Tiger Woods Arrest & Defending Against DWI Charges, By Dallas DWI Defense Lawyer

Tiger Woods was recently arrested in Florida for what Florida law calls Driving Under the Influence (“DUI”).  In Texas, we call this driving while intoxicated (“DWI”). Texas has a crime called DUI, but it applies to people under the legal drinking age who have a “detectable amount” of alcohol in their system, even if they are not intoxicated.

Mr. Woods was found asleep in his car with the engine running. When police officers woke him up, he said some incoherent things and apparently failed some field sobriety tests. He gave a breath sample that showed he had no alcohol in his system. He made a public statement blaming his condition on a combination of prescription medication. What does all this mean about whether he was guilty of DWI or DUI?

First, the fact that he was not actually driving his car when the police found him does not matter. DWI and DUI laws usually refer to “operating” a motor vehicle, and “operating” is usually defined as being in control of a running motor vehicle. Because the car was running, and Mr. Woods was alone in the car and at the wheel, he is considered to be in control of it. If the car had not been running, but Mr. Woods was alone, asleep, and intoxicated and in the driver’s seat, he could still be arrested for DWI or DUI, but at trial, the State would have to prove that he drove the car to wherever he was found and that he was intoxicated at the time he was driving the car.

Second, the fact that Mr. Woods had no alcohol in his system does not mean he is not guilty. DWI and DUI laws usually do not require that the intoxication must be due to alcohol. In Texas, for example, “intoxication” is defined as the loss of a person’s normal physical or mental capabilities because of ingestion of alcohol or other substances, or a combination of alcohol and other substances, OR a blood/alcohol concentration of 0.08 percent or more. So, in Texas, it is possible to be intoxicated even if you have no alcohol in your system. The key is that the person must have lost their normal physical or mental capacity. After all, the point of DWI and DUI laws are to protect the public by preventing people from driving who are not able to drive safely. Someone who has taken something other than alcohol can be just as dangerous a driver as someone who is drunk.

The fact that Mr. Woods was incoherent and failed field sobriety tests is strong evidence that he was intoxicated. If the case goes to trial, a jury would be able to watch a videotape of Mr. Woods talking and doing the field sobriety tests, so they would be asked to decide if the video shows that he had lost his normal physical or mental capacity. Slurred or incoherent speech and poor balance can be enough.

Mr. Woods put out a statement that the cause of his condition was a combination of prescription drugs that had an unexpected effect on him. Strictly speaking, that is not a legal defense. DWI and DUI laws do not require that a person has to try to become intoxicated or want to be intoxicated. They just require that the person be intoxicated. So, why would Mr. Woods put out a statement like this?

Mr. Woods is, of course, a public figure who wants to protect his public image as much as possible. In effect, he is saying that he is less blameworthy if his intoxication was unintentional than if he was drinking because he wanted to feel the effect of alcohol. In other words, he seems to be saying, “It’s not like I was out partying and was irresponsible and started driving.”

But could his defense that he was the victim of a combination of medications really help his case? If he is correct that the combination of medications caused him to be intoxicated unexpectedly, a prosecutor might be willing to reduce the charge to something like obstruction of a roadway.

A prosecutor is not simply going to accept his explanation, though. If there was no blood test to show what was really in his system, a prosecutor is going to want to know exactly what he claims to have taken, and a prosecutor will ask medical or pharmaceutical experts whether the combination he claims could really produce his condition. A prosecutor would also probably want to get prescription records to see whether he was really taking what he claims and in the quantity he claims, and whether he had been taking the medications before, so that he would know how they would affect him.

If I were defending Mr. Woods, I would consult with a medical or pharmaceutical expert as soon as possible to make sure that what Mr. Woods claims to have been the cause of his condition was really capable of producing it. If it was not, I would not use it as a defense, because if a prosecutor, a judge, or a jury is convinced that a person is both guilty and lying to try to get out of what they did, the person will end up worse off.

Being a criminal defense lawyer does not mean that you accept whatever your client says. All experienced DWI defense lawyers know that their clients will ultimately be worse off if their defense turns out to be a lie.

As a former federal prosecutor, I know that it is invaluable to be able to think like a prosecutor in order to test what a client is telling you. Clients may not like it at first, because no one likes to be challenged, but most ultimately understand that it is in their best interest. For Mr. Woods’ sake, I hope the DUI defense lawyer he hires will approach his case this way. Otherwise, the result in his case could be a bad one, both in terms of any punishment and in terms of publicity.

In 1960, Stralka joined the 104th Weather Flight in the Maryland Air National Guard as their Chief Meteorological Forecaster. Stralka passed away in January, 2017, survived by his wife of 64 years, Wanda Stralka, and his five children.

We all know and statistics have proven that younger drivers are more prone to be involved in car accidents. They are simply more likely to engage in dangerous behavior while behind the wheel. Enter: drag racing. While this past time may make you feel like you’re in the movie Fast and Furious, the real-life consequences are far more deadly.

How Did Drag Racing Even Start?

Per an article on the CRC Health Group website, drag racing dates back to the glamorous and wild years of the 1920s and was given the name to describe racing down the “main drag” of a town.

But it wasn’t until the 1950s when movies like Rebel Without A Cause inspired teenagers  to soup up their cars and turn them into hot rods for racing. Since that time, teenagers have been more likely to drive fast and give in to the urge to race other fast cars to see who wins.

Because of this, the accident rate among young drivers is four times higher than adults and nearly half of all teen deaths from car wrecks involve speeding.

What Is Drag Racing Culture Like?

Far from simply being a plot point in a movie, drag racing that occurs in real life is more likely to take place in neighborhoods that have developed a culture around racing.

According to The New York Times,  that culture is what likely lead to the death of James Miro, a young driver who died when his vehicle skidded off a road and splashed into a Brooklyn creek.

James lived in a small neighborhood in Gerritsen Beach that has a wide road with few traffic lights that attracts young drivers who want to push their speedometer to the max. In the months before James’ death, there were drag racing accidents that were reported to police in and around Gerritsen Beach.

Going back to the New York Times story, “Between 2010 and 2014, according to the New York City Department of Transportation, there were 18 serious injuries from traffic accidents on the [Gerritsen] street, which stretches for about two miles from Nostrand Avenue to the water.”  

In fact, four people have died on that street since 2010 and a speed camera that police installed to help slow down vehicles, was vandalized.  It has also become common in the drag racing culture to have CB radios or scanners to help them stay ahead of law enforcement and out of trouble.

A story in The Journal News looked at the dangers of drag racing and highlighted the difficulty that police have in catching people. According to Mount Pleasant, New York Police Chief Paul Oliva, drag races can occur at any time and are a risk to public safety.  

Police Chief Paul Oliva said that drag racers run a fairly “sophisticated” operation in which they plan their races around police shift changes and use spotters to alert them when police officers are in the area.

Why Can’t Police Stop This? Laws Are Hard To Enforce.

In New York, where drag racing is a big problem, the laws on the books are often difficult to enforce. Since a 2009 law passed in New York allowing police to seize vehicles involved in drag racing, very few of those cars have been actually taken into custody.

In many cases the drivers are not the legal owners of the vehicles and in other cases the vehicles were under a lien, which means that the lien-holder would have the right to seize the vehicle.

A bill that would have made it a felony for a driver to have more than one drag racing citation has stalled in the New York state Assembly, frustrating Amy Paulin, a Democrat from Scarsdale who is a co-author of the bill.

“We see more incidents like this and young people are particularly susceptible,” Paulin stated. “This [bill] could act as a deterrent.”

How Ventilation Affects Air Quality At Food Processing Plants

Studies have found that even the most efficient air-conditioning system can spew out high amounts of bacteria into an indoor facility, and when that facility is responsible for the manufacturing and packaging of food, that pollutant can create a health crisis. That’s why air quality at a food processing plant is so important, and also why it’s nearly impossible to eliminate pollutants without an effective air filtration system. Best Air Filters for Food Industry

“Outdoor air can carry from 200 to 1,500 bacteria per cubic meter,” stated Mark Davidson, Camfil USA Food & Beverage Segment Manager. “That means that poorly filtered air conditioning systems can circulate as much as 15 million bacteria each hour, and that can compromise the quality of products at food processing plants. Understanding the importance of temperature, humidity and air filtration are the keys to establishing an effective air filtration strategy.”

Like cleanrooms and bio-labs where sterility is required, food-processing plants must be kept as free of pollutants as possible. Per an article on food safety, one of the most common ways that pathogens enter these facilities is through air that flows from doors and other openings.

These pollutants are known as “bioaerosols,” defined as (1) “airborne contaminants that include bacteria, fungi, viruses and pollen. These free-floating microorganisms may be present in the air as solids (dust) or as liquids (condensation and water), and they are an important bacterial vehicle.”

The problem is that there are often deficiencies and breakages within those openings that allow pollutants to enter the food processing facility.

That’s why the proper sealing of doorways and openings is one of the key factors in preventing pathogens from flowing through the facility.

Per the article, there are other issues in addition to sealing openings:

“Slow operating doors compromise quality and safety by enabling dust and fumes to travel with the forklift between areas. Slow speed can also reduce control over desired temperatures, threatening food quality. The faster a door operates, the more effective it serves as a barrier.”

The Importance of Air Flow

One of the biggest problems in a food processing facility is the constant amount of negative pressure.

That is the reason that food processing facilities must have as many as two-dozen air changes per hour.

Years ago, the U.S. Department of Agriculture had established a minimum of six air changes per hour for meat packing facilities, but that requirement was phased out. Typically, food-processing facilities need about 20 to 25 ACHs per hour to:

“…remove off odors, steam and other airborne contaminants and filter them out of in the recycle process. The actual number of air turns depends on the type of processing taking place in the plant and must be designed by a competent HVAC engineer to fit the facility and the process.”

“Airflow in meat-processing plants, due to the presence of live animals, carry a high risk of airborne contaminants.”

In a piece on the Stellar Food for Thought website, design and construction expert Luke Facemyer writes: (3)

“In these facilities, the direction and frequency that air flows is especially important. The air from kill floors and rendering areas, where raw poultry and meat are handled, must never flow to areas such as packaging, where the airborne bacteria could infect the final product.”

Facemyer also writes that condensation control and temperature control must be strictly regulated to ensure the proper air balance between different areas or rooms of a food processing facility.

Condensation in particular can create moisture in “equipment crevices and on ledges,” causing the growth of bacteria and mold.

1. Withdrawal Can Be Life-Threatening

Perhaps the best reason for choosing a medically supervised detox over doing it yourself is that the symptoms of withdrawal for alcohol and some drugs can be fatal. While it may seem like the effects of drugs and alcohol are short-lived, providing users with a high that fades away fairly quickly, the changes that happen to the brain can be persistent and suddenly stopping the use of drugs or alcohol can lead to dangerous, and even life-threatening, complications. For example, people who are addicted to benzodiazepines can suffer from seizures when they discontinue use, and that is even when they are taking therapeutic doses and not abusing the drug. 2. Withdrawal Symptoms Often Cause Relapse

Most relapses occur within a short time frame of getting sober. This is especially true when a person doesn’t continue with treatment after detoxing from substances. Continuing treatment, like an inpatient addiction treatment program, provides addicts with the education, coping skills, and therapy that are needed to deal with life without the use of drugs or alcohol. Without treatment, even though a person has been able to stop using drugs on their own, they run a very high risk of returning to their addiction because they have not made any other changes to their life or how they deal with their problems.

Additionally, when a person stops using drugs or alcohol, even if everything in their life is going well, they will have cravings to use again. Without having treatment, they will be ill prepared to handle those cravings and will almost certainly return to using.

3. Withdrawal Isn’t Like You See on Television

In the movies and on television, withdrawal from drug use is often portrayed unrealistically. Characters who know they are going to go into withdrawal prepare with soft foods, clean towels and sheets, and a bucket or bowl to throw up into. In the withdrawal scenes, the character will toss and turn in bed, throw up, and sweat a lot, but then soon after they appear looking fresh and ready for whatever life throws at them. Getting clean at home isn’t that easy. The withdrawal symptoms of stopping cold turkey can be far worse that what you see on TV and in movies. Simply put, the symptoms and cravings that come up during withdrawal are extremely difficult to handle with do-it-yourself methods.

In a detox facility, patients are often given small doses of medications (like benzodiazepines) and then weaned off of them to make withdrawal symptoms more bearable. It would be very difficult to do this at home, if not impossible, but it’s quite easy to manage in a detox facility.

4. Education and Support Are Available in Detox Facilities

Withdrawal symptoms can seem to go on forever to someone detoxing at home. With no one there to ask questions about withdrawal and addiction or access to others who have been through it themselves that can lend support, it may feel absolutely endless. In the depths of withdrawal, with no support or education, it’s very easy to give up and use again to feel better.

Patients who are in a detox facility have access to educational information, classes, lectures, and therapy, if they are feeling up to it, as well as support from both facility staff and other patients. In other words, there is hope in a treatment center that cannot be found at home.

5. The Focus is on Recovery

In a detox facility, the focus is on recovery. Patients do not have to worry or manage their daily lives outside of treatment. If you try to detox at home, there are still the basics of daily living that have to be dealt with, and that can be a very difficult thing to deal with while withdrawing from a substance. It’s very unlikely that a person who is going through drug or alcohol withdrawal will be able to perform their normal daily tasks – even those aside from going to work or school.

Patients in an inpatient detox program are able to put all of their efforts into their recovery. They don’t have to be concerned with their family members, household chores, or other distractions that they would have to if they were at home. This time of focusing on recovery, talking with others in recovery, and taking care of their body, provides them with a solid foundation for continued recovery. They would not get that at home.

Making the Right Choice

Making the decision to stop using drugs or alcohol is probably the most important thing people can do, for themselves and their loved ones. Whether they choose to start on the path to recovery at home or in a detox facility is a personal choice. But there are some compelling reasons to accept the help that a drug treatment facility can offer; the above are just a few. Whatever choice is made, keep in mind that detox is only the first step toward recovery. There must be additional treatment, education, support, and therapy to fully reap the benefits of sobriety and recovery. The American Automobile Association (AAA) expects to get calls from 7 million American motorists suffering car trouble this summer, according to a new survey. AAA stated most of those stranded drivers will be dealing with dead batteries, flat tires and keys locked inside their vehicles, according to Fox News.

AAA’s survey results are that:

Four out of ten drivers are not prepared for breakdowns though three-quarters of all family vacationers plan to travel by car.

Two-thirds of car owners have never had their car battery tested, and one out of five drivers don’t know how to change a tire.

Higher heat, driving more miles and traffic jams take their toll on vehicles, causing overheating engines, tire blowouts and dead batteries. AAA suggests vehicle owners schedule a vehicle checkup by a mechanic before taking summer road trips. Drivers should also carry an extra set of keys and pack an emergency kit, including a phone charger, flashlight, first-aid kit and jumper cables.

Breaking down out of the blue can be a huge inconvenience. Getting towed and unexpected repairs can also cost a lot of money. More importantly a broken down car located where it may be hit by other vehicles, especially at a time when visibility is bad or when other drivers may be fatigued or distracted (such as at night or in rainy conditions), carries a high risk of being involved in an accident.

The Washington State Patrol has these suggestions if your car breaks down:

If it’s in the middle of traffic and you can’t get to the side of the road, call 911 and stay in the vehicle until help arrives so you and your vehicle can be moved safely off the road.

If you can get to the shoulder or off-ramp, move it as far to the right as possible.

Put on your emergency flashers on so others can see your vehicle.

If you can arrange for a tow truck wait in the vehicle until it arrives. This would be safer that having you and your passengers possibly walking into a travel lane.

If you must exit the vehicle, don’t turn your back to traffic and always be aware of your surroundings.

If you abandon your vehicle, call 911 to notify law enforcement and explaining what happened and your contact information. You could also leave a note in the vehicle. This will allow officers to contact you in case the vehicle needs to be removed immediately.

Drugged Drivers Common In Florida Warns Boca Car Accident Lawyer Joe Osborne

A driver can become dangerous for many reasons, including being impaired by prescription drugs. One of Florida’s more famous residents, Tiger Woods, was recently arrested for suspicion of driving under the influence (DUI) of drugs near his home on Jupiter Island, reports CNBC. Woods, who had been ranked as the world’s best golfer early in his career, blamed an unexpected reaction to prescribed medications for his arrest. He’s had four back surgeries, most recently earlier this month to relieve lingering back pain. Woods was arrested and later released according to the Palm Beach County Police.

A statement released by Woods’ spokesman stated that alcohol was not a factor but he apologized and added that he took full responsibility. He claimed he didn’t expect the mix of medications he was taking would have such a strong impact on him.

The police report states that Woods’ Mercedes appeared to have “fresh damage” when he was found asleep at the wheel the morning of his arrest by an officer from the Palm Beach County Sheriff’s Office. Both tire rims on the driver’s side had minor damage, the front and rear tires on that side of the vehicle were flat, there was damage to the bumpers and a tail light was out, reports CNN.

Woods was found on the side of the road, the car running, its brake lights illuminated and right turn signal flashing, according to the arrest report. The officer woke him up, his speech was slurred and he stated he didn’t know where he was. Woods reportedly told the officer he was taking several prescriptions. A Breathalyzer test showed no signs of alcohol use and he also took a urine test.

Woods is not alone when taking to the streets too drugged to drive.

Results of a 2010 nationwide study of fatal vehicle accidents show that prescription drug use is a greater hazard than illegal drugs. It found that about 47% of drivers who tested positive for drugs had used a prescription drug, compared to 37% of drivers who tested positive for marijuana and about 10% of drivers who had used cocaine, according to the National Institute on Drug Abuse. The most common prescription drugs found were pain relievers.

The National Highway Transportation Safety Board states that for fatal vehicle accidents in 2009 in Florida, 42% of drivers were not tested for drugs. About 16% of those who were tested showed drug use or 239 of 1,485 drivers.

Woods’ situation is all too common. Many drivers may take to the road despite the fact they know they can’t safely drive because of prescription medication or their effect may come as a surprise. Either way it’s a dangerous situation that could result in serious injuries or deaths. Though Woods’ professional and personal life has taken well publicized turns for the worse both he and everyone else on the roads on Jupiter Island that night are lucky no one was injured or killed after Woods got behind the wheel. Others are not so lucky.

Drowsy driving – Driving when you’re tired is just as dangerous as driving intoxicated, according to researchers. Because truckers spend long hours on the road and often drive through the night, they are especially vulnerable to the dangers of driving while tired.
Reckless maneuvers – Reckless driving can also be distracted driving. In recent years, the number of serious vehicle accidents caused by driver distractions has jumped considerably. Although federal regulations prohibit truck operators from using cell phones behind the wheel, it only takes one trucker breaking the rules to cause a major accident.
