Texas Truck Accident Lawyer Discusses Possibility Of SCOTUS Hearing Electronic Log Device Case

In December 2015, the Federal Motor Carrier Safety Administration (FMCSA) issued a final rule requiring semi-trucks to switch from paper logs to electronic logging devices (ELDs).

The rule is being rolled out in stages, so not every semi-truck driver must comply right away. However, the majority of truckers must have an ELD on board by December 18, 2017.

The purpose of ELDs is to cut down on errors — intentional or otherwise — on old fashioned paper logs. Truck drivers are dangerous behind the wheel when they drive without enough sleep. ELDs, which log hours automatically through a computer system, are designed to prevent drivers and carriers from breaking federal hours of service rules.

However, the FMCSA’s rule has been challenged and now the U.S. Supreme Court must decide if it will hear the challenge.

SCOTUS May Decide Whether to Hear ELD Case Soon

After the ELD rule was passed, the Owner-Operator Independent Drivers Association filed a lawsuit against the Department of Transportation challenging the rule. Filed in a lower federal court in March 2016, the lawsuit asks the court to overturn the rule. The drivers association claims that the rule violates truckers’ Fourth Amendment right against unreasonable searches.

The lawsuit also makes a “slippery slope” argument, claiming that the introduction of electronic recording devices could open the door to intrusive monitoring in other industries.

However, the drivers association hasn’t had much luck with this argument. The U.S. Court of Appeals for the Seventh Circuit ruled in favor of the FMCSA and against the drivers association.

The U.S. Supreme Court could decide by June 8, 2017 whether it will hear the case. The Supreme Court receives around 10,000 petitions each year. If four out of the nine justices believe the case is worth hearing, the Court will take it on.

Out of all the petitions the Court receives, it only hears about 75 to 85 cases a year. If the Court believes the outcome of the case will impact the entire nation, or that the issue involved in the case is one that truly needs settling on a national level, the court will most likely take it on.

Adolescents Dying In Accidents Says Philadelphia Car Accident Lawyer Rand Spear

The world’s young adults are dying by the thousands each day, many of them from preventable accidents. The World Health Organization (WHO) estimates that more than 1.2 million adolescents die each year or about 3,000 deaths each day. In a report the organization states the causes are largely preventable, reports CNN. The leading cause of death for 10 to 19 year olds in 2015 was “road injury,” which killed more than 115,000 adolescents, followed by lower respiratory infections and self-harm. About two-thirds of deaths among adolescents happened in Southeast Asia and Africa.

Road injuries are listed as the greatest cause of death globally and the rate is especially high for boys 15 to 19 years old. Overall most of them aren’t driving vehicles, they’re more likely to be pedestrians and cyclists, though more drive vehicles in wealthier countries. The second leading cause of death for young males was interpersonal violence including physical or sexual abuse or emotional threats.

Dr. Sonia Saxena, a primary care expert at Imperial College London quoted by CNN, stated that prior studies have shown the leading causes of adolescents’ deaths in developed countries are risky behaviors, including drug and alcohol abuse, not their environment. “These factors for adolescents are around their whole environment,” she said. “It should not be dangerous to walk down the road.”

Most of the deaths of girls 10 to 14 are due to lower respiratory infections, such as pneumonia, which could be caused by the use of polluting fuels to cook in their homes. Older girls 15 to 19 face greater risk of death due to pregnancy complications, childbirth or unsafe abortions.

Road injuries are the leading cause of death of adolescents of both sexes in developed countries and low and middle income countries of Southeast Asia and the Western Pacific. Self-harm is the leading adolescent cause of death in Europe, war in the Eastern Mediterranean, violence and abuse in the Americas and lower respiratory infections in Africa.

The report recommends a range of strategies to try to prevent the deaths of adolescents, including more comprehensive sex education, cleaner cooking fuels, mandatory seatbelt and helmet use and increased drinking age limits.

Motor vehicle crashes are the leading cause of death for U.S. teens, according to the federal Centers for Disease Control and Prevention. It estimates that in 2015 2,333 residents aged 16 to 19 were killed and 221,313 were treated in emergency departments for injuries from vehicle crashes the prior year. Every day, on average, six teens aged 16 to 19 died due to motor vehicle injuries.

Stats From The Safety And Justice Challenge

Funded by a $100 million investment from the John D. and Catherine T. MacArthur Foundation, the Safety and Justice Challenge was created to reduce over-incarceration in the United States. The organization has published some startling statistics that show just how critical a problem the country’s incarceration rate has become.

American’s Prison Overpopulation Problem

The U.S. has the highest incarceration rate of any country on earth. In total, the U.S. makes up just 5 percent of the world’s population, yet it is home to a staggering 25 percent of the world’s prison population. This means that for every 100,000 people in the country, 716 of them are in prison.

Furthermore, victimization rates — meaning the number of people who are victims of crimes — are the same in the United States as they are in the majority of European countries. Yet the U.S. imprisons a disproportionately high number of people compared to every other country in the world.

As the Washington Post reports, criminal justice experts say that the United States’ system of criminal justice fees is partly to blame for such high incarceration rates. Unlike most other industrialized nations, the U.S. has a for-profit criminal justice system that allows judges to issue arrest warrants for people who can’t afford to pay their court fees. American courts also impose fines on defendants who fail to appear in court.

Safety and Justice Challenge Statistics

The dismal state of incarceration in the United States is further highlighted by compelling statistics from the Safety and Justice Challenge.

There are 12 million jail admissions each year in the U.S.
The number of annual jail admissions in the U.S. is equivalent to the populations of New York City and Los Angeles combined.
14.5 percent of men and 31 percent of women admitted to jail suffer from a serious mental illness.
The rate of mental illness among the U.S. prison population is four to six times higher that of the general population.
Nearly 75 percent of people convicted of crimes are nonviolent offenders imprisoned for traffic, property, or public order crimes.
African-Americans are jailed at four times the rate of white Americans.
Between 1982 and 2011, local spending on incarceration ballooned by 235 percent.
The United States spends $22.2 billion each year on incarceration.
Local jails in the U.S. hold an average of 731,000 people every day.

The Fight to Lower the U.S. Prison Population

Data shows that crime rates have dropped steadily over the past few decades and now sit at levels comparable to those in the 1970s. Despite the nation getting safer, prison population rates continue to climb. Advocates of lowering the incarceration rate say that one of the easiest ways to address the prison overcrowding problem is to change harsh sentencing laws that imprison people for nonviolent crimes.

Should Texas “Raise the Age” Of Criminal Responsibility To 18?

In Texas, along with a handful of other states, 17-year-olds accused of criminal offenses are automatically tried as adults. Texas lawmakers have introduced two bills that propose raising the age of criminal responsibility from 17 to 18.

If the proposed laws are passed, Texas will join the majority of states that have lifted their criminal responsibility ages to 18.

New York Becomes Most Recent State to Raise the Age

In April 2017, New York governor Andrew Cuomo signed in a law that raises the state’s age of criminal responsibility from 16 to 18. Previously in New York, 16-year-old offenders were housed in the same facilities as adult criminal offenders. Teenagers were also prosecuted in the adult system, which meant they received a criminal record if convicted.

Under the new law, 16-year-old and 17-year old criminal defendants accused of misdemeanors will have their cases diverted to judges in the family court system. Teen defendants will also get access to special training and social services programs.

Teens accused of nonviolent felonies will be tried in special “youth part” courts in criminal court.

Finally, defendants under age 17 will no longer be held in county jails. When the last phase of the new law goes into effect, 18-year-olds will also no longer be held in county jails.  

According to a New York Times article, North Carolina is the only state left in the country that prosecutes 16-year-olds in the adult criminal justice system. A few states, including Connecticut, Illinois, and Vermont, are considering raising the age of criminal responsibility to 21.

Experts Saying Raising the Age Helps Kids and State Costs

Criminal justice experts have stated that treating teenagers as adults in the criminal justice system is detrimental for both the young people involved and the states.

Scientific studies show that the juvenile brain is structured differently than the adult brain. Research supports the idea that teens accused of crimes benefit more from intervention and education than they do punishment and imprisonment. Sadly, teens who can’t make bail can be held so long in jail that they end up expelled from school for non-attendance.  

Proponents of “raise the age” laws also point to the added costs that come with housing teen criminal offenders in the same facilities as adults. Because many jails and prisons require teen defendants to be kept in separate areas of the facility, prison administrators must often designate an entire cell block for just one or two teens. This creates extra costs that put pressure on state budgets.

There’s a higher risk of an accident if you’re at an intersection compared to other places you drive. They are worth looking for because, according to the Florida Driver’s Association, more than 40% of all accidents happen in or around intersections.

Lt. Adam Falk of the Walton County Sheriff’s Office stated that from March 13 to April 27 there were 15 traffic accidents at four U.S. Highway 98 intersections between the Okaloosa County line and Sandestin. He stated all were rear end accidents. The victims were either stopped or slowing and the accidents could’ve been avoided if drivers paid attention.

Patrol officers for three counties’ sheriff’s offices identified 12 intersections along U.S. Highway 98 (or “Bloody 98” as it’s called), which runs east-west along the coastline through the Panhandle, that have the greatest potential for disaster.

Many times accidents are caused by tailgating or speeding.

Accidents are caused by drivers trying to “beat the red” by speeding through intersections while the light is yellow or while it turns red.

One intersection was known to be dangerous because of how it’s laid out with people going at high speed on a street with two sharp curves.

Failing to yield the right of way or running a stop sign is a common issue at one intersection.

Vehicles failing to slow down due to traffic congestion is a common problem at another intersection.

The high number of accidents at one intersection was often the result of high vehicle volume, motorists coming out of a convenience store, failing to use turn signals and running red lights.

The fifteen recent accidents U.S. 98 intersections in Walton County motivated that county’s Sheriff’s Office to launch an aggressive driving campaign. Marked and unmarked patrol cars at the intersections enforced laws against speeding, reckless or careless driving, texting, running red lights and following too closely.

But law enforcement can only do so much. The sheriff’s office stated that from spring break 2016 to spring break 2017 there was nearly a 30% increase in accidents despite the fact the number of traffic stops doubled.

Though not paying attention and negligence causes many accidents, it’s speed that kills, said Tracey Vause, Okaloosa County’s Chief of Emergency Services. “A crash itself can be caused by any number of reasons, but the severity of the injuries is always a factor of speed.”

Why Is Fentanyl So Deadly?

Almost unheard of even just a couple of years ago, fentanyl has dominated news headlines lately. The drug received, even more, attention when iconic singer Prince died of an accidental fentanyl overdose in April 2016. In 2016 alone, fentanyl deaths rose by 73 percent. In the U.S., opioid deaths have increased by 200 percent since the year 2000.

So what is fentanyl? And why has it claimed so many lives?

Fentanyl Is 50 to 100 Times Stronger Than Morphine

Although fentanyl can be legitimately prescribed by doctors to treat chronic pain and other conditions, illegal fentanyl also poses a problem. Most illegal fentanyl is produced in overseas labs. When it arrives on American streets, users have no way of knowing how potent it is or what has gone into it.

Prescription fentanyl is 50 to 100 times stronger than morphine and 30 to 50 times more potent than heroin. It takes just a quarter of a milligram to cause death. With such an extremely narrow margin of error, it’s easy to see how people can accidentally overdose after taking even a tiny quantity of the drug.

What makes fentanyl particular dangerous is that it’s easy and inexpensive to make. Although fentanyl deaths have been reported across the country, some areas have been hit particularly hard. In Ohio, for example, there were over 4,000 fentanyl deaths in 2016 — an increase of 30 percent over 2015.

Prescription Fentanyl comes in a variety of forms, including pill, injection, patch, lozenges, and even lollipops. Street fentanyl is typically sold as a powder or spiked on blotter paper. It’s also common for dealers to cut fentanyl into other drugs, such as heroin.

What Fentanyl Does to the Brain

Fentanyl causes the brain to produce a rush of dopamine, the chemical responsible for pleasant emotions. Users feel relaxed and euphoric. Side effects include drowsiness, nausea, confusion, and constipation.

The problem is that the brain can only produce so much dopamine at a time. As users become addicted, they crave the euphoria and relaxed state. However, they can’t quite attain the same high levels they’re used to, so they consume more and more of the drug.

The opioid receptors in the brain are also responsible for controlling the body’s breath rate. High doses of fentanyl can make a person stop breathing.

Seizures By Drivers Rare But Dangerous Says Boca Car Accident Lawyer Joe Osborne

To be safe a driver you must be fully alert and capable of mentally and physically functioning so there’s no danger posed to the driver, passengers and others on the road. The chances of being struck by a driver suffering a seizure is low. An article in the journal Neurology states that based on certificates of drivers who died in car crashes from 1995 to 1997 very few people suffer seizures before fatal accidents. Of the roughly 44,027 drivers being killed annually in this time frame only 86 of the death certificates (or 0.2%) listed seizures or epilepsy as a contributing factor.

One of the reasons it’s so rare is that states, including Florida, have laws restricting those suffering seizures from driving. Under state law someone with epilepsy can get a license to drive with their doctor’s recommendation if they haven’t had any seizures for two years, according to the Epilepsy Foundation.

Though it may not happen often, drivers suffering seizures can seriously injure or kill others.

In Bay County, Florida, an employee of the county’s road and bridges department was seriously injured in May in an accident caused by an Alabama driver believed to be suffering a seizure, according to WJHG. The Florida Highway Patrol states that the employee was next to an arrow board in a temporary lane closure when he was struck. The employee’s injuries were described as critical.

A car accident involving a driver suffering a seizure killed one and injured others in El Cajon, California, in 2015. The driver of an SUV was exiting an interstate when she apparently suffered a seizure. Her teenage daughter was a passenger and she tried to use the parking brake to slow the car down but the vehicle was travelling too fast. The Lexus rear-ended two cars on the off ramp, killing one of the drivers. A total of six vehicles were involved in the accident, according to NBC San Diego.

The issue of drivers with seizures got a lot of attention in 2012 when the then Secretary of Commerce John Bryson took a medical leave after he claimed a seizure caused him to hit two cars in California, according to ABC News.

Bryson was found unconscious in his car by police who cited him for leaving the scene of an accident after he rear-ended one car, left the scene then struck another. After the first collision Bryson got out of his car, spoke with the occupants then left. About five minutes later he hit another car. He took and passed a blood alcohol test.

According to medical experts interviewed in the story:

Seizures are a neurological disorder and there are different types of seizures.

They cause a temporary disturbance of behavior or consciousness and affect the non-dominant side of the brain, which is on the right for most people.

A complex partial seizure may result in the person appearing to be staring or fumbling, losing awareness of his or her surroundings. If this happens to someone driving they can lose control of their vehicle.

An epileptic seizure can cause a driver to have an accident and possibly drive off in a confused state. The driver may have little or no memory of the incident.

If the driver never had a seizure and had no reason to expect one, such a person might not be negligent if he or she caused an accident. However if a person is violating the law or ignoring a doctor’s advice not to drive, drives anyway, has a seizure and causes an accident then a good argument the driver committed negligence could be made.
