said he was “really into fitness” often hiking and camping with his wife, “Now it’s the exact opposite.”

What Does It Mean When a Federal Court Affirms a Lower Court?

In a federal criminal appeal, the appellate court doesn’t hear the entire case all over again. This is a common misconception people have—that an appeal is like a “second chance to get it right.”

Although an appeal can be like a second chance, the court doesn’t start the trial at the beginning and replay every step. Instead, the federal criminal appeals court only considers the parts of the case the appealing party claims the lower court got wrong. In some cases, it’s a specific piece of evidence the appealing party feels should have been excluded. In other cases, it might be the sentencing handed down by the lower court.

For one of the defendants in the Making a Murderer series, the federal criminal appeal court was asked to uphold the lower court’s decision to overturn his criminal conviction for sexual assault and murder. At the time of the alleged crime, which took place in 2005, the defendant was just 16 years old. He confessed to the crime when investigators questioned him, however, his federal criminal appeals lawyers have argued that a variety of factors, including his intellectual disabilities, led him to make a false confession.

The appellate case turned on whether the investigators involved in the case made “repeated false promises” that “when considered in conjunction with all relevant factors, most especially [the defendant’s] age, intellectual deficits and the absence of a supportive adult, rendered [his] confession involuntary.”

In 2016, a federal judge held that the defendant’s confession was involuntary. The federal criminal appeal court agreed, calling the confession a produce of coercion through fact-feeding, false promises, manipulation, and leading questions.

According to an NPR report, the state of Wisconsin can choose to appeal the case to the U.S. Supreme Court. Alternatively, the state could decide to try the defendant again in a new trial.

Human Microbiology Institute: Bacteriophages May Cause Neurodegenerative Diseases

Viruses called bacteriophages affect bacteria that populate mammal gut environment and may cause human diseases, according to the  Human Microbiology Institute (HMI).  The revolutionary findings were revealed today during an oral presentation at the largest European microbiologist gathering, FEMS-2017 in Spain. 

The study describes bacteriophages as a new group of Human Viral Diseases and was presented by Dr. George Tetz, head of research and development at HMI. “They are focusing on a very important subject, showing the consequences of bacteriophages effect on human gut microbiome. They have shown for the first time that the impact of bacteriophages may result in increased gut permeability, which is associated with diabetes, Alzheimer’s, autism, heart conditions, rheumatoid arthritis and others. This could pave the road to further breakthrough research and new discoveries related to the origin of many diseases,” said Adriana Heguy, Ph.D., Professor of Pathology, NYU Langone Medical Center, and Director, Genome Technology Center.

The HMI’s high-profile study looked into effects of exposure to bacteriophages on gut microbiome and intestinal permeability in rats. It showed – for the first time– that bacterial viruses, which exist both in the environment and in the human gut, and were previously considered to be safe for humans, can lead to a pathological condition known as the “Leaky Gut Syndrome”. In turn, leaky gut results in an altered immune response and triggers a variety of currently incurable human pathologies including those associated with neuroinflammation. The HMI’s results showed increased gut permeability accompanied with reductions in Lactobacillus spp. and Faecalibacterium spp., the useful bacteria for mammals and in other bacteria groups.  For the first time a research study showed how bacteriophages could produce conditions that may cause the above-mentioned diseases.

The HMI conducted its work together with NYU specialists; the study was accepted for publication by Nature magazine’s Scientific Reports under the “Bacteriophages as possible new mammalian pathogens” title. Previously, George and Victor Tetz published their findings in Gut Pathogens. 

 “As far as we know, this is the first study to indicate that bacteriophages can cause human diseases. Infection from bacteriophages that are known solely to target bacteria may be harmful to mammals and humans, opening new ways to prevent and cure the neurodegenerative diseases, diabetes and other diseases with so-called autoimmune component,” said Dr. George Tetz.    

HMI researchers have also said that one of the mechanisms of spreading many diseases may be the fact that bacteriophages can be found almost anywhere, from the ocean to everyday meals.  They say infection of human microbiota by bacteriophages can be considered a new class of viral diseases in mammals.

A Bright Future Ahead For UK Buy-To-Let

On interest rates:

“Given the uncertainty of everything Brexit, Trump and North Korea-related, the Bank of England (BoE) knows it needs to achieve economic harmony as best it can, so a big jump in interest rates is unlikely to happen in the near future.”

 

On housing:

“In the last economic crash, huge numbers of people were forced out of house-building trades. This means that, even if the government could put the structure in place to build, there are not enough people to do the work.

For this reason, housing will continue to be in short supply, house prices will be out of reach to many and rental property will be in demand.”

 

On the 3% stamp duty levy:

“Landlords run property investments as a business, just like any other business owner across the UK. A business has to make profit to be worthwhile. If costs to offer a service go up and demand for the service is sustained or heightened, a business will up the cost of the service to its clients.

 

Buy-to-let is the same.

 

The government has not helped tenants by increasing stamp duty tax to landlords, they have simply increased the rent bill.”

Pennsylvania’s Heroin Epidemic Hits Its Most Vulnerable – Newborns

It’s not news that Pennsylvania is in the throes of an opioid epidemic that is claiming thousands of lives each year and ever-increasing as time passes. It is known as one of the hotbeds of the epidemic and is deemed by the state’s drug and alcohol secretary as “the worst overdose crisis in the history of humanity.” The opioid drug problem in Pennsylvania affects everyone, including women. In fact, the Center for Disease Control (CDC) has reported that heroin use among the women in Pennsylvania has more than doubled since 2002. With statistics like those, it isn’t hard to believe that the horror of opioid addiction has made its way to the state’s most vulnerable residents – newborn infants.

In a report by the Pennsylvania Health Care Cost Containment Council (PHC4), it is shown that there is a 250% increase in the last 15 years of the number of newborns who require specialized care due to the drug use of the mother. Addiction to opiates caused more than 80% of those cases. This is an extremely costly problem. In the year 2015 alone, addiction-related postnatal hospital stays accounted for a whopping $20 million and an additional 28,000 days in the hospital.

However costly though, the effects of heroin and other opioid drugs on newborns is far more terrible. Withdrawal from any substance can be uncomfortable and unpleasant, but heroin withdrawal is one of the worst experiences an addict can face. Adults who go through heroin withdrawal are able to understand what is happening and know that it is to their benefit to be going through it and that it will end. Newborn babies certainly are not able to do that.

Babies whose mothers abused heroin during pregnancy are subject to some serious medical conditions and withdrawal symptoms. Some of those include:

Miscarriage and Stillbirth – The death of an unborn baby before the 24th week of pregnancy is considered a miscarriage, and after the 24th week is considered a stillbirth. Both types of fatalities can be caused by heroin use during pregnancy.

Placental Abruption – This occurs when the placenta separates from the uterine wall before the mother goes into labor. It is commonly caused by smoking, drinking alcohol, or abusing drugs during pregnancy. Placental abruption is not usually fatal, but it can cause developmental problems in the child.

Low Birth Weight – A baby that weighs less than five and a half pounds at birth is considered to have a low birth weight. Some low birth weight babies have serious complications like respiratory problems, heart problems, digestive tract issues, vision problems, and brain bleeds. Additionally, low birth weight can lead to future problems for the child including diabetes, heart disease, hypertension, and obesity.

Brain Damage – Babies with mothers who abused heroin during pregnancy may be born with brain damage that is irreparable.

Developmental Problems – Heroin use during pregnancy can affect an unborn baby’s central nervous system, which can lead to developmental delays and poor academic performance later in life.

Premature Birth – If a baby is born before the 37th week of pregnancy, it is considered a premature birth. Heroin addiction can cause premature birth and lead to respiratory issues, trouble maintaining a stable body temperature, and trouble eating and drinking. Sometimes the baby’s internal organs are underdeveloped and he or she will require ongoing medical care for an extended period of time.

Neonatal Abstinence Syndrome – Neonatal abstinence syndrome (NAS) refers to several complications that affect babies born to mothers who used opioids while pregnant. The drugs are passed to the unborn baby through the placenta and the baby becomes dependent on them. When the baby no longer receives the drugs after birth, it will suffer withdrawal symptoms that include:

Blotchy skin

Fever

Diarrhea and vomiting

Rapid breathing

Sweating

Trembling

Seizure

Babies that are born with NAS are often premature, with a low birth weight and smaller than normal body size. They must be detoxed from the opioids gradually and using medication. Withdrawal symptoms typically begin 24 to 48 hours after birth and can last for up to six months or more.

Microcephaly – This refers to a small head circumference, and it usually means that the baby’s brain is not developing correctly.

Sudden Infant Death Syndrome (SIDS) – SIDS is the unexpected and sudden death of a child that is less than a year old. While autopsies do not show an explainable cause of death, babies who are born to mothers who abused drugs or alcohol during pregnancy have a higher rate of death due to SIDS than those born to women who did not use drugs or alcohol during pregnancy.

Babies who are born addicted to heroin require a carefully managed medical care regimen and monitoring, typically in a neonatal intensive care unit. They may have to be given small doses of opioid medication and be tapered off to prevent the withdrawal symptoms from becoming too risky. They may require a hospital stay of a month or more.  

Ending heroin and another opioid addiction in newborns has to start with the prevention of addiction in the mothers who carry them. Pennsylvania’s law enforcement, healthcare, and government officials are trying to keep up with the opioid crisis that is taking over the state. Some of the actions that have been taken in accordance with the battle against opioid abuse in Pennsylvania are:

Pennsylvania’s 2016-2017 budget earmarks $15 million for the development of PA treatment centers and improvement of treatment options.

In July 2016, the Pennsylvania boards of pharmacy, medicine, and dentistry approved all or parts of new opioid prescribing guidelines that seek to curb some of the overprescribing of painkillers that have helped fuel the opioid problem.

In October 2015, Pennsylvania Physician General Dr. Rachel Levine signed a standing order for the opioid-blocking drug naloxone, which can reverse an opioid overdose. The standing order means that anyone can purchase naloxone at pharmacies without a prescription.

PA’s Act 139 or “David’s Law” permits firefighters, EMS staff, and law enforcement agents to administer naloxone to people overdosing on opioids. It also prevents anyone who reports or responds to an opioid overdose from being prosecuted by the law (also known as the Good Samaritan law).

With funding from insurance companies and grant money, Pennsylvania’s Department of Drug and Alcohol Programs has been able to supply over 300 PA police departments with naloxone. Surveys have shown that police are the first responder on the scene of an overdose about 70% of the time.

Unfortunately, even with the above efforts taking place, the federal Drug Enforcement Administration (DEA) has reported that there were over 4,600 Pennsylvanians who died from drug overdoses in 2016, an increase of 37%. The full report, “Analysis of Drug-Related Overdose Deaths in Pennsylvania, 2016,” will be released at the end of June.

A collision occurred with the truck, killing one. That accident resulted in the barriers coming off the truck, which led to a second fatal accident. The two that were killed were a high school student and a medical school student, according to the Sun Sentinel. In May the truck driver was arrested and charged with two counts of vehicular homicide and one count of reckless driving causing serious bodily injury.

The accident happened in a construction zone. Police claim the truck impeded traffic because it covered four lanes of I-75. The truck was hit by a sedan with so much force the vehicles traveled about a quarter mile before they stopped, killing the driver. Another vehicle swerved to avoid the truck, hit the trailer and one of the barriers fell onto the car, killing that driver. After these accidents barriers were scattered over the highway. A third accident was caused when a barrier was struck by a third car.

The unsecured load of one tractor-trailer, which hit another tractor-trailer, ended up seriously injuring the driver of a Toyota on Route 17 in Paramus, New Jersey, in February, according to WNBC. The driver of the first tractor trailer said his brakes locked while he was slowing down in the center lane because of traffic ahead. The truck came to a stop, the driver put on hazard lights and called for help.

Another tractor-trailer carrying steel beams weighing about 2,500 pounds each was traveling in the center lane and tried to avoid the truck but struck the back of the trailer. The steel beams came loose and spilled all over the northbound lanes. One of them went across the highway divider and struck the Toyota which was travelling in the opposite direction, demolishing the car and seriously injuring the driver.

Hazardous objects coming off commercial vehicles need not be as massive as Jersey barriers or steel beams to be dangerous. Often drivers will swerve to avoid much smaller objects falling off trucks, causing accidents and injuries.

John Helms, Dallas Fraud Defense Lawyer Discusses Insider Trading

The United States Supreme Court recently held that, if you receive inside confidential information about a company from a friend or relative, and if you use that to trade on the company’s stock, you can be convicted of criminal securities fraud if you knew the information came from an inside source, even if you did not give anything in return for the information. In other words, just getting and using the information is enough. You do not have to pay anything for it or promise anything in return for it, adds Dallas fraud defense lawyer John Helms.

In Salman v. United States, a Citibank employee who knew confidential information about the bank’s clients’ merger and acquisition plans passed on inside information to his brother, who then passed it on to his brother-in-law, Mr. Salman. Mr. Salman knew that the information was confidential and came from the Citibank employee. He used the inside information to make money trading stock. He was convicted of securities fraud and sentenced to spend three years in federal prison.

On appeal, Mr. Salman argued that he should not be guilty because he did not give anyone anything in return for the information. The Supreme Court disagreed.

Essentially, the Supreme Court held that the sense of satisfaction you get from giving a gift to a friend or relative is enough of a benefit to the person supplying the inside information. No other pay or compensation is necessary. By analogy, the court said that a person with inside information could not use it to trade stock and then give a gift of the profits to a friend or relative, and this is no different.

The Supreme Court’s ruling makes sense. The purpose of the securities laws is to protect the integrity of the securities markets so that no one has an unfair advantage. If people with inside information could pass it on to friends and relatives and they could feel free to use it to make profits from trading, they would get an unfair advantage, and the public would know that the securities markets were not a level playing field. This could reduce people’s desire to invest, which would hurt companies and the financial markets.

So, if you are at a party or a holiday gathering with the family, and a friend or relative happens to mention some inside information that could help you make you money in the stock market, don’t use it. Even though it was just a casual conversation, and even though you didn’t secretly pass the person a briefcase full of money, it is still illegal.

Improperly Loaded Cars Cause Accidents Says Boca Car Accident Lawyer Joe Osborne

The photo above was taken by the New Hampshire State Police who, like their Florida law enforcement colleagues, often deal with drivers who can’t pack enough into, onto or behind their vehicles. According to the Boston Globe New Hampshire State Police last month published a warning against over-packing vehicles after a state trooper pulled over the driver of this minivan which was practically covered by a variety of items (including a bicycle, lamps and furniture) strapped on by rope.

“Driving with items attached/strapped to your vehicle can be extremely dangerous for you and those driving nearby,” police wrote. “These objects can obstruct your view or even worse become unsecure and cause an accident.”

The driver was stopped on Interstate 93 North in Londonderry, New Hampshire, according to police. He received summonses for negligent driving and driving an uninspected vehicle. The vehicle was towed from the scene.

No matter the vehicle if items are outside, on the back of a truck, on a trailer or on the roof of a passenger vehicle, if the items fall off and onto a roadway, especially at highway speeds, it can cause an accident. A following vehicle may strike the item, or swerve to avoid it, causing it or other vehicles to crash.

If not done properly even items stored inside a vehicle can be a threat to safety. Consumer Reports states that:

You shouldn’t overload your vehicle by going beyond its load capacity (calculated by subtracting the vehicle’s curb weight (the vehicle’s empty weight) from its Gross Vehicle Weight Rating (GVWR, the maximum weight the vehicle can safely carry)). The load capacity includes passengers, cargo and weight of the gasoline in your tank.

Put the heaviest items as far forward and as close to the center of the vehicle as possible. This reduces the adverse impact on handling. If the greatest weight is in the back it may affect braking and steering of the vehicle.

Smaller items should be boxed to prevent them from flying around the vehicle. Large items should be strapped down using cargo anchors (if available). Large items in a trunk or in an SUV should be secure enough so they don’t shift, possibly hitting passengers or the driver or impact handling in an emergency situation.

Don’t pile items so high the driver can’t see what’s behind the vehicle. This is especially dangerous when the vehicle needs to reverse.

If you’re transporting a heavy load maintaining correct tire pressure in safe tires, which is always important, can be critical. Look at your tires before your trip. Look for sidewall bulges, tread damage, extreme wear, punctures or sidewall cuts. Additional weight puts additional stress on tires. If they’re already well worn a long trip with a heavy load may be too much for them to safely handle.
