Construction Zones Endanger Boca Car Accident Lawyer

The National Highway Traffic Safety Administration2 (NHTSA) states that in 2008 Florida had the second highest number of motorist fatalities in work zones at 81 behind only Texas, which had 134 fatalities. NHTSA has these suggestions for drivers entering into contraction zones:

Watch for cones, barrels, signs, large vehicles or workers in bright colored vests to warn you and direct you where to go.

Lower your speed to reduce the risk of an accident.

Be aware of traffic around you and be prepared to reduce your speed, obey signs and flaggers and increase the following distance with the vehicle in front of you.

You may tend to ignore work zone signs in areas where a project has lasted weeks or months but traffic patterns can suddenly change including lane shifts or alternating lane closures.

Be extremely careful when driving through a work zone at night whether you see workers or not.

Try to travel in the lane farthest away from where workers and equipment are located.

Be wary of mobile and moving work zones such as line painting, road patching or mowing beside the roadway.

Expect delays, leave early to reach your destination on time so you won’t feel the need to speed.

What is Fentanyl?

Fentanyl is a prescription painkiller that is 50 to 100 times stronger than morphine. It is an opioid analgesic that is commonly used for severe and chronic pain. It is also found illicitly on the street, where it is often mixed with heroin, making it more potent and much more dangerous. Fentanyl has a high risk of overdose because of its potency, and can cause very serious short-term and long-term health consequences when misused. Fentanyl abuse and overdose can be fatal, so it is crucial that patients taking it understand the risks of abuse and overdose so they can be treated as soon as possible, in the event that they occur.

What Are the Signs and Symptoms of Fentanyl Abuse?

The National Institute on Drug Abuse (NIDA) warns that the high potency of Fentanyl significantly raises the risk of overdose and other serious symptoms. There is added risk for people who purchase illicit drugs in powder or pill form on the street, as they may be unaware that the drugs contain Fentanyl.

Some of the signs and symptoms of Fentanyl abuse include:

Extreme euphoria and relaxation
Sense of well-being
Dizziness and confusion
Lightheadedness
Drowsiness or sedation
Upset stomach, nausea, and vomiting
Constipation
Tolerance to increasing amounts of the drug
Drug-seeking behavior
Respiratory arrest
Withdrawal when use is stopped

While it can sometimes be difficult to recognize Fentanyl abuse, multiple signs from the list along with drug-seeking and other addictive behaviors may indicate abuse.

What Does Fentanyl Overdose Look Like?

Fentanyl can be dangerous even when it is taken as prescribed. It is usually only prescribed as a last resort for those patients who are experiencing extreme, chronic pain who have become tolerant to other opioid painkillers. Patients taking Fentanyl have to be closely monitored to ensure their medical safety. There are many considerations that patients need to be aware of when taking Fentanyl. One example is, patients who use a Fentanyl patch must pay attention to the temperature, as increased heat can cause the patches to release larger amounts of the drug, which could lead to overdose. Those using the drug recreationally are at an even higher risk of overdose because they may not be aware of the strength of the drug or the risk of interactions when it is combined with other drugs or alcohol.

It is important that family and friends of those taking Fentanyl understand the signs of overdose and that they are able to recognize them quickly. A Fentanyl overdose has several physical symptoms that are easily observable to people who know what they are looking for. Those symptoms include:

Dizziness and confusion
Difficulty with motor skills and speaking
Pale, pasty skin
Bluish lips and extremities
Choking sounds
Vomiting
Pinpoint pupils
Seizures
Slow heart rate
Nodding off or fainting
Limp body
Unresponsive
Slow or shallow breathing
Coma
Respiratory arrest
Death

Once overdose symptoms start, it is imperative to get the user medical attention as quickly as possible to reduce the chances of long-term or fatal consequences.

How is Fentanyl Overdose Treated?

When a person is overdosing on Fentanyl, treatment must start immediately once recognized. The first step is to remove a patch or lozenge if that it is how the Fentanyl is being administered so they do not absorb or ingest anymore into their system.

If the drug was taken orally, the patient’s stomach may be pumped, or activated charcoal may be given, to remove as much of the Fentanyl as possible before it has a chance to reach the bloodstream. That will not alleviate the overdose symptoms that are already present, but it may help keep the patient from further damage due to additional absorptions of the drug.

Narcan (Naloxone) is an opioid antidote that is often used to counter the effects of opioid overdose. It can be administered by injection or nasal spray. Narcan can help restore breathing and central nervous system functioning within minutes, but because Fentanyl is so potent, several doses of Narcan are often necessary to counteract overdose. Narcan almost immediately causes a patient using Fentanyl to go into serious withdrawal from the drug. This can result in several uncomfortable and often painful side effects that typically require additional medical management. While Narcan may reverse many of the symptoms of overdose, some symptoms may persist and require treatment. For example, the patient may no longer be in respiratory arrest, but may still need a ventilator to assist with breathing.

Fentanyl Addiction is Treatable

Once the emergency of overdose is treated, the user will need to go through detox to remove the remaining Fentanyl from their body. This can be a long and unpleasant process and is best done with medical supervision in a treatment facility.

The good news about Fentanyl addiction is that if the user is fortunate enough to survive addiction or overdose, they can be treated and recover. Inpatient rehabilitation is one way to get that treatment, and it is commonly recommended over outpatient treatment for Fentanyl addiction.

Treatment will focus on therapy for any underlying conditions, addiction education, life and coping skills, and relapse prevention techniques that will help patients stay clean and learn to live fulfilling and drug-free lives. Ongoing and consistent treatment of some kind is often necessary for Fentanyl, or other opioid, addicts. Treatment facilities typically offer aftercare for alumni, and 12-step programs are often recommended for addicts upon completion of inpatient treatment.

Addiction Treatment Center Offers 5 Steps That May Save Your Life And Your Job

According to an Employer Brief1 from the U.S. Department of Health and Human Services’ Substance Abuse and Mental Health Services Administration (SAMHSA), 76 percent of people with drug or alcohol abuse problems are employed. Unfortunately, many of those people do not seek help because of the stigma associated with addiction. Many believe that having to talk to their employer about a problem with drugs or alcohol would be detrimental to their career. It takes a lot of courage to make the decision to seek help from an addiction treatment center and begin recovery for anyone. But it takes even more when one feels that there is more to lose by choosing to go, despite the fact that it is a decision that could be live saving.

Addiction is extremely difficult to overcome without professional help. Perhaps you feel like your addiction is not affecting your work right now. The reality is, it probably is. However, even if no one knows about your addiction, it will be very difficult to continue to keep it under wraps indefinitely. Addiction is a progressive disease that, when left untreated, only gets worse – never better. It is better to seek treatment now, before your job has suffered from the effects of drug addiction, so that you have a position to return to.

Once you have made the decision that you need inpatient treatment for an addiction and must be away from work for an extended period, you are going to have to talk to your employer about it. This may seem like a daunting and scary task, but it’s better done sooner rather than later. The following are some steps that you can follow to make the task less difficult.

Steps to Take Before Talking to Your Boss

There are a couple of things you should do in preparation for the conversation:

Check to see if your employer has an EAP program. Most companies offer an employee assistance program (EAP) as one of their benefits. The program is designed to help employees with personal or work-related problems that might impact their job performance, physical or mental health, and emotional well-being. Most EAP inquiries can be kept confidential and they may be able to help you with resources and support to begin your recovery.
Examine your company’s alcohol and drug policy. Check your employee handbook or with your Human Resources department to see if there is a policy specific to alcohol or drug addiction treatment. If there isn’t one, look at policies that are in place for sick employees – specifically, the process for taking a leave of absence due to illness.
Know what your rights are. The Americans with Disabilities Act2 (ADA) prohibits employees from discrimination and protects the rights of employees with disabilities. Chemical dependency is considered a disability, so employees with addiction issues cannot be discriminated against if they are performing their work duties satisfactorily.
Research treatment options and facilities. Before you speak to your employer have a plan in place for your treatment so that you can communicate exactly what your employer’s expectation should be regarding your leave of absence and return to work.
Understand the financial aspects of treatment. Missing work can cause a financial burden, but you do have some options. It’s important to become familiar with your company’s short-term disability benefits as well as the Family and Medical Leave Act3 (FMLA). Some employers will allow employees to exhaust their paid-time-off (or vacation and sick time) hours before having to use short-term disability.
Having a Professional Conversation About Your Addiction

Now comes the hard part – sitting down and discussing your situation with your boss. Ideally, you have a supervisor who is understanding and will be compassionate. But if you don’t, there are still some ways to keep the conversation as professional and painless as possible. If you have a supervisor who you do not feel comfortable having the conversation with at all, you may want to consider talking to your Human Resources department first, and having them act as an intermediary. Whether it’s your boss or HR, you can use the following steps when you have your conversation:

Keep it simple. You don’t have to give details about what you are going through, and your boss doesn’t have the right to ask. Just state simply that you currently have a substance abuse issue that requires treatment and that your treatment facility will be able to provide the necessary documentation to HR.

Ask for resources. If you haven’t already spoken to HR, this is the time to ask your supervisor who you should contact. You can also inquire about other resources your company may have for sick employees.

Request confidentiality. Clearly, your boss shouldn’t discuss your situation with other employees, but it is still a good time to request that your privacy be guarded.

Express your desire to return to work. At the end of the conversation, be sure to let your boss know that your desire is to return to work, ready to do the best job you can, as soon as your treatment is completed.

Keep records. Document any conversations that you have with your supervisor and HR regarding your treatment plans and your temporary absence from work. You may never need the documentation, but it’s better to err on the side of caution in case you do.

Final Thoughts

You are making a courageous and healthy choice to begin recovery for your addiction, don’t let the fear of telling your employer keep you from doing what is best for you and your family. You cannot be fired for asking for help, and doing so may open up doors for you that addiction has closed.

The first source of the Mugshot Problem lies in a little unknown but very powerful law called the Communications Decency Act of 1994. This law passed under the Clinton Administration and gave websites protection from content posted by a third party, thus shielding them from defamation lawsuits. In essence, it means that sites like Google and Yahoo are given immunity from liable lawsuits because they simply provide the platform – and are not the originators of the content. Without the Communications Decency Act the internet would not exist as we know it today, because the risk of monetary damages would have long since hindered its growth.

The second source of the mugshot problem lies in something called State Transparency Laws. These Transparency Laws are simply defined as state government’s obligation to share information with citizens, and make that content easily accessible. The original intent of such laws were designed to hold state officials accountable, but the side effect of Transparency Laws has resulted in sensitive information like divorce decrees, bankruptcies, and booking photos from the local Sherriff’s Office landing on the first page of Google.

Once a mugshot photo has been uploaded to the internet by the arresting Sherriff’s department, it could become very difficult to remove, and will remain published as long as the mugshot website is active. The other annoying issue with mugshot websites is the sheer size of their databases inadvertently gives the sites page ranking strength in Google, causing the negative links to land at the very top of search results.  Such is the case with many of the links from mugshot websites like WhoPostedBail.org and BailBondCity.com.  

Possible Solutions?

According to a New York Times article mugshot removal services like RemoveSlander.com has had experience removing mugshot photos from the internet, but even they admit that the process often feels like playing whack-a-mole.

“People eager to vanish from mug-shot sites can try a mug-shot removal service, a mini-industry that has sprung up in the last two years and is nearly as opaque as the one it is intended to counter. Motto: (“Bailout of the Internet for good!”).

The CEO of RemoveSlander.com suggest that a great starting point to gather as much information about published mugshots, is to search Google and add the word ‘Mugshot’ to the end of your name. In doing so he says that Google or Yahoo will return results that best match – and give you the opportunity to get all of the mugshot links destroyed at once.

Understanding Drug Abuse and Addiction

People begin using drugs for different reasons. It may be curiosity, fitting in socially, dealing with stress or anxiety, improving performance athletically or at school or work, or coping with an underlying psychological issue, that cause someone to pick up a drug for the first time. Recreational use doesn’t always lead to dependence or addiction, and there isn’t a specific time frame or amount that causes someone to cross the line to addiction. It is more about the underlying reason for their use and the negative consequences that result from it. If a person’s drug use is causing problems in his or her life (work, school, home, or relationships), then he or she may have a drug problem or addiction.

Why Do Some Users Become Addicted and Others Don’t?

Just like other illnesses and diseases, how susceptible someone is to addiction can vary greatly from person to person. Genetics, environmental factors, and social circumstances all play a part in addiction. Risk factors that increase a person’s susceptibility include:

History of addiction in the family
History of trauma, abuse, or neglect
Mental health conditions like depression and anxiety
Use of drugs at a young age
How drugs are used – smoking and injecting drugs may increase the addictive potential
How Does Addiction Develop?

There is a gradual progression from not using drugs at all to addiction, it doesn’t happen overnight. The length of time that it takes depends on the person’s individual risk factors and the type of drug they are using. These are the phases of drug use, abuse, and addiction:

Sobriety – This period is before a person has ever tried the drug and has no issue staying away from it.

Recreational or social use – Drug use in this phase is typically moderate. The user sees drug use as something that is expected in certain situations or with certain people.

Negative consequences begin – Drug use begins to increase in this phase, and other aspects of life begin to be affected. It may be the time when work or school suffers, or relationships begin to deteriorate.

Reliance on the drug – In this phase, the user has become reliant on the drug for various reasons. The drug may be used for energy, to calm down, or for confidence. The drug use may become a way of dealing with depression, anxiety, or stress. During this phase, it is unlikely that a person will stop using unless they are able to find a healthier alternative to rely on.

Dependence or addiction – At some point, the user crosses a line, specific to him or her, to addiction (a physical and/or psychological dependence on) to the drug of choice. Once in this phase, it is extremely difficult for a person to stop using without help.

Warning Signs and Symptoms of Drug Abuse and Addiction

Most drug abusers try to hide their symptoms and minimize their problem. If you think that your loved one may be abusing drugs, there are warning signs that you can look for.

Physical Signs of Drug Abuse
Red, bloodshot eyes, larger or smaller pupils
Sudden change in weight
Change in sleep patterns or appetite
Changed or reduced personal grooming habits
Unusual odors on breath, clothing, or body
Shaking, slurred speech, or motor impairment
Behavioral Signs of Drug Abuse
Being secretive – more than previously
Unexplained attendance issues at work or school
Unexplained need for money
Change in friends and hangouts
Getting into trouble, altercations, accidents, or legal issues
Psychological Signs of Drug Abuse
Change in personality
Mood swings, anger or irritability
Unexplained hyperactivity or agitation
Lethargy or lack of motivation
Appearing scared, anxious, or paranoid

Of course, symptoms are different depending on which substance is being abused, but the above gives you a starting point for what to look for in your loved one.

When Your Loved One Has a Drug Problem

Addiction doesn’t just affect the person who has the problem – it affects friends and family, as well. The most important thing that you can do in this situation is take care of yourself first. When you are dealing with your loved one, here are a couple of things you can do:

Talk to them. You can share your concerns, offer help and support – but do so without judgment. Tell your loved one exactly which behaviors have you concerned. And don’t wait! The sooner addiction is treated, the better. A person does not have to reach rock bottom to begin recovery.

Don’t blame yourself. You cannot control whether your loved one decides to seek help or not, it has to be his or her decision and responsibility. No matter what happens, don’t blame yourself for the addict’s behavior or decision regarding help.

There are also some things that you shouldn’t do when dealing with an addict. It’s important that they suffer the consequences of their actions – it’s essential to recovery.

Don’t try to negotiate, punish, bribe, or preach.
Don’t make excuses or try to cover up for the addict.
Don’t be a martyr by trying to use guilt with your loved one.
Don’t take on the addict’s responsibilities.
Don’t argue with your loved one when they are high.
Don’t feel guilty about the addict’s behavior.
Getting Help

Many people who have a drug addiction don’t reach out for help on their own. Loved ones may need to step in and help them seek help in order to begin the recovery process. This isn’t usually an easy thing to do. Some users will deny that they have a problem, others may know they have a problem, but not want to go to treatment for various reasons – fear, cost, or thinking they can stop on their own.

Once they do make the decision to give treatment a try, they will need to decide which type of program to enter, inpatient or outpatient.

Outpatient treatment is typically classes, therapy, group sessions that discuss coping skills and relapse prevention, and addiction education. There are usually several sessions each week that last a few hours. This type of treatment allows patients the flexibility to maintain their lives outside of treatment.

Inpatient, or residential, treatment requires that patients stay at the treatment facility for the length of their treatment. Inpatient treatment is preferred by patients who want to focus on their recovery without temptations and distractions. This type of treatment provides the same type of classes and support as outpatient treatment, but on a more intensive basis.

Dallas Criminal Defense Lawyer Answers! “What Kind Of Lawyer Do I Need?”

I am a Dallas criminal defense attorney. I am not an Dallas immigration lawyer, but I often handle criminal immigration cases. Confusing? It is for many people who contact me. This article explains the differences.

A criminal defense lawyer like me defends people who are accused of a crime.  A crime is usually something that can result in jail time, or at least a fine. In order to prove someone guilty of a crime the government has to prove that they are guilty beyond a reasonable doubt. There are special rules and procedures for criminal cases. A criminal defense lawyer needs to know them in order to defend an accused person.

On the other hand, an immigration lawyer helps people with immigration issues, which usually involve a person’s citizenship status, whether a person can legally enter the country, for what purposes, and for how long. So, for example, if you want to become a U.S. citizen, or if you are not a citizen and want to be able to work in the U.S., or if you are seeking asylum in the U.S., you need an immigration lawyer.

A violation of the U.S. immigration laws can result in deportation, which means that the government removes you from the U.S. and sends you back to your home country. If you are trying to avoid being deported, you need an immigration lawyer.

Here is the confusing part: There are also immigration crimes. These are violations of laws relating to immigration that can result in jail time. Someone who is convicted of an immigration crime, and who is not a U.S. citizen, can be sentenced to jail first and then deported after serving their sentence. In these situations, a criminal defense lawyer tries to help the accused avoid a conviction for the crime or minimize the jail time after a conviction.

Here are some examples of immigration crimes that I have handled:

-Illegal re-entry. It is a crime to come back to the United States after being deported. If you come back and are found in the United States, you can be sent to prison and then deported.

-Alien smuggling. It is a crime to take payment to help others get into the United States illegally. It does not matter whether the smuggler is a U.S. citizen or not.

-Passport fraud. It is a crime to apply for a U.S. passport using false information designed to trick the government into issuing a passport. It does not matter whether the person actually gets a passport or not.

-Visa fraud. It is a crime to apply for a visa to come to the United States or to bring someone to the United States using false information designed to trick the government. Recently, there have been criminal prosecutions of U.S. companies that apply for work visas to bring foreign workers to the U.S. for improper purposes, such as to pay them less than what U.S. citizens would receive.

-Harboring or employing undocumented workers. It is a crime for a person or company to employ undocumented workers knowing that they are not in the United States legally. Usually, it is U.S. citizens or companies who hire undocumented workers in order to pay them less and therefore reduce costs.

There are also sometimes immigration consequences for a crime. In many cases, a conviction for a crime can result in a person being deported and never being allowed to return to the United States. This can be true even if the person was in the U.S. legally, such as on a visa or because the person had become a lawful permanent resident (green card holder).

As a criminal defense lawyer, I have to find out my client’s citizenship status in order to advise them of the possible immigration consequences if they are convicted of a particular crime. Sometimes, I know the answer, but sometimes I have to talk to colleagues who are immigration lawyers in order to be sure.

The basic rules of thumb are:

-If you are trying to adjust your citizenship status, get into or stay in the United States, or avoid deportation, you need an immigration lawyer.

-If you are accused of a crime that involves a fine or jail time, you need a criminal defense lawyer.

-If you are accused of a crime, and if you want to fight the effect of a criminal conviction on your citizenship status or fight being deported after serving your sentence, you need both.

Branford Hall Career Institute Opens Expansive New Facility in Albany

Branford Hall Career Institute’s Albany campus has relocated to an impressive new facility in the city’s Capitol Hill section, at 155 Washington Avenue.

Branford Hall has taken over the entire third floor after six months of renovations customizing the space to accommodate the needs of students, faculty, and staff. Now the new campus features four full-size, fully equipped medical labs overlooking the city.

These full-service medical labs include a phlebotomy lab, where students learn the basic procedures of collecting blood; a dedicated space for learning lab procedures and testing a variety of specimens; an EKG lab, where students learn to prepare patients for as well as perform electrocardiograms; and a clinical skills lab for practicing the taking of vital signs and administering wound care.

In addition to the medical labs the campus includes two computer labs and five lecture classrooms. Students are also supported by other departments on campus including Admissions, Financial Aid, and Career Services – all on one floor. Branford Hall offers two training programs at this location: medical assisting and medical billing and coding, both preparing students for careers in the healthcare field.

“This terrific new location, in the heart of the city near the Capitol building, makes a huge difference for our students,” says Campus Director Cathlene Schwartzbeck. “With bus stops at either end of our block, serving a number of different bus routes, access to our campus is now more convenient than ever. Students are loving it.”

The New York State Bureau of Proprietary School Supervision (BPSS) approved the new location after a site visit in late January. The facility is fully wheelchair accessible.

In the first week at the new location, Branford Hall held its traditional “Pinning” ceremony in the new student lounge. This tradition recognizes the students’ hard work in completing coursework and also their readiness for the internship/externship aspect of their training. The school will schedule a ribbon cutting ceremony in the coming weeks.
