What To Do When There’s No Construction Cost Record For Your Investment Property

With any older investment property there is a strong possibility that no reliable records, reflecting the building’s construction costs way back when, exists. Yet, because these are claimed as tax deductions over a very long period, there’s value in it to start claiming the remaining amount of the depreciating costs. Property acquisition and taxation specialist Matthew Mousa partner at Sydney-based TLK Partners’ offers some possible solutions for this scenario.

“Basically, if no reliable records can be found to back up a claim, the new owner will have to estimate the construction costs,” Matthew says, “and then pick up where the last owner left off. If the building was constructed prior to 17 July, 1985, there is no need to worry about construction costs, as no deductions are allowed on buildings constructed for residential purposes or to earn an income.”

According to the tax regulations, valuers, estate agents, accountants and solicitors are not allowed to assess the construction costs, unless they are otherwise qualified to make a reliable estimate. The cost of any of the following experts is recognised (and deductible in the income year in which the payment was made).

The tax man will allow you to use the following people to assist you in estimating construction costs:

A Clerk of Works: Someone who is, for example, the project manager for a large construction company; A Supervising Architect: This is an architect who approves payments for stages in a building project; An Experienced Builder: This builder would have to have experience in estimating costs for similar sized projects; and A Quantity Surveyor.

Let’s suppose a property is bought on 19 July, 2016, and the owner wants to work out the deduction for the 2016/2017 tax year. The construction costs that will act as the base cost, were estimated by a quantity surveyor to be $115 000.

Construction costs are multiplied by the rate applicable to the year of construction by the proportional amount of the year for which he is able to claim. That means the number days during the tax year that he owned the property and used it to generate a rental income.

In this example that would involve multiplying $115 000 (the construction cost) by 2.5% (the applicable rate) and then multiplying that by 346/365 days (a full year less 19 days as he bought it on 19 July). The total deductible would be $2 752.

Estimating the construction costs of a pre-existing building can be a bit of a nightmare, but it is essential to ensure that rental property owners enjoy the maximum tax benefits allowable under the law.

“There’s a lot more to maximising investment property returns than meets the eye,” says Matthew. “Proper taxation and structure advice can yield significant returns for the savvy investor,” Matthew concludes.

RODA Signs Memorandum of Understanding with NMFS, BOEM on Fisheries and Offshore Wind Coordination

NOAA Fisheries, the Bureau of Ocean Energy Management (BOEM), and the Responsible Offshore Development Alliance (RODA) signed a 10-year Memorandum of Understanding that brings local and regional fishing interests together with federal regulators to collaborate on the science and process of offshore wind energy development on the Atlantic Outer Continental Shelf.

Safe, reliable, and affordable domestic energy production powers the U.S. economy, promotes jobs and is critical to our nation’s security. Offshore wind is an abundant, domestic energy resource that is located close to major coastal load centers, providing an alternative to long-distance transmission or development of electricity generation in these land-constrained regions.

Fishing has occurred in New England and Mid-Atlantic waters for hundreds of years and is an integral part of the region’s culture and economy. Regional fisheries not only provide a healthy and sustainable source of food for both domestic and international markets, but also recreational opportunities for thousands of anglers, divers, and nature enthusiasts. Fisheries also support numerous shoreside processing jobs and support industries important to the economies of many coastal communities.

“Any development on the Outer Continental Shelf must consider how these activities can affect current ocean users and the marine environment,” said BOEM Acting Director Walter Cruickshank. “That is why working with federal, state, and local agencies, fishing communities, and the public is such an essential part of our renewable energy program. “The fishing industry has expressed its concern about the potential impacts of rapid large-scale wind energy development to coastal communities and sustainable fishing practices,” said Annie Hawkins, executive director of RODA. “This agreement paves a way forward for fishing communities to give meaningful input to federal regulators in determining the future of our ocean resources.”

Working together to engage local and regional fishing interests early and often throughout the offshore wind development processes will help develop a collaborative regional research and monitoring program and lead to scientifically sound decisions.

Focus on Engagement, Research, and Monitoring

Today, the Federal Government has 15 active leases covering nearly 1.7 million acres in the Outer Continental Shelf for potential offshore wind development. Collectively, these leases could generate more than 19 GW of energy – enough to power more than 6.5 million homes and further solidify our nation’s energy future.

NOAA Fisheries manages more than 42 commercially and recreationally important species as part of 14 fishery management plans. In 2016, approximately 4,600 vessels landed more than 1 billion pounds of key fish species, supporting roughly 140,000 seafood jobs. The region is also vital for many endangered and threatened marine species, including the North Atlantic right whale, necessitating protective measures to ensure their survival for future generations.

“NOAA is committed to assessing the impacts of offshore wind energy projects on these resources,” said Michael Pentony, regional administrator for the Greater Atlantic Regional Fisheries Office. “The development of offshore wind energy projects must be done in ways that support the protection and sustainable management of our marine trust resources, fishing communities, and protected species.”

The new Memorandum of Understanding identifies four areas of mutual interest, which include the responsible planning, siting, and development of offshore wind power and working with regional and local fishing interests. The parties agree to collaborate on: engaging local and regional fishing interests in the offshore wind development process; identifying the most effective ways to bring fishing industry expertise and information into planning and development processes; and developing a collaborative regional research and monitoring framework to ensure decisions are based on the best available science.

Collaboration with BOEM, states, and fishing industry interests throughout the renewable energy leasing process will help improve compatibility of offshore wind with other ocean uses and create an effective regional research and monitoring program that will help improve our understanding of potential ecological, economic, and social impacts of offshore wind development.

Skeena Initiates Metallurgical Optimizations and Preliminary Economic Assessment for Eskay Creek

VANCOUVER, BC / ACCESSWIRE / March 26, 2019 / Skeena Resources Limited (TSX.V: SKE, OTCQX: SKREF) (“Skeena” or the “Company”) is pleased to announce that metallurgical optimizations as well as a Preliminary Economic Assessment (“PEA”), for the Eskay Creek Project (“Eskay Creek”) have been initiated. The Company also welcomes Stacy Freudigmann, P.Eng., to the Skeena team as Project Manager for the aforementioned studies. Eskay Creek is endowed with excellent infrastructure including road access, proximity to recently commissioned 195MW run-of-river hydroelectric facilities, tailings storage capacity and historical underground development situated less than 100 metres from existing mineral resources.

Phase I Metallurgical Optimizations

Demonstrated metallurgy from the past producing Eskay Creek mine involved a 350 TPD flotation plant with average gold and silver recoveries of 80% and 92% respectively. Gravity separation of gold accounted for 10-30% of preliminary separation. Sulphide concentrates were subsequently transported via truck to either the Port of Stewart for further smelting in Japan or trucked to Kitwanga for loading onto rail cars and transported to a smelter in Quebec.

Notwithstanding the proven historical process associated with flotation, the Company will be investigating the amenability of the Eskay Creek blended mineralization to leaching.

The Blue Coast Research Group (“Blue Coast”), located in Parksville British Columbia, is currently undertaking the metallurgical investigations and subsequent optimizations. Blue Coast provides metallurgical laboratory test work services, specializing in precious and base metals, metallurgical flowsheet development, evaluation of processes and technologies including grinding, froth flotation, gravity concentration, leaching, heap leaching, to full continuous pilot plant testing.

The Phase I metallurgical testing is proceeding on schedule with results anticipated in Q2 2019.

Preliminary Economic Assessment

Ausenco Engineering Canada Inc. (“Ausenco”) has been engaged to perform a Preliminary Economic Assessment (PEA) for Eskay Creek. The PEA will contemplate an open pit mining scenario with a small up-front contribution of underground resources. Dependent on the results of the metallurgical optimizations, subsequent trade-off analyses will contemplate either the leaching or flotation processes. The Eskay Creek PEA is scheduled for completion in Q3 2019.

Banning Shark Fin Sales Not Effective Conservation Tool, Sustainable Shark Alliance Tells Congress

WASHINGTON, DC / ACCESSWIRE / March 26, 2019 / Banning the domestic sale of shark fins will be less effective for global shark conservation than legal, regulated shark fishing, according to testimony from the Sustainable Shark Alliance (SSA), delivered today before a House panel.

Shaun Gehan, testifying on behalf of SSA before the House Subcommittee on Water, Oceans, and Wildlife, voiced SSA’s opposition to H.R. 737, the Shark Fin Sales Elimination Act. Instead, SSA, which represents shark fishermen, dealers, and processors, expressed its support for H.R. 788, the Sustainable Shark Fisheries and Trade Act.

Mr. Gehan was quick to point out in his prepared remarks that opposition to H.R. 737 is not based on a difference of opinion on the troubling practice of shark finning, which he testified is an “abhorrent and unsustainable” practice that “wastes an important source of low-cost protein that can feed growing populations.” Rather, SSA opposes H.R. 737 because, by banning the sale of legally caught shark fins that are not inhumanely harvested, it will not effectively promote global shark conservation.

“Sustainably-sourced fins from our well-managed fishery will be replaced by those from bad actors. Only American fishermen, abiding by the world’s strictest shark conservation laws, and sharks in unmanaged waters will suffer,” he said.

NOAA has expressed similar concerns with the legislation. Last year, Alan Risenhoover, Director of NOAA’s Office of Sustainable Fisheries, told the same subcommittee that “we cannot support the Shark Fin Sale Elimination Act because the bill’s negative impact on U.S. fishermen would outweigh its minimal benefit to shark conservation,” adding, “this would hurt U.S. fishermen who currently harvest and sell sharks and shark fins in a sustainable manner under strict federal management.”

SSA supports H.R. 788, which “leverages the power of the U.S. market to ‘export’ the best management practices of our country.” Rather than banning the sale of all shark fins, H.R. 788 requires all shark products that are imported into the U.S. come from fisheries that meet the same high standards as U.S. fisheries. This means that not only must they come from sharks that are not finned, but that they must also come from shark fisheries that are managed sustainably.

H.R. 788 promotes high standards of shark conservation at a global level, while, just as importantly, preserves increasingly important American shark fisheries.

“Not only do shark harvests provide an important source of income for American fishermen and their communities, but growing shark populations are rapidly increasing natural mortality on such important food and game fish as red snapper and grouper species, not to mention increasing predation on whales and marine mammals,” Mr. Gehan said.

Unfortunately, the subcommittee did not consider H.R. 788 at today’s hearing, instead focusing on a bill that will harm many constituents in coastal communities without providing meaningful shark conservation. SSA urges the subcommittee to reconsider H.R. 788 as a better alternative.
