Report Makes Recommendations For Use Of Police Body Cameras

In recent years, there have been numerous high profile incidents involving allegations of police misconduct that led to the death of a suspect. In response, many police departments have started wearing body cameras that record their encounters with citizens.

But how should police departments police themselves when it comes to body cams? If each department has its own procedures and policies for when a body cam starts rolling, or which types of encounters should or shouldn’t be recorded, how do the courts make evidentiary decisions in police misconduct cases? Or criminal defense cases?

Recently, the National Association of Criminal Defense Lawyers released a report, “Policing Body Cameras: Policies and Procedures to Safety the Right of the Accused.” The report makes several recommendations for police departments that use body cams for their officers.

Report Gives 10 Recommendations for Police Body Cams

The report, which gathered opinions and advice on police body cameras from legal scholars, criminal justice experts, and other notable sources, makes the following recommendations:

Police departments should have clear policies that establish when cameras will start rolling. These policies should make it clear that the decision to start recording is never left up to the officer.
All video recorded during a police encounter should be stored for a specific period of time and long enough to allow the accused to gather evidence to support his or her defense.
An individual who has been arrested should be given prompt access to all videos recorded via police body cam.
Police departments’ body cam policies should be crafted in a way that’s designed to minimize misinterpretation of videos.
Police officers shouldn’t have access to the videos prior to preparing their reports.
Policies should prohibit the use of biometric technology in conjunction with the use of body cameras.
Police departments and investigators shouldn’t be allowed to view the video after the encounter for purposes of bringing additional charges against the defendant.
Adequate resources must be available to make sure officers have ongoing training in the use of body cameras.
Counsel should be given adequate time and access to experts to render effective assistance of counsel.
Independent, non-police agencies should be given control and access to all body camera footage.

The report states that these recommendations will allow police to use body cameras without infringing on individuals’ rights. According to the report, the adoption of uniform policies will also maximize body cameras’ use in “generating reliable criminal justice outcomes.”

Eberstein Witherite, LLP Awards 2017 Scholarships To Dunbar High School Students

During a special ceremony on May 25, 2017, Eberstein Witherite, LLP presented a total of 10 graduating students at Paul Laurence Dunbar High School in Fort Worth, Texas, with $1,000 and $2,000 checks as part of the law firm’s Making a Difference scholarship program.

“At Eberstein Witherite, LLP, we are proud to support students who display a commitment to outstanding academics as they seek to achieve their future goals,” stated Attorney Amy Witherite, founding partner of the firm. “This scholarship program is so fulfilling for us, because it is helping to further the dreams of young men and women who have made sacrifices in order to excel in the classroom and within their community.”

The Making a Difference Scholarship Fund provides financial assistance to students enrolled in undergraduate study in community colleges, trade schools and universities. The scholarship also includes students pursuing paralegal training, information technology, ultrasound techs and medical records personnel. Each scholarship recognizes students that have made a positive impact on their community and school, and have set an example for others to follow.

This year, the fund was originally intended for only five $1,000 scholarships, but after meeting the applicants, Amy found that she was unable to limit the recipients to just five deserving students. As a result there were 10 award recipients, with eight receiving $2,000 and two receiving $1,000, which was awarded to the two students with full ride scholarships.

“Having had the chance to sit down with these young men and women, I was blown away by their intelligence, passion and résumés,” Witherite added. “It seems as if every year, the bar is raised even higher, and as a result, we had to expand our awards to ensure that we helped all the worthy applicants pursue their dreams.”

This year’s winners included:

How Data Center Pollution Is Driven By Fossil Fuels And Insane Network Demand

As demands for network bandwidth continues to increase due to billions of online users, data center pollution has become a growing environmental concern. Although most people don’t really know where the power to stream movies or download videos comes from, the public does become aware of data centers when network grids overload and lead to a brownout.

Recent Data Center Statistics

As online activity has mushroomed to nearly unmanageable proportions, data centers have become the beating digital pulse that sustains networks throughout the world.

A piece on the Ciena website, (1)  shed some light on the proliferation of data centers, citing statistics that show there are more than 7,500 data centers in the world, with a third of them located in 20 of the biggest cities on earth.

Furthermore, data center construction is expected to increase by 21 percent through 2018, as demand for networks continues to grow.

In the U.S., California leads all states with more than 300 data centers, second in the world only to London, which has 337 data centers.

But the growth of data centers does not come without an environmental cost.

Data centers require power to operate, which means the construction of new power plants to keep these facilities running.

The National Resources Defense Council warns that,(2) “data center electricity consumption is projected to increase to roughly 140 billion kilowatt-hours annually by 2020, the equivalent annual output of 50 power plants, costing American businesses $13 billion annually in electricity bills and emitting nearly 100 million metric tons of carbon pollution per year.”

In fact, more than 40 percent of the entire operating costs of a data center are spent on the power needed to keep these facilities running. This includes the costs of cooling the equipment to prevent malfunctions.

Data Center Pollution

People who binge-watch their favorite streaming TV series are not often aware that the power to keep that streaming channel running has an environmental cost.

Per The Guardian, (3)  data centers throughout the world are contributing two percent of total global greenhouse gas emissions, which is nearly equivalent to the emissions from aircraft.

One example may help you understand how consuming content has a direct effect on the power necessary to keep that content streaming: Watching a 10-minute video of cute cats doing cute things on YouTube releases one gram of carbon dioxide into the atmosphere.

One of the lesser-known aspects about powering data centers is that many of the largest companies building the largest data centers fail to report fossil fuel usage in their emissions.

Per the Environmental Leader, (4) data centers such as those used by Google and Amazon, “underestimate fossil fuel usage by 30 percent or more, and thus have much higher emissions than they report.”

Lux Research estimated that Google’s massive data center in Berkeley County, South Carolina derives 62 percent of its power from fossil fuels, although the company reports fossil fuel usage at 35 percent.

Similarly, Amazon reports that its 23 data centers in Virginia only derive 35 percent of their power from fossil fuels, but Lux Research estimated that usage to be closer to 43 percent.

Why is this so important?

Because according to the Union of Concerned Scientists, (5) “coal plants are the nation’s top source of carbon dioxide emissions, the primary cause of global warming. In 2011, utility coal plants in the United States emitted a total of 1.7 billion tons of CO2. A typical coal plant generates 3.5 million tons of CO2 per year.”

Furthermore, fossil fuel burning is also a primary component of smog and pollution, and releases harmful pollutants such as sulfur dioxide, nitrogen dioxide, particulate matter (PM), and mercury.

Mindful of the public relations nightmare associated with using fossil fuels, some of the bigger companies such as Google are starting to invest heavily in clean, renewable energy, which provides some hope for the future as data center construction continues to grow.

Are You At Risk For A Drug Overdose?

Drug addiction doesn’t discriminate. People from all sorts of backgrounds and social groups are affected. Sadly, overdoses continue to spiral upward with each passing year. Study Identifies Characteristics of Those More Likely to Overdose

A study published in the Journal of General Internal Medicine analyzed 254 deaths of individuals age 18 and older. The purpose of the study was to attempt to identify which people are more likely to suffer an unintentional prescription drug overdose.

Researchers found that people with the following characteristics had a higher risk of overdosing on a prescription drug:
More likely to be middle-aged and Caucasian
Less educated
Unmarried
Reside in a rural community
In the year before their death, over 87 percent had been prescribed a prescription painkiller by a doctor
Over 31 percent had obtained painkillers from more than one doctor
More likely to have financial problems, a disability, or mental illness
More likely to smoke, drink, or use illegal drugs

The study also revealed that over 91 percent of the individuals studied had obtained the medication from a healthcare provider.

What You Can Do to Help

If your loved one, spouse, or friend is showing signs of a prescription drug addiction, don’t ignore it. Furthermore, these characteristics don’t always have to be present for someone to be addicted to prescription drugs. Just because you don’t observe any of the signs identified in the study doesn’t mean your loved one isn’t struggling with a prescription drug addiction.

If you believe someone close to you is misusing their prescription medication, don’t be afraid to speak up. Many addicts are too embarrassed or afraid to ask for assistance or to admit they have a problem. Detective Behind Seven Wrongful Convictions Faces Inquiry For Framing Defendants

It sounds like something out of a crime novel. Unfortunately, it’s reality. A New York Times report states that Louis Scarcella, an infamous New York City detective, is facing an inquiry into his past police work.

So far, Mr. Scarcella has not been accused of a crime. However, courts have overturned seven murder convictions brought about by his investigative work — and more could follow. In 2013, the Brooklyn district attorney’s office ordered a review of 50 murder cases Scarcella worked on throughout the 1980s and 1990s.

Inquiry Reveals Pattern of Unreliable Investigative Techniques

A closer look at dozens of Scarcella’s cases reveals what the New York Times has called “a disturbing pattern.” Throughout his career, evidence shows that Scarcella relied on the same eyewitness — a drug addict — over and over again across multiple cases.

In one case, a court overturned a conviction after the defendant had already spent 23 years in prison for allegedly murdering a rabbi. The New York Times reports: “[Scarcella and his partner] removed violent criminals from jail to let them smoke crack cocaine and visit prostitutes in exchange for incriminating [the defendant].” Another witness said that Scarcella told him who to choose in a police lineup rather than letting him select a person on his own.  

Despite never charging Scarcella with a crime or officially accusing him of police misconduct, the State of New York and New York City have paid over $40 million in civil claims stemming from his police work.

The article goes on to state that even if Scarcella was accused of a criminal act, the statute of limitations has most likely passed, which means he would not be subject to prosecution in connection with any of the cases currently under review.

Study Says 1 in 25 Death Row Inmates Are Innocent

The U.S. has the highest incarceration rate in the world. According to one study, 1 in 25 inmates facing execution is actually innocent. In 2015 alone, 149 people were exonerated and released from prison after having served time for a crime they didn’t commit. In 2014, there were 139 exonerations. And in 2015, an astounding 40 percent of the exonerations involved official misconduct.

Should You Be Concerned About the Safety Of Your Child’s Rear Seat?

The Digest of Motor Laws published on the American Automobile Association (AAA) website, states that all 50 states have a child restraint law, with a majority of these states requiring child rear seats for children between birth and the age of 6.

Despite the fact that child rear seats have significantly reduced injuries and deaths caused by car accidents, there is growing evidence that the consequences of some types of car wrecks may be worse in these seats.

“No one would argue against the statistics that show how effective child safety seats have been when it comes to protecting kids from injuries and death,” stated Car Wreck attorney Amy Witherite of Eberstein Witherite, LLP. “But what we’re finding out through safety crash tests is that there may be some real danger in where parents place a child’s rear seat.”

In fact, according to a piece on Autoblog written by Pete Bigelow, the Center for Auto Safety (CAS) has issued a report that urges parents to understand the dangers of placing a child rear safety seat directly behind an occupied front seat.

Bigelow quotes CAS Executive Director Clarence Ditlow who said:

“While the rear seat is the safest location for a child, it is safer still if the child is placed behind an unoccupied front seat or behind the lightest front-seat occupant.”

Ditlow said that this recommendation is based on studies that have found that the backs of some front seats tend to collapse in a rear-impact car accident. And when the car wreck occurs at a speed that exceeds 30 miles per hour, the front seatback can smash into children in rear safety seats, causing fatalities.

From 1990 to 2014, 900 children in rear safety seats were killed in rear-impact car accidents where a passenger occupied the front seat.

Although there is not enough information known about these deaths to confirm that they were all directly caused by the collapse of the front seatback, Ditlow believes that the National Highway Transportation Safety Board (NTSB) should investigate the exact cause of those deaths.

“Until cars on the American highway are equipped with adequately strong front seats and seatbacks, children in rear seats behind occupied front seats will continue to be in danger of death or severe injury from front seatback failures in rear-end impacts,” stated Bigelow.

So Where Do I Put The Seat?

Even prior to the findings of this new study, where you decide to put a child seat in the back has been the subject of some debate.

When the seats were first introduced, some parents thought that they were safe enough to place in the front passenger seat, an idea that was quickly dispelled by safety experts.

The Mayo Clinic advises that all child rear seats should be placed in “the back seat, away from active air bags.”

But if only one row of seats is available, then parents should turn off all front air bags to ensure that they do not deploy in the event of an accident.

If parents are only placing one child seat in a vehicle, the safest place is in the middle of the back seat, to reduce the danger of injury from a door that is crushed during a car wreck. That placement is backed up by a government study that found children seated in the middle of a back row are 43 percent safer than children seated to the either side of a back row.

According to a recent report, the Minnesota Department of Public Safety has admitted that it secretly installed thousands of GPS trackers when it put ignition interlock systems in the vehicles of drunk driving offenders. An ignition interlock device is a breathalyzer that requires a motorist to submit a breath sample before the vehicle will start. If the individual has alcohol in his or her system, the device will prevent the car from turning on.

The inclusion of GPS tracking technology raises Fourth Amendment concerns, as tracking a person’s movements without their knowledge or consent may be a violation of the right to be free from unreasonable searches and seizures. The Fourth Amendment specifically states that citizens have a right “to be secure in their persons, houses, papers, and effects…”

The central question is whether an individual has a reasonable expectation of privacy in his or her vehicle—and whether this expectation extends to their routes and destinations when they drive. For example, if someone with an ignition interlock device consistently drives in and out of an area of town known for being a high-crime area, or a place where drug deals are carried out, do the police have probable cause to follow the person simply for driving to a certain destination? It’s a potential slippery slope for the erosion of privacy rights.

One Minnesota lawyer pointed out that the U.S. Supreme Court has already addressed the issue of GPS tracking devices in Jones v. U.S., in which it ruled that the use of GPS tracking technology by the government is unconstitutional except in limited circumstances. A Minnesota congressman stated that he thinks the trackers are a “bad idea with serious questions surrounding the legality of it” and will call for hearings on the issue unless the agency discontinues the practice.
