Top Estate Planning & Probate Attorney Sam Allen Reveals How A Special Needs Trust Can Protect A Child With Disabilities – Duxbury, MA

Leading Estate Planning Attorney Sam Allen, founder of Law Mom, LLC in Duxbury, MA, explains how important a special needs trust can be and how it can protect a family’s disabled child throughout their lifetime. For more information please visit https://lawmom.com

Duxbury, Massachusetts, United States – July 31, 2023

A special needs trust can be an effective and efficient way to protect the long-term future of a child with disabilities, Wills and Trusts attorney Sam Allen disclosed in a recent interview.

For more information please visit https://lawmom.com

Sam Allen, the founder of Law Mom, LLC., elaborated: “A Special Needs Trust also known as a Supplemental Needs Trust will help a child with disabilities from losing needs-based government benefits, such as Supplemental Security Income or Medicaid, when they receive an inheritance.”

She detailed: “There are numerous options in passing down an estate to a child, such as leaving an inheritance or placing an estate with close family members.”

“Contrary to what many think, leaving an inheritance to someone reliant on needs-based government assistance can do more harm than good. An inheritance can negatively impact a child’s ability to qualify for certain programs, or worse, interrupt services that provide stability and safety in the child’s life.”

These programs include services that a child with disabilities might require throughout their lifetime, such as assisted or group housing, employment support, personal care aides, assistance in transportation and specialized medical services.

She said: “If government support is restricted or limited in some way, a Special Needs Trust can provide financial security and ensure a minimum standard of living for the child. If for any reason a child can no longer benefit from public assistance fully, the money held in a trust can act as a backup of funds that can be made available to them.”

Setting up a Special Needs Trust  can also ensure trust assets are well-managed and work to benefit the child over the long term.

Allen said: “One of the main features of a Special Needs Trust is that assets held there are not directly available to the child. They must first be released by a trustee, who can also act as the child’s money manager to ensure the funds are spent as intended.”

She recommended parents consult an attorney who specializes in developing well-drafted and clear Special Needs Trusts.

As a mother of a child with unique medical needs, Allen understands how expensive medical care can be and the importance of creating an effective trust to protect her child’s financial future. “Contacting a law firm that specializes in special needs planning to create a comprehensive legal plan for you and your child is probably the best starting point”, she said. ‘’They can then outline all the options and help parents build a robust and effective trust.”

Top Estate Planning & Probate Attorney Rory Clark Casts Doubt Over Validity Of Medicaid And Nursing Home Fees – Leesburg, VA

Leading Elder Law Attorney Rory Clark founder of the Legacy Elder Law Center in Leesburg, VA, discusses the misinformation of Medicaid and nursing home fees that influences people’s decisions on their finances. For more information please visit https://legacyelderlaw.com

Leesburg, VA, United States – July 31, 2023

Growing concerns over the misinformation plaguing and influencing people’s decisions over the impact of Medicaid and nursing home fees on their finances has spurred Elder Law Attorney Rory Clark to re-address the issues.

For more information please visit https://legacyelderlaw.com

He urged those looking at their long-term care needs or trying to grapple with Medicaid’s conditions to first seek specialist guidance and advice from Elder Law and Estate Planning attorneys who were specialists in their fields.

Mr Clark, founder of The Legacy Elder Law Center, in Leesburg, VA, asserted: “Don’t rely on second-hand information or hearsay from friends, family, neighbors and relations on such important topics as Medicaid. Go to a specialist attorney who can advise the best approach.”

He said numerous clients had perceived that Medicaid was universally the same for everyone. “Each and everyone’s situation and finances will vary, and so will their Medicaid experience. Even from state to state, that can change as well. So they should investigate their situation thoroughly.”

Applications will be considered on various grounds, including age, a person’s assets, income bracket, and the level of care they require. “Some states look at the applicant’s income, including pension and social security, to determine Medicaid eligibility, while others consider both the income and the person’s assets.”

He also enlightened on two misconceptions that could cloud people’s thinking– that they can either delay Medicaid planning or be too late to apply for it.

Mr Clark said: “Many people don’t know that long-term nursing care can be very costly. Preparing ahead of time, or at least planning contingencies before seeking Medicaid assistance, is highly recommended. Ultimately, this could mean a couple could save or protect more financial assets in the long run.

“If someone has already moved into long-term nursing care, it is never too late for Medicaid planning. Even if a loved one has used funds to pay for care at a nursing facility, there could still be time, especially if they are married.”

Another misconception is that Medicaid is a welfare system primarily for people who don’t work. But he countered that, adding: “Over 60% of those receiving Medicaid are from working families.”

Another misconception is that people cannot keep their incomes if their spouse receives Medicaid benefits for nursing home expenses. “Your income is handled separately in Medicaid matters. Money and property owned by both spouses will be taken into consideration when it comes to qualifying for Medicaid,” he said.

Leading CPA & Corporate Accountant Pauline Ho Shares Her Best Accounting Tips When Starting A New Business – Orlando, FL

Top accountant Pauline Ho founder of Orlando’s Laus Consulting Services LLC in Orlando, FL advises to take on certain accounting tips to ensure they flourish financially and retain good, strong management structures. For more information please visit https://lausconsult.com

Orlando, Florida, United States – July 31, 2023

Startups are advised to take on these accounting tips from Corporate Accountant Pauline Ho to ensure they flourish financially and retain good, strong management structures.

For more information please visit https://lausconsult.com

Ho, founder of Orlando’s Laus Consulting Services LLC, advised that among the pressures new businesses face is the challenge of accounting, and how it can make or break a company without the necessary discipline.

She said: “Nearly one-fifth of businesses fail to make it past their first year of trading, so having a person dedicated to overseeing the accounting and the relevant cash flows will enable a centralized approach and help prevent any issues arising revolving around finances.”

Ho acknowledged that small business owners should quickly separate their company accounts from personal accounts to give clarity – and ease of auditing – in tracking expenses and take advantage of any tax deductions.

Having separate accounts enables the business to adopt a line of credit for cash shortfalls and to avail of other services, such as credit cards and business insurance.

“One of the most important elements of a business is the bookkeeping. Software options are available, but dedicated bookkeeping can keep track of expenses and income, and provide a clear picture of a business’s financial health.

“Using software systems can help reduce time and errors dedicated to this part of the company. It means the owner can also dedicate more time to what they know best – the front end of the business.”

She added that keeping to budgets and maintaining accurate accounting data would not only help reduce the stress of running a business, but recordkeeping would help in the filing of tax returns on a monthly, quarterly and annual basis.

Startup owners should also educate themselves about the accounting terms that often come up in business. Fixed assets, expenses, gross and net income are just some of the terms they will get used to during their accounting.

She advised business owners can hold on to their cash longer by speaking to their suppliers who may offer credit terms or offer a discount if they pay early. “Equally, they should be discussing with their clients to meet payments on time to ensure a cash smooth flow.”

By keeping an eye on the finances, a business owner can quickly build a picture of where their money is going, how they can best employ cheaper, outsourced labor to achieve the same ends, and better control their expenses.

Up-to-date finances can also aid an owner in making more accurate tax predictions and payouts when the time comes, she advised. “Nevertheless, it is always advisable to use an external tax accounting professional to ensure their taxes are correct and on time. The bonus here for a sole proprietor is that the cost of hiring someone to prepare their business’s tax return is deductible.”

Ho added that companies should be prepared to retain income statements, a balance sheet, and a cash flow statement as they are required by banks and investors to understand the financial state of the company when it comes to securing loans and investments.

These can also help to assert financial projections for a business in determining cash flow and questions from potential lenders and investors.

She concluded: “All the elements drawn together present a clear and unequivocal picture of a business’s performance, its potential going forward, and assurance to the owner and its lenders that it is not on troubled ground financially.”

Leading Criminal Defense Attorney Edward La Rue Reveals Do’s And Don’ts When Dealing With The Police – Cleveland, OH

Top Criminal Defense Attorney and founding partner of the Law Offices Edward R. La Rue, in Cleveland, Ohio assesses top scenarios to be aware of when a person comes under police questioning. For more information please visit https://www.edwardrlarue.com

Cleveland, Ohio, United States – July 31, 2023

The founding partner of the Law Offices of Edward R. La Rue in Cleveland, OH has outlined some scenarios to be aware of when subjected to police questioning.

For more information please visit https://www.edwardrlarue.com

La Rue explained that a person could be questioned because they are a potential witness to a crime, as part of a fact-finding mission in an investigation, and when they are under arrest and treated as a criminal suspect.

“Most people are unaware of their rights when questioned by police. Specifically, Officers are trained to use certain tactics to get a confession from someone they suspect of wrongdoing,” he said.

He elaborated: “While it is critical for those being questioned by law enforcement to determine why the police are talking to them in the first place, it is all too common that we fail to establish the particulars: are they a person of interest in a crime, or are they viewed as a likely witness in a case the police are investigating.”

“If an officer approaches someone in a consensual encounter, that person does not have to talk to the authorities. If they do not want to answer an officer’s questions, they should ask the officer if they are free to leave, and walk away, making their intentions not to engage clear.”

Many people are unaware they cannot leave during an investigative detention even though they are not under formal arrest. Such detention is usually only for a very limited time while police conduct their investigations. “But they still don’t have to answer law enforcement’s questions if they don’t want to,” said Mr La Rue.

He asserted: “An arrest is different because, at that point, a person has typically been placed in handcuffs and been committed to police custody, and police can search a suspect before taking them to the police station. But as long as that person provides their name and address, they can choose to remain silent and not answer any questions.”

“Anyone being questioned by law enforcement should know that officers use certain tactics to get people to make statements against their own interests. In fact, the law allows police and law enforcement to lie to their suspects and witnesses in their attempt to “investigate” the crime. The best rule is to remain silent until they have a lawyer by their side as that is everyone’s constitutional right, and they should exercise it! To choose not to, is to do so at your peril.”

Top Elder Law & Estate Planning Attorney Dennis Toman Reveals Medicaid Myths – Greensboro, NC

Leading Estate Planning Attorney Dennis Toman founder of The Elderlaw Firm in Greensboro, NC outlines the main misconceptions surrounding Medicaid. For more information please visit https://www.elderlawfirm.com

Greensboro, North Carolina, United States – July 31, 2023

Several misconceptions and misinformation could unduly influence people considering applying for Medicaid for nursing home bills, said Estate Planning attorney Dennis Toman, this week.

For more information please visit https://www.elderlawfirm.com

The Founder of The Elderlaw Firm in Greensboro, NC, said he had been moved to make a number of statements over Medicaid based on the number of clients he had spoken to that were not up to speed on the subject.

He commented: “One of the biggest misperceptions is confusing Medicaid with Medicare. The former is used to pay for long-term care in nursing homes, while Medicare is health insurance that provides only short-term and limited coverage for care in a nursing home.”

Toman said another major myth he was keen to nail was that most people believed Medicaid was solely for impoverished people.

“There are certain financial limitations, but many will be surprised they could apply for Medicaid. The best advice is to seek an attorney specialized in Medicaid to learn more about the process and what they could be eligible for.

He said that planning for Medicaid was one that few took seriously. “The later you plan, the more limited options are available. Some ignore the process until it’s too late.”

The misconception that is the undoing of most people is that they believe the time is never right to plan for Medicaid. He concluded: “There’s never a wrong time to begin Medicaid planning.”

“You can start even if you or your loved one are years away from needing long-term out-of-home care. Or you can begin planning after a loved one is already in a nursing home facility.

He concluded: “Rather than listen to relatives or third parties on what Medicaid entails, I would suggest they seek immediate guidance from an estate planning and elder law attorney to know exactly where they stand on financial assistance from Medicaid.”

Leading Estate Planning Attorney Robert Brumfield Discloses Executor’s Responsibilities In The Probate Process – Bakersfield, CA

Top estate planning lawyer founder of the Law Offices of Robert H. Brumfield, P.C., in Bakersfield, CA explains the importance of choosing the right probate lawyer. For more information please visit https://www.brumfieldlawgroup.com

Bakersfield, CA, California, United States – July 31, 2023

Choosing a probate lawyer wisely could enable an executor to ensure a will’s smooth progress to conclusion in the distribution of assets, Bakersfield Estate Planning Attorney Robert Brumfield asserted this week.

For more information please visit https://www.brumfieldlawgroup.com

Before seeking a probate attorney, an executor must evaluate the best one available, as each estate will differ. “An executor should invest a little time in choosing the best probate attorney to fit the circumstances they need them for,” advised the Founder of the Law Offices of Robert H. Brumfield, P.C.

“Find one that is sympathetic and communicative but is also highly experienced in this area of the law.”

While patience and preparation go hand in hand in a will’s progress, an executor can help themselves enormously before hiring an attorney by collecting various documentation to affect the process.

These include certified copies of the death certificate, last will and any codicils, bank statements and other financial documents, a list of a loved one’s assets, and names and contact details of the heirs and the individuals named in the will.

If they believe family members could contest or cause problems during the probate process, having all the relevant documents will help them and their probate attorney in the long run.

Brumfield said: “An executor carries a lot of power but also shoulders burdens and responsibilities, so they must be thoroughly detailed and focused. According to the deceased’s wishes, they will be responsible for distributing assets, such as money and property.”

An executor must understand what probate is all about. While it is the legal distribution and transfer of assets following someone’s death, legal steps still must be followed before they can be distributed to beneficiaries.

However, a probate court filing may not be necessary if a loved one leaves a small estate. This keeps the proceedings out of the court system and gives a faster path to settlement.

When an estate is large enough to require probate, the person named in the will to serve as executor (or personal representative) must remember that they have actual legal authority once an official probate is filed and the Court appoints them as a personal representative.

“That is where an executor should fully consult on the best probate lawyer skilled in this legal process to ensure a smooth transition,” he concluded.

Leading Estate Planning & Probate Attorney Sam Price Clarifies What A Disputed Trust Or Will Entails – Redlands, CA

Top Estate Planning Attorney R. Sam Price, founder of Price Law Firm, APC in Redlands, CA, explains the process of disputing a trust or will. For more information please visit https://pricelawfirm.com

Redlands, California, United States – July 31, 2023

Seeking to contest a family trust or will is not for the faint-hearted and requires skill, hard work, and a thick skin, Estate Planning attorney Sam Price commented this week.

For more information please visit https://pricelawfirm.com

Only those with a “legal standing” can launch a lawsuit. These are defined as beneficiaries, heirs, those who would be personally affected, and even creditors. Anyone with a stake in a decedent’s will or family trust can challenge the estate based on a number of grounds.

The Founder of Price Law Firm, APC, in Redlands, CA, said: “The first step is to seek the advice of a probate litigation attorney who will be able to offer a professional view on the potential to challenge a will.”

Grounds for challenge include proving that the will was made under undue duress, written when the person suffered mental incapacity, through fraud, or that mistakes and omissions occurred in the will-making process.

Another objection could be that the executor who administers the will is in breach of their fiduciary obligations – essentially not carrying out the person’s true wishes to the letter.

“However, a person who is simply disgruntled with a settlement and wants to challenge a will on that basis to get more of a fair share in their minds will see their objection rebuffed by the courts,” said Mr Price.

He urged that speed is of the essence in launching a challenge as the window for contesting an estate is relatively short and varies from state to state.

“An attorney is best placed to advise beneficiaries of contesting a trust or will. They can assess the key strengths and weaknesses and advise the costs of taking such action.

“If a contest is successful and a court judge rules in favor, the document will be void, and the estate’s assets will be distributed per state law,” Mr Price concluded.

However, if they lose the challenge, they could find themselves challenged to cover the financial costs of the legal case – and those forced to defend it.

Top Divorce Attorney, Francis King, Shares Why Mediation Offers An Effective Way To Settle Your Case Without A Trial – Nashville, TN

Leading family law attorney Francis King, founder of the Law Offices of Francis King in Nashville, TN explains why mediation is strongly recommended when thinking about divorce. For more information please visit https://franciskinglaw.com

Nashville, TN, United States – July 31, 2023

Divorce can often be a financial, physical and mental drain on couples in Tennessee. This is particularly so for those whose divorce case ultimately proceeds to a full-blown trial before a judge (which can take years).

For more information please visit https://franciskinglaw.com

Fortunately, however, most divorce cases are resolved by a negotiated settlement – and mediation presents an effective opportunity to accomplish that, Divorce Attorney, Francis King, revealed this week. Mediation can enable spouses to resolve issues regarding alimony, property distribution, child custody and child support – without putting their fate in the hands of the court.

Moreover, the founder of Law Offices of Francis King pointed out that, in Tennessee, parties are required to attend and complete mediation as a prerequisite before a divorce case goes to trial. King explained, “The process is entirely confidential and off the record. The court will never know what anyone offered or said at mediation. The only information the judge receives is a one-sentence report form the mediator indicating either that the case was settled or it was not.”

King stated, further, that the mediator will be an experienced family law attorney who has special training per Rule 31 of the Tennessee Supreme Court, and that the process is designed to allow each party and his/her attorney to talk with the mediator alone and confidentially, which enables the mediator to fully understand where each spouse is coming from.

“Tennessee law says you have to try to settle your divorce case at mediation, but it doesn’t say when,” King said. “This means that you can do it early in the divorce process or wait until the eve of trial, or do it somewhere in between. I try to get my clients to mediation sooner rather than later whenever possible. The only thing worse than a bad marriage is a long, expensive divorce case. Mediation can provide an early exit opportunity that saves everyone a lot of money and aggravation.”
