Can You Get Arrested For Laughing At The Police?

Most people know what’s legal and which types of behavior will get you arrested. If you rob a bank, for example, you’re going to get charged with theft. If you punch someone in a bar, you can count on being taken into custody for assault.

However, some allegedly criminal behavior exists in a gray area. In some cases, whether a person’s conduct constitutes a crime comes down to their word against the word of the police officers involved.

Police officers have a tough job. They’re supposed to protect the public, enforce laws, and promote safety. But they don’t have unlimited authority to govern people’s conduct.

Interfering with an arrest is one thing. If an individual tries to stop the police from doing their job, the police have the authority to make an arrest. However, is laughing at the police a crime? Is taunting police officers a criminal offense? A recent case is asking that question.

Former NFL Player Arrested for “Taunting” the Police

In the NFL and other professional sports, players can get fined for taunting the opposing teams, fans, or officials. But what happens when they do it off the field?

In a recent case, one former NFL player is facing charges for allegedly taunting the police during a friend’s DUI arrest.

According to Bleacher Report, former football player Louis Delmas was arrested in Miami for “yelling at an officer while he conducted a field sobriety test on Delmas’ friend.”

The official name of the charge levied against Delmas is “resisting arrest without violence.” He was released on $500 bond.

Tips for Interacting with the Police

In most cases, the police aren’t going to arrest someone for laughing at them. However, if you put yourself between the police and a fleeing suspect, or you are a distraction that prevents officers from fully concentrating on carrying out their job, you could be arrested.

It’s quite possible that Delmas was simply concerned for his friend, or that he felt the police were wrong to stop his friend. However, a better course of action would have been to stay calm and seek legal counsel as soon as possible.

Let Police Do Their Job. Keep in mind that the police are responsible for their safety and yours. If you are distracting to the point that they feel you’re a threat to their safety, a suspect’s safety, or your own safety, they have the authority to take you into custody.

Cooperate, then Call Your Lawyer. If you disagree with what the police are doing, it’s best to be cooperative and to follow their instructions. Video Series – What Are The Treatment Programs At Summit Behavioral Health

In a recent addition to their Health and Wellness series of videos, Summit Behavioral Health’s Chief Operating Officer, Maria Ulmer MA, LMFT, CAADC, spoke about the types of drug and alcohol addiction treatment programs the organization offers to clients.

Will Tech Make It Possible For Police To Predict Crime?

Several years ago, Steven Spielberg made a movie called “Minority Report,” in which police officers in the future used technology to predict crimes. They were able to “see” crimes before they happened, and they arrested the future perpetrator before the crime could take place.

As you might expect, this cut down on crime, but it wasn’t foolproof. Is a “predicted” crime a crime? If the actual crime doesn’t take place, what is the person being prosecuted for? And what if the technology makes a mistake? In the movie, that’s precisely what happens to Tom Cruise’s character when he’s accused of a future murder in error.

If this sounds like nothing more than an interesting movie plot, think again. According to one report, the company behind police tasers is introducing a body camera that will enable police to “anticipate criminal activity.”

Police Body Cams That Predict Crime

The Intercept reports that Taser International—the company that manufacturers taser guns and other police technology—has acquired a “computer vision” startup. Taser plans to market the computer vision technology to police departments and says officers will be able to “automatically…detect emotions and objects” without human intervention.

In essence, artificial intelligence will analyze a person’s face and characteristics and compare it to millions of faces and other information in police databases.

Although Taser says the more advanced features of its product are between five to seven years away, it believes that computer analysis can be used to predict future criminal activity. “Analytics will also allow departments to observe historical patterns in behavior for officer training,” a company spokesperson stated.

An Arizona State University scientist who contributed to the Law Enforcement Technology Report stated: “…patterns of individual behavior will become increasingly informative in revealing the probability that an individual will act in a particular fashion.”

A portion of the report states, “Imagine you can find out if someone has a criminal record instantly — or be notified if someone’s demeanor has changed and may now be a threat.”

While this technology may still be years away, retailers are already using computer analysis and artificial intelligence to predict what people will buy. As the article points out, Wal-Mart, Amazon, and Google comb user data to optimize search results and tailor what types of content people see online.

The ISO 16890 standard – which took effect on December 1, 2016 – creates new guidelines for air filter efficiency with values that replace the old ASHRAE standards’ Minimum Efficiency Reporting Value (MERV). In the past, ASHRAE 52.2 and EN779 were a cause of confusion among air filter consumers as they were unsure how to compare efficiency rates in countries that did not use the same standards.

“This new standard clears the field for both air filter consumers and air filter manufacturers,” added Wood. “With ISO 16890, comparisons are now useful, because every filter is subject to the same standards. Therefore, consumers can compare air filtration products and devices on an equal basis, and decide what works best for their needs. In the long run, this will also benefit consumers because it will drive out some of the lower-quality products from the market.”

The ISO 16890 Standard also rates the ability of air filters to trap ultrafine particles, referred to as PM1, that are one micron or less in diameter. Furthermore, air filters are now tested for efficiency when they are new, and also after their electrostatic charge has faded or been removed. This secondary testing is important because studies have found that electrostatic charges artificially enhance air filter performance during lab testing. The requirement of a second test now provides a true analysis of an air filter’s capability to trap hazardous particles.

What Coal-Burning Plants Are Doing To The Environment

Throughout the world, coal-burning power plants are generating the energy required by millions of residences and commercial facilities. But these coal-burning plants are not just providing energy, they are also triggering the release of harmful particulates that are worsening air quality.

In fact, burning coal caused nearly 400,000 premature deaths in China in 2013, according to the New York Times. Coal burning generates 40 percent of the country’s harmful pollutants known as particulate matter (PM), contaminants that include solid and liquid airborne particles. (1)

There are three critical ranges of PM – PM10, MP2.5 and PM1. The latter, PM1 and PM2.5 are the most dangerous to human health because they are very small, smaller that the eye can see, which makes it easy for people to inhale or swallow these contaminants. Once PM enters the body, it can harm the lungs and respiratory passages, and studies have found that long-term exposure to PM1 and PM2.5 can cause decreased lung function, lung cancer and heart disease.

Coal-burning is especially dangerous in China because the country uses as much coal annually as all other countries combined, and coal burning in the country is the biggest source of both air pollution and greenhouse gas emissions, the leading cause of climate change.

So why is coal such a major contributor to pollution not just in China but also throughout the world, and what steps are countries taking to reduce the amount of coal burned by power plants?

How Coal Power Causes Pollution

Coal is a combustible black fossil fuel that is made of carbonized plant matter found in deep underground reservoirs. It is a primary source of fuel in many countries, especially developing countries, because it is cheap and plentiful.

But as mentioned earlier, there are consequences to using this fossil fuel, which become clearer as you begin to understand how coal power causes pollution.

When coal is burned, it releases carbon dioxide (CO2), which scientists have found helps trap heat and is a primary cause of global warming. But long-term exposure to CO2  is also harmful to human health, because it can lead to dizziness, difficulty breathing, headache and an inability to make logical decisions.

At higher concentrations, CO2 can cause you to become unconscious, and if medical treatment is not available, it can lead to death.

And according to the Union of Concerned Scientists, the average coal-burning plant in the U.S. creates 3.5 million tons of CO2 each year, making the U.S. and China the countries with the largest total coal emissions in the world. (2)

What makes coal burning even more dangerous to human health is that it also generates sulfur dioxide, nitrogen oxides, mercury and lead.

Coal burning plants are the biggest generators of sulfur dioxide in the U.S., and sulfur dioxide has been linked with lung disease due to microscopic, acidic particulates that enter the lungs.

Nitrogen oxide has been linked with the creation of ground level ozone that contributes to lung tissue damage, worsens asthma conditions and increases the risk of people developing respiratory illnesses.

Numerous studies have identified PM as a contributor to illnesses such as bronchitis, lung disease, and heart disease. In fact, people in countries where PM is at a high level often experience higher incidences of premature deaths. And to put things into perspective, the average coal-burning plant emits 500 tons of PM into the environment each year.

How to Reduce Coal Pollution

Countries are beginning to find answers to the challenge of how to reduce coal pollution.

In the U.S. for example, CO2 emissions from all power plants decreased 21 percent from 2005 to 2015, driven in large part by the country’s adoption of the Clean Power Plan. (3)

Part of this decrease in emissions has been achieved by a gradual shift from coal-burning plants to plants that generate electricity through natural gas.

China is following the U.S.’s lead and is investing in other sources of clean energy, while also implementing stricter emission standards for coal-burning plants.

“Coal is an inexpensive way for developing countries to generate the power necessary to meet increasing energy demands,” Kevin Wood, Camfil USA Vice President Sales & Marketing. “But the consequence of coal-fired power plants as well as coal used for household cooking is that it creates toxic pollutants. Countries are beginning to implement clean-energy solutions to lower outdoor coal pollution. They are also implementing public education strategies to help their citizens begin the shift from coal-based cooking to electrical and gas-based cooking.”

How to Reduce Your Carbon Footprint

As countries around the world grapple with how to handle pollution generated by coal-burning plants, government officials continue to urge the public to join in the fight.

The Most Dangerous Highways Are In FL Says Boca Car Accident Lawyer Joe Osborne

You may drive on at least one of them frequently and according to the Auto Insurance Center, sponsored by a group of insurance companies, they are the most dangerous in the country: I-95 and I-10. I-95’s southern end starts in Miami and ends on the Canadian border in Maine while I-10 starts in Jacksonville and goes all the way to Santa Monica, California. They stretch across the country, says Boca car accident lawyer Joe Osborne, but locally they can be very dangerous.

The Auto Insurance Center (AIC) looked at the National Highway Traffic Safety Administration (NHTSA) statistics and found that in 2014 I-10 was the scene of 278 deaths and I-95 was where 204 people died.

Florida’s 382-mile stretch of I-95 was the most dangerous road in the country, with the worst rate of fatal accidents, from 2004 to 2008 according to NHTSA reports the Sun Sentinel. Aggressive and distracted drivers along with heavy traffic congestion may have been to blame.

One of the problems with I-10 is that there are long stretches without barriers between those going in opposite directions. If a driver loses control of a vehicle and heads toward those coming the other way there’s nothing to prevent it.

Florida is not listed as one of the most dangerous or safest five states when it comes to fatal traffic accidents. Wyoming is listed as the worst with 25.7 traffic deaths per 100,000 population and New Jersey is the best at 6.2.

The AIC also has a number of other facts:

Motor vehicle crashes killed 32,675 people in the U.S. in 2014, which averages out to a fatality about every 16 minutes.

Driving while impaired by alcohol was a factor in at least 31% of the fatal crashes. The most frequent blood alcohol level was .22%, about 2.5 times higher than the legal limit in most states. Young drivers have the highest risk of being involved in an alcohol related fatality. For those people involved in fatal accidents in 2014, 30% of drivers with blood alcohol content levels of 0.08% or above were 21 to 24 years old.

More than 1,900 (or 6%) of traffic deaths involved drug use. When lab tests were done on drivers killed in accidents marijuana was present in 900 fatal vehicle crashes, almost half of the total. Other drugs found included cocaine (a factor in 241 fatalities), amphetamines (224 fatalities) and methamphetamine (212 fatalities).

Based on five years’ worth of data the most dangerous days of the year to drive are July 4, January 1, September 18, August 4 and August 27. Traffic accident deaths on those days are about five times the average.

The most dangerous time of day to drive is during the afternoon rush hour, between 5:00 and 6:00. Despite this, the most dangerous day of the week happens when most of us don’t work, Saturday, with 5,317 deaths, followed by Friday with 4,658.

July and August are the most dangerous months each with more than 2,700 deaths. The month with the least fatalities is February with 1,917.

Criminal Charges For Looting After Hurricane Harvey

The flooding and devastation caused by Hurricane Harvey will affect Houston and greater Texas for years to come. As people slowly begin to return to their homes and rebuild, prosecutors in Harris County and the surrounding areas have already pursued looting charges against 14 people, according to media reports.

The Harris County District Attorney has also stated that “burglarizing a home in a disaster area could carry a life sentence under Texas law.” Under state law, prosecutors can also pursue enhanced penalties for property crimes, such as burglary and robbery, which occur “during a state of disaster.”

However, is there a difference between looting for material gain and looting for survival? If you’re charged with “stealing” bottled water or groceries because you’re desperate and starving, does the law allow any leniency? A natural disaster like a severe hurricane often forces courts to examine the individual and unique circumstances of a case and the environment in which it occurred. Just a handful of states have specific laws that address looting. In most states, prosecutors turn to theft statutes to pursue charges against individuals charged with looting.

Looting for Survival vs. Opportunistic Theft

The potential differences between looting for survival versus so-called “opportunistic theft” surfaced when an ABC News reporter announced on Twitter that he had observed individuals breaking into a grocery store and had reported them to the police. The reporter faced backlash online, with people responding “looting a supermarket in a flood is also known as getting food” and “people taking food from supermarkets in a multi-day disaster are not looters, they are survivors.”

Most people tend to make a distinction between “theft” of things like food items, water, and first aid supplies versus breaking into an appliance store and making off with plasma televisions and expensive electronic equipment. The first items likely have little monetary value; the second are unrelated to basic needs, such as food and water.

According to a Forbes report, social psychologists even make a distinction between “looking of goods needed for survival,” “opportunistic theft of goods such as TV sets,” and “collective action, conditioned by the political environment.”

James Glass, a political science professor at the University of Maryland, calls the first type of looking “justifiable,” stating, “When there is a breakdown of civil order, and when people fear they are going to starve or die of thirst, one could make a moral case in these sorts of circumstances for looting.”

Summit Behavioral Health Will Sponsor 2017 Drug Prevention Walk In Cranford, NJ

Summit Behavioral Health is a major sponsor of the 2017 Drug Prevention Walk that takes place Saturday, October 21, 2017 at 10:00 am at Nomahegan Park, 1024, Springfield Avenue, Cranford, New Jersey 07016.

“New Jersey is suffering through a horrible heroin crisis,” stated Paul Lavella Jr. MA, LPC, LCADC, ACS Director of Alumni Services. “It’s important that every one of us to do what we can to support programs that help addicts recover and regain control over their lives. Last year’s walk showed the power of a group of people committed to the same goal, and as a major sponsor this year, we are hoping to exceed all our fundraising goals.”

The Raymond Lesniak ESH Recover High School provides recovery support programs – including 12 Steps, individual and family counseling and mentorship, family support that encourages parents and students to work together in the recovery process, emergency assistance, housing  assistance, and child care. The high school also offers continuing education classes for adults, as well as job training programs.

Prevention Links will also receive a portion of the donations for the Drug Prevention Walk, as the organization continues to provide educational resources that can help steer young people in the right direction and prevent the next generation from becoming addicts.

Tourist Death From Jet Engine Blast

When you’re on vacation, the last thing you should have to worry about is being involved in a life-or-death situation. Yet for one woman visiting the Caribbean, an island getaway turned tragic.

News reports state that the woman was a 57-year-old mother visiting St. Maarten from New Zealand when she was killed at Princess Juliana International Airport. According to media reports, the mother of three was standing behind a fence separating the airport’s runway from the beach when a jet’s engine blasted her from her feet and sent her flying into nearby rocks. She struck the rocks and was knocked unconscious. She later died from her injuries.

Jet Engine Tourist Attraction: Too Dangerous?

The tragic story has drawn attention to a relatively common tourist attraction on St. Maarten. According to media reports, tourists from around the world flock to the beach adjacent to the airport to watch jets fly in and take off. Videos available online show just how close massive airliners get to the beach as they approach the runway, and dozens of YouTube videos show tourists in bathing suits clinging to the airport’s chain length fence as jets prepare to take off. Tourists can stand just yards away from aircraft — and some can be seen tumbling away from the fence and into the sand.

Spokespersons from the St. Maarten police department told reporters that there have been minor injuries in the past due to the tourist attraction, but that no one has ever been killed. The incident has caused many to question whether the airport bears any responsibility for permitting people to get so close to the runway and the planes. One video posted by the Washington Post shows a young girl being blasted forcefully away from the fence near the runway and catapulted into a concrete barrier beside the beach. The force of the jet’s engine is so powerful she is lifted off the ground and slammed headfirst into the concrete.

The fence separating the beach from the airport has barbed wire along the top, and the fence itself contains several signs that explicitly state that jet blasts can cause severe physical harm and/or death. Media reports also state that police officers from the island regularly patrol the fence during busy hours.

Are Weaponized Police Drones On Their Way?

It may sound like something out of a science fiction movie, but weaponized drones may soon be hitting the skies — at least in Connecticut.

Lawmakers in Connecticut have introduced a bill that would allow law enforcement agencies to use drones equipped with weapons capable of inflicting deadly force. The proposed legislation has been opposed by civil liberties groups, but is still pending before state lawmakers.

Interestingly, the bill was actually written as a total ban on weaponized drones, however, an exception was added in later to exclude law enforcement agencies from the ban. Theoretically, this would give police departments the authority to use drones outfitted with weapons, which they could ostensibly use to inflict deadly force on citizens.

Civil Liberties Groups Oppose Weaponized Police Drones

Citing research showing that police tend to unfairly target those in minority communities, opposition groups have stated they fear that okaying weaponized drones for police departments will result in an uptick in the misuse of deadly force against minority communities.

The executive director of the American Civil Liberties Union in Connecticut stated, “Data shows that police force is disproportionately used on minority communities, and we believe that armed drones would be used in urban centers and on minority communities.”

Weaponized drones are banned in 36 states, and four states have adopted policies that limit police drones. North Dakota passed legislation allowing weaponized police drones in 2015, however, the drones are limited to “less than lethal” weapons like tear gas, pepper spray, and rubber bullets.

If the bill in Connecticut passes, the state will become the first to allow police drones to include weapons capable of inflicting deadly force. The bill also provides that new policies governing the use of weaponized police drones in the state would have to be developed by the state’s Police Officer Standards and Training Council.

Opponents of Police Drones Say Robots and Drones Depersonalize the Use of Force

Dallas police made headlines in 2016 when they used a robot to exercise deadly force against a suspect in a standoff. Opponents of weaponized police drones say the situation is similar and takes the “human” element out of the decision to exercise deadly force. They argue that allowing a robot or drone to pull the trigger or fire the weapon makes the decision more anonymous and thus far easier to make.
