Houston Jury Awards $6.4M In Hospital Defamation Case

On March 29, 2017, the jury in the case of Gomez v. Memorial Hermann Hosp. Syst., rendered a verdict against Memorial Hermann in the amount $6.4 million for defaming Dr. Gomez’s reputation and making false statements about his surgical competence. Dr. Gomez sued Memorial Hermann almost five years ago, alleging that it misused the peer review process and manipulated data to harm his practice after he tried to move to another hospital.

Mr. Gomez, a heart surgeon in Houston, Texas, decided to move his practice to Houston Methodist West because of concerns he was having at Memorial Hermann’s business practices. In response, doctors at Memorial Hermann joined together to destroy Dr. Gomez’s reputation and prevent patients from following him to Methodist. They manipulated statistical data and misused the peer review process for the financial gain of Memorial Hermann. The jury found that Memorial Hermann made false statements about Dr. Gomez’s surgical competence and mortality rates and shared falsified peer review data with referring cardiologists.  In turn, Dr. Gomez’s reputation was harmed.

This is an unusual verdict for a defamation case. Although, Memorial Hermann believes judge Daryl Moore will reduce the award when he enters the judgment, Texas hospitals should now be cognizant of abusing the peer review process to protect their pecuniary interests.

It often rains in Florida and it’s not uncommon for roads to be covered in water. Last year the state got 53.83 inches of rain, according to Florida State University’s Florida Climate Center, while the nation, as a whole, on average, got a little more than half that amount, 31.7 inches. The Florida Department of Highway Safety and Motor Vehicles report that there were 138 fatal accidents during rainy conditions in the state in 2015 and 14,290 accidents resulting in injuries during wet weather.

If there is a layer of water (along with oil and other substances on the road) between the two, there is little or no friction so your vehicle may be unable to stop or steer. Other than the water on the road, there are two main causes for hydroplaning, travelling too fast for the conditions and tires whose treads aren’t deep enough.

You would expect “bald” tires to lose their grip in wet conditions, but Consumer Reports found that tires that have only gone through half of their expected lifetime can lose “a significant amount of grip” in wet conditions, potentially causing an accident. There are many vehicles out there that could find themselves slip sliding away in the rain, according to a recent study by the National Highway Traffic Safety Administration. They found that of 11,500 cars, pickup trucks vans, and sport-utility vehicles the agency checked about half had at least one tire with half-worn tread. Another 10% had at least one “bald” tire.

Worn and “bald” tires can be deadly on wet roads because the grooves of the tread, pushed down by the weight of the vehicle, pump water away from the road surface so the tires maintain contact with the pavement. When the grooves aren’t deep enough the result is hydroplaning, where the tread skims the water’s surface.

As your speed increases, the higher the chance of hydroplaning, since there’s not enough time for water to escape through the tread grooves. Shallower tread makes the situation worse because they allow more water to stay beneath the tire.

To reduce the risk of an accident on wet roads:

You should slow down when the roads are wet. Depending on the conditions that may mean travelling below the speed limit.

Worn tires should be replaced. You may try to save some money by using tires that still have a little bit of tread hanging on, but given how often Florida roads are wet you may end up spending far more money if you cause an accident.

Hydroplaning occurs when your tires lose contact with the road surface because of a layer of water. Without friction between your tires and the road you can’t effectively brake or steer, according to Indiana Public Media.

If the roadway is wet enough a layer of water can build up between your tires and the road and your tires lose their grip. If the road is covered in water the pressure downward from the tires due to the weight of your vehicle against the road surface causes the water to be squeezed up into the tire treads, away from the surface, creating the friction that will stabilize your car.

The faster your vehicle travels the more water needs to be removed by the tires. As a result it may be safe to travel at thirty miles per hour, but dangerous to go sixty miles per hour because the tires can’t pump away enough water. At highway speeds in a hard rain, each tire needs to push away about a gallon of water every second to maintain control.

Another factor is how worn the tires are. If they are old and their treads are worn down there isn’t enough room in the tire’s grooves to pump enough water out. Water doesn’t have a place to go and a layer of water forms between the tire and road causing hydroplaning.

You can take steps to prevent or reduce hydroplaning:

Keep your tires properly inflated. Hydroplaning becomes more likely if they have too little or too much air.

Make sure your tires have enough tread to safely drive on them.

If you are buying replacement tires, some designs are better than others when it comes to wet traction so consider that before making a purchase.

Most hydroplaning occurs because vehicles go too fast. You may or may not feel the loss of control while hydroplaning so if it starts to rain or the road is covered in water, slow down.

Avoid, or slow down before hitting puddles because hydroplaning is more likely to occur on standing water because it’s easier to float over the water if it has some depth.

If you feel loss of control due to hydroplaning, don’t panic. Don’t hit your brakes but take your foot off the gas until you’re traveling slowly enough for your tires to handle the water.

Weather and road conditions are issues that all drivers need to cope with. If a vehicle uses tires that are ineffective for wet roads or a driver is in too much of a hurry to slow down an accident can happen, leaving victims seriously injured or killed.

She has over 5,000 flying hours as a Loadmaster and continues to fly once a week.

“I have been truly blessed with a wonderful 24 years in the Air National Guard, and I hope to continue my service for at least another 10 years,” said Turrill.

Chambers was nominated by her friend, Penny Skaff.

“Debbie is hardworking, dedicated, and loves her work,” said Skaff. “She flies many missions all over the world, putting herself in harm’s way when duty calls. She is also an animal lover and, along with caring for her own pets, she fosters homeless animals and gets them ready for a home that she’ll find for them. She has a big heart, and I couldn’t ask for a better friend.”

The Roads Truckers Call The Most Dangerous In America

According to one commercial trucking site, here are the top 13 worst roads in the U.S. based on truck drivers’ experiences as well as data from the Department of Transportation and other organizations.

I-10 in Arizona

Arizona’s I-10 is the fourth-longest interstate highway as well as the southernmost interstate highway. Its 150-mile span from Phoenix to the California border sees about 85 fatalities each year.

I-95 in Connecticut

Running north and south from Maine all the way to Miami, I-95 is one of the country’s oldest highways. Altogether, it stretches over 1,900 miles. Because it runs through numerous heavily populated areas, it accounts for many highway fatalities.

Dalton Highway in Alaska

Alaska’s Dalton Highway is dangerous because of its meandering route through mountainous terrain — with just one fuel stop and little access to emergency help if needed.

Highway 2 in Montana

The University of Minnesota claims that Montana’s Highway 2 has the highest traffic death rate of any other region. Winter weather and an 80-minute wait time for an ambulance makes the highway especially treacherous.

Highway 550 in Colorado

A specific 25-mile stretch of Highway 550 is particularly twisting and winding, with heights that reach up to 11,000 feet. This dangerous stretch of highway also lacks shoulders and guardrails.

California & Arizona’s I-15

The most heavily traveled section of I-15 sees a lot of Las Vegas tourist traffic. It has high rates of drunk driving accidents and injuries due to low seat belt use.

California’s Route 138

Route 138 runs through the Mojave Desert and has been named the “Highway of Death” after a five-year period in which 56 people were killed and 875 were injured.

I-285 in Georgia

At 64 miles long, I-285 loops around the city of Atlanta. It sees about 2 million vehicles each day.

I-26 in South Carolina

Between 2000 and 2010, there were 286 accidents that claimed 325 lives on I-26, which has been called South Carolina’s most dangerous road.

US 431 in Alabama

The 98-mile section of US 431 that runs between Phenix City (yes, it is spelled “Phenix”), Alabama and Dothan. The Alabama stretch has a reputation for being extremely dangerous.

US 24 Fort Wayne to Toledo

Built in 1926, US Route 24 is a main commercial route between Toledo, Ohio and Fort Wayne, Indiana. For decades, the narrow road saw an overwhelming number of serious accidents, leading to its nickname, “The Killway.”

US 6 in Utah

Because it’s a curvy road in an area that experiences a lot of ice and snow, US 6 is particularly dangerous.

US 129 in North Carolina

One section of US 129 in North Carolina has 318 curves in just 11 miles, earning its spot in the top 13 most dangerous roads.

Defending Firearm Possession Cases Explained By A Dallas Criminal Defense Lawyer

When I was a federal prosecutor, one of my best friends specialized in prosecuting federal firearms offenses. I handled some of those cases, too, both at trial and on appeal, but we had a specific program dedicated to going after gun crime. That program had a slogan:  “Gun Crime Means Hard Time,” offers Helms, Dallas criminal defense lawyer. The term “gun crime” applies to a lot of different types of cases, including possession of illegal weapons and ammunition and taking a weapon to a prohibited place. The most common type of gun case, though, is a “felon-in-possession” case at the federal level, or Unlawful Possession of a Weapon (“UPW”), at the state level. These types of cases involve the possession of a firearm by someone who has been convicted of a felony. If you have been convicted of a felony, it is illegal for you to possess a firearm.

After a felony conviction, Texas law prohibits you from possessing a firearm within five years after you have been released from prison, community supervision, parole, or mandatory supervision, whichever is LONGEST. This means, for example, that if you are sent to prison and released on parole, the five years begins to run after you are finished with parole. Even after that period expires, though, you are ONLY allowed, under Texas law, to possess a firearm in your home or residence.

Here is the problem: Federal law says that, if you have a felony conviction, you cannot possess a firearm for the rest of your life. So, if you have been convicted of a felony, the federal government can prosecute you for possessing a firearm no matter how long ago your conviction or release from prison, supervision, or parole was. Why can they do that? Because Texas law does not trump federal law. The fact that you can possess a firearm under Texas law does not mean it is legal under federal law.

Most cases under either state or federal law come down to whether the accused was knowingly “possessing” the gun. Many people accused of illegally possessing a gun say, “It wasn’t my gun.” That does not matter. You can possess a gun even though it does not belong to you. Possession means that you have the ability to exercise control over it. You can do that whether the gun belongs to someone else or not.

The law says that people with felony convictions cannot possess a gun because our society believes that it is too dangerous to allow convicted felons to have guns. Think about this: You can rob a bank with someone else’s gun. You can shoot someone after an argument with someone else’s gun. That gun is just as lethal even though it belongs to someone else. So, the danger that the law is trying to stop is not lessened because the gun belongs to someone else.

Defending gun possession cases usually involves focusing on whether the accused knew that gun was wherever the police found it. If you do not know anything about the gun, you cannot knowingly possess it.

For example, lots of guns are discovered in cars during a traffic stop. They are often under the seat or somewhere like that. If you are just temporarily borrowing the car from someone else, there is a chance that the owner of the car left it there without telling you, and you did not know the gun was there. That might be the reasonable doubt you need.

A good criminal defense lawyer will investigate all of the circumstances of how and where the gun was discovered. If it was found in your pants pocket, you are probably out of luck, because you were in control of it, and it is hard to claim you didn’t realize there was a gun in your pocket. Semis Used To Transport Nuclear Weapons

Texas truck accident attorneys of 1800-Truck-Wreck explains, “The current administration has stated it plans to expand the country’s nuclear weapons cache by upgrading the arsenal by $1 trillion over the next 15 years. With a nuclear weapons transport fleet that is already short-staffed and overworked, it’s troubling to think about adding more shipments and more routes.”  

When you share the highway with semi-trucks, there is always a risk of being involved in a serious or life-threatening accident. Semis can weigh up to 80,000 pounds, which means they do a lot more damage in a crash compared to a regular car.

Now, a new report sheds light on a semi-related danger few people know about. According to a Los Angeles Times article, a fleet of semi-trucks is responsible for transporting nuclear weapons across the country.

The Office of Secure Transportation

The report states that the “covert fleet” is part of a division of the U.S. Department of Energy known as the Office of Secure Transportation. The report also states that the department is “so cloaked in secrecy that few people outside the government know it exists.”

This mysterious fleet of semi-trucks may sound like something out of a Harry Potter movie, but it is very real. Furthermore, investigators report that the fleet is understaffed and overworked, which could be making the roads more dangerous for everyone.

Moving Nuclear Weapons by Semi-Truck

Tasked with moving nuclear weapons and their parts between military bases and weapons facilities located around the country, including Texas, the trucks within the Office of Secure Transportation cover about 3 million miles each year.

Reporters conducted an investigation that revealed the fleet is understaffed, falling nearly 50 drivers short from its goal. As a result, more than a third of the truck drivers who transport the nuclear weapons put in more than 900 hours of overtime each year. The Energy Department has said this overtime contributes to “a breakdown in morale and rapid turnover.”

A 2010 inquiry also found widespread alcohol problems among the fleet’s workers, including 16 alcohol-related incidents over a three-year span. An agent was arrested for public intoxication in 2007, and the agency’s top executive was charged with drunk driving with a blood alcohol concentration of .15% in 2009.

Get the Whole Family Involved

Keeping the secret that there is someone suffering from addiction in the family can do a lot more harm than good. If certain members of your family aren’t aware of the situation, they may make things worse without meaning to. When the time comes to do an intervention, you will need to get as many loved ones rallying around your loved one as possible. By showing this type of support, you will be able to show him/her that there are people who want them to succeed in life. By keeping this secret, you will only alienate the people in your family and will be unable to put up a unified front when it comes to getting the drug addict in the family treatment.

Be Honest About the Risks

Rather than sugar coating the situation at hand, you will need to be honest with the drug user in your family about the risk they are in. Jail time and death are an inevitable when you are addicted to opiates. If the drug abuser is aware of the danger they are in, it may cause them to snap back into reality and get treatment.

Fort Worth Court Of Appeals Finds Online Arbitration Policy Unenforceable

Dallas employment attorney Keith Clouse stresses the importance of expressly notifying employees of company arbitration policies. Many companies use online acknowledgments to enter into arbitration agreements with employees. However, under Texas law, these are only enforceable if the employee received notice of the policy and accepted it. A recent opinion from the Fort Worth Court of Appeals demonstrates some of the challenges companies may face with enforcing online arbitration policies.

In Doe v. Columbia N. Hills Hosp., et al., Columbia tried to enforce an arbitration policy that was posted on its intranet website. However, the Fort Worth Court of Appeals found that Doe was not expressly notified of the arbitration policy. “Merely posting an arbitration policy on an intranet site is insufficient to give an employee notice.” Moreover, Columbia provided no evidence that Doe actually accessed the intranet site. Because Doe did not have notice of the arbitration policy, the trial court abused its discretion in compelling arbitration.

Companies should expressly notify employees of online arbitration policies and, if possible, have employees sign and acknowledge receipt of the arbitration polices.

People who have suffered an emotionally painful trauma, such as a troubled childhood or past abuse, may turn to drugs as a means of coping with a memory that prevents them from fully addressing the root cause and being able to move on.

Although not everyone with a physical injury gets hooked on painkillers or other types of legal drugs, this is a gateway for many people. Many opioids are so powerful and insidious that most patients don’t even realize they have become addicted to until they attempt to quit.
