New York City Defective Product Lawyer Jonathan C. Reiter – PetSmart Agrees to $4.25 Million Penalty in Defective Fish Bowl Case

Most people don’t think of fish bowls when they imagine a dangerous product. However, a recent penalty assessed against pet product retailer PetSmart demonstrates why it’s important for all manufacturers and retailers to follow the law when it comes to keeping dangerous products off their shelves.

According to a press release from the Consumer Product Safety Commission (CPSC), PetSmart has agreed to pay a $4.25 million civil penalty for failing to report certain fish bowls sold by its stores. The glass fish bowls contained a defect that posed an unreasonable risk of injury. Shaped like a brandy snifter with a small pedestal bottom, the fish bowls are sized to hold 1.75 gallons of water.

The fish bowls, which were manufactured by “Top Fin” and “Grreat Choice” (misspelling intentional) were made of glass that contained a flaw that made the bowls prone to cracking, breaking, and shattering during regular use. PetSmart received 19 reports of injuries, including 12 reports of serious injuries. In some cases, consumers suffered deep lacerations that needed stitches. Three consumers suffered severed tendons that required surgical repair.

An investigation by the CPSC revealed that PetSmart failed to identify the correct number of bowls affected, as well as the correct distribution dates of the affected products. Initially, the retailer recalled just 10,200 fish bowls in 2014. Due to the misidentification, it had to expand its recall to 81,300 fish bowls in 2015. The recall affects consumers in both the U.S. and Canada.

In addition to paying the penalty, PetSmart has also agreed to implement an enhanced system of internal procedures to help it comply with the Consumer Product Safety Act.

The holidays can be filled with mixed emotions for those in early recovery. There’s often a sense of excitement about experiencing the joy of the season and gratitude to be able to share this special time with those close to us.  And yet many also experience feelings of stress and anxiety about family expectations and managing the triggers related to celebrating the holidays. During this time, addiction treatment professionals can support clients in early recovery with utilizing tools to aid in managing potential emotional and environmental stressors. In working to treat individuals in early recovery,  it is especially important to be mindful of these emotional states and offer a variety of ways to build and strengthen individual’s coping skills to help them be able to better handle both the joy and the stress of this time of year. Here are some strategies to help you guide your recovering clients through the holidays:

      Encourage the development of a plan to help guide the activities around your client’s celebrating. It is helpful to schedule fun and enjoyable activities that involve healthy and supportive people such as watching a funny movie, having coffee with a friend, or playing a board game. Limiting idle time can be an effective way to avoid falling back into old, maladaptive behaviors.
      Discuss the importance of maintaining the normalcy of a regular routine. That involves attending twelve step meetings, attending work/school, eating regular meals, sleeping and exercising. Check in with your client about the activities of daily living that help them to feel healthy and grounded.
      Help your client to identify a support system whom they can ask for help from during the holidays. In early recovery, it can be challenging to face family, friends and other relationships that may have been negatively impacted by their addictive behaviors. In addition, discerning which relationships are healthy and which are unhealthy can be difficult to assess in early recovery. Thorough evaluation of these relationships in counseling can assist individuals in gaining insight and understanding to help them make healthy decisions regarding their support system. Mustering the courage to ask for help can sometimes be hard to do, but letting family and friends know how they can help will provide the support necessary when your client needs it most during the holidays.
      Research local twelve step meetings days/times for the areas that your client will be visiting. Many recovery clubhouses and twelve step meetings often have a designated holiday schedule consisting of hourly meetings and special celebrations for the recovery community.
      Discuss the importance of taking time to relax. Simple ways to slow down can be done by reading a book, mediating, listening to soothing music – intentionally spending time just quieting the mind from all the hustle and bustle of the holidays can help those in early recovery avoid becoming overwhelmed and stressed.
      Explore the use of journaling with your client. Journaling can be structured with goals to address the stressors of the day or difficult feelings that were experienced. But journaling can also be free flowing with focus on gratitude for life’s gifts and even prayer. Whether it’s a gratitude list, prayer of thanks, or reflection of the day’s events, utilizing a journal should be encouraged for recovering individuals to help them slow down and reflect on their strengths to manage life’s challenges.
      Address potential triggers related to risky People – Places – Things that your client may be exposed to over the holidays. Helping your clients to recognize which triggers pose a risk can lead to the development of healthy decision making and healthy coping skills. With this gained insight, one can choose to avoid these triggers altogether or a safety plan can be created in the counseling session that identifies steps to manage these triggers and aid in relapse prevention. Examples of such steps include limiting the amount of time spent in high stress situations or bringing a supportive friend along to an event.
      Promote reframing negative thoughts with positive affirmations in your counseling sessions. Individuals in early recovery often struggle with negative thoughts and diminished self-confidence. Focusing on happy, healthy thoughts will lead to keeping a rational perspective of themselves and the world around them which can strengthen self-confidence to better be able to cope with stress. Work with your client’s cognitions to build mindfulness of negative self-talk and practice thought-stopping exercises to minimize the power of those negative messages.
      Educate your client about boundaries and practice defining healthy boundaries in their relationships. Remind your client that it’s ok to say no. For when they over-extend themselves or do too much for others, they often compromise themselves and their recovery needs. Setting healthy boundaries and maintaining a balanced lifestyle are important components of long term recovery.
      Teach your client to prioritize self-care through being diligent in maintaining their daily steps of wellness such as: Taking a shower/bath, meal planning, staying hydrated, physical activity or exercise, getting a haircut or nails done, or taking medication/supplements as prescribed.

The stress of the holidays may be unavoidable, but by providing a toolbox filled with a variety of therapeutic tools, your clients can find healthy ways to manage the stress without compromising their recovery. As an addiction treatment provider, you have an amazing opportunity to support your clients in gaining the strength and ability to manage these holiday stressors and empower them to have the confidence to manage life on life’s terms.

Drug Addiction: The Shocking And Disastrous Tie To Trauma Exposed

There is a powerful connection that exists between trauma victims and substance abuse or addiction. Many people who have experienced a traumatic event or suffered ongoing trauma, turn to drugs or alcohol as a way to cope with negative emotions. While this type of self-medicating often works – at least temporarily – to quiet the sufferer’s feelings and memories, it can ultimately lead to addiction, and that can be a recipe for disaster.

What is Trauma?

Trauma is broadly defined as, “a deeply distressing or disturbing experience.” Perhaps this definition is intentionally vague because trauma is such a personal and subjective issue. Two people who experience the same disturbing experience may react in completely different ways. Trauma is really defined by the individual; it’s what his or her internal beliefs and sensitivity to stress dictate, not what a friend, family member or doctor diagnoses.

Traumatic experiences can include physical, sexual, or emotional abuse, or neglect as well as other frightening events like military combat, accidents, bullying, natural disasters, or any life-threatening incident, whether experienced personally or witnessed. Trauma can also occur as a result of childhood issues such as growing up in an alcoholic or drug-addicted home, or with abusive mentally ill household members.

Trauma can cause feelings of extreme fear, helplessness, and hopelessness. The person suffering may struggle with anxiety and depression, and may even develop post traumatic stress disorder (PTSD). It is no wonder that many trauma survivors resort to using drugs or alcohol as a way to cope.

The Relationship Between Trauma and Addiction

Research shows that there is a strong link between trauma and addiction. In fact, it’s estimated that over half of people who seek help for substance abuse or addiction have been victims of some type of trauma; and those numbers are increased when childhood abuse or neglect caused it. But the trauma-addiction relationship is not a one-way street. It is a cycle that perpetuates itself unless proper treatment is sought and received.

Trauma is a Risk Factor for Addiction

Unresolved trauma can have a disruptive effect on a person’s daily life, making relationships, work, and school difficult. It can cause much more than depression and anxiety. A person who has suffered trauma may have flashbacks and nightmares of the event, panic attacks, negative memories, and problems sleeping. Because people who have been traumatized often attempt self-medication to help manage the distress associated with the symptoms of unresolved trauma, they are at risk of developing a drug or alcohol problem which may lead to addiction. They turn to drugs or alcohol to numb themselves from the flood of emotions and reminders associated with their trauma, to quell the relieving symptoms, or to be able to sleep.

Addiction is a Risk Factor for Trauma

Trauma being a risk factor for addiction may seem logical because the desire to shut off the negative symptoms is so strong. However, the opposite is also true. Addiction can be a risk factor for trauma, as well. People with substance abuse issues are more likely to engage in risky behaviors (driving while using drugs or alcohol, frequenting unseemly places with sketchy people, promiscuity, fighting, or other dangerous behaviors) which increases the likelihood of experiencing traumatic events, including harm to themselves or witnessing harm to others.

Regardless of which comes first, the trauma or the addiction, people who suffer from both experience behavioral and emotional difficulties, and that makes it much harder for them to stop using drugs or alcohol. So a successful treatment approach must tackle this dangerous cycle.

Recovery for Dual-Diagnoses

When unresolved trauma and addiction are at play together, what began as one problem becomes increasingly complicated by a second serious problem. The strategy that was being used to cope will itself become so disruptive that treatment is needed.

Sometimes people are unaware that they are using drugs or alcohol to cope with unresolved trauma. They may only remember parts of the trauma that they experienced (or not remember at all), yet they are experiencing problematic patterns in their lives, that they cannot seem to resolve. They may end up in drug rehab, or another type of treatment, but they will likely get stuck in a cycle of repeated relapse until the unresolved trauma is addressed as well.

Whether you are a trauma survivor who began using substances to cope and developed an addiction, or an alcoholic or addict who suffered trauma as a result, it is important for you to find treatment that addresses both issues.

In the past, it was thought that each condition had to be treated independently of the other, and they would be addressed at separate facilities. People with unresolved trauma or PTSD were sent to mental health professionals, while addicts and alcoholics were sent to rehab. It is now recognized that not only is it possible to treat both conditions concurrently, it is better for the patient to do so. It is not enough to treat the addiction without treating the unresolved trauma, and vice versa.

Many treatment facilities are now equipped to handle dual diagnosis patients; they treat a number of mental health issues while also addressing the addiction. Comprehensive treatment for both mental health and addiction issues is needed to lessen the chances of relapse. Without it, relapse rates are very high. Strategies for relapse prevention for a trauma victim will include learning coping skills for managing the psychological and emotional triggers for drug or alcohol use.

Dallas Criminal Lawyer Helms Wins Acquittals Before Texas Highest Criminal Court

On December 14, 2016, Texas’ highest criminal court, the Court of Criminal Appeals, reversed the convictions of a husband and wife who were convicted at trial of bribery of a judge, reports Dallas criminal lawyer John Helms. In State of Texas v. David Cary and State of Texas v. Stacy Stine Cary, the Texas Court of Criminal Appeals held that the evidence at trial was insufficient to prove bribery under the Texas bribery statute.

The trials took place in McKinney, Collin County, Texas. The Carys were convicted of bribing former State District Judge Suzanne Wooten. The State’s theory was that the Carys directed payments to Ms. Wooten’s campaign manager, who used the funds to pay campaign bills at times when the campaign had not yet raised the money to pay the bills. Ms. Wooten ran against incumbent judge Charles Sandoval, who was presiding over a highly contentious child custody matter involving Mr. Cary and his ex-wife. There was evidence that the Carys wanted someone to defeat Judge Sandoval, who was widely regarded as highly vindictive, but there was no evidence that Ms. Wooten knew about the Carys’ relationship with her campaign manager. Ms. Wooten ultimately defeated Judge Sandoval in the election.

John Helms, a criminal defense attorney in Dallas, represented the Carys on appeal. He argued to the high court that, as charged, the Texas bribery statute required the State to prove beyond a reasonable doubt that the payments to the campaign manager were NOT campaign contributions, but in fact, under a proper interpretation of Texas law, the State had actually proved that they WERE campaign contributions. Because the jury was not charged and instructed on a theory of bribery by campaign contribution (which requires a much higher level of proof that the State did not meet), the State’s proof was insufficient. The Court of Criminal Appeals agreed and ordered that the Carys must be acquitted of all charges.

The ruling from the state’s highest criminal court effectively ends a multi-year nightmare for the Carys, who maintained their innocence from the beginning. “The Carys are obviously very relieved and very happy this is over. Justice is finally served,” added criminal defense attorney Helms.
