Louisiana Man Escapes Injury From Exploding E-Cig, As E-Cigarette Explosion Lawsuit Cases Count Rises

June 27, 2016 – – LipsigLawyers.com’s Marc Freund commented on a February e-cigarette explosion that occurred in New Orleans, Louisiana, where a local man and his companions narrowly escaped injuries after his e-cig exploded in his hand. Freund notes how fortunate the man is, and emphasizes that in most cases, victims are less fortunate and often sustain injuries such as burns, cuts, lacerations and in some rare cases even blindness and severed limbs.

As reported by a local CBS affiliate WWLTV.com, a local New Orleans man was holding his e-cigarette when the device exploded in his hand, “just like a bottle rocket or a roman candle.” The victim claims that the e-cigarette launched from his hand to the ceiling, consequently, burning everything in its path. Remarkably, the victim grabbed the burning device with a towel and threw it into the street preventing further damage.

There have been 200 reported e-cigarette explosions since 2009, luckily, this is the first e-cig explosion in Louisiana. However, the prevalence of e-cigarette explosions is far more common in some states, such as in, California, Arizona, and Oklahoma. Since 2009, there have been 20 e-cig explosions in California, 11 such explosions in Arizona, and 8 e-cigarette incidents in Oklahoma making up nearly 20 % of all reported e-cigarette explosions. Furthermore, there have been 163 e-cigarette explosions since 2014, which equates to nearly 5 times more than the total number of reported explosions in the four previous years.

FDA Issues Public Safety Warning Regarding Potential Risks Of IVC Filters, As IVC Filter Lawsuit Filings Increase

June 27, 2016 – – TheProductLawyers.com reports on IVC filters and the increasing controversy surrounding their use which has increased tremendously in recent years. In 2012 approximately 259,000 implantations of the device have occurred, as compared with only 2,000 in 1979 when the devices were first FDA approved.

The IVC filter is a small cage-like device that is surgically implanted and is designed to capture blood clots emanating in the legs moving toward the heart and lungs, where they could precipitate a pulmonary embolism. The filter retains the clot until it dissipates and according to the FDA is only to be used temporarily until the risk of blood clots disappears.

The filters have become the focus of lawsuits claiming the devices were defectively manufactured by several different manufacturers and that the devices can fracture into pieces. Allegations have been made that the pieces then migrated to other parts of the body that are considered “high risk,” such as the intestines or other organs, thus preventing their removal and causing significant and life-threatening risks to the patient.

The FDA has issued a public safety warning about the devices after the agency received a significant number of patient adverse event reports in excess of 920. The FDA communication was designed to warn patients and medical professionals of the potential dangers of using the devices. The FDA also reminded the public that the devices needed to be removed as soon as feasibly possible when the threat of the development of blood clots was no longer an issue.

The FDA has stated that the adverse reports include claims such as fracturing and migration of the filter, embolization of the pieces, and tearing of the inferior vena cava. The FDA has asked that patients be keenly aware of any symptoms of possible movement of the pieces such as pain in the chest, palpitations of the heart, out of the ordinary heart rhythms or fainting.

The Citizens Commission on Human Rights (CCHR), a non-profit mental health watchdog dedicated to the eradication of abuses committed under the guise of mental health, has held over 100 events and toured more than 3,000 people through the Psychiatry: An Industry of Death museum as part of an ongoing effort to educate Floridians on their rights under the mental health law and are inviting all to view the museum at their headquarters in downtown Clearwater from 10 am to 10 pm daily.

Since opening the new headquarters for the Citizens Commission on Human Rights (CCHR) of Florida in July of last year, there have been more than 3,000 tours of the Psychiatry: An Industry of Death museum, which presents the unvarnished history of psychiatry while also providing information on the state of psychiatry today.

Tours of the museum have been given to everyone from a mother who wanted to know how to protect her children from involuntary commitment to psychiatric nursing students brought by their professors to learn the truth about psychiatry.

The headquarters has also hosted or participated in over 100 events designed to educate individuals on their rights under the mental health law of Florida commonly referred to as the Baker Act.

“Our goal is to ensure that Floridians know their rights under this law, especially parents since minors may legally be sent for involuntary examination without parental knowledge or consent” said Diane Stein, President of CCHR Florida. “The museum tours and events help us to accomplish this goal faster and more effectively.”

In 2014, there were a total of 181,471 involuntary examinations initiated in Florida which was an almost 82% increase from 2002 to 2014 and 17% (30,850) of the total involuntary examinations were on children. Unfortunately the majority of parents in the state are not aware of this risk.

Working to educate as many families has possible, CCHR has also mailed 84,000 postcards to families in Florida directing them to a website where they can learn more about the law and download a legal form to help protect their children from unnecessary involuntary examination.

“We want to see a reduction of the number of involuntary examinations of minors in 2016 and hope to be able to restore the rights of parents under this law during next year’s legislative session,” said Stein.

Lebanon County Business Owner Killed In Trench Fall, Triggers Comments By Construction Accident Lawyer

An estimated 359 construction workers died in 2014 from fatal falls, equating to just under one fatal fall accident per day. Hopefully, with the proposed requirement for workers to be equipped with safety harnesses, many such accidents can be avoided in the future.

Xarelto Lawsuit Cases In MDL Move Forward As Trial Dates Are Announced

Last year, the U.S. Judicial Panel on Multidistrict Litigation consolidated the more than 2,000 cases related to the drug in order to expedite legal proceedings. Multidistrict litigation (MDL) number 2592, which is the result of the consolidation, will be tried in the Eastern District of Louisiana under the supervision of Judge Eldon Fallon.

Four bellwether hearings are expected to begin early in 2017. These proceedings will test the reaction of jurors to informational and evidentiary presentations, and will be used for future trials related to the MDL. The first two bellwether cases will be tried in the Eastern District of Louisiana on February 6th and March 13th of next year. However, the other two cases will be tried elsewhere on April 24th and May 30th of 2017.

While it was initially hailed as a breakthrough in the treatment of dangerous blood clots, the new-generation anticoagulant has since caused great concern for the public. As the litigation against Xarelto and its manufacturers has accumulated in recent years, a few major trends have emerged. Plaintiffs allege that use of the drug places patients at a heightened risk of catastrophic bleeding episodes, often adding the claim that the manufacturers were negligent in their duty to inform both physicians and patients of this risk.

The combined number of cases brought against Xarelto in the United States alone stands to exceed 4,000, many of which claim substantial harm as a result of using Xarelto or allege negligence on the part of the drug companies, Bayer AG, and Janssen Pharmaceuticals. Plaintiffs are confident that as the date for the bellwether trials approaches, additional independent claims will be added to the MDL. In Philadelphia, Pennsylvania, a mass tort program composed of 550 individual cases has been consolidated by the Court of Common Pleas.

Salted Caramel Popcorn Recipe

Ingredients:

*1/4 cup popcorn kernels

*1/2 cup brown sugar

*1/4 cup butter

*2 tablespoons light corn syrup

*1 teaspoon coarse salt, or more to taste, divided

*1/2 teaspoon vanilla extract

Directions:

*Place the popcorn into the popper with no oil or salt.

*Secure the lid, and microwave on high until popping slows. This will take about 2-2 1/2 minutes, depending on your microwave.

*Carefully remove the hot popper from the microwave, and pour the popped corn into a medium bowl. Remove any unpopped kernels and discard.

*Place the brown sugar, butter, corn syrup, 1/2 teaspoon of salt, and vanilla into the popper, securing the lid. (Do not rinse the popper before doing this, as water droplets can interfere with the caramel.)

*Microwave on high for 2 minutes, stir, then return to the microwave and cook for 1 more minute.

*Remove the sauce and carefully pour over the popcorn in the bowl, stirring to coat. Work quickly, as you don’t want the caramel to set before it coats the popcorn.

*Return the coated popcorn to the popper, and secure the lid.

*Microwave on high for 45 seconds.

*Remove from the microwave, and spread the caramel corn on a silicone baking sheet.

*Sprinkle the remaining 1/2 teaspoon (or too your taste) of salt onto the popcorn.

*Wash and thoroughly dry the popper.

Allow to set until hardened, then break and store in the clean, dry, popper.
