Students Injured In Houston School Bus Crash Reports 1800CarWreck

Dallas, TX – 3/30/2015 /SubmitPressRelease123/ – Several students were injured in a recent school bus crash that occurred on a Houston freeway. Reports say the collision, which involved the bus and a passenger vehicle, occurred in the afternoon as the bus was returning Air Force Junior ROTC members from a school field trip.

“The accident happened about 2:30 p.m. on U.S. 59/Eastex Freeway near Bush Intercontinental Airport. Cleveland High School officials say the bus was returning about 57 members of the school’s Air Force Junior ROTC from a NASA field trip when the crash happened.”

In an update on the crash, it was reported that at up to 15 students were taken to local hospitals to be treated for injuries. The bus driver was also transported to a hospital.

A similar accident occurred in Houston earlier this year. Three people, including one student was hurt after a sedan and school bus collided in an early morning crash.

School bus accidents unfortunately occur with more frequency than many expect. According to statistics from the National Highway Transportation Safety Administration more than 100 fatalities and hundreds more injuries occur in collisions involving school buses each year.

Says Houston car injury attorney Amy Witherite of the Eberstein & Witherite law firm with regards to school bus crashes, “these can be distressing to hear about on a personal and community level.” The attorney has in her career worked with clients who have been injured in related crashes and says that when a school bus crash occurs families sometimes fear sending their children to school using this mode of transportation for some time after.

For parents whose children have been injured, the attorney further says that some face legal challenges in the aftermath. According to the injury lawyer, “particularly in cases when a child has sustained a serious injury questions of liability for medical expenses and other damages typically come into play.”

Safety advocates have sought to address the concerns of parents and others who question the risks posed to the more than 20 million children who are transported to and from schools daily via school bus. One idea that has long been considered is the mandatory addition of safety belts on school buses. Some; however, suggest that this move would be too costly, and is unwarranted because of the safety in design of school buses. Statistics suggest that school buses are seven times safer than passenger vehicles and light trucks.

Both the National Transportation Safety Board and The National Highway Traffic Safety Administration have reached similar conclusions regarding this, stating that research shows seat belts did not prove the protection of occupants on school buses for the severity of the impact studied. The matter continues to be a point of controversy; however, in light of the research.

Currently, six states including Texas require larges school buses to be equipped with seat belts; however, not all require passengers to wear them.

Proposition 65 Limits the Type of Claims That Individuals Can Make in Tort Reform Claims

March 27, 2015 – In “Tiva v. Pepsico, Inc.,” a worker’s compensation case, the plaintiff indicated that they were exposed to certain chemicals while on the job that increased a person’s risk of certain medical conditions. The court found that the plaintiff’s claim was ultimately speculative, as they failed to show a link between an increased chance of these conditions and their own exposure to them.

In the state of California, all employers are required to have an insurance policy that is set aside specifically to cover victims of work related accidents and illnesses. Under the law, all employees who are injured while on the job – regardless of who is at fault – are supposed to have this type of safety net set up to cover things like medical bills, rehabilitation costs and lost wages.

“Thanks to Proposition 65, it is now significantly more difficult for victims to bring about certain types of tort actions in California” said Alexander D. Napolin, Esq, a personal injury attorney. “Making the decision to obtain legal representation before bringing about a claim is now more important than ever for their success.”

Personal injury law is governed by the doctrine of negligence, which lays out very specific criteria that must be met to prove that someone is at fault in these types of situations. The person bringing about the lawsuit has the burden of proving that the person they are suing (like a careless employer, a reckless driver or a negligent doctor) was acting unreasonably given the circumstances.

In the case of Proposition 65, the court determined that the plaintiffs had not adequately shown that their employer was acting carelessly regarding their exposure to the chemicals.

Depending on the situation, they may also have to prove that the defendant ignored risk or acted with an intention to harm, which can be very difficult for a plaintiff to do without any type of legal aid.
