NY Train Accident Lawyer Discusses Brooklyn Train Accident That Injured Over 100

Just days after the 2017 New Year, a serious train crash injured at least 100 passengers in Brooklyn.

According to a Chicago Tribune report, the accident, which involved the Long Island Rail Road (LIRR), occurred at 8:30 a.m. during the morning commute when the front of a “slow-moving train hit a bumping block as it pulled into Atlantic Terminal… left the tracks and smashed into a small structure.” The train was carrying around 450 passengers at the time of the accident.

Authorities have stated that a rail pierced the floor of a train car, “hurling passengers onto the floor and slamming them into each other.” The terminal, which is next to the Barclays Center, is located beneath a shopping mall.   

The report goes on to state that some passengers were removed from the scene on stretchers, while others looked stunned as they were helped to the pavement outside the terminal. Many passengers had visible injuries involving limps and bleeding lacerations. One passenger said “people just went flying” when the train crashed.

Witnesses Say Terminal Structure Shook on Impact

One witness told the Tribune that “the entire structure started shaking” at the time of the collision, making him fear a bomb had exploded.

Fortunately, no one was killed in the accident, however, the crash comes just months after a deadly rail crash in Hoboken, New Jersey, which also involved a commuter train. The news report notes that the Hoboken train accident also involved a train colliding with and going over bumping posts and that federal investigators are investigating whether a more modern bumper could have prevented the crash. More than 100 people were injured and one person was killed in the Hoboken crash, which occurred on September 29, 2016.

LIRR and Hoboken Crash Investigations May Be Combined

According to a February 21 Newsday report, the National Transportation Safety Board (NTSB) has stated that it is considering combining the investigations of the LIRR crash and the September Hoboken crash to “address the need to prevent slow-speed train accidents at rail terminals.”

NTSB officials stated in the story that the LIRR train was traveling 10 miles per hour at the time of the accident, which was five miles per hour faster than the posted speed limit.

New York City Construction Accident Lawyer Discusses Tougher Crane Regulations

Recently, the NYC Department of Buildings released a report stating that a deadly crane collapse in February 2016 was caused by human error. The massive 565-foot crane crashed into the street, killing one man, injuring three pedestrians, and crushing several cars. The carnage extended over two city blocks. Emergency responders stated they were shocked that the accident didn’t cause more deaths or injuries.

The Department of Buildings report states that the crane’s operator failed to secure the crane the night before during high winds, then lowered the boom at an incorrect angle — both of which caused the crane to become unstable. As a result, the operator’s license was suspended.

Tragedy Brought New Regulations

After the accident, the Department of Buildings announced tougher regulations for crane operations, including mandatory prohibition of any crane operation when winds are greater than 30 miles per hour.

Additionally, the new regulations require a licensed engineer to be present for any operation of a crawler crane rated for less than 30 mph winds.

The regulations also raise the fine for crane safety violations from $4,800 to $10,000.

The new regulations have been challenged in a lawsuit filed by several construction groups. The groups say the mandatory shut-down provision requiring cranes to stop operating once winds reach 30 miles per hour is not based on any scientific research. The lawsuit also challenges the requirement of a lift director being present on any site where a crane is being operated.

Construction Worker Deaths in Crane Accident

Sadly, there have been other deadly crane accidents in New York City, including a catastrophic accident that took the lives of two construction workers in November 2016. The workers were killed with a beam they were lifting when a crane caught on part of a building, causing the cable holding the beam to snap and crash into the crane.

There were close to 7,000 accidents that involved tractor trailers in Pennsylvania in 2015. Despite the preventative measures taken by Penn DOT to display warning signs alongside Pennsylvania’s busy highways, auto accidents still occur.   

When it comes to transporting goods across the state, truck drivers are charged with the task of following protocols to secure loads and prevent accidents. But, often times unsecured loads or truck malfunctions lead to injury and death of innocent travelers.

 

In fact, Pennsylvania is home to many dangerous commercial vehicle companies. These trucking companies were responsible for 27 fatalities in 2015. FedEx Ground Package Systems was responsible for five deaths between 2015-2017, and Septa was responsible for the loss of four lives and 478 injuries during that same two-year stretch.

 

What this means to Pennsylvania drivers is that it’s time to learn how to share the road with these commercial vehicles.  

 

Attorney Joel Kofsky, a Philadelphia accident attorney, has dealt with many families who have been involved in accidents with trucks. He cautions drivers, “Truck drivers are crucial to our economy, and we need them to transport goods across the state. If you can learn how to share the road with these commercial vehicles properly, you will be much safer driving on Pennsylvania’s highways.”

 

A few ways that drivers can exercise caution when traveling near tractor trailers is to follow the “No Zone” advice of the Commercial Vehicle Safety Alliance.

 

The first “No Zone” is in front of a tractor trailer. Their hoods are big and long which creates a blind spot that makes it hard to see smaller cars.
The second “No Zone” is on the driver’s side of tractor trailers. Drivers should avoid the area from the middle of the cab to the middle of the trailer to stay out of a tractor trailer’s blind spot.
The third “No Zone” is the entire passenger side of a large tractor trailer. These vehicles make wide turns that can take more than one lane. It’s wise to stay out of this area so that you are not pushed off the road.
The final “No Zone” is behind a tractor trailer.  A good rule to follow to ensure you are far enough behind the truck is to make sure you can see both mirrors on the cab.
