One common infection is MRSA (Methicillin-Resistant Staphylococcus Aureus). It’s resistant to several common antibiotics. MRSA occurs normally in one of two settings: in a healthcare setting like a nursing home or hospital or out in the community where one person has physical contact with the infected skin of another. A 2013 study of California nursing homes found that residents in 20 of the 22 facilities tested had the infection, according to US News & World Report2. According to the Mayo Clinic3 MRSA may start as swollen, painful red bumps on the skin that may look like pimples or spider bites. The area could be:

Warm to the touch

Full of pus or other drainage

Include a fever

The infected area can quickly become a deep, painful abscess requiring surgical draining. The bacteria may be limited to the skin or burrow deep into the body, possibly causing life-threatening infections in bones, joints, surgical wounds, blood, heart valves and lungs

The biggest risk factors of getting a MRSA infection are:

Being in the hospital where it affects the most vulnerable: older adults and those with weakened immune systems

Having an invasive medical device such as medical tubing (intravenous lines or urinary catheters) which can create a pathway for MRSA to travel into the body

Living in a nursing home where MRSA is prevalent and can be spread by residents, visitors and employees who may have the bacteria but who aren’t ill

Without proper precautions MRSA infections can spread. Those who are infected or colonized with MRSA are often put in isolation.

Visitors and employees may need to wear protective garments and follow strict hand hygiene procedures. Contaminated surfaces and laundry need to be properly disinfected.

You probably know this already but a study that was published earlier this year made it official, Florida has the most dangerous drivers in the country. Personal finance tech company SmartAsset looked at driver-related information and determined that the state is plagued by the most road perils. Four out of the top (or bottom, depending on how you look at it) ten states in the study are in the southeast.

2016 Marks A Banner Year For Breast Health

2016 was a monumental year for women’s breast health, with major advancements including the addition of insurance coverage of 3-D mammography by Cigna, increased efforts by the NFL to drive women to make breast health a priority, developments in research that prove the impact of screening patients ages 40 to 49 and research that confirms there is no need to observe a cutoff age for mammography.

With the year quickly coming to a close, Solis Mammography would like to highlight the top four advancements in breast health research and awareness that helped create a banner year:

1. Cigna announced they would begin providing insurance coverage for 3-D mammograms, becoming the first national private insurer to cover tomosynthesis (3-D). Aug. 23 – the day Cigna made the announcement – was a monumental day for women and women’s breast health, reported Solis Mammography. Medicare announced coverage in January 2015, and for the past 20 months, certain private insurers have added coverage, but only in select regional markets.

Cigna based the change on published clinical research from the National Comprehensive Cancer Network, which highlighted the benefits of 3-D Mammograms. The insurer now provides coverage of 3-D mammograms for annual breast cancer screening for all women over age 40 and for women at high risk starting at age 25.

2. The National Football League (NFL) provides a direct call to action for women’s breast health by encouraging and raising the importance of making time for annual breast cancer screening.

Since the inception of the NFL’s “A Crucial Catch campaign in 2009, it has raised nearly $15 million in the fight against cancer. Additionally, in October 2016, the NFL ran a series of commercials during prime-time football games that showed celebrity athletes filling in for busy women and moms, so they had time to go get their annual mammogram. The commercials highlighted a call to action that reinforces the importance of preventative health and regular screening – both key tenets of early detection.

3.  Solis Mammography’s chief medical officer and president of Rose Imaging Physicians Group, Dr. Stephen Rose, presented his abstract on Tomosynthesis’ Impact on Screening Patients 40 to 49 (comparing 3-D to 2-D) on Sunday, Nov. 27, at the Radiological Society of North America 2016 Scientific Assembly and Annual Meeting in Chicago.

The addition of tomosynthesis (3-D) to mammography in women 40 to 49 years old shows improved outcomes in recall rates and cancer detection rates (similar to the general population) versus 2-D mammography. Tomosynthesis (3-D) addresses a primary concern regarding screening women who are in their 40s by reducing recall rates as cited in both the U.S. Preventive Services Task Force and American Cancer Society guideline changes.

Adding 3-D to mammography takes about the same amount of time as digital mammography yet takes around 60 pictures. Radiologists can now see cancers as early as stage zero with tomosynthesis (3-D).

Rose commented, “Our study is confirming the benefits of tomosynthesis. For a disease with no known form of prevention, early detection is key, and the earliest detection is with tomosynthesis, especially in women under 50 years old with dense beast tissue.”

“For years, radiologists and referring physicians have attested to the importance of early detection in saving lives and in offering women the best treatment options,” Polfreman stated. “Adding 3-D to mammography represents the best technology available, offering more and clearer images of breast tissue, and less recalls, which in turn means less anxiety for the women we serve. This is an important milestone for women’s health, and we hope that with research like Dr. Rose’s, more private insurers will follow suit.”

4. In the largest study ever on screening mammography outcomes, researchers found that there is no clear cutoff age to stop breast cancer screening.

The findings presented at the annual meeting of the Radiological Society of North America by Dr. Cindy S. Lee, assistant professor in residence at the University of California San Francisco, and her research team lend support to the argument that the decision on whether or not to stop screening should be informed by an individual’s personal health history and preferences.

Using the largest amount of data ever gathered from the National Mammography Database, Lee and her research team analyzed data from more than 5.6 million screening mammograms performed over a 7-year period between January 2008 and December 2014 in 150 facilities across 31 states in the U.S. The research team looked at patient demographics, screening mammography results and biopsy results. Data from more than 2.5 million women over age 40 were sorted into patient groups by age in 5-year intervals (40-44, 45-49, etc.).

Overall, researchers found a mean cancer detection rate of 3.74 per 1,000 patients, recall rate of 10 percent, PPV2 of 20 percent and PPV3 of 29 percent. Based on increasing age from 40 to 90 years old, these performance metrics demonstrated a gradual upward trend for cancer detection rate, PPV2 and PPV3, but a downward trend in recall rate. Learn The Nine Signs Of Elder Prescription Drug Addiction

2016 Uhuru Expedition Celebrates 55th Anniversary Of Tanzania’s Independence

Truck Driver in Tracy Morgan Crash Won’t Go to Jail: Texas Truck Accident Lawyer Explains

The June 2014 truck accident that seriously injured comedian Tracy Morgan and killed another passenger in Morgan’s limo bus has struck a deal with the state of New Jersey that allows him to avoid serving any jail time in connection with the vehicular homicide, aggravated manslaughter, and other charges he faced stemming from that accident. According to one report, the driver faced up to 30 years in prison—time he won’t have to serve now.

The news may come as a shock to many, considering the facts of the case. As reported by CNN, investigators determined that the semi-truck driver had already driven 12 hours from his home before getting in his truck to begin a 14-hour shift. When he began his shift, he had gone 25 hours without sleep. At the time of the accident, he was driving over 20 miles per hour faster than the speed limit in a construction zone. He fell asleep at the wheel and crashed into the back of Morgan’s limo bus.

Morgan settled a civil lawsuit for an undisclosed amount against both the truck driver and Walmart, the company the truck driver was working for. Now, the semi-truck driver’s lawyer has stated that prosecutors in his criminal case have agreed to a deal that allows him to avoid any time in prison.

What Are Pre-Trial Intervention Programs?

Texas truck accident lawyer Amy Witherite explains, “Some states offer pre-trial intervention or diversion programs for certain offenders, usually first-time offenders with no criminal history.”

The truck driver in the Morgan case has agreed to enter such a program, which will last for three years. During those three years, he must perform 300 hours of community service and avoid any criminal charges. If he successfully completes the pre-trial intervention program, he can ask the state to expunge his criminal record.

To qualify for the program, the driver was required to plead guilty to all of the charges against him. However, those charges are put on “hold” while he completes the pre-trial intervention program. The charges are dropped at the conclusion of the program, as long as he complies with all of its requirements.

The crash has prompted many to call for stricter regulations regarding semi-truck drivers who commute for work. Current federal hours-of-service regulations prohibit semi-truck drivers from exceeding 14 consecutive hours of driving time following 10 hours of continuous duty.

The Dallas Truck Wreck lawyers at 1-800-Truck-Wreck are examining the effects of electronic logging devices (ELDs) installed in commercial trucks to determine whether this technology is helping to lower truck accidents.

One of the biggest contributing factors to commercial truck accidents is driver fatigue.

But the problem with driver fatigue is that it doesn’t just lead to drivers who fall asleep momentarily behind the wheel, or who are less alert, it also creates other factors that cause truck accidents.

For example, driver fatigue impairs judgment, which means that it can lead to dangerous behavior such as unsafe lane change, failure to obey traffic sign and failure to maintain speed.

In response, the U.S. Department of Transportation (USDOT) instituted hours of service regulations that mandated rest periods after a specific number of hours that a truck driver has been on the road.

Hours of Service Regulations

In 2012, the Federal Motor Carrier Safety Administration (FMCSA) implemented new Hours of Service regulations for all drivers of commercial vehicles, including big trucks.

The rule applied to any commercial vehicle involved in interstate commerce that fit one of these categories:

10,001 pounds or more in weight
Gross vehicle weight or gross combination weight of 10,001 or more
Transports 16 or more passengers (without a fee)
Transports 9 or more passengers for a fee
Transports hazardous material that requires a warning sign

For commercial truck drivers, the regulations created a 14-hour window, an 11-hour driving limit, and 60/70 hours-per-week on-duty limits.

During the 14-hour window, commercial truck drivers are allowed to drive a total of 11 hours if they have been off duty for 10 or more consecutive hours before that 14-hour window begins.

After the 14-consecutive-hour window ends, truck drivers cannot operate their vehicles again until they have remained off duty for another 10 consecutive hours.

The 14-hour window is longer than the 11-hour driving limit, because it takes into account rest periods, lunches, dinners and other activities that do not include actual driving.

One example illustrates how this would work:

After being off duty for 10 consecutive hours, a truck driver starts work at 7 a.m. That driver is allowed to operate that vehicle until 9 p.m. that night, which is 14 hours later. However, the driver is only allowed 11 hours of driving time during that 14-hour window.

The driver may not do any driving of any kind after 9 p.m., although he/she is permitted to do other work such as maintenance that does not involve driving.

The next time that truck driver can operate that truck would be at 7 a.m. the next morning, which is 10 consecutive hours off duty.

The 11-hour driving limit stipulates that no commercial truck driver can sit behind the wheel and drive for more than 11 hours.

The driver is mandated to take a 30-minute rest period after eight or more consecutive hours of driving have passed since the last rest period.

The 60/70 hours-per-week on-duty limit gives commercial truck drivers two choices: 60 hours of driving during any seven consecutive days, or 70 hours of driving during any eight consecutive days.

Daily Logs

The 2012 FMCSA hours of service regulations required that commercial truck drivers keep track of their rest periods and driving time in a daily log that is subject to inspection by government officials.

But the issue with daily logs is that some truck drivers do not accurately or truthfully record their driving time and rest periods, which means that the logbooks are not a reflection of how long those drivers were actually driving.

ELDs Are Now Required

To combat the incidences of inaccurate logbooks, the FMCSA recently passed a new proposal requiring the installation of ELDs in all commercial trucks by December 2017.

An ELD can interface with a truck’s engine to record hours driven, rest periods and other important data that conforms to inspection requirements.

Is the Wrong Problem Being Addressed?

But the question remains:  How effective are these hours of service regulations in actually lowering the rate of accidents?

A cursory glance at the 2015 USDOT motor vehicle accident report shows that the number of commercial truck accidents caused by fatigued drivers did not decrease significantly from 2014, nor did the number of fatigue-caused truck accidents in 2014 show a marked improvement from 2013.

In other words, for all the dangers posed by exhaustion among truck drivers, the real issue may not be the exhaustion among these men and women, but what is causing them to risk road safety by driving even when they know they are tired?

“What we’ve seen in the past decade is that driver fatigue is a huge problem with commercial truck drivers,” stated Dallas truck wreck attorney Amy Witherite, partner at Eberstein Witherite, LLP, a personal injury law firm with offices in Dallas, Houston and Fort Worth, as well as in Atlanta, Georgia. “The government has tried to combat this issue with proposals such as speed limiters in these vehicles that would prevent big trucks from exceeding a preset speed, and especially with hours of service regulations that now include electronic logging devices that record the time when a truck is in operation and alert drivers when it’s time to take a break. But to me, the real issue isn’t the fact that commercial drivers are exhausted, it’s why are they so tired, and what can we do to eliminate that cause?”

Witherite is referring to the fact that many commercial truck drivers are under tremendous pressure to make deliveries.

Truck carriers are not simply paid by the amount of cargo they are delivering to a location; they are largely paid premiums to deliver that cargo in the shortest amount of time possible.

Whether that urgency is to meet a client’s immediate demand for product, or is due to the perishable nature of the cargo that truck drivers are delivering, the fact is, many truck carriers demand that their drivers make delivery times above all else.

And that pressure to make a delivery on time has spurred many truck drivers to do whatever they can to bypass rest regulations so that they don’t lose their jobs by not meeting a delivery schedule.

In theory, rest regulations are supposed to keep exhausted drivers off the road, but in reality, how effective can these regulations be if truck drivers simply decide to ignore an ELD alert or a call from their supervisors asking that they stop to rest?

The very nature of commercial truck driving throughout the U.S. these days is one of urgency and timeliness, and that isn’t likely to change.

Millions of truck drivers are given conflicting directives: stay safe on the road, but do everything you can to make that delivery, or else.

When economic livelihood is at stake, most people will do whatever is necessary to ensure survival, and unfortunately, truck drivers risk the lives of others when they make the choice to drive when they are exhausted.

“Without having a tag-team system of some sort in which two drivers take turns hauling cargo, it is going to be very difficult to lower these incidents of driver fatigue-caused truck wrecks,” Witherite added. “The mentality that many truck carriers create is that of a race to the finish line, and they offer bonuses to drivers who can get the cargo to the delivery site on time or even a few hours before the scheduled time of delivery. The other side of that is truck drivers who actually try to follow the rules and get the proper amount of rest may not make those delivery windows, and that can mean they get fired for prioritizing safety over delivery time. It’s a persistent problem that will require a real culture-change in the mindset of the majority of truck carriers, who often only pay lip service to the safety of their drivers and other motorists on the road.”

Car Wreck Lawyers Examine Speed Limits And Their Effect On Car Accidents

For years, Texas has led the nation in the total number of car wrecks, and auto safety experts believe that one of the reasons is that the state has a high speed limit, which may encourage a mindset of driving at an unsafe speed among motorists.

And the truth is, speeding is one of the leading causes of car wrecks throughout the country, simply because most drivers cannot control a vehicle that is moving at a high rate of speed, which often leads to actions that compound the problem.

To understand the relationship between speed limits and accidents, it is important to first take a look back at the development of speed limits and their original intent.

Speed Limit History

According to the American Safety Council, the state of Connecticut passed the first speed limit law in 1901, which made it illegal to drive faster than 12 miles per hour in the city, and 15 mph on country roads.

And though other states followed with their own speed limits, the government did not institute a national speed limit law until the 1970s.

Until then, states had complete jurisdiction over speed limit laws, and speed limits in those days ranged from 40 mph to 80 mph.

This created confusion for interstate motorists who had to conform to faster or slower speed limits depending on what state they were visiting.

But in 1974, President Richard Nixon signed the Emergency Highway Energy Conservation Act, which included the National Maximum Speed Law (NMSL) that set the national speed limit at 55 mph.

The irony is that the impetus for the NMSL was less about safety and more about saving fuel, because the U.S. was in the midst of an energy crisis at that time, and studies had determined that driving 55 mph or under would conserve the most fuel.

Although car wreck fatalities decreased by the thousands in the years following enactment of the NMSL, many states and many drivers disregarded the law, arguing that the government had been too intrusive in implementing a law that should have been left up to each state.

In 1995, Congress responded to many opponents of the law and repealed the NMSL by passing the National Highway System Designation Act, which reinstated the power to set speed limits to each state.

Statistical Link Between Speed Limit and Car Accident Fatalities

The real question after the repeal of the NMSL was how the differing speed limits in the U.S. would affect the rate of car accidents.

“While the national speed limit of 55 miles per hour may have seemed too slow for many motorists, the most important aspect of that law to me was the positive psychological effect it had on making drivers aware of not going too fast,” stated car wreck lawyer Amy Witherite, partner at Eberstein Witherite, LLP, a personal injury law firm with offices in cities such as Dallas, Fort Worth, Tyler, Lubbock and Austin, as well as in Atlanta, Georgia. “I’m not saying that people didn’t violate or disregard the 55 miles per hour limit, but I am saying that it did create a mindset that I believe helped lower driving speed and lower accidents due to speeding.”

Research conducted by the Insurance Institute of Highway Safety (IIHS) supports Witherite’s comment.

According to IIHS, there have been an estimated 33,000 car wreck fatalities in the U.S. since the repeal of the NMSL.

A study the IIHS conducted in eight major cities (Albuquerque, Atlanta, Boston, Denver, Los Angeles, Omaha, Tampa, and Washington) found that the average rate of speed among motorists routinely exceeded the speed limit in half these states.

In Albuquerque, 38 percent of the drivers surveyed exceeded 70 mph on highways, and 49 percent of drivers in Tampa exceeded 75 mph on suburban and rural interstates.

Not surprisingly, drivers in Los Angeles exceeded the speed limit more than any other city surveyed.

A staggering 86 percent of drivers in Los Angeles routinely drove faster than 70 mph, 35 percent drove faster than 80 mph, and 10 percent drove faster than 85 mph.

More troubling, the average driver drove at 78 mph, which was the highest number the IIHS had recorded in the history of its speed limit surveys.

“During the 1990s, opponents of the national maximum speed limit argued that since drivers were already exceeding posted limits, states should be able to set limits to match then-current travel speeds,” stated Anne McCartt, Senior Vice President for Research at IIHS. “The result was faster travel and more highway deaths.”

And as Witherite pointed out, high speed limits may encourage motorists to not only push the edge of that limit, but to exceed it.

In other words, a speed limit of 70 mph may mean that drivers will actually go faster than that speed, hitting 75 mph or 80 mph.

“You really have to build in five or ten additional miles per hour when you have a speed limit,” Witherite added. “It’s just not realistic to believe that drivers will stay under or at the speed limit, especially on highways. So when you had a 55 miles per hour limit, you could probably count on drivers traveling at about 60 miles per hour or 65 miles per hour, which is still reasonable. But once the government left it up to the states, 70 miles per hour and 75 miles per hour are permitted on some highways, so just imagine how fast drivers will actually go. It’s a recipe for more speeding accidents and more fatalities.”

Effects of High Speed Limit In Texas

Texas is a state with some of the highest speed limits in the country, but other states also have high speed limits, which is likely the result of a culture that places a premium on getting to destinations in as short a time as possible.

According to the Texas Department of Transportation (TxDOT), the law has established the maximum highway speed limit in Texas at 70 mph, but the Texas Transportation Commission is allowed to set a speed limit of 75 mph, 80 mph or 85 mph, if a highway engineering study finds that this is a safe and reasonable speed, and if the highway is built to accommodate that speed.

These speed limits only apply to highways, because TxDOT only has jurisdiction over the highway system. Local governments determine speed limits on city streets and county roads.

Texas is also home to a stretch of highway that has an 85 mph speed limit, the highest speed limit in the U.S.

The record-breaking stretch of road runs on SH 130, which spans 41 miles from IH 35 in Williamson County to US 183 in Travis County.

Texas also has an 80 mph speed limit on a stretch of road that runs on SH 45 S, which spans 9.2 miles from US 183 to IH 35 in Travis County.

The speed limit gained the attention of the Governors Highway Safety Association (GHSA), a nonprofit organization dedicated to highway safety.

“Speeding is a big issue where we are not making progress,” stated GHSA spokesman Jonathan Adkins.

In addition, Texas also allows vehicles on rural freeways to travel at a maximum speed of 85 mph.

The reason for this high speed limit is that rural freeways often have little traffic and are built in sparsely populated areas, which lowers the risk of a car wreck.

But those facts did not prevent the first recorded fatal car wreck on SH 130 on November 11, 2012, when the driver of a Honda Civic died after crashing into a Chevy Tahoe in the southbound lane.

Martha Melinda Harris, 60, a resident of Lockhart, TX was killed in the car wreck, and the driver and passenger in the Tahoe – whose names were not disclosed – suffered minor injuries.

In 2015, there were 16,754 total car wrecks caused by unsafe speed, according to TxDOT, and 290 people died in those accidents.

It’s impossible to determine how many of those accidents were influenced by the higher speed limits in Texas, but the fact is that anytime a speed limit is raised, drivers tend to respond by going five to 10 mph over that limit, which becomes a habit.

Charles Framer, Vice President for Research and Statistical Services at IIHS framed the debate in stark terms.

“Since 2013, speeds have only become more extreme, and the trend shows no sign of abating,” Farmer stated. “We hope state lawmakers will keep in mind the deadly consequences of higher speeds when they consider raising limits.”
