The Risks of Teenage Drinking

The human brain is still developing until the mid-20s, and heavy drinking before that time can cause various problems. Drinking alcohol while the brain is still developing can damage brain growth and it is irreversible. Teens who drink are more likely to suffer from blackouts, loss of short and long-term memory, and alcohol poisoning than adults. All parts of the growing brain are affected negatively by alcohol, with memory being the most impacted. Additionally, a study done at the University of California, San Diego found that teens that drink routinely typically have damaged nerve tissue when compared to teens who don’t. It is believed that this can negatively affect boys’ attention spans and girls’ ability to understand and process visual information.

Because the brain (specifically, the serotonin regulation, which dictates balance and impulsiveness) becomes tolerant of the use of alcohol, individuals who begin using alcohol at a young age are likely to develop full-blown alcoholism at some time in their lives. In fact, according to another study published in Archives of Pediatrics & Adolescent Medicine of over 43,000 adults, 47% of those who started drinking at age 15 or younger became addicted to alcohol during their lifetimes, compared to only 9% of those who didn’t drink until at least 21 years of age. And, teenage drinkers are more likely to become susceptible to chronic, relapsing alcoholism at much younger ages than adults who abuse alcohol.

Rollover Accidents Often Fatal Says Boca Car Accident Lawyer Joe Osborne

Rollover accidents are “complex crash incidents” according to NHTSA and they can be particularly violent. The agency states the type of vehicle plays a significant role in causing the crash and other factors include the driver’s behavior, road and environmental conditions.

Vehicle type: Those with higher centers of gravity such as those that are taller and more narrow like SUV’s, pickups and vans are more likely to rollover if they’re involved in a single vehicle accident.

Speed: Fatal rollover crashes are more likely to involve fast moving vehicles. About 40% of fatal rollovers involved excess speed. Nearly three-quarters of rollovers causing fatalities happened where the speed limit was at least 55 miles per hour.

Alcohol: Nearly half of all fatal rollover crashes involve alcohol use by the driver.

Location: Rural roads, which are often undivided and lacking barriers are more likely to be the location of a deadly rollover. About three-quarters of fatal rollovers take place in rural areas where the speed limit is normally at least 55 miles per hour.

Routine driving: More than 90% of vehicles involved in fatal, single vehicle rollover accidents were engaged in routine driving maneuvers (going straight or negotiating a curve) at the time of the crash. NHTSA states this suggests that driver behavior (distraction, inattentiveness, speeding and impaired driving) can be a significant cause of rollover crashes.

Single vehicle crashes: Nearly 85% of rollover-related deaths are caused in single-vehicle crashes. Since most of these crashes and fatalities don’t involve other vehicles it appears driver behavior plays a significant role in rollover crashes.

NHTSA states that 95% of single vehicle rollovers accidents are “tripped” which happens when the vehicle leaves the roadway, slides sideways, digs its tires into soft soil or strikes an object like a curb or guardrail causing it to trip over. The rest of the rollovers mostly happen with top-heavy vehicles, often travelling at high speed and the driver tries to steer clear of a hazard of accident, causing the vehicle to roll over.

SCOTUS Might Hear Double Jeopardy Case

Double jeopardy is a subject most people have heard of but don’t always fully understand. According to news reports, the Supreme Court of the United States may be set to hear a double jeopardy case that originated in Texas.

The case involves a former contract electrician for a Texas school district who was accused of fraud and money laundering in federal court in 2011. After a mistrial, he pleaded guilty to a misdemeanor charge of failing to pay his taxes on time.

After the mistrial at the federal level, the state leveled charges against him — again for fraud and money laundering. Now, he is asking the Supreme Court to revise an exception to the double jeopardy rule that allows states to prosecute individuals for similar federal offenses, even after they have been prosecuted at the federal level.

What Is Double Jeopardy?

The Fifth Amendment provides that a person can’t be prosecuted twice for the same crime. This means that an individual can’t be prosecuted more than once after a conviction or acquittal. The Double Jeopardy Clause also protects against a person being punished twice for the same crime.

The Double Jeopardy Clause only applies to criminal cases, which means a person can be prosecuted for a crime, such as a murder, and still face civil penalties in civil court for causing damaged arising out of the same incident. In the case of a murder, for example, the person could still be sued in the civil system for wrongful death.  

What Is the Dual Sovereignty Doctrine?

The Texas case turns on what is known as the “dual sovereignty” doctrine, which holds that the federal government and the individual states are each “sovereign” over their own territories. Under this exception to the Double Jeopardy Clause in the Constitution, an individual can be prosecuted at the federal level, then again at the state level, even for the same criminal acts.

If dual sovereignty applies to a case, a person can even be punished twice — once by the federal government and once by the state — for the same offense.

The State of Texas has argued that it should be allowed to proceed with its prosecution because the federal case ended in a mistrial. The state also argues that the one count the former electrician pleaded guilty to — failure to pay his taxes in a timely manner — is a separate and unrelated offense from the fraud and money laundering charges.

The defendant has argued that, in his case, the state and the federal government are not truly separate entities because they cooperated in the prosecutions.

The Supreme Court has not yet determined if it will hear the case. If it does, the Court’s decision is likely to have a significant impact on the dual sovereignty exception to the Double Jeopardy Clause.

The feature can also be set to act like a gatekeeper by permitting only specific callers to come through while a user is behind the wheel.

According to an NPR report, eight people are killed each day in distracted driving accidents. Over 1,000 people are injured in distracted driving crashes. And at any given time on U.S. roads, about 660,000 people are using a phone while they drive.

Currently, the majority of states prohibit the youngest drivers from using mobile phones, but just 14 states have laws on the books that ban all drivers regardless of age from using handheld devices behind the wheel. Pennsylvania law prohibits drivers from sending or reading texts, emails, or messages. However, the law does not ban motorists from using a cell phone to talk.

More Accidents To Come Warns Philadelphia Motorcycle Accident Lawyer Rand Spear

Motorcycle accidents are far too common in Pennsylvania and New Jersey.

In Fair Haven, New Jersey, three people were hospitalized after an accident involving a car and three motorcycles last month. Local police reported the car collided with three motorcycles at a local intersection, according to NJ 101.5. The driver and two motorcyclists went to the hospital for treatment.

A motorcyclist was killed in Logan Township, in Blair County, Pennsylvania, after he was struck by a pickup truck earlier this month, according to WJAC. Police stated the motorcyclist was traveling north when the truck entered his lane in front of him, causing a collision. He was pronounced dead at the scene.

A passenger on a motorcycle was killed in a motorcycle crash in late May in Cumberland County, Pennsylvania, reports Penn Live. The motorcycle collided head-on with a sedan on Route 15 southbound at Route 581 in East Pennsboro Township. The motorcycle operator was sent to the hospital and was in critical condition. The sedan made a left turn in front of the motorcycle when the two vehicles collided.

An off-duty Bucks County sheriff’s deputy was killed in a motorcycle accident in May in East Rockhill Township, reports CBS Philly. 48 year old Keith Clymer was killed when his motorcycle hit a truck that turned into his path on Route 313. The truck driver lacked a valid driver’s license because it had been suspended through at least 2023 due to multiple convictions for driving while intoxicated. He was turning into his driveway at the time of the crash and reportedly smelled of alcohol at the time of the accident.

Many motorcycle accidents happen when a vehicle cuts in front of a motorcycle, often making a left turn through the lane with an oncoming motorcycle. If the vehicle driver is distracted, fatigued or under the influence of alcohol or drugs this may be the result of poor judgement or failing to make sure it’s safe to turn the vehicle.

A driver may see the motorcycle but misjudge its speed or distance because he or she isn’t used to driving around motorcycles, which because they’re smaller than other vehicles, may appear to be farther away or moving slower than they actually are.

Motorcyclists can improve their chances of being seen by always using their headlight and wearing bright clothing. The seriousness of injuries may be reduced if a helmet is worn along with protective boots, gloves and pants.

Pedestrian Struck Of The Road Says Boca Car Accident Lawyer Joe Osborne

Pedestrian accidents often involve people walking across streets and into the path of negligent drivers, but not always. Many pedestrians walking along the side of the road are struck by vehicles driven by those who are distracted, intoxicated, fatigued or simply not paying attention. One example is what happened in Englewood last month, according to WWSB. Maria Blanco-Taha was walking her dog in the grass along the side of Headley Road, facing oncoming traffic, when she was struck by a car driven by Kyle Dilley. He was reaching into the back seat of his car when he lost control of it, according to the Florida Highway Patrol. Blanco-Taha was taken to a hospital where she later died of her injuries. Dilley’s been charged with careless driving.

About 10% of all accidents involving vehicles and pedestrians happen off streets and highways, according to the National Highway Transportation Safety Administration (NHTSA). The agency estimates that in 2013 4,735 pedestrians were killed in accidents involving vehicles on or near a public roadway (not counting in parking lots and driveways) and another estimated 66,000 pedestrians were injured in traffic crashes across the country.

On average that year a pedestrian was killed every two hours and injured every eight minutes in vehicle accidents. If NHTSA estimates are correct that means about 470 pedestrians were killed and 6,600 injured in accidents that didn’t occur on a roadway.

Florida is an especially bad state when it comes to pedestrian accidents. In 2013 NHTSA states that in Florida there were a total of 2,407 fatal accidents, 501 of them involving pedestrians. Florida was second only to California in number of pedestrian accidents. It was also second behind Delaware in the pedestrian fatality rate per 100,000 residents.

State percentages of pedestrian fatalities compared to total traffic fatalities ranged from a low of 0.7% (North Dakota) to a high of 45% (District of Columbia) while the national average was 14.5%. Florida was 20.8%.

Nearly three-quarters of all pedestrian accident fatalities occurred in urban areas in 2013. In NHTSA’s list of cities with a population greater than 500,000 people Jacksonville ranked as the biggest Florida city at number 13 with a population of 835,508. It had a total of 33 pedestrian fatalities.

Slightly smaller San Francisco had 18 and slightly larger Indianapolis had 20.

Philadelphia is nearly twice the size of Jacksonville but had only three more pedestrian fatalities.

Chicago, more than three times the size of Jacksonville, had less pedestrian fatalities with 27.

If you’re walking you need to be vigilant of the traffic that’s near you. Face oncoming traffic so if it appears a vehicle may leave the roadway and towards you, you may have a chance to try to avoid it. Be especially careful when walking across driveways, entrances and exits to parking lots. Drivers may be more focused on reaching their destination than noticing pedestrians in their way.
