Invokana Lawsuit News: Patients Are Saying That One of the Side Effects They Have Experienced is Kidney Failure

IVC Filter Lawsuit Filings Draw Public Concern Over Statements Of IVC Filter Removal Doctor During NBC Report

April 29, 2016 – – TheProductLawyers.com reports on a news segment released by NBC which was a follow-up to a previous story. The follow-up was conducted in order to further investigate the reasons that IVC filter device manufacturer C.R. Bard has been able to continue to market their filters, even after reports regarding concerning patient suffered complications quickly followed the filter’s FDA approval. NBC noted that the information they had collected from confidential records included both a memo and a study conducted on the medical devices, and had first aired on December 31, 2015.

The report further investigated a topic that is currently alarming for many, as lawsuits referencing IVC filters have now been filed in Canada and the United States. Plaintiffs who have filed suit against various manufacturers of IVC filters similarly claim that the devices are defectively designed and are therefore dangerous, making them able to break loose from their original insertion points and travel within the body becoming lodged in other locations where they could cause additional and serious health complications.

NBC’s report detailed information showing that manufacturer C.R. Bard had concerns over possible product failures within the GC series filters, and that these worries were expressed as early as four months after the filters were given FDA approval. Despite the noted concerns, the filters were left on the market for public sale. Perhaps most concerning, NBC interviewed Dr. William Kuo, an IVC filter removal specialist, who commented, “The number of complications, the frequency of severe failures makes it obvious that it was never safe to be implanted.” The Doctor also used the opportunity to directly address the actions of IVC filter manufacturers, stating that they are not able to be trusted to act within the best interests of patients.

This alarming information and the details uncovered by NBC’s investigation are quite concerning for patients currently implanted with various brands of IVC filters. The filters are used among patients who are deemed at increased risk for blood clots, and are intended to capture and hold blood clots until they dissipate, preventing them from traveling toward the heart and lungs. The filters are meant to be used temporarily, and then removed from the inferior vena cava veins of patients after blood clot risks have subsided.

Risperdal Plaintiff Awarded $1.75 Million In Damages

April 29, 2016 – – LegalHerald.com reports on the fourth Risperdal lawsuit to go to trial which has resulted in a ruling in favor of the plaintiff. The Philadelphia jury’s verdict awarded a young man $1.75 million in damages to be paid by Risperdal drug manufacturer Janssen Pharmaceuticals (a Johnson & Johnson subsidiary).

The plaintiff began taking Risperdal in 2003 when he was nine years old. During this time the drug had only been approved for adult use for the treatment of schizophrenia. The suit claims that Janssen illegally marketed the drug for use in children for treatment of various conditions. The plaintiff continued to take the drug for five years, during which time Risperdal gained FDA approval for the treatment of children and adolescents. Unfortunately, during that time, the plaintiff also developed a condition known as gynecomastia or male breast growth. His complaint claimed that Janssen failed to inform consumers and physicians of the potential risk of developing gynecomastia when using the drug. While this particular case posed additional difficulties for the plaintiff and his legal team due to the fact that he continued to take the drug after its approval for use in children, the jury still ruled against the drug company.

This is not the first time that the drug manufacturer has faced legal trouble. In 2013, Johnson & Johnson paid a $2.2 billion settlement for charges brought against them by the U.S. Department of Justice for the illegally marketing drugs, including Risperdal, “off-label.” If a drug is prescribed “off-label” it means that it is being prescribed in a way that has not been approved by the FDA.
