I am a Dallas criminal defense attorney. I am not an Dallas immigration lawyer, but I often handle criminal immigration cases. Confusing? It is for many people who contact me. This article explains the differences.

A criminal defense lawyer like me defends people who are accused of a crime.  A crime is usually something that can result in jail time, or at least a fine. In order to prove someone guilty of a crime the government has to prove that they are guilty beyond a reasonable doubt. There are special rules and procedures for criminal cases. A criminal defense lawyer needs to know them in order to defend an accused person.

On the other hand, an immigration lawyer helps people with immigration issues, which usually involve a person’s citizenship status, whether a person can legally enter the country, for what purposes, and for how long. So, for example, if you want to become a U.S. citizen, or if you are not a citizen and want to be able to work in the U.S., or if you are seeking asylum in the U.S., you need an immigration lawyer.

A violation of the U.S. immigration laws can result in deportation, which means that the government removes you from the U.S. and sends you back to your home country. If you are trying to avoid being deported, you need an immigration lawyer.

Here is the confusing part: There are also immigration crimes. These are violations of laws relating to immigration that can result in jail time. Someone who is convicted of an immigration crime, and who is not a U.S. citizen, can be sentenced to jail first and then deported after serving their sentence. In these situations, a criminal defense lawyer tries to help the accused avoid a conviction for the crime or minimize the jail time after a conviction.

Here are some examples of immigration crimes that I have handled:

-Illegal re-entry. It is a crime to come back to the United States after being deported. If you come back and are found in the United States, you can be sent to prison and then deported.

-Alien smuggling. It is a crime to take payment to help others get into the United States illegally. It does not matter whether the smuggler is a U.S. citizen or not.

-Passport fraud. It is a crime to apply for a U.S. passport using false information designed to trick the government into issuing a passport. It does not matter whether the person actually gets a passport or not.

-Visa fraud. It is a crime to apply for a visa to come to the United States or to bring someone to the United States using false information designed to trick the government. Recently, there have been criminal prosecutions of U.S. companies that apply for work visas to bring foreign workers to the U.S. for improper purposes, such as to pay them less than what U.S. citizens would receive.

-Harboring or employing undocumented workers. It is a crime for a person or company to employ undocumented workers knowing that they are not in the United States legally. Usually, it is U.S. citizens or companies who hire undocumented workers in order to pay them less and therefore reduce costs.

There are also sometimes immigration consequences for a crime. In many cases, a conviction for a crime can result in a person being deported and never being allowed to return to the United States. This can be true even if the person was in the U.S. legally, such as on a visa or because the person had become a lawful permanent resident (green card holder).

As a criminal defense lawyer, I have to find out my client’s citizenship status in order to advise them of the possible immigration consequences if they are convicted of a particular crime. Sometimes, I know the answer, but sometimes I have to talk to colleagues who are immigration lawyers in order to be sure.

The basic rules of thumb are:

-If you are trying to adjust your citizenship status, get into or stay in the United States, or avoid deportation, you need an immigration lawyer.

-If you are accused of a crime that involves a fine or jail time, you need a criminal defense lawyer.

-If you are accused of a crime, and if you want to fight the effect of a criminal conviction on your citizenship status or fight being deported after serving your sentence, you need both.

Regulations can cost businesses money and impede their productivity. But getting rid of regulations doesn’t eliminate costs; it just shifts or changes them.

Congress suspended regulations issued by the prior administration mandating drivers take two nights off to rest if they take only the minimum break before starting a new workweek. Drivers for companies operating on a seven day schedule can work up to 80 hours in a workweek through a combination of driving and other responsibilities, like loading and unloading, according to the Los Angeles Times1.

Changing federal laws and regulations isn’t enough for the American Trucking Association. They plan on having a federal law limit the states’ ability to regulate the industry passed while Republicans control the White House and Congress.

This new law would prevent state laws from requiring additional rest breaks for truckers beyond what federal rules require. The association says one, less burdensome, uniform national rule on work hours for interstate truckers would be better and those extra breaks helping to keep drivers awake and alert really aren’t necessary for safety.

Normally Republicans see the federal government as too large and powerful and that more power should be given to state and local governments. Whether that will change in this instance, we don’t know yet.

Safety advocates fear this may just be the beginning of a broad rollback of transportation safety regulations since there’s no longer a traditionally consumer-friendly Democratic president to check the actions of traditionally business-friendly Republican lawmakers, says  Osborne Boca Raton personal injury lawyer.

You may see on the roads longer, heavier, potentially more dangerous tractor-trailers if the industry gets its way. Shippers and the trucking industry will probably lobby for their long-sought goals of increasing the weight limit on trucks to more than 90,000 pounds (10,000 pounds more than current standards) and increasing the length of individual trailers in double-trailer combinations from 28 feet to 33 feet (resulting in tandem trailers being 63 feet long, ten feet longer than current standards).

Though heavier, longer trucks would be more difficult to maneuver, accelerate and stop, making them more dangerous the industry claims if they can put more cargo on each truck, the number of trucks will go down and with less trucks the chances of an accident should decrease. With bigger trucks come less costs and fewer trucks need fewer drivers which would help an industry short of tens of thousands of drivers.

Just like other illnesses and diseases, how susceptible someone is to addiction can vary greatly from person to person. Genetics, environmental factors, and social circumstances all play a part in addiction. Risk factors that increase a person’s susceptibility include:

History of addiction in the family
History of trauma, abuse, or neglect
Mental health conditions like depression and anxiety
Use of drugs at a young age
How drugs are used – smoking and injecting drugs may increase the addictive potential
How Does Addiction Develop?

There is a gradual progression from not using drugs at all to addiction, it doesn’t happen overnight. The length of time that it takes depends on the person’s individual risk factors and the type of drug they are using. These are the phases of drug use, abuse, and addiction:

Sobriety – This period is before a person has ever tried the drug and has no issue staying away from it.

Recreational or social use – Drug use in this phase is typically moderate. The user sees drug use as something that is expected in certain situations or with certain people.

Negative consequences begin – Drug use begins to increase in this phase, and other aspects of life begin to be affected. It may be the time when work or school suffers, or relationships begin to deteriorate.

Reliance on the drug – In this phase, the user has become reliant on the drug for various reasons. The drug may be used for energy, to calm down, or for confidence. The drug use may become a way of dealing with depression, anxiety, or stress. During this phase, it is unlikely that a person will stop using unless they are able to find a healthier alternative to rely on.

Dependence or addiction – At some point, the user crosses a line, specific to him or her, to addiction (a physical and/or psychological dependence on) to the drug of choice. Once in this phase, it is extremely difficult for a person to stop using without help.

Warning Signs and Symptoms of Drug Abuse and Addiction

Most drug abusers try to hide their symptoms and minimize their problem. If you think that your loved one may be abusing drugs, there are warning signs that you can look for.

Physical Signs of Drug Abuse
Red, bloodshot eyes, larger or smaller pupils
Sudden change in weight
Change in sleep patterns or appetite
Changed or reduced personal grooming habits
Unusual odors on breath, clothing, or body
Shaking, slurred speech, or motor impairment
Behavioral Signs of Drug Abuse
Being secretive – more than previously
Unexplained attendance issues at work or school
Unexplained need for money
Change in friends and hangouts
Getting into trouble, altercations, accidents, or legal issues
Psychological Signs of Drug Abuse
Change in personality
Mood swings, anger or irritability
Unexplained hyperactivity or agitation
Lethargy or lack of motivation
Appearing scared, anxious, or paranoid

Of course, symptoms are different depending on which substance is being abused, but the above gives you a starting point for what to look for in your loved one.

When Your Loved One Has a Drug Problem

Addiction doesn’t just affect the person who has the problem – it affects friends and family, as well. The most important thing that you can do in this situation is take care of yourself first. When you are dealing with your loved one, here are a couple of things you can do:

Talk to them. You can share your concerns, offer help and support – but do so without judgment. Tell your loved one exactly which behaviors have you concerned. And don’t wait! The sooner addiction is treated, the better. A person does not have to reach rock bottom to begin recovery.

Don’t blame yourself. You cannot control whether your loved one decides to seek help or not, it has to be his or her decision and responsibility. No matter what happens, don’t blame yourself for the addict’s behavior or decision regarding help.

There are also some things that you shouldn’t do when dealing with an addict. It’s important that they suffer the consequences of their actions – it’s essential to recovery.

Don’t try to negotiate, punish, bribe, or preach.
Don’t make excuses or try to cover up for the addict.
Don’t be a martyr by trying to use guilt with your loved one.
Don’t take on the addict’s responsibilities.
Don’t argue with your loved one when they are high.
Don’t feel guilty about the addict’s behavior.
Getting Help

Many people who have a drug addiction don’t reach out for help on their own. Loved ones may need to step in and help them seek help in order to begin the recovery process. This isn’t usually an easy thing to do. Some users will deny that they have a problem, others may know they have a problem, but not want to go to treatment for various reasons – fear, cost, or thinking they can stop on their own.

Once they do make the decision to give treatment a try, they will need to decide which type of program to enter, inpatient or outpatient.

Outpatient treatment is typically classes, therapy, group sessions that discuss coping skills and relapse prevention, and addiction education. There are usually several sessions each week that last a few hours. This type of treatment allows patients the flexibility to maintain their lives outside of treatment.

Inpatient, or residential, treatment requires that patients stay at the treatment facility for the length of their treatment. Inpatient treatment is preferred by patients who want to focus on their recovery without temptations and distractions. This type of treatment provides the same type of classes and support as outpatient treatment, but on a more intensive basis.

In other cases, the truck drivers have bad driving records or aren’t properly licensed. Moving companies have been shut down2 for employing drivers who fail drug and alcohol screenings. The problem has become so widespread, the National Consumers League3 has launched an online resource for people preparing to move.

Tips to Avoid Being Scammed by a Moving Company

The National Consumers League recommends the following steps when looking for a company to help you with your move.

Get a binding estimate. Make sure you know exactly how much you’re going to pay, and get the company to commit to it in writing. The estimate should include an in-person visit from a representative of the moving company to get an accurate idea of what is being moved.
Don’t sign an incomplete estimate. Wait until your estimate is signed by both you and the moving company before making any payments toward the moving company’s services.
Avoid cash payments. The National Consumers League suggests paying by check or credit card so you can dispute the charge if the company attempts to scam you.
Watch out for “phantom” movers. Be suspicious of a bait-and-switch technique fraudulent movers sometimes try to use. It works like this: You contract with a company, but a plain, unmarked truck shows up on moving day with movers dressed in street clothes. This could be a sign of a moving scam.

Brain damage – Women are more susceptible to brain damage due to alcohol than men, including loss of brain functioning and reduced brain size.
Liver disease – Women are more likely to develop alcohol-related liver problems like hepatitis and are more likely to die from liver cirrhosis than men.
Breast cancer – Alcohol abuse also increases a woman’s chances of developing breast cancer.

When compared to women who don’t drink, or who drink moderately, women who are heavy drinkers are more likely to suffer:

Falls and fractures
Osteoporosis
Early menopause
Infertility issues including miscarriage
Hypertension
Heart Disease
How Alcohol Affects Women

Alcohol is metabolized more slowly in a woman’s body than in a man’s. The result is that one drink for a woman has about twice the affect it does for a man. Women also tend to advance from their first drink to alcohol-related problems to dependence and the need for addiction treatment more quickly than men.

There are several biological factors that play a part in making women more affected by alcohol.

Enzymes – Women have smaller amounts of the enzymes alcohol dehydrogenase and aldehyde dehydrogenase than men. These enzymes break down alcohol in the stomach and liver. Because levels of these enzymes are lower in women, they absorb more alcohol into their bloodstream than men.
Body fat – Women’s bodies typically have more body fat and less water than men’s. Body fat retains alcohol and water dilutes it, causing alcohol to remain in women’s bodies at higher levels. This causes the brain and other organs to be exposed to alcohol for longer periods of time.
Hormones – Hormonal changes that women experience during menstrual cycles may change the way alcohol is metabolized.

The above biological factors explain why women are more affected by alcohol, becoming more intoxicated even when drinking smaller amounts than men.

History of Sexual and Physical Abuse Increases Risk

Research has shown that people who experience sexual or physical abuse in childhood have a higher risk of alcohol abuse and addiction. Because women are more likely to have suffered abuse during childhood than men, they are disproportionally affected by alcohol abuse. Additionally, the following are true:

Women who suffered abuse (physical or sexual) during childhood are much more likely to drink, have negative consequences as a result, and become physically or psychologically dependent on alcohol.
Physical abuse in adulthood, which affects women more than men, raises the risk of alcohol abuse.
Alcohol is involved in as many as three-quarters of all rapes and domestic violence against women.
Women with a family history of alcoholism are more likely than men with the same history to have a problem with alcohol.
Alcohol Abuse Treatment for Women

Women also face different barriers to seeking treatment than men. Men are more likely to seek help for their drinking problems from alcohol treatment facilities, while women are more likely to go to their primary care doctor or mental health professionals.

Women who abuse alcohol:

Are reluctant to be labeled alcoholics
Frequently attribute their issues to mental health conditions like depression, anxiety, and stress
May be reluctant to go to a treatment facility due to the stigma attached to women drinking

These things result in women not getting the care and treatment that they need in order to have long-lasting sobriety, even though research shows that they are just as likely as men to recover from alcoholism.

Women experience other barriers to entering treatment programs as well. Some of those include:

Financial challenges – Women typically have lower paying jobs than men, and may have trouble affording the cost of treatment even if they have insurance.
Mental health issues – Women may be more likely to seek treatment for mental health disorders than addiction. However, if the conditions are not treated as co-occurring disorders, rates of relapse are very high.
Childcare – Women with young children often face challenges in finding adequate care for them while receiving treatment. They may also fear that they will lose custody if they admit to having a problem with addiction.
Need for gender-specific treatment facilities – Many women feel most comfortable attending women-only facilities, but those may be hard to find.

While there are challenges for everyone, but perhaps more for women, in seeking help for alcohol abuse or addiction, there is hope. More and more facilities are making it easier to treat co-occurring disorders, and more are offering gender-specific programs.

Women are every bit as likely to get and stay sober as their male counterparts, so it’s important that they take the right steps and find an alcoholism treatment facility that can help them get on the road to recovery.

Boca Nursing Home Abuse Lawyer Says Nursing Homes Can Be Crime Scenes

Nursing homes have a responsibility to keep residents from harm. You may think of that as preventing falls or bed sores but it’s much more than that. It includes keeping residents away from criminals, including those who are employees and fellow residents. Boca nursing home abuse lawyer Joe Osborne states nursing homes’ obligation to keep residents safe includes sufficient supervision of residents and properly screening job applicants.

A former North Miami nursing home employee faces three counts each of grand theft and exploitation of the elderly after her arrest in August, reports WPLG1. Haymee Hernandez is accused of deceiving three sick or disabled residents and stealing more than $13,000 from their bank accounts. She was the Medicaid coordinator at the Claridge House in North Miami, adds Joe Osborne, a nursing home negligence attorney in Boca Raton.

The Medicaid Fraud Control Unit of the Florida Office of the Attorney General states Hernandez used some of the money to shop at Macy’s and buy baked goods, among other things.

Hernandez is accused of conning victims into giving her their ATM cards, then accessing their accounts and withdrawing cash without their knowledge or consent.

She falsely told nursing home residents they had too much money in their accounts to qualify for Medicaid. Hernandez offered to make withdrawals and put their cash in a nursing home safe. Instead she spent the money on herself.

It was a successful con at least three times. Her victims included a man with diabetes, anemia, chronic kidney disease and hypertension. Another is wheelchair bound and a third is partially blind.

After being confronted by authorities and the nursing home administrator Hernandez admitted to using patients’ money due to financial problems caused by her divorce. She faces a possible jail sentence of up to 30 years if convicted.

It’s not just employees who are a possible threat to nursing home residents. An 87-year-old nursing home resident faces criminal charges after he was found having sex with a 94-year-old man debilitated by Parkinson’s disease and too disabled to consent. Louis Lawson was charged with sexual battery in July, according to the Palm Beach Post2.

His roommate told Lantana police Lawson would “screw anything that walked” and was “oversexed.”

He was living at the Village on High Ridge. Employees stated they have found Lawson touching himself and was known for grabbing and fondling staff but he had no prior criminal record in Palm Beach County.

The Lantana facility is in the bottom 20% of the state’s nursing homes for administration, according to rankings by the Florida Agency for Health Care Administration. Overall the facility received two out of a possible five stars.

When the newspaper asked the facility about the situation, they responded the alleged sexual assault of a severely disabled 94-year-old man and resulting criminal charges had been blown out of proportion by the media and declined to comment.

New Jersey Drug Rehab Center Marijuana & Drug Abuse

When is the last time that you heard about someone who is high on marijuana assaulting someone unprovoked? Or totaling their car? Or overdosing? Or choosing to check into a drug rehab center? Chances are your answer is never. Most people who smoke marijuana don’t end up doing the bad things that people who abuse alcohol and other drugs do. Not to mention the fact that marijuana use in some form has been legalized in twenty-nine states and the District of Columbia.

California, Massachusetts, and Nevada recently joined seven other states and D.C. in adopting expansive laws legalizing marijuana for recreational use. The laws that passed allow adults age 21 and older to possess up to one ounce of marijuana for personal use. Other states have passed laws that allow for marijuana use for medical reasons. The scope of the legalization is varied, but there is a definitely a pattern of acceptance of marijuana use.

Doesn’t the fact that over half of the states in the U.S. allow for marijuana use prove that marijuana must not be that bad for you? Well, in a word, no. Much like alcohol and tobacco products are legal but can be dangerous, marijuana use does come with significant risks.

Risks Associated with Marijuana Use

While smoking marijuana may not be as dangerous as some other drugs and it may be legal in your state, it does have some serious negative ramifications, the biggest of which is addiction.

Marijuana use can negatively affect your health and your life in the short-term and long into the future, and it’s more than just the obvious – munchies and being apathetic. In fact, research shows that getting high affects your academic life and career. After a review of 48 different studies, the National Institute on Drug Abuse1 found that marijuana use is associated with reduced educational attainment (reduced chances of graduating). Another study found that workers who had a positive drug test for marijuana had 55% more accidents, 85% more injuries, and 75% more absences than other drug-free employees.

While the high from marijuana doesn’t last all that long, the effects on memory can last days or weeks, even when you stop smoking. So the impairment you suffer while using can continue to have adverse effects on your life in the short-term.

Long-term effects are more serious. Cognitively, marijuana can affect your intellect – especially if you start using it when you’re a teen. It affects brain development, thus the memory, learning, and thinking issues that may seem short-term, can last for a long period of time or even be permanent because it hampers the brain from building the necessary connections for those functions. In other words, if you’re brain isn’t fully developed (and it isn’t until you’re in your mid-twenties) when you start using marijuana, and you continue to use, by the time you quit when you are an adult, it may be too late. According to a study3 performed in New Zealand, long-time marijuana users who began using in adolescence suffered a 6 to 8 point loss of IQ.

Those statistics are especially unnerving when you consider that marijuana use on college campuses, where most users are under 25 years of age, is more rampant now that it ever has been before. Additionally, as many as 90 percent of marijuana users on campus participate in other dangerous behavior including binge drinking, smoking cigarettes, and risky sexual behavior.

Aside from the cognitive effects, smoking marijuana regularly can have long lasting health complications, including physical and mental issues. Any type of smoking leads to breathing problems, and marijuana is no different. A daily cough, excess phlegm, more frequent lung illness, and a higher risk of lung infections are just some of the problems you may experience. It can also cause heart problems because marijuana increases your heart-rate for up to 3 hours after smoking.

Using marijuana can also lead to mental illness in some long-term smokers. It can cause:

Hallucinations
Distorted perception
Paranoia
Worsening symptoms of other mental illnesses, like schizophrenia
Depression and anxiety
Suicidal thoughts – especially in younger users
Is Marijuana Addictive?

While there is debate about whether or not marijuana is addictive, the truth is that any drug use can lead to addiction, because the risk of addiction is different for each person. There is a genetic component that may predispose you to becoming dependent on drugs or alcohol, so using any substance, marijuana included, can be a dangerous thing to do. But it’s not only those who are predisposed who are at risk, there are many people who do not have the family history of addiction and yet they still became addicted.

Treatment for Marijuana Addiction

The good news is: if you are currently using or addicted to marijuana, and you want to stop, there is help available to get you clean. Despite the legalization and decreased stigma of marijuana use, more and more people are seeking treatment for marijuana addiction, so you are not alone.

Treatment for marijuana abuse and addiction is similar to treatments used for alcoholism and other drug addictions. Currently, there are no medications that are specifically designed for medication-assisted treatment of marijuana dependence, but professional detox facilities provide a supportive and safe place for addicts to get the drug out of their bodies. If detox from marijuana causes severe anxiety or panic attacks, medical staff may administer sedatives to relieve the withdrawal symptoms and make the patient more comfortable.

After being detoxed, patients have both inpatient and outpatient drug rehab facilities available to begin their recovery. Like addiction treatments for other drugs, therapy, addiction education, learning coping skills, 12-step meetings, and relapse prevention are typically included in marijuana dependence treatment.
