Lawsuit Filed By Family Members of Deceased Xarelto Users

June 10, 2016 – – TheProductLawyers.com reports on a new lawsuit filed against the makers of Xarelto, Bayer AG and Janssen Pharmaceuticals (a subsidiary of the Johnson and Johnson Corporation). The suit alleges that because of deceptive marketing using celebrities as spokespersons, the public was not sufficiently informed about the potentially dangerous side effects of taking Xarelto. It is alleged that despite the company’s research showing otherwise, the makers of the drug knowingly and fraudulently depicted it as a safe option for patients that had undergone knee and hip replacement procedures or as a treatment for a medical condition impacting the heart called atrial fibrillation.

The U.S. Food and Drug Administration (FDA) pursued this argument as well. In June 2013 it had sent written correspondence to Bayer and Janssen stating that the marketing of the drug was misleading and that it needed to change. Both Bayer and Janssen continued their marketing of Xarelto, despite the FDA letter, with no changes.

Relatives of deceased family members filed a wrongful death lawsuit in St. Clair County Circuit Court on November 20, 2015. There are 10 plaintiffs in this particular case, residing in different states, but all are alleging that their family members’ deaths were precipitated by their use of Xarelto when it caused fatal bleeding.

The plaintiffs, in this case, are requesting a minimum payment of $50,000 for each deceased family member with the purpose of covering medical bills, funeral expenses, legal fees and other such costs to compensate for the pain and suffering endured by those family members left behind. There have been 9 counts of misconduct ranging from wrongful death to fraud.

In addition to this case, there have been many other suits filed all across the country. In Philadelphia, PA there is a mass tort program of 550 cases. In addition, there is a federal multidistrict litigation (MDL 2592) underway in Louisiana encompassing well over 2,800 cases.

Domestic Violence Cases The Facts from Dallas Criminal Defense Lawyer

Let’s say that you and your spouse or you and your boyfriend/girlfriend get into an argument, and the police are called because someone claims there has been some kind of violence.  Usually, the police will arrest one of the two parties in order to prevent further violence and to give everyone a chance to cool off, says John Helms an experienced Dallas based lawyer who deals with domestic violence cases.  Obviously, many, if not most, claims of domestic violence are true, but I see a lot in which the person making the allegation made up some or all of it in a fit of anger, exaggerated the other person’s conduct or their own alleged injuries, or failed to admit to what they did that may have caused the other person to have to use force in self-defense.

If what was reported to the police in the heat of the moment was not the truth, the whole truth, and nothing but the truth, people sometimes decide they do not want their significant other to be prosecuted.  This usually happens in the light of day (these incidents almost always happen at night), and after the significant other has been arrested and spent the night in jail.  By that time, things have probably cooled off.

When this happens, the alleged victim may contact the police or the district attorney’s office (or be contacted by them), and explain that they do not want to “press charges.”  In this situation, they may be given what is called an “affidavit of non-prosecution,” prepared by the district attorney’s office, that says that they do not want their significant other to be prosecuted.  After they sign this, they may think everything is fine and that the case is over.  This is rarely the case.  In fact, they may be surprised to learn that their significant other is charged with domestic violence and prosecuted as if they had never signed the affidavit in the first place.  If you have been accused of domestic violence, and your significant other has signed this kind of affidavit, YOU may be surprised that the case is not dropped, too.

How can this happen?  The answer is that a crime victim does not get to decide whether a district attorney’s office prosecutes a crime or not.  That is up to the district attorney’s office.  They do not represent the alleged victim.  Instead, they represent the public, such as the State of Texas.  That is why cases are always called State of Texas (or other state) v. John Doe, Defendant.  The public has an interest in punishing people who commit crimes, even if the victim does not want them charged.  For example, consider a gang member who fires shots into a house with innocent men, women, and children, who threatens to kill anyone who goes to the police.  The public wants that person punished because he or she is a danger to everyone, even if the victims are too afraid to “press charges.”

Now, back to the affidavit of non-prosecution.  The kinds of affidavits that district attorney’s offices usually have someone sign just say that the person does not want the accused to be charged with a crime for what they did.  Some affidavits may actually imply or say that the accused did, in fact, commit the crime.  But the alleged victim’s desire is only one factor that prosecutors consider.  In domestic violence cases, especially, the alleged victim’s desire may have very little influence, because prosecutors believe that domestic violence victims typically want to protect their abusers because of threats or emotions.  So these affidavits may mean very little and might even commit the alleged victim to testifying that the accused is guilty.

Even worse, by the time the accused hires a domestic violence lawyer who finds out that the affidavit of non-prosecution will not help, it may be too late to try to stop an indictment.  As we say, at that point, the train will have left the station.

An effective affidavit of non-prosecution will set out specific facts showing that the accused is not guilty.  This kind of affidavit is most helpful early in the process BEFORE an indictment.  I will do a separate blog entry on effective affidavits of non-prosecution, but for now, keep in mind that you should never rely on an affidavit of non-prosecution prepared by a district attorney’s office.  Instead, hire a skilled and experienced domestic violence lawyer to investigate and prepare one as soon as possible after the incident.

10 Loved Ones Of People Who Allegedly Died From Using Xarelto File Lawsuit Against Manufacturers

The plaintiffs, in this case, are comprised of 10 people living in different states claiming that family members died from excessive bleeding from taking Xarelto. Xarelto lawsuits now exceed 3,000 cases, with 2,800 being consolidated in a federal court in Louisiana and an additional 550 in Philadelphia, PA that have been joined together in a mass tort program.

The plaintiffs also allege that Janssen and Bayer misled the public through its marketing and advertising which utilized celebrities to endorse and discuss the product. The plaintiffs state the manufacturers falsely represented the drug and did not sufficiently mention the potentially dangerous side effects that could result from taking it. Despite research done by the defendants that may have shown otherwise, the court filings details suggest that Bayer and Janssen clearly chose to market Xarelto as an effective safe treatment for patients who required knee and hip replacements or for those who suffered from a common heart ailment called atrial fibrillation.

In June 2013, the U.S. Food and Drug Administration contacted Bayer and Janssen via written correspondence stating that the public claims made in their advertising and marketing were not accurate. However, despite the FDA’s concern as expressed in its letter, the drug continued to be promoted as it had been with no changes made to the marketing strategy by the defendants.

Former Arms Dealer Efraim Diveroli Publishes His True Life Memoir at Core of Suit Against Bradley Cooper, Todd Phillips, Warner Bros

MIAMI – The former gun runner, Efraim Diveroli,who is the real-life inspiration for Jonah Hill’s character in this summer’s upcoming Todd Phillips movie, ‘War Dogs’ has released his personal memoir, Once A Gun Runner… to the public.

The new book is at the center of a controversial and recently filed federal lawsuit against Warner Bros, Todd Phillips, Bradley Cooper, and other big name Hollywood entities by Incarcerated Entertainment, a company created by Diveroli and his business partner, Ross Reback. The suit states that Diveroli authored a 360-page manuscript and the company shopped the motion picture rights to his story.

In an exhaustively detailed complaint, they claim that Reback communicated to Phillips and the studio and offered to provide them a copy of the manuscript to discuss the rights for a feature-film, which Phillips was already working on based only on a Rolling Stone article, but was turned down.

According to the suit, Diveroli and Reback were subsequently contacted by producer Elliott Kahn and his partner Simon “Shimmy” Spira, providing them with a copy of the manuscript, after both first signed non-disclosure agreements. Spira however, turned out to be the son of Steven S. Spira, Warner Bros.’ President of Worldwide Business Affairs.

The lawsuit alleges that around that same time, Phillips was working on a rewrite of the ‘War Dogs’ script, as he was having difficulties writing the screenplay from the limited source material of the magazine article; and that “Shimmy” Spira could have easily made the manuscript available to his father to give to Phillips, thereby giving him unauthorized access to it. “Shimmy” Spira’s home address is listed as the same as his father’s.

As of this date, all defendants including Warner Bros., Phillips, Cooper, RatPac-Dune Entertainment, The Mark Gordon Company, 22nd and Green Productions, and Kahn have been served the suit, with the exception of Spira, who has managed to avoid process servers since the lawsuit’s filing on April 28th.
